<section id="H62F1A34B49184C4D91DF6E3834295584" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Forage Fish Conservation Act of 2025</short-title></quote>.</text></section> <section id="H29705FE834A04CF0A3AA2A46675196CD" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Section 2(a) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801(a)</external-xref>) is amended by adding at the end the following:</text>

<paragraph id="HF08DEECEB0914170B88DC8D37207E141"><enum>(14)</enum><text display-inline="yes-display-inline">Forage fish are generally small to intermediate-sized species, occurring in schools or dense aggregations, and function as a main pathway for energy to flow from phyto- and zooplankton to higher trophic level predators, including tuna, Alaska pollock, and other wildlife, in marine ecosystems. While most species function as prey of others at some life stage, especially when small and young, forage fish maintain this important trophic role throughout their life. Further, fluctuations in their populations can result in significant changes in marine communities and ecosystems. Therefore, particular attention to management of forage fish species, and addressing their unique role in marine ecosystems, is critical to maintaining ecosystem function and sustainable fisheries.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H7DEC1D7C18674674B5F92E9EA2BBADBD" commented="no"><enum>3.</enum><header>Definitions</header> <subsection id="H61DFAB1E67D54FEFA7EB0B3329EC3790" commented="no"> <enum>(a)</enum> <header>Secretary To define forage fish</header> <text display-inline="yes-display-inline">Section 305 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1855">16 U.S.C. 1855</external-xref>) is amended by adding at the end the following:</text>

          <subsection id="H8CD25EE929CD4677BBBC6CE088687C2E" commented="no">
            <enum>(l)</enum>
            <header>Forage fish</header>
 <text>Not later than 12 months after the date of the enactment of the <short-title>Forage Fish Conservation Act of 2025</short-title>, the Secretary, with advice from the Councils, shall issue a definition of the term <term>forage fish</term> for the purposes of this Act, giving due consideration to definitions of <quote>forage fish</quote> included in approved fishery management plans. In defining such term, the Secretary shall consider factors including whether a species covered by such definition, throughout the lifecycle of such species—</text>
            <paragraph id="HEAEDA41383504B3D953EBCAA81E090AC" commented="no">
              <enum>(1)</enum>
 <text>is at a low trophic level;</text> </paragraph> <paragraph id="HA0496062E6414027834B1889E765B264" commented="no"> <enum>(2)</enum> <text>is generally small- to intermediate-sized;</text>
            </paragraph>
            <paragraph id="HE0D7FDD487BC40CA925CE57919B54AED" commented="no">
              <enum>(3)</enum>
 <text>occurs in schools or other dense aggregations;</text> </paragraph> <paragraph id="H06438C7D78B94F61B2A85DC9849CBDFA" commented="no"> <enum>(4)</enum> <text>contributes significantly to the diets of other fish, marine mammals, or birds; and</text>
            </paragraph>
            <paragraph id="H5C480376EA404B8297848D09BC3F23DE" commented="no">
              <enum>(5)</enum>
 <text>serves as a conduit for energy transfer to species at a higher trophic level.</text>
            </paragraph>
          </subsection>

        </quoted-block>
      </subsection> 
<subsection id="H00C9724BE6DE4DAD8F39243029AFDBF6" commented="no"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1802">16 U.S.C. 1802</external-xref>) is amended—</text> <paragraph id="H3CE88ED6DABB49ECB30ECECC2C73EA14" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating the second paragraph (33) as paragraph (53);</text></paragraph> 
