which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, and <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish within the Environmental Protection Agency the Office of Mountains, Deserts, and Plains, and for other purposes.</official-title></form><legis-body id="H11FB8C4AFB694CF08A608FD130BDEC7E" style="OLC"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="HDFB03085E30F405F93EB6CCEFA8EE61D"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Legacy Mine Cleanup Act of 2025</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HFF3E0C4BA6CE404C9B14176EC6422737"><enum>2.</enum><header display-inline="yes-display-inline">Office of Mountains, Deserts, and Plains</header><subsection commented="no" display-inline="no-display-inline" id="H3DDDD2EE375947B8897284CAF4283C71"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H48E76BC18D5542C79027A3AEF57B4F24"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCE4BA6D92A8D445D811B97B45D856F10"><enum>(2)</enum><header display-inline="yes-display-inline">Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="HC8E40E0B847C4868AE77F54E72AFE85B"><enum>(A)</enum><text display-inline="yes-display-inline"><committee-name committee-id="SSAP00">the Committee on Appropriations of the Senate;</committee-name></text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H554178C141FE4650BB7380F4B8BB39A3"><enum>(B)</enum><text display-inline="yes-display-inline"><committee-name committee-id="SSEG00">the Committee on Energy and Natural Resources of the Senate;</committee-name></text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H654C3F3E785D4566A777D775B43CBD7F"><enum>(C)</enum><text display-inline="yes-display-inline"><committee-name committee-id="SSEV00">the Committee on Environment and Public Works of the Senate;</committee-name></text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC9B5E80C0A974E608EE37F1821B045F3"><enum>(D)</enum><text display-inline="yes-display-inline"><committee-name committee-id="SSHR00">the Committee on Health, Education, Labor, and Pensions of the Senate;</committee-name></text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB2A02AA46F4949E58754FF5FBED5D322"><enum>(E)</enum><text display-inline="yes-display-inline"><committee-name committee-id="SLIA00">the Committee on Indian Affairs of the Senate;</committee-name></text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE018D6690B414F36AD185AC8BAB2DDE4"><enum>(F)</enum><text display-inline="yes-display-inline"><committee-name committee-id="">the Committee on Appropriations of the House of Representatives;</committee-name></text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H42863628F45240AAB86A4140372D986B"><enum>(G)</enum><text display-inline="yes-display-inline"><committee-name committee-id="">the Committee on Energy and Commerce of the House of Representatives;</committee-name></text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBB62464C1AD74340A87CAD1B2BE69300"><enum>(H)</enum><text display-inline="yes-display-inline"><committee-name committee-id="">the Committee on Transportation and Infrastructure of the House of Representatives;</committee-name></text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HECBED6BC3D8C48C79F77F774E7A7C76B"><enum>(I)</enum><text display-inline="yes-display-inline"><committee-name committee-id="">the Committee on Natural Resources of the House of Representatives; and</committee-name></text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H79ECAA67688E43078FF2B1D666292D1A"><enum>(J)</enum><text display-inline="yes-display-inline"><committee-name committee-id="">the Committee on Oversight and Accountability of the House of Representatives.</committee-name></text></subparagraph></paragraph><paragraph id="HD791505A13D0413295E2C95088D5D0BD"><enum>(3)</enum><header>Cleanup action</header><text>The term <term>cleanup action</term> means 1 or more actions taken to address contaminated media at a covered mine site pursuant to 1 or more existing authorities of the Administrator, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="H7C080BD64DF54D9CA4F2D9495AD49CD0"><enum>(A)</enum><text display-inline="yes-display-inline">the <act-name parsable-cite="CERCL">Comprehensive Environmental Response, Compensation, and Liability Act of 1980</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8A14106CE41542989A767DCE3A13A392"><enum>(B)</enum><text display-inline="yes-display-inline">the Good Samaritan Remediation of Abandoned Hardrock Mines Act of 2024 (<external-xref legal-doc="usc" parsable-cite="usc/30/1245">30 U.S.C. 1245</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/118/155">Public Law 118–155</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H310D16C493A04602B502974A9B669E00"><enum>(C)</enum><text display-inline="yes-display-inline">the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0C6BFFEF3B7442C1A7A5285C213A1500"><enum>(D)</enum><text display-inline="yes-display-inline">the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>); and<committee-name committee-id=""></committee-name></text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBB7EC390A0344E03B6534E7A94A8E53C"><enum>(E)</enum><text>any other existing authority of the Administrator.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HACABDA7CB101424CACEB2915BA66F1F5"><enum>(4)</enum><header display-inline="yes-display-inline">Covered mine site</header><text display-inline="yes-display-inline">The term <term>covered mine site</term> means the land, water, and surrounding watersheds where extraction, beneficiation, or processing of hardrock ores or minerals occurred, but has been discontinued, including discontinued temporarily.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0CACCCB9F26448F7B7C8110204F6424B"><enum>(5)</enum><header display-inline="yes-display-inline">Indian country</header><text display-inline="yes-display-inline">The term <term>Indian country</term> has the meaning given the term in section 1151 of title 18, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4DAE5600B4F3469FA349EBD4BF5A5A6C"><enum>(6)</enum><header display-inline="yes-display-inline">Navajo Nation abandoned uranium mine site</header><text display-inline="yes-display-inline">The term <term>Navajo Nation abandoned uranium mine site</term> means an abandoned uranium covered mine site on land of the Navajo Nation. