<section id="H395B569BD6034FCAB5F77B2DDD350004" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Visa Overstays Penalties Act</short-title></quote>.</text></section> <section id="HD023B96043F540D19421C654559EA352"><enum>2.</enum><header>Expanded penalties for illegal entry or presence</header><text display-inline="no-display-inline">Section 275 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1325">8 U.S.C. 1325</external-xref>) is amended—</text> 
<paragraph id="H773BD0BD57F745C3BCE583C892EA5E45"><enum>(1)</enum><text>in subsection (a) by inserting after <quote>for a subsequent commission of any such offense</quote> the following: <quote>or if the alien was previously convicted of an offense under subsection (e)(1)</quote>;</text></paragraph> <paragraph id="H9CCCE8FA00C14D2B8397AE16C5F1752F"><enum>(2)</enum><text>in subsection (b)—</text> 
<subparagraph id="H30C342037DBE4457AC5B8368279EFD67"><enum>(A)</enum><text>in paragraph (1), by striking <quote>at least $50 and not more than $250</quote> and inserting <quote>at least $500 and not more than $1,000</quote>; and</text></subparagraph> <subparagraph id="H39466FC4D1474C659EC5BD45D7FCC3F8"><enum>(B)</enum><text>in paragraph (2), by inserting after <quote>in the case of an alien who has been previously subject to a civil penalty under this subsection</quote> the following: <quote>or subsection (e)(2)</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HF7AC9B3540764F75B44B08AE0F7146B5"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" id="HC31BAA64F03040F78AA60A772F571970" display-inline="no-display-inline"> <subsection id="H504D789C30284AD09E836C982E349004"><enum>(e)</enum><header>Visa overstays</header><text display-inline="yes-display-inline">Any alien who was admitted as a nonimmigrant and who has failed to maintain the nonimmigrant status in which the alien was admitted or to which it was changed under section 248, or to comply with the conditions of any such status, for an aggregate of 10 days, has violated this subsection. An alien who has violated this subsection—</text> 
<paragraph id="HFEF74956DD024A5A8933CFCE9BC13220"><enum>(1)</enum><text display-inline="yes-display-inline">shall—</text> <subparagraph id="H6D3567F566044DBC97B257B2AB315348"><enum>(A)</enum><text>for the first commission of such a violation, be fined under title 18, United States Code, or imprisoned not more than 6 months, or both; and</text></subparagraph> 
<subparagraph id="HD6781C33796A4933870340CEF96E206A"><enum>(B)</enum><text>for a subsequent commission of such a violation or if the alien was previously convicted of an offense under subsection (a), be fined under such title 18, or imprisoned not more than 2 years, or both; and</text></subparagraph></paragraph> <paragraph id="HB50D00B31F0048A7A5F1FCA8E5B0EBC4"><enum>(2)</enum><text display-inline="yes-display-inline">in addition to, and not in lieu of, any penalty under paragraph (1) and any other criminal or civil penalties that may be imposed, shall be subject to a civil penalty of—</text> 
<subparagraph id="H2FD9B4D534E54FFF9936DE11713E4CE4"><enum>(A)</enum><text>at least $500 and not more than $1,000 for each violation; or</text></subparagraph> <subparagraph id="H190D049B844B4BA7A601FB91D3128355"><enum>(B)</enum><text display-inline="yes-display-inline">twice the amount specified in subparagraph (A) in the case of an alien who has been previously subject to a civil penalty under this subsection or subsection (b).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
