<section id="HFCCD341366C8473A98135740EFB14ABD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drones for First Responders Act</short-title></quote>.</text></section> <section id="HD8FDA5634EE94588A143E26D2E2AE7AA"><enum>2.</enum><header>Findings and sense of Congress</header> <subsection id="HC9C879D024C64404AF3540E8E30F6EC8"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress makes the following findings:</text> 
<paragraph id="H4271D9ACD0E347BDBE29A836F5B6EB34"><enum>(1)</enum><text display-inline="yes-display-inline">Unmanned aircraft that are made in the People’s Republic of China dominate the current market in the United States for unmanned aircraft and present an unacceptable national security risk.</text></paragraph> <paragraph id="H946BB601B9B041179C02640A183D11CC"><enum>(2)</enum><text>Through direct subsidization and targeted investment by the Chinese Communist Party, unmanned aircraft suppliers in the People’s Republic of China are undercutting the domestic and partnered unmanned aircraft markets and undermining ad valorem tariffs.</text></paragraph> 
<paragraph id="H768BB18F4014428F83642C85531AFEB8"><enum>(3)</enum><text display-inline="yes-display-inline">Over 90 percent of unmanned aircraft operated by America’s first responders are made in the People’s Republic of China.</text></paragraph> <paragraph id="H645CC334BAED4DDE9F88E6D7BB71C984"><enum>(4)</enum><text>It is strategically critical for first responders, critical infrastructure providers, and farmers and ranchers to have access to secure unmanned aircraft that are manufactured in the United States or by our partners and allies.</text></paragraph> 
<paragraph id="H7CC29200DCFD4EFE9FA2DD1FFA402D5B"><enum>(5)</enum><text>The United States cannot rely on the People’s Republic of China to supply unmanned aircraft that are critical to first responder operations.</text></paragraph> <paragraph id="H855BD4E212BF4DDDA09C0CA5B8B17D66"><enum>(6)</enum><text>It is vital to the national security of the United States that unmanned aircraft manufacturers of the United States and our partners and allies are competitive with Chinese unmanned aircraft manufacturers.</text></paragraph> 
<paragraph id="H317EB41CC8C7433D82A5DA7248EB8FAC"><enum>(7)</enum><text>The United States has a national security interest in securing the supply chain for unmanned aircraft to the domestic market, allies, and free trade partners.</text></paragraph> <paragraph id="H5CD2C00246DE4E81A51FFC9F65A529A4"><enum>(8)</enum><text>Implementing tariffs on unmanned aircraft from the People’s Republic of China has the effect of incentivizing sourcing domestically and in allied and partnered countries, which in turn has the effect of promoting resilient supply chains.</text></paragraph></subsection> 
<subsection id="HDFC40E0AB9B543A183A8E1981F4D4CC8" commented="no"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that phasing-in a protective specific duty for unmanned aircraft is prudent and necessary to safeguard this critical industry and increase the competitiveness of the unmanned aircraft industry outside of the People’s Republic of China.</text></subsection></section> <section id="H7A17E1B80C3344618E3D2DE451658A81"><enum>3.</enum><header>Duty increase for imports of unmanned aircraft</header> <subsection id="H1DB7DE1A496C4DADA8592540B422BEB7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter III of chapter 99 of the HTS is amended—</text>

<paragraph id="H98EF006814E347BC818AA2BB38852CCC"><enum>34.</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H36B3245CDCD140A4B3E3508BBA78D192"><enum>(a)</enum><text display-inline="yes-display-inline">For the purposes of subheading 9903.87.01, certain products of China shall be subject to additional ad valorem rates of duty, as provided for in this note. The products of China that are subject to additional ad valorem rates of duty under subheading 9903.87.01 and in accordance with the provisions of this note are products of China that are classified in the following subheadings: 8806.10.00, 8806.21.00, 8806.22.00, 8806.23.00, 8806.24.00, 8806.29.00, 8806.91.00, 8806.92.00, 8806.93.00, 8806.94.00, or 8806.99.00. All products of China that are classified in the subheadings enumerated in this U.S. note are subject to the additional ad valorem rates of duty imposed by subheading 9903.87.01, in accordance with the provisions of this note.</text></subparagraph> <subparagraph id="H346A6DF31F3F4C41B4C737160A4C981A" indent="up1"><enum>(b)</enum><text>The duty rate in the Rates of Duty 1-General column for goods entered under subheading 9903.87.01 shall be as follows:</text> 