<paragraph id="HC1E921C49CA147258D8F9DF802C0A3E7" commented="no"><enum>(2)</enum><text>by redesignating paragraphs (28) through (50) as paragraphs (30) through (52), respectively;</text></paragraph> <paragraph id="HE865AE3D77A849C1BCF9BE8F07D3D4BB" commented="no"><enum>(3)</enum><text>by redesignating paragraphs (19) through (27) as paragraphs (20) through (28), respectively;</text></paragraph> 
<paragraph id="H2E914F893DD94E5590324772C37FC268" commented="no"><enum>(4)</enum><text>by inserting after paragraph (18) the following:</text> <quoted-block id="HDFC4C2CB8A2F4DDFA259C4913CAEF470" style="OLC"> <paragraph id="HBB403C8500A648EC8E9D202C03EF6C6C" commented="no"><enum>(19)</enum><text>The term <term>forage fish</term>—</text> 
<subparagraph id="H04A34C1377FE43A19A69478A67EF662B" commented="no"><enum>(A)</enum><text>has the meaning given the term by the Secretary under section 305(l); and</text></subparagraph> <subparagraph id="H45500B8822BF4DCA859EE662B486A073" commented="no"><enum>(B)</enum><text>with respect to a species in a fishery managed pursuant to a fishery management plan or plan amendment that is approved by the Secretary, in coordination with the Councils, under section 304(a), means any species identified in such plan as a forage fish.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H59785FCBE28043E3844CCE3208194760" commented="no"><enum>(5)</enum><text>by inserting after paragraph (28), as so redesignated by paragraph (3) of this section, the following:</text> <quoted-block id="H1DE0228EED6E44DFAB6FBBFFAC8CE768" style="OLC"> <paragraph id="HCDAE6F06CE4D4CBA95497920F152D27C" commented="no"><enum>(29)</enum><text>The term <term>low trophic level</term> means a position in the marine food web in which the fish generally consume plankton.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H82834E31FE064DA8BCE53EF0B91BD6E3"><enum>4.</enum><header>Scientific advice</header><text display-inline="no-display-inline">Section 302(g)(1)(B) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(g)(1)(B)</external-xref>) is amended to read as follows:</text> <quoted-block id="H8DB7561472764399A48F1DBB86CFFED4" style="OLC"> <subparagraph id="H3EDD4571DD804DC6B2B6F068BD7CB954" indent="up1"><enum>(B)</enum><text>Each scientific and statistical committee shall provide its Council ongoing scientific advice for fishery management decisions, including recommendations for—</text> 
<clause id="H5E54E32DF9614EF6957558FD92E089A8"><enum>(i)</enum><text>acceptable biological catch;</text></clause> <clause id="H8453203911004ACA95FB50F1ECF958F8"><enum>(ii)</enum><text>preventing overfishing;</text></clause> 
<clause id="H59EF6520AD1648BBB2D18E27CAA8963B"><enum>(iii)</enum><text>maximum sustainable yield;</text></clause> <clause id="H4B100F32B5324D47A8F1F0F9557EB511"><enum>(iv)</enum><text>achieving rebuilding targets;</text></clause> 
<clause id="H463F2BEC155C4952890CB04C3DC13B08"><enum>(v)</enum><text>maintaining a sufficient abundance, diversity, and localized distribution of forage fish populations to support their role in marine ecosystems; and</text></clause> <clause id="H443F37F7EFD2416B8129ABB4D7FCFB6E"><enum>(vi)</enum><text>reports on stock status and health, bycatch, habitat status, social and economic impacts of management measures, and sustainability of fishing practices.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HD238C7DCFDDF4592854B922EBF340124"><enum>5.</enum><header>Council functions</header> 
<subsection id="H0B301499457E4AC3916F5C966054B506"><enum>(a)</enum><header>Research priorities</header><text display-inline="yes-display-inline">Section 302(h)(7) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(h)(7)</external-xref>) is amended, in the matter preceding subparagraph (A), by inserting <quote>forage fish populations and distribution,</quote> after <quote>habitats,</quote>.</text></subsection> <subsection id="HC42E97AC98054B03887295084B640E04"><enum>(b)</enum><header>Unmanaged forage fish</header><text display-inline="yes-display-inline">Section 302(h) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(h)</external-xref>) is amended—</text> 
