<section section-type="section-one" id="HAE619595CC4C40988CC47318393EBA17"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Plant Biostimulant Act of 2025</short-title></quote>.</text></section> <section id="H038167D130B549B8A8215CFD81E950FB"><enum>2.</enum><header>Defining plant biostimulants</header> <subsection id="HA06E84BD9FFD4AEBBEFA21D73A8D6FE5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2 of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136</external-xref>) is amended—</text> 
<paragraph id="HA54D62651F2045EE959C5F346785AEA2"><enum>(1)</enum><text>by striking subsection (v) and inserting the following:</text> <quoted-block id="HB625C08C9E5C4E6B99F82244F7AC2C75" style="OLC"> <subsection id="HFB01EE3B57C447BEAF380DA2A9063CAB"><enum>(v)</enum><header>Plant regulator</header> <paragraph id="H33415AE4C9094667AF2F697D86406730"><enum>(1)</enum><header>In general</header><text>The term <quote>plant regulator</quote> means any substance or mixture of substances intended, through physiological action, for accelerating or retarding the rate of growth or rate of maturation, or for otherwise altering the behavior, of plants or the produce thereof.</text></paragraph> 
<paragraph id="H4875EE76C5794A98BE11D204FC7F6F87"><enum>(2)</enum><header>Exclusions</header><text>The term <quote>plant regulator</quote> does not include—</text> <subparagraph id="H358A3F4BABC744E5AC26B87FC918C722"><enum>(A)</enum><text>substances to the extent that they are intended as plant nutrients, trace elements, nutritional chemicals, plant inoculants, soil amendments, or vitamin hormone products; or</text></subparagraph> 
<subparagraph id="HF56CDFC05CBA4D00ABACA54392E97786"><enum>(B)</enum><text>plant biostimulants that—</text> <clause id="H0E8BF8872EC246A39EFF7343F824EB2E"><enum>(i)</enum><text display-inline="yes-display-inline">are of biological origin; or</text></clause> 
<clause id="HE39D05075E5B42CCA28DEC0BFE2EE0F6"><enum>(ii)</enum><text>include chemical compounds that are synthetically derived, but are structurally similar and functionally identical to, substances of biological origin.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H7CF5D139D26E46C587137B5907061501"><enum>(2)</enum><text>in subsection (hh)—</text> 
<subparagraph id="HB664EA8E00D84FEB8484B0E529DD2BFE"><enum>(A)</enum><text>in paragraph (2), by striking <quote>or</quote> at the end;</text></subparagraph> <subparagraph id="H304ECB8E696747C5B261066CFA6CFA96"><enum>(B)</enum><text>in paragraph (3)—</text>

                            <enum>(i)</enum>
 <text>in the matter preceding subparagraph (A), by striking <quote>substances.</quote> and inserting <quote>substances</quote>; and</text>
                        </clause> 
<clause id="HE4649A68B3E04CE2880E479ACA380C63"><enum>(ii)</enum><text>in subparagraph (B)—</text> <subclause id="H350EC040A2144A1CA9A88F4EA1703277"><enum>(I)</enum><text>by inserting <quote>, or</quote> after <quote>volatilization</quote>; and</text></subclause> 
<subclause id="HE82A9855809A4A818E71F54DDE6C35FB"><enum>(II)</enum><text>by striking the period at the end and inserting a semicolon; and</text></subclause></clause></subparagraph> <subparagraph id="H4B35609A81C04C6A820F61D972E8AE87"><enum>(C)</enum><text>by inserting before the undesignated matter following paragraph (3) the following:</text> 
<quoted-block id="HEBFB795B35A740B9ADCDA361578A1448" style="OLC"> 
<paragraph id="H028F8D9477FC4D16B2EF11D5EC62C7C7"><enum>(4)</enum><text>a plant biostimulant; or</text></paragraph> <paragraph id="HD432E048EBA34356A56F02853E81C201"><enum>(5)</enum><text>a nutritional chemical.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HD6C01D560F43487CA7B5078E94109C0C"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="H4BE1D3564383415EB5EDACED41408EB5" style="OLC"> <subsection id="H3E7A5774E6714A1A8C9F51BADAD72C55"><enum>(pp)</enum><header>Plant biostimulant</header><text>The term <quote>plant biostimulant</quote> means a substance, microorganism, or mixture thereof, that, when applied to seeds, plants, the rhizosphere, soil, or other growth media, act to support a plant’s natural processes independently of the nutrient content of that substance, microorganism, or mixture thereof, and that thereby improves—</text> 