<clause id="H03E35BC329054A28A0D3ACA72C45EC0D"><enum>(1)</enum><text display-inline="yes-display-inline">Effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on the day that is 30 days after the date of enactment of the Drones for First Responders Act through the close of the day that is one year after the date of enactment: 30%.</text></clause> <clause id="H405DDBC73FFF415CB8DD52464880F1A2"><enum>(2)</enum><text display-inline="yes-display-inline">Effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on the day after the day that is one year after the date of enactment through the close of the day that is two years after the date of enactment: 35%.</text></clause> 
<clause id="HD6ABE49062BA42199527B135C2C39AE7"><enum>(3)</enum><text display-inline="yes-display-inline">Effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on the day after the day that is two years after the date of enactment through the close of the day that is three years after the date of enactment: 40%.</text></clause> <clause id="H23CD81C269BF4158A7E9CA963908C869"><enum>(4)</enum><text display-inline="yes-display-inline">Effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on the day after the day that is three years after the date of enactment through the close of the day that is four years after the date of enactment: 45%.</text></clause> 
<clause id="HE4327E98DF35409E92720C67EAC2B2BE"><enum>(5)</enum><text display-inline="yes-display-inline">Effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on the day after the day that is four years after the date of enactment: $100 each + 50%.</text></clause></subparagraph> <subparagraph id="HEA4D491A662C4C0CAFCBF8D7D8324396" indent="up1" commented="no"><enum>(c)</enum><text display-inline="yes-display-inline">Notwithstanding U.S. note 1 to this subchapter, all products of China that are subject to the additional ad valorem rates of duty imposed by subheading 9903.87.01, and provided for in this note, shall also be subject to the additional rates of duty imposed by any other headings or subheadings in subchapter III of chapter 99 of the HTS and to the general rates of duty imposed on products of China classified in the subheadings enumerated in this note.</text></subparagraph> 
<subparagraph id="HCDD4C042C65E48B78E78B20DB33665E7" indent="up1"><enum>(d)</enum><text>Products of China that are classified in the subheadings enumerated in this note that are eligible for temporary duty exemptions or reductions under subchapter II to chapter 99, shall be subject to the additional ad valorem rates of duty imposed by subheading 9903.87.01.</text></subparagraph> <subparagraph id="HE9FFC05FECA745F59CE5CACB7C8F30B4" indent="up1"><enum>(e)</enum><text display-inline="yes-display-inline">Products of China that are provided for in subheading 9903.87.01 and classified in one of the subheadings enumerated in this note shall continue to be subject to antidumping, countervailing, or other duties, fees, exactions, and charges that apply to such products.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HAA0F6570BB994E868A1F14AF7A7E6D03"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">Subheading 9903.87.01, the superior heading to subheading 9903.87.01, and U.S. note 31 to subchapter III of chapter 99 of the HTS, as added by subsection (a), shall be effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time 30 days after the date of enactment of this Act.</text></subsection></section> <section id="H7612EBD9B66745C9A3870DD80B88FB83" commented="no"><enum>4.</enum><header>Strengthened rules of origin for entries of unmanned aircraft under heading 8806 of the HTS</header> <subsection id="H5B611AE344024FDFA200DBC0083563DA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any provisions of the general notes to the HTS, beginning on January 1, 2031, unmanned aircraft classified under heading 8806 of the HTS may not enter the customs territory of the United States unless—</text> 
<paragraph id="HF237E5EB3BF847BC9400AEB48A1005DA"><enum>(1)</enum><text display-inline="yes-display-inline">the entry of the unmanned aircraft is accompanied by a certificate or other documentation required by U.S. Customs and Border Protection establishing the unmanned aircraft does not contain a flight controller, radio, data transmission device, camera, gimbal, ground control system, operating software, network connectivity hardware, or data storage manufactured in the People’s Republic of China; and</text></paragraph> <paragraph id="H3C67C3F6EEB9462EA8FAE164FE36EDF6"><enum>(2)</enum><text>U.S. Customs and Border Protection confirms the veracity of the certificate or other documentation required by paragraph (1).</text></paragraph></subsection> 
