<section id="H0DF5E08B53514B209FE0D4AE9824DD75" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Space Launch Noise Mitigation Study Act</short-title></quote>.</text></section> <section id="H0F62F865686C432EB01703509FE27C6C"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="HE4F828AE701D4779AA4AEF6D1D83E716"><enum>(1)</enum><text display-inline="yes-display-inline">the commercial space launch industry is a fundamental part of United States national security and contributes greatly to assured access to space;</text></paragraph> <paragraph id="HF997E6742FC04732B3C4A8EE7EA18404"><enum>(2)</enum><text display-inline="yes-display-inline">United States national security benefits from a competitive and diverse launch industry;</text></paragraph> 
<paragraph id="H454067D1BCBB40398E04D9E3D873B0A4"><enum>(3)</enum><text>space services are critical to sectors including transportation, communication, agriculture, financial services, and others; and</text></paragraph> <paragraph id="H4D858983FC124605A9115521218FB60E"><enum>(4)</enum><text display-inline="yes-display-inline">as referenced in the report of the Committee on Armed Services of the House of Representatives accompanying H.R. 8070 of the 118th Congress, the increase of launches as a result of national security and commercial launches can be disruptive to nearby communities.</text></paragraph></section> 
<section id="HBECA0CD058F34672B669E3664D9071FF" commented="no"><enum>3.</enum><header>Study on space launch noise mitigation</header> 
<subsection id="HD1BB4D74F789406D936D81A2C97972AB" commented="no"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Under Secretary of Defense for Acquisition and Sustainment shall complete a study on the feasibility of conducting a space launch noise mitigation grant program.</text></subsection> <subsection id="HE3256CE716A34B3BA11C7E474B3E83BB" commented="no"><enum>(b)</enum><header>Matters included</header><text>The study under subsection (a) shall include the following:</text> 
<paragraph id="HD09B6167A3D141F1B86A30CF15C0820F" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">An estimate of funds necessary to carry out a space launch noise mitigation grant program, including estimated breakdowns for different covered facilities, and how many covered facilities are in each eligible community.</text> </paragraph> <paragraph id="H986D9CAE4E914614AAFF6EC42BC3BA4C" commented="no"><enum>(2)</enum><text>Recommendations on the geographic range for which communities shall be eligible.</text></paragraph> 
<paragraph id="H93C4BA7B6A794583AB626B23B9FDB5E2" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Recommendations on noise mitigating techniques and technologies for eligible communities, and the estimated cost for each recommendation.</text></paragraph> <paragraph id="HD9DDB98CCD384D67B27590149DAA8643" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">Recommendations for ways the Space Force can work better with eligible communities to avoid noise disturbances.</text></paragraph> 
<paragraph id="H0251AF1A78FB4028A7765756CD723B97" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">Recommendations for a community outreach program to educate eligible communities near launch ranges on the benefits of space.</text></paragraph></subsection> <subsection id="H77C6434701714E679720A2B73CD076F9" commented="no"><enum>(c)</enum><header>Considerations</header><text display-inline="yes-display-inline">In conducting the study under subsection (a), the Under Secretary of Defense, in consultation with the Commanders of Space Launch Delta 30 and Space Launch Delta 45, shall consider the following:</text> 
<paragraph id="H4D24561DEA184BE19C36AD8AAAF07E0A" commented="no"><enum>(1)</enum><text>C-weighted single-event noise, including noise generated by sonic booms, of 100 dB or greater.</text></paragraph> <paragraph id="HF43F327BC50E44ED86FAFA5A7889DC12" commented="no"><enum>(2)</enum><text>A-weighted maximum sound level of 90 dB or greater.</text></paragraph> 
<paragraph id="H90D5981FFAB746A8A93CC72D0AB06AE5" commented="no"><enum>(3)</enum><text>C-weighted day night average sound level of 115 dB Peak or greater.</text></paragraph> <paragraph id="HE755186A1C444A41AE64EE8B9198F2A9" commented="no"><enum>(4)</enum><text>PK 15.</text></paragraph> 
<paragraph id="HB225DAF5677A41B18913A1704A4687C4" commented="no"><enum>(5)</enum><text>A direct association between noise and its measured effect on the geographic regions where sonic booms from space activity can be heard.</text></paragraph> <paragraph id="HA36F96408AE845F7943434BCDD525760" commented="no"><enum>(6)</enum><text>A literature review of the research to date.</text></paragraph> 
<paragraph id="HD3A024A380D24F54B1309C9D7634D9FB" commented="no"><enum>(7)</enum><text>Structure responses to vibration from sound power levels and overpressure.</text></paragraph> <paragraph id="HE0DCC39B2873463CAA97C7B8A497B4E1" commented="no"><enum>(8)</enum><text>Data from all Federal ranges with at least one or more vertical space launches per year in 2024 and thereafter.</text></paragraph> 
<paragraph id="H9805322FAC6D47979FEF8E9429008E5E" commented="no"><enum>(9)</enum><text>Sonic boom monitoring stations for a wide area in the region surrounding the space launch range.</text></paragraph> <paragraph id="HB702819D3AB941D6B6A85615644811C6" commented="no"><enum>(10)</enum><text>Any other metrics or indicators the Under Secretary determines appropriate.</text></paragraph></subsection> 
<subsection id="H3321785FDC5448618B49642ECC34086A"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H43E1F0D282954360A618A75C60186AF4"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>covered facility</term> means a hospital, daycare facility, school, facility serving senior citizens, or a single- or multi-unit private residence, that is—</text> 
<subparagraph id="H78507AF9F101440B92953BA440249C21"><enum>(A)</enum><text>built before January 1, 2026; and</text></subparagraph> <subparagraph id="H8C4D849431054BFBBE7630141F8522BD"><enum>(B)</enum><text>not owned by the Federal Government.</text></subparagraph></paragraph> 
<paragraph id="H13AA1E5F875C477190C82D2244829289"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>eligible community</term> means a unit of local government serving a geographic region that the Secretary of the Air Force determines to be negatively affected by noise from space launch activities of the Department of Defense.</text></paragraph> <paragraph id="H9ECB49E696674B66A6FE4F7F4CECC9D9"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>PK 15</term> means the calculated peak noise level, without frequency weighting, expected to be exceeded by 15 percent of all space launch activities of the Department of Defense.</text></paragraph> 
<paragraph id="H49250554AD8448C7AACB2D71CFD68C34"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>space launch noise mitigation grant program</term> means a potential grant program administered by the Secretary of Defense under which eligible communities install technologies to mitigate noise from the space launch activities of the Department of Defense.</text></paragraph></subsection></section> </legis-body></bill>
