which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the employees, officers, and agents of the Department of State, and persons and entities awarded grants or contracts or otherwise provided, directly or indirectly, Federal funds from the Department of State, from censoring the free speech of United States citizens.</official-title></form><legis-body id="HB2C012C6FFE84B78BC713169A81C5B9A" style="OLC"><section id="H989F2246C71F480FB041476B29BDF667" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring American Freedom Act</short-title></quote>.</text></section><section id="HE289F3EBA5604CD09EBA414F9FAF7967"><enum>2.</enum><header>Prohibiting censorship of free speech of United States citizens</header><subsection id="H3EE1CFAF04D14B2A80263560051CA4BE"><enum>(a)</enum><header>Prohibiting censorship of free speech</header><paragraph id="H5A329019764E48BFADC2E90D7D9283CA"><enum>(1)</enum><header>In general</header><text>Section 1(b)(3) of the State Department Basic Authorities Act of 1956 (<external-xref legal-doc="usc" parsable-cite="usc/22/2651a">22 U.S.C. 2651a(b)(3)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H52EBD6678E7E43E0A9A47FEB4D127CD7"><subparagraph id="H34339E877FE04E5CA782F0D0415C02B6"><enum>(G)</enum><text display-inline="yes-display-inline">monitor and ensure that—</text><clause id="H22521B09C08540FCA7C77B6A3D4CB166"><enum>(i)</enum><text display-inline="yes-display-inline">no Department employee, officer, and agent, and no person or entity awarded a grant or contract or otherwise provided, directly or indirectly, Federal funds from the Department, engages in or facilitates conduct that would unconstitutionally abridge the free speech (as such term is defined in section 2(b)(2)(C) of the Restoring American Freedom Act) of a United States citizen;</text></clause><clause id="H7AA90CC4DDE74A6497F4227BD053019C"><enum>(ii)</enum><text display-inline="yes-display-inline">none of the funds authorized to be appropriated or otherwise made available to the Secretary are used to engage in or facilitate conduct that would abridge the free speech (as so defined) of a United States citizen; and</text></clause><clause id="H3DD10A4E18AB4ADDA93DB7FD2345D431"><enum>(iii)</enum><text display-inline="yes-display-inline">appropriate action is taken to correct past misconduct by each Department employee, officer, and agent, and each person or entity awarded a grant or contract or otherwise provided, directly or indirectly, Federal funds from the Department, who engaged in or facilitated the censorship of the free speech (as so defined) of a United States citizen.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HE885DEC930CD4C89A57A955D9E89C583"><enum>(2)</enum><header>Clerical amendments</header><text>Section 1(b)(3) of such Act is amended—</text><subparagraph id="H2055309109544FDB81EAEB1D67C4D779"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>; and</quote> and inserting a semicolon; and</text></subparagraph><subparagraph id="H6F72781DB49C4DDD9A9F91976D37695B" display-inline="no-display-inline"><enum>(B)</enum><text>in subparagraph (F)—</text><clause id="HCE101C350C83448082563D931FC05979"><enum>(i)</enum><text>in clause (iii), by striking the semicolon at the end and inserting <quote>; and</quote>;</text></clause><clause id="H20BDC34A20914140BCD65CA72CD97EE2"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking clause (iv); and</text></clause><clause id="HE196E79566174FABA424E2F247C93918"><enum>(iii)</enum><text display-inline="yes-display-inline">in clause (v),</text><subclause id="H5394E129594345CF8A3B7BA1E59F3B3C"><enum>(I)</enum><text>by striking <quote>bureaus.</quote> and inserting <quote>bureaus; and</quote>; and</text></subclause><subclause id="HCC1CD6C481464562A838732E9854A279"><enum>(II)</enum><text>by redesignating clause (v) as clause (iv).</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H990DE91B65A4494684C242DF4E954FA6" display-inline="no-display-inline"><enum>(b)</enum><header>Prohibiting using funds to censor free speech</header><paragraph id="HE36FD3C97E9741818A7BBA26CE2E1699"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No funds authorized to be appropriated or otherwise made available to the Secretary of State may be awarded, granted, or otherwise provided, directly or indirectly, to any person or entity that—</text><subparagraph id="H8E35D66D42024961A8019C1AA2B865E5"><enum>(A)</enum><text>publishes or disseminates an advertising blacklist; or</text></subparagraph><subparagraph id="H2FA1324DC93B4DD2822BA0AF21D1437F"><enum>(B)</enum><text display-inline="yes-display-inline">creates, tests, or distributes a censorship tool without sufficient safeguards, as determined by the Under Secretary for Public Diplomacy, for preventing such tool from being used to censor the free speech of a United States citizen.</text></subparagraph></paragraph><paragraph id="H8882B81B9BC743F495648E926FFD6C88"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection: </text><subparagraph id="H7D37A1A93E394B3BABD6DF7742AA9601"><enum>(A)</enum><header>Advertising blacklist</header><text display-inline="yes-display-inline">The term <quote>advertising blacklist</quote> means a curated list used to identify a United States citizen for the purpose of discouraging or prohibiting an advertiser from placing an advertisement with, or providing financial support to, such citizen because of the content of the free speech of such citizen.</text></subparagraph><subparagraph id="HFC95DCE92F2048A5A7256F1991181A56"><enum>(B)</enum><header>Censor</header><text>The term <quote>censor</quote> means to scrutinize and examine the free speech of a United States citizen with the intent to suppress such free speech, and includes—</text><clause id="H211517AB696C48B596D7B34BAF9A6173"><enum>(i)</enum><text>exerting substantial coercive pressure on a third party, such as a social media company, to moderate, remove, or otherwise suppress such free speech; or</text></clause><clause id="H24895FE4417D455CBD7640DA88D5A7C0"><enum>(ii)</enum><text display-inline="yes-display-inline">contacting, directly or indirectly, such as through an academic institution, a social media company, to moderate, remove, or otherwise suppress such protected speech.</text></clause></subparagraph><subparagraph id="HA434CEF7CC494800AF110D23A7BC53B7"><enum>(C)</enum><header>Free speech</header><text display-inline="yes-display-inline">The term <quote>free speech</quote> means speech protected by the First Amendment of the United States Constitution from being suppressed by the United States Government.</text></subparagraph></paragraph><paragraph id="H46594F9164604138A51686512117C96F"><enum>(3)</enum><header>Enforcement</header><text display-inline="yes-display-inline">As soon as practicable, but not later than 7 days after the date on which the Secretary of State is notified of each employee, officer, and agent of the Department of State, and of each person and entity awarded a grant or contract or otherwise provided, directly or indirectly, Federal funds from the Department of State, who is actually or potentially engaging in or facilitating the censorship of the free speech of a United States citizen, such Secretary shall notify the Chairman and ranking member of the Committee on Foreign Affairs in the House of Representatives, the Chairman and ranking member of the Committee on Foreign Relations in the Senate, and such United States citizen of such censorship.</text></paragraph></subsection></section></legis-body></bill>