<subsection id="H4EEE2107E4964F0B9ECFEAF949E8EBF6"><enum>(b)</enum><header>Exemption</header> 
<paragraph id="H51D9FC66A13B44C8B85BE20CCC59455F"><enum>(1)</enum><header>In general</header><text>Subsection (a) shall not apply with respect to unmanned aircraft classified under heading 8806 of the HTS that—</text> <subparagraph id="H0F75EB103EFD4A16AE48B992EBF35D68"><enum>(A)</enum><text>the Federal Aviation Administration has, before January 1, 2026—</text> 
<clause id="H55C394A016D04EB9B1F4B28B9FB23400"><enum>(i)</enum><text>authorized for operations under the provisions of title 14 of part 135 of the Code of Federal Regulations; or</text></clause> <clause id="H776BBB6C357842D2BE8B57B39C37BCD7"><enum>(ii)</enum><text>included in an air carrier’s exemption under section 44807 of title 49, United States Code; and</text></clause></subparagraph> 
<subparagraph id="H293E1008F4624B01B38217702777BB0E"><enum>(B)</enum><text display-inline="yes-display-inline">are not manufactured in whole by a covered foreign entity or in a foreign adversary country.</text></subparagraph></paragraph> <paragraph id="H5B7D21AFD0CE42238ABFC8557F275614"><enum>(2)</enum><header>List</header><text display-inline="yes-display-inline">Not later than January 1, 2026, the Administrator of the Federal Aviation Administration shall—</text> 
<subparagraph id="H1374312B096F48E8A1B346ED28FD0780"><enum>(A)</enum><text>provide the Commissioner for U.S. Customs and Border Protection with a list of unmanned aircraft that qualify for the exemption under this subsection; and</text></subparagraph> <subparagraph id="H4C1B5387E8E84DCAA017A702FE6052F3"><enum>(B)</enum><text>certify that the list required by subparagraph (A) contains only unmanned aircraft that are not manufactured in whole by a covered foreign entity or in a foreign adversary country.</text></subparagraph></paragraph></subsection> 
<subsection id="H3F80358630F7469694F7EDA6D5B82207" commented="no"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text> <paragraph id="H7EE8147A57754A6CA206FD1A422341D0"><enum>(1)</enum><text>the term <term>air carrier</term> has the meaning given that term in section 40102 of title 49, United States Code; and</text></paragraph> 
<paragraph id="HB21757DD2F654327A297D69B8310C4E0"><enum>(2)</enum><text>the term <term>customs territory of the United States</term> has the meaning given that term in general note 2 of the HTS.</text></paragraph></subsection></section> <section id="H781F389FED82467FAF86949561A1256C"><enum>5.</enum><header>Secure Unmanned Aircraft Systems for First Responders Fund and grant program</header> <subsection id="H58E5D08BFFA143A79E5F6C089BAC01DB"><enum>(a)</enum><header>Secure Unmanned Aircraft Systems for First Responders Fund</header> <paragraph id="H3F0CEEA661EB4E95AF7D742D27EC05C6"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a fund, to be known as the “Secure Unmanned Aircraft Systems for First Responders Fund” (in this section referred to as the <quote>Fund</quote>).</text></paragraph> 
<paragraph id="HBFAC97F258834900908201144425527C" commented="no"><enum>(2)</enum><header>Deposit of amounts</header><text display-inline="yes-display-inline">There shall be deposited in the Fund all duties imposed and collected by the United States under subheading 9903.87.01 of the HTS, and as further provided for under U.S. note 31 to subchapter III of chapter 99 of the HTS, as added by section 3(a).</text></paragraph> <paragraph id="H675E133620A04C05ACF61BE9D633F2FF"><enum>(3)</enum><header>Use of amounts</header> <subparagraph id="H3E0EBAE9B887475B8AD2E8EA544D9A37"><enum>(A)</enum><header>In general</header><text>The Secretary is authorized to use the amounts in the Fund for a fiscal year for purposes of carrying out the grant program established under subsection (b) for the next fiscal year.</text></subparagraph> 
<subparagraph id="H64DCD69244CB49E78905ADC83464CDC3"><enum>(B)</enum><header>Unobligated and unexpended funds</header><text>The Secretary is authorized to make amounts in the Fund that are not obligated or expended in accordance with subparagraph (A) available for the purposes described in subparagraph (A) for the next available fiscal year.</text></subparagraph></paragraph></subsection> <subsection id="H3C19B5519EB04BCFB1C3E60E8965B787"><enum>(b)</enum><header>Grant program</header> <paragraph id="H2B615A0134A24D18A5F8A03107439EB9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning not later than one year after the date of the enactment of this Act, the Secretary shall establish and carry out a program to provide grants on a fiscal year basis to first responders, farmers and ranchers, and providers of critical infrastructure to—</text> 