<paragraph id="HAA7ACE3837CB4B76949E47A6D77E3714"><enum>(1)</enum><text>nutrient availability, uptake, or use efficiency;</text></paragraph> <paragraph id="H5720D20B0C784A37B9ACF05D59A71F21"><enum>(2)</enum><text>tolerance to abiotic stress; and</text></paragraph> 
<paragraph id="H494954A792FF44A5A0237E7DAFA6D0DB"><enum>(3)</enum><text>consequent growth, development, quality, or yield.</text></paragraph></subsection> <subsection id="H6AA79F3EC2C648EAB094E18148CD4B0D"><enum>(qq)</enum><header>Nutritional chemical</header><text display-inline="yes-display-inline">The term <quote>nutritional chemical</quote>—</text> 
<paragraph id="H0A93D72D9EB24B0FB75CA92BB6A0309B"><enum>(1)</enum><text>means any substance or mixture of substances that interacts with plant nutrients in a manner which improves nutrient availability or aids the plant in acquiring or utilizing plant nutrients; and</text></paragraph> <paragraph id="HFAB67963AD55444CA9B642A492A39421"><enum>(2)</enum><text>includes some plant biostimulants.</text></paragraph></subsection> 
<subsection id="HBC3544386F27433EA544BC31482A9F64" commented="no"><enum>(rr)</enum><header>Vitamin hormone product</header><text>The term <quote>vitamin hormone product</quote> means a product consisting of a mixture of plant hormones, plant nutrients, inoculants, or soil amendments.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H035B008D899E4459ABD705D3BF463EB7" commented="no"><enum>(b)</enum><header>Regulations</header><text>Not later than 120 days after the date of the enactment of this Act, the Administrator of Environmental Protection Agency shall revise the regulations under subchapter E of chapter I of title 40, Code of Federal Regulations (as in effect on the date of the enactment of this Act) to carry out the amendments made by subsection (a).</text></subsection></section> 
<section id="H6BAB143652AD4FE4915B66B7DAE84FFA"><enum>3.</enum><header>Soil health study</header> 
<subsection id="H17A0564C447B49B5BC9B1725807C67BC"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary of Agriculture (referred to in this section as the <quote>Secretary</quote>) shall conduct a study to assess the types of, and practices using, plant biostimulants (as defined in section 2 of the Federal Insecticide, Fungicide, and Rodenticide Act (<external-xref legal-doc="usc" parsable-cite="usc/7/136">7 U.S.C. 136</external-xref>), as added by section 2 of this Act) that best achieve the following:</text> <paragraph id="HCE0D75AA215B481394A8981D7AFD0765"><enum>(1)</enum><text>Increasing organic matter content.</text></paragraph> 
<paragraph id="H041434A63D4249A3BB79BFFB29515D14"><enum>(2)</enum><text>Reducing atmospheric volatilization.</text></paragraph> <paragraph id="H824D84EE836F428BB6FBA4D0C6E40A0B"><enum>(3)</enum><text>Promotion of nutrient management practices.</text></paragraph> 
<paragraph id="HA85585EF3741456093BE97EDE0DDAFF2"><enum>(4)</enum><text>Limiting or eliminating runoff or leaching of soil or nutrients such as phosphorus and nitrogen into groundwater or other water sources.</text></paragraph> <paragraph id="HFDCCEE755BD749ACBA3E04224058C713"><enum>(5)</enum><text>Restoring beneficial bioactivity or healthy nutrients to the soil.</text></paragraph> 
<paragraph id="H80762E536F6D455B84AC1D784346F1E3"><enum>(6)</enum><text>Aiding in carbon sequestration, nutrient use efficiency, and other climate-related benefits.</text></paragraph> <paragraph id="H7C64265A59254524A682B8F3EC3635D7"><enum>(7)</enum><text>Supporting innovative approaches to improving agricultural sustainability, including the adoption of performance-based outcome standards and criteria.</text></paragraph></subsection> 
<subsection id="H60E6A994635F4A568C7F8270EDAF2DF5" commented="no"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which funds are first made available to conduct the study under subsection (a), the Secretary shall make publicly available, and submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate, a report that describes the results of the study.</text></subsection></section> </legis-body></bill>
