<section id="H83650132F13E4FAEA33E029327CBF5FD" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Emergency Access in Key Sites Act</short-title></quote> or the <quote><short-title>PEAKS Act</short-title></quote>.</text></section>
<section id="H75E2E4FC07FC4DDD8F6A272CCD81738D"><enum>2.</enum><header>Update to fee schedule for ambulance services provided by critical access hospitals</header><text display-inline="no-display-inline">Section 1834(l)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(l)(8)</external-xref>) is amended in the flush left text following subparagraph (B) by inserting <quote>(or, in the case of mountainous terrain or in areas with only secondary roads available, a 15-mile drive)</quote> after <quote>35-mile drive</quote>.</text></section> <section id="HEBE8AF7A363F4A038C5191A69A7F8C31"><enum>3.</enum><header>Treatment of hospitals that met mountainous terrain or secondary roads distance requirement for designation as critical access hospital</header><text display-inline="no-display-inline">Section 1820(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-4">42 U.S.C. 1395i–4(h)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HA75FC7B6C29E4BD48FCEFC69D988E07A"><enum>(4)</enum><header>Treatment of hospitals that met mountainous terrain or secondary roads distance requirements for designation</header>
<subparagraph id="HDD8C0552D4F746E08385CE0B7105A280"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning January 1, 2026, in the case of a hospital described in subparagraph (B), such hospital shall be deemed to meet the 15-mile distance requirement for mountainous terrain or secondary roads described in subsection (c)(2)(B)(i)(I).</text></subparagraph> <subparagraph id="HCD08FE5E98F24269A7D29AA3C5DF0A1F"><enum>(B)</enum><header>Hospital described</header><text display-inline="yes-display-inline">A hospital described in this subparagraph is a hospital that—</text>
<clause id="HD3747A4C90074DC3A11A33882927CE2C"><enum>(i)</enum><text display-inline="yes-display-inline">as of the date of enactment of this paragraph, is designated as a critical access hospital;</text></clause> <clause id="HEEA8289CAC354DFBA2B80DB1AFEB8F30"><enum>(ii)</enum><text display-inline="yes-display-inline">demonstrates (in a manner determined by the Secretary) that the hospital met the 15-mile distance requirement for mountainous terrain or secondary roads described in subsection (c)(2)(B)(i)(I) as of the hospital’s last certification as a critical access hospital; and</text></clause>
<clause id="HDA53F3B33DEB40D1BBBB9E6CABEF88D7"><enum>(iii)</enum><text display-inline="yes-display-inline">after such date of enactment, has a new hospital or other facility described in this subsection that is located not less than 10, but no more than 15, miles from the hospital.</text></clause></subparagraph> <subparagraph id="H319EEF45735548D3A855AF90797AEBA9"><enum>(C)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this paragraph, the Secretary shall promulgate regulations to carry out this paragraph.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