<paragraph id="HB5343B18D1454401BA1F5E0834A074ED"><enum>(1)</enum><text>in paragraph (8), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="HB9F5E45B78EE445D9D56051CD0639D88"><enum>(2)</enum><text>by redesignating paragraph (9) as paragraph (10); and</text></paragraph> 
<paragraph id="H688EE50FFD3041C8BAA7AA012718A992"><enum>(3)</enum><text>by inserting after paragraph (8) the following:</text> <quoted-block id="H5A0D5E2E79DB413EBA87B65C5B0EB8E4" style="OLC"> <paragraph id="H89263F6450664989A6441797D3C3B72A"><enum>(9)</enum><text>develop a list of unmanaged forage fish occurring in the area under its authority and recommend within fishery management plans the prohibition of the development of any new directed forage fish fishery until the Council has—</text> 
<subparagraph id="HA7132F71AF0F45748D42814476AA8C02"><enum>(A)</enum><text>considered the best scientific information available and evaluated the potential impacts of forage fish harvest on existing fisheries, fishing communities, and the marine ecosystem;</text></subparagraph> <subparagraph id="HB4FE9809A6EC478DBDB9B695E1872886"><enum>(B)</enum><text>determined whether conservation and management of the forage fish fishery is needed;</text></subparagraph> 
<subparagraph id="HEECB7D8ECB274A2BBE1CB3861B694551"><enum>(C)</enum><text>if a determination is made that conservation and management is needed, prepared and submitted to the Secretary a fishery management plan or amendment consistent with section 303; and</text></subparagraph> <subparagraph id="H78E327920EA24C96BDB2C97410260F9D"><enum>(D)</enum><text>received final, approved regulations from the Secretary pursuant to section 304(b)(3); and</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF86EC2EF4D644841816833C15FD87FD6"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsections (a) and (b) shall take effect 2 years after the date of the enactment of this Act.</text></subsection></section> <section id="H4695E8D7179C4608A67152F38018E47C"><enum>6.</enum><header>Contents of fishery management plans</header> <subsection id="H8DD67F66143E48F0A821F9DF3A6C2237"><enum>(a)</enum><header>Forage fish management</header><text display-inline="yes-display-inline">Section 303(a) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1853">16 U.S.C. 1853(a)</external-xref>) is amended—</text> 
<paragraph id="H96C6EB152798409A9B7AB721854E4814"><enum>(1)</enum><text>in paragraph (14), by striking <quote>and;</quote> and inserting a semicolon;</text></paragraph> <paragraph id="H71391F34703C4162862016A1EBCD1D34"><enum>(2)</enum><text>in paragraph (15), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HC7350FC836414B838B999E00BCBB5958"><enum>(3)</enum><text>by adding at the end the following:</text> <quoted-block id="HBCD5DD1625894FB0BBF0FF674D2D298B" style="OLC"> <paragraph id="H5E7A6AFE4F774831975EF086139EA1C9"><enum>(16)</enum><text>when setting annual catch limits for forage fish fisheries, assess and specify such limits by the diet needs of fish species and other marine wildlife, such as marine mammals and birds, for which forage fish is a significant part of their diet.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H18DD6B285B734C70A73B801D42701A78"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect 5 years after the date of the enactment of this Act.</text></subsection></section> <section id="HBC27CA89D3D34CD08A78A70728083117"><enum>7.</enum><header>Action by Secretary of Commerce</header><text display-inline="no-display-inline">Section 304 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1854">16 U.S.C. 1854</external-xref>) is amended—</text> 
<paragraph id="H16B78C223032460898ED01C90E1CD8F4"><enum>(1)</enum><text>by redesignating the second subsection (i) as subsection (j); and</text></paragraph> <paragraph id="H25A093227CF94903B2FB54B1294F861C"><enum>(2)</enum><text>by adding at the end the following:</text>

<subsection id="H94DD45A4FF9F4B8AAFA508FF78A855F6"><enum>(k)</enum><header>Forage fish management guidelines</header> 