<subparagraph id="H78688C79D64748B09FDC0446E6E35BEE"><enum>(A)</enum><text display-inline="yes-display-inline">purchase or lease secure unmanned aircraft systems;</text></subparagraph> <subparagraph id="H204677B8C2DB45C48DCCC1D29CAF044D"><enum>(B)</enum><text>support operational capabilities of such systems by the grant recipient; and</text></subparagraph> 
<subparagraph id="HAEA5F8CA48C04A239F8AC2F6327C984D"><enum>(C)</enum><text>support the program management capability of the grant recipient to use such systems.</text></subparagraph></paragraph> <paragraph id="H9E522BB15FA94B888173681D36C47B34" commented="no"><enum>(2)</enum><header>Consultation</header><text>In carrying out the program, the Secretary shall—</text> 
<subparagraph id="H82A6404C8E714BC9AEEF3BC03785464A" commented="no"><enum>(A)</enum><text>consult with the Secretary of Agriculture with respect to developing criteria for reviewing applications for grants submitted on behalf of farmers and ranchers; and</text></subparagraph> <subparagraph id="H275071C1355947DD8A1E83D533D61B88" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">consult with the Secretary of Transportation with respect to providing grants to providers of critical infrastructure.</text></subparagraph></paragraph> 
<paragraph id="H738025B83E4F482697EF3E62ACC7DE1D"><enum>(3)</enum><header>Priority for grants</header><text>Of the amounts made available for purposes of carrying out the program—</text> <subparagraph id="HCC0D8486E1554ABE9ACD7D52016E4FC0"><enum>(A)</enum><text>60 percent of such amounts in the Fund shall be made available for grants that benefit first responders;</text></subparagraph> 
<subparagraph id="HD0432468BDD54172A8D678D00B0F1790"><enum>(B)</enum><text display-inline="yes-display-inline">20 percent of such amounts in the Fund shall be made available for grants that benefit farmers and ranchers; and</text></subparagraph> <subparagraph id="H24E6C9FDFE4540E78CBC19C04BFDC647"><enum>(C)</enum><text display-inline="yes-display-inline">20 percent of such amounts in the Fund shall be made available for grants that benefit providers of critical infrastructure.</text></subparagraph></paragraph> 
<paragraph id="H825985A30ACC42CD87D363945BBB8793"><enum>(4)</enum><header>Review of applications</header> 
<subparagraph id="H324C84831F1742168A23AEA3ECE87D95"><enum>(A)</enum><header>Deadline</header> 
<clause id="H36861A55E44747FC915813EB883D8E73"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (iii), the Secretary shall approve or deny an application for a grant under the program not later than 90 days after the date of the submission of the application.</text></clause> <clause id="HFF0A36244B444A71B9FA386794DE7EAD" commented="no"><enum>(ii)</enum><header>Allocation timing</header><text>Amounts under a grant shall be allocated in a manner that prioritizes the funding to recipients in States or localities that have established bans on the purchase, lease, or operation of unmanned aircraft based on their country of origin or on their manufacturer.</text></clause> 
<clause id="H009CFF5A6B924D798091D04C06B13579"><enum>(iii)</enum><header>Additional time needed for review</header><text>If the Secretary determines that, because an excessive number of applications have been filed at one time, the Secretary needs additional time for the Secretary to process the applications, the Secretary may extend the deadline described in clause (i) for not more than 45 days.</text></clause></subparagraph> <subparagraph id="HDE6891282634490D98123631A3C88567"><enum>(B)</enum><header>Effect of denial</header><text>Denial of an application for a grant under the program shall not preclude the applicant from resubmitting the application with additional documentation or submitting a new application at a later date.</text></subparagraph></paragraph> 
<paragraph id="HB7D82118C5D146A194D737E0420F6A54"><enum>(5)</enum><header>Report</header><text>Not later than 1 year after the date on which the program is established, and annually thereafter, the Secretary shall submit to Congress a report on the implementation of the program in the prior year, including a description of all grants provided under the program and the amounts of such grants.</text></paragraph></subsection></section> <section id="HC294B762B0654D83AA9C522A2FE32F94"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HC94890317D144B1A93CDB0352A98E7F0"><enum>(1)</enum><header>Covered foreign entity</header><text display-inline="yes-display-inline">The term <term>covered foreign entity</term> means a foreign entity that is—</text> <subparagraph id="H635D6E79B8F846ED9447718741218841"><enum>(A)</enum><text>an entity on the Federal Government’s Consolidated Screening List;</text></subparagraph> 
