R. 3759</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250605">June 5, 2025</action-date><action-desc><sponsor name-id="D000628">Mr. Dunn of Florida</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for streamlined cost exemptions for public assistance projects by the Federal Emergency Management Agency, and for other purposes.</official-title></form><legis-body id="H5E0CF5E982DF4E6D9D489F076C0BD544" style="OLC"><section id="H8313338678E4496CA42EC6B51D47FFE3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Streamlined FEMA Cost Exemption Act</short-title></quote>.</text></section><section id="HDE3380A296C94437A1FB6C181338D2FC" section-type="subsequent-section"><enum>2.</enum><header>Recoupment of certain assistance prohibited</header><text display-inline="no-display-inline">Section 705(a)(1) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5205">42 U.S.C. 5205(a)(1)</external-xref>) is amended by striking <quote>3 years</quote> and inserting <quote>2 years</quote>.</text></section><section id="H4D17799A7C93449C9F2FFB7ED7ADB929"><enum>3.</enum><header>Restoration of waiver authority</header><subsection id="HF413B67008F7426D896C1262C5051FEF"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">Section 312(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5155">42 U.S.C. 5155(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H980FC89E03D14765B356DCCD28690507" display-inline="no-display-inline"><paragraph id="HDE6E6FC14888455487E4181D0713B587"><enum>(4)</enum><header>Waiver of general prohibition</header><subparagraph id="H4ED77273229F437FAC9325A77C73730E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The President may waive the general prohibition provided in subsection (a) upon request of a Governor on behalf of the State or on behalf of a person, business concern, or any other entity suffering losses as a result of a major disaster or emergency, if the President finds such waiver is in the public interest and will not result in waste, fraud, or abuse. In making this decision, the President may consider the following:</text><clause id="H804E87AAB744434CADAE00C99959C388"><enum>(i)</enum><text>The recommendations of the Administrator of the Federal Emergency Management Agency made in consultation with the Federal agency or agencies administering the duplicative program.</text></clause><clause id="HE14A19545496459AA3C7D3D89350F0A2"><enum>(ii)</enum><text>If a waiver is granted, the assistance to be funded is cost effective.</text></clause><clause id="H95BA66D3AF1344B8B0E327ADD20F4830"><enum>(iii)</enum><text>Equity and good conscience.</text></clause><clause id="H4461EE6DA5AC42BFA1054038F6CB05E4"><enum>(iv)</enum><text display-inline="yes-display-inline">Other matters of public policy considered appropriate by the President.</text></clause></subparagraph><subparagraph id="H00893F81C8334FC4BDD9C9B7C662E6E1"><enum>(B)</enum><header>Grant or denial of waiver</header><text>A request under subparagraph (A) shall be granted or denied not later than 45 days after submission of such request.</text></subparagraph><subparagraph id="H1DB38BADA3434B1BB952978F772AD04F"><enum>(C)</enum><header>Prohibition on determination that loan is a duplication</header><text display-inline="yes-display-inline">Notwithstanding subsection (c), in carrying out subparagraph (A), the President may not determine that a loan is a duplication of assistance, provided that all Federal assistance is used toward a loss suffered as a result of the major disaster or emergency.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H020FC37FEE944A57B6A1A2188438CFE3"><enum>(b)</enum><header>Limitation</header><text>This subsection, including the amendment made by subsection (a), shall not be construed to apply to section 406 or 408 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5172">42 U.S.C. 5172</external-xref>, 5174).</text></subsection><subsection id="HB35D7D8E167D4ACD83CFF52497E07BCB"><enum>(c)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply to any major disaster or emergency declared by the President under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) on or after the date of enactment of this Act.</text></subsection></section><section id="HAC135C5A1B8F4307BB548C026A0C6728"><enum>4.</enum><header>Waiver of certain recoupment of funds</header><text display-inline="no-display-inline">Title VII of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H60363DEA6DE54AFBAB7D2178DDCF38B7" style="OLC"><section id="HD79B1AD1C04B4F63BAD6E57B64C512DA"><enum>707.</enum><header>Waiver of certain recoupment of funds</header><subsection id="H6AD690878F2A4CA2A35A7A6F40A95DD4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/33">chapter 33</external-xref> of title 31, United States Code, the Administrator may waive recoupment of funds provided for a covered project that—</text><paragraph id="HD55DA14F63984D77AC46E901B052C1D6"><enum>(1)</enum><text>are otherwise eligible to be recouped by a provision of this Act; and</text></paragraph><paragraph id="HD6F0EEE258534E63B3073395CDCB7C9F"><enum>(2)</enum><text display-inline="yes-display-inline">that exceed the total cost of a covered project by not greater than 5 percent.</text></paragraph></subsection><subsection id="H934D45AC9906405B90E3C6ED3E228DF3"><enum>(b)</enum><header>Covered project </header><text>In this section, the term <term>covered project</term> means a project for which financial assistance was provided under section 403, 406, 407, 428, or 502.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1F7BD6D7C484408E9F57C26713112B34"><enum>5.</enum><header>Acceptable error ratio</header><text display-inline="no-display-inline">Title VII of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>) is further amended by adding at the end the following:</text><quoted-block id="HA47B5809156A43C79176A349032C0B25" style="OLC"><section id="H22C66B2F1E95497088236CF5457D8C8D"><enum>708.</enum><header>Acceptable error ratio</header><subsection id="H087C194B850746BA9C2732231470CE40"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Notwithstanding subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/33">chapter 33</external-xref> of title 31, United States Code, the Administrator of the Federal Emergency Management Agency shall develop and establish an acceptable error ratio for allocations during eligibility negotiations relating to financial assistance provided under this Act.</text></subsection><subsection id="H257891D92DE74DB79DAC949C2650BCD5"><enum>(b)</enum><header>Use of funds</header><text>The Administrator shall ensure that any amount provided under this Act that the Administrator considers to be within the error ratio established under subsection (a) is used for an eligible purpose for which the assistance is provided.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