<paragraph id="H35B3378EFE6F465589D47DB6F720E54C"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of the enactment of <short-title>Forage Fish Conservation Act of 2025</short-title>, the Secretary, in coordination with the Councils, shall establish by regulation guidelines to assist the Councils in implementing sections 3(19), 302(h)(9), and 303(a)(16).</text></paragraph> <paragraph id="H8A48163C84064B80B9D6EE7CAF137244"><enum>(2)</enum><header>Workshops</header><text>In developing the guidelines under paragraph (1), the Secretary shall conduct workshops with Councils and other scientific, fisheries, and conservation interests.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H710565E1A5D64A34BBED86E61E1E362E"><enum>8.</enum><header>River herring and shad</header> 
<subsection id="HB30451D706A8405E863DE5BF3E1CF2A8"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="H9A848941C6D042CF8C9108FBB49F5FCD"> <enum>(1)</enum> <header>River herring</header> <text>The term <term>river herring</term> means blueback herring (Alosa aestivalis) and alewife (Alosa pseudoharengus).</text>
                </paragraph> 
<paragraph id="HDA4CDC6056F042758CFEFE654733ADE4">
                    <enum>(2)</enum>
                    <header>Shad</header>
 <text>The term <term>shad</term> means American shad (Alosa sapidissima) and hickory shad (Alosa mediocris).</text>
                </paragraph></subsection> 
<subsection id="H6BD19B9B0A774F3EB838859E5F7B6DB4"><enum>(b)</enum><header>Amendments of plans</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Commerce shall—</text> <paragraph id="H420A5F564B96419F90053FFA8FFA5287"><enum>(1)</enum><text>amend the fishery management plans for the Atlantic Herring and Atlantic Mackerel, Squid, and Butterfish fisheries for the New England and Mid-Atlantic Regions to add shad and river herring as managed stocks in such plans consistent with section 302(h)(1) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852(h)(1)</external-xref>);</text></paragraph> 
<paragraph id="H813FF21D2B124CDDA2E4180F750BE362"><enum>(2)</enum><text>initiate additional fishery management plan amendments to be completed in not more than 1 year from the date of the addition of the species identified in paragraph (1) in order to develop and implement all required conservation and management measures for such stocks consistent with the Magnuson-Stevens Fisheries Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>) and all other applicable law; and</text></paragraph> <paragraph id="H518699363E6F4CB8A6DEE598365AE415"><enum>(3)</enum><text>notwithstanding any other law, rule, or fishery management plan provision, including conservation and management measures under section 303(a)(11) of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1853">16 U.S.C. 1853(a)(11)</external-xref>), reallocate existing resources to provide, for not less than 50 percent of all relevant fishing trips, not fewer than 1 at-sea observer or an on-board electronic or video means of producing equivalent at-sea monitoring information, for any vessel using mid-water trawl or paired mid-water trawl fishing gear in the Atlantic herring and Atlantic mackerel fisheries.</text></paragraph></subsection></section> 
<section id="H2F349BD19D924679A8B3CA17D4574B80"><enum>9.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act may be construed as—</text> <paragraph id="H3D220C2820D848439369057AB30690FD"><enum>(1)</enum><text>extending or diminishing the jurisdiction or authority of any State within its boundaries; or</text></paragraph> 
<paragraph id="HE371D981AAC0447796B131992CE047CA"><enum>(2)</enum><text>affecting—</text> <subparagraph id="HCB4494C100874378BCD35A57D57BE69A"><enum>(A)</enum><text>section 306 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1856">16 U.S.C. 1856</external-xref>); or</text></subparagraph> 
<subparagraph id="HEBD3CFF8036C4496A477A2846408990F"><enum>(B)</enum><text>the Atlantic Coastal Fisheries Cooperative Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/5101">16 U.S.C. 5101 et seq.</external-xref>).</text></subparagraph></paragraph></section> </legis-body></bill>