<subparagraph id="H5B16FA948B294A1AB6BE2E6E76AE94AE"><enum>(B)</enum><text>an entity on the Department of Defense’s Chinese Military Company List as established by section 1260H of William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/10/113">10 U.S.C. 113</external-xref> note);</text></subparagraph> <subparagraph id="H48645465A79F47DA86B54ABD8DF6DD7D"><enum>(C)</enum><text>an entity on the Department of Treasury’s Non-SDN Chinese Military Industrial Complex Companies List;</text></subparagraph> 
<subparagraph id="H02E1DF001AEC481B90454478C6DA30D9"><enum>(D)</enum><text>an entity on the Department of Homeland Security’s Uyghur Forced Labor Prevention Act Entity List; or</text></subparagraph> <subparagraph id="HFB720FA5B96D40FB8444FDEAE7AAA44D"><enum>(E)</enum><text>an entity identified as a covered foreign entity, as such term is defined in section 1822(1) of the American Security Drone Act of 2023 (41 U.S.C. note prec. 3901), for purposes of such Act.</text></subparagraph></paragraph> 
<paragraph id="HF55E3F5206314D109845B84E88977CB2"><enum>(2)</enum><header>Critical infrastructure</header><text>The term <term>critical infrastructure</term> has the meaning given that term in the Critical Infrastructures Protection Act of 2001 (<external-xref legal-doc="usc" parsable-cite="usc/42/5195c">42 U.S.C. 5195c</external-xref>).</text></paragraph> <paragraph id="HF133FFF304134091B3A37A128CFEF31D"><enum>(3)</enum><header>First responder</header><text>The term <term>first responder</term> has the meaning given that term in section 3025 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10705">34 U.S.C. 10705</external-xref>).</text></paragraph> 
<paragraph id="H5B130F43554C438F86708AAA14874A33"><enum>(4)</enum><header>Foreign adversary country</header><text display-inline="yes-display-inline">The term <term>foreign adversary country</term> means a covered nation, as such term is defined in section 4872(d)(2) of title 10, United States Code.</text></paragraph> <paragraph id="H7BDE0D52FC0B4A6785401DB0A4E1C2BC"><enum>(5)</enum><header>HTS</header><text display-inline="yes-display-inline">The term <term>HTS</term> means the Harmonized Tariff Schedule of the United States.</text></paragraph> 
<paragraph id="HB87F388443DA47FAAE3B1A4F13E74E05"><enum>(6)</enum><header>Fund</header><text display-inline="yes-display-inline">The term <term>Fund</term> means the Secure Unmanned Aircraft Systems for First Responders Fund established by section 5.</text></paragraph> <paragraph id="HF54FF02F049549F095BC22B314554B4E"><enum>(7)</enum><header>Schedule of Concessions</header> <subparagraph id="HA2A7B0FB54F6429384CFC31F9F8802BA"><enum>(A)</enum><header>In general</header><text>The term <term>Schedule of Concessions</term> means Schedule XX of the WTO.</text></subparagraph> 
<subparagraph id="H72EC6352F0714B2CAF2AA011AA8C0BAD"><enum>(B)</enum><header>Terms from Uruguay Round Agreements Act</header><text>In this paragraph, the terms <term>Schedule XX</term> and <term>WTO</term> have the meanings given such terms in section 2 of the Uruguay Round Agreements Act (<external-xref legal-doc="usc" parsable-cite="usc/19/3501">19 U.S.C. 3501</external-xref>).</text></subparagraph></paragraph> <paragraph id="H451DB58DDAF440F7AE8F7A0EBF3BD514"><enum>(8)</enum><header>Secretary</header><text>Except as otherwise provided, the term <term>Secretary</term> means—</text> 
<subparagraph id="HF59161502618434A8F9CB3E25C75EB9F"><enum>(A)</enum><text>the Secretary of Homeland Security; or</text></subparagraph> <subparagraph id="H84CAAD252471436BB7AB379E9CEA1D86"><enum>(B)</enum><text>the Secretary’s designee.</text></subparagraph></paragraph> 
<paragraph id="HDA29B762F5334CF8AA6DA3C8ED2F957E" commented="no"><enum>(9)</enum><header>Secure unmanned aircraft system</header><text display-inline="yes-display-inline">The term <term>secure unmanned aircraft system</term> means an unmanned aircraft system, as such term is defined in section 44801 of title 49, United States Code, that is not manufactured or assembled by a covered foreign entity or in a foreign adversary country.</text></paragraph></section> </legis-body></bill>