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDC8FEA30AB97479A9DA1200D53E223D9"><enum>(7)</enum><header display-inline="yes-display-inline">Office</header><text display-inline="yes-display-inline">The term <term>Office</term> means the Office of Mountains, Deserts, and Plains established by subsection (b)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H175837CE66B24BD68D2F593A4E830754"><enum>(8)</enum><header display-inline="yes-display-inline">Regional Office</header><text display-inline="yes-display-inline">The term <term>Regional Office</term> means a Regional Office of the Environmental Protection Agency.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3E75E36EC39F4CEBB38CD67DCE192869"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><paragraph commented="no" display-inline="no-display-inline" id="HF08DD6E4FEEF491C90AB0FC35C2A4B23"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established within the office of the Environmental Protection Agency that administers solid waste programs the Office of Mountains, Deserts, and Plains.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H73D384935131470EAFEEFB26A14CA27A"><enum>(2)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The Office shall be headed by a Director, to be selected by the Administrator (or a designee). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0B05F1E7C3AA4C14A3CE91650BD7BED0"><enum>(c)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of the Office shall be—</text><paragraph commented="no" display-inline="no-display-inline" id="H4194AFA693FD48D39BA717C079161EA0"><enum>(1)</enum><text display-inline="yes-display-inline">to coordinate between the headquarters of the Environmental Protection Agency, Regional Offices, and stakeholders on cleanup actions of the Environmental Protection Agency at a covered mine site, including a covered mine site in Indian country, in accordance with Federal law;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7ABA0FBD8A944AB3A39A353726E20763"><enum>(2)</enum><text display-inline="yes-display-inline">to establish and disseminate best practices for covered mine site cleanup actions, including identifying—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB51F572344E74530AE7082EB862A5B41"><enum>(A)</enum><text display-inline="yes-display-inline">innovative technologies and reuse approaches that support and make progress toward those cleanup actions; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9A4D9213D7A54AB393FC0443B3E3266A"><enum>(B)</enum><text display-inline="yes-display-inline">waste storage and disposal solutions;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H65283C2231B94BD995D89AB8989C51E6"><enum>(3)</enum><text display-inline="yes-display-inline">to coordinate among the headquarters of the Environmental Protection Agency, Regional Offices, Federal land management agencies, States, Indian Tribes, and voluntary nongovernmental organizations, watershed groups, nonliable entities and mining companies, and other entities on voluntary cleanup actions at covered mine sites, where applicable, including timely issuance of administrative guidance for nonliable parties;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6F778E85AADD4649A36F73C2A0D964B7"><enum>(4)</enum><text display-inline="yes-display-inline">to coordinate within the Environmental Protection Agency and with other Federal agencies to encourage contracting opportunities for small businesses to participate in cleanup actions at covered mine sites, consistent with applicable Federal procurement authorities; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA4EFE797D0904B7CBAFE96768EE77D21"><enum>(5)</enum><text display-inline="yes-display-inline">to coordinate with the Secretary of the Interior, the Secretary of Agriculture, the Secretary of Energy, the Secretary of Health and Human Services, the Nuclear Regulatory Commission, and other Federal agencies, as the Administrator determines to be appropriate, to ensure interagency coordination of covered mine site cleanup actions, with priority given to coordinating cleanup actions at covered mine sites for which there is no potentially responsible party; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H390BC8531BC24165A813EE9993DFD8AB"><enum>(6)</enum><text display-inline="yes-display-inline">to coordinate other actions as the Administrator determines to be appropriate, pursuant to existing authorities of the Administrator—</text><subparagraph commented="no" display-inline="no-display-inline" id="H5020F5430DA8453C9D44BA1B51383007"><enum>(A)</enum><text display-inline="yes-display-inline">to support efforts to investigate, characterize, or clean up a discharge, release, or threat of release of a hazardous substance, pollutant, or contaminant into the environment at or from a covered mine site; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2C9DE527B7344AE1A362C9FE67DE0017"><enum>(B)</enum><text display-inline="yes-display-inline">to establish best practices to protect and improve human health and the environment and implement appropriate reuse options, including through the use of innovative technologies to recover valuable resources from covered mine site features or areas, as applicable.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3D80D25114CC4F20BD769A39CE829970"><enum>(d)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Administrator shall carry out through the Office, at a minimum, the following duties:</text><paragraph commented="no" display-inline="no-display-inline" id="HE35D3D5CBC8C44AE9D65CE7209133077"><enum>(1)</enum><header display-inline="yes-display-inline">Priority mine list</header><subparagraph commented="no" display-inline="no-display-inline" id="H20667CD0AAD14F14AB707B8D84B7915B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Annually, the Administrator shall identify covered mine sites that are prioritized for cleanup actions, which may include covered mine sites that are or are not included on the National Priorities List developed by the President in accordance with section 105(a)(8)(B) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9605">42 U.S.C. 9605(a)(8)(B)</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE9BDDA97878B47078C4D23E1E72257BA"><enum>(B)</enum><header display-inline="yes-display-inline">Creation of list; reports</header><text display-inline="yes-display-inline">The Administrator shall annually—</text><clause commented="no" display-inline="no-display-inline" id="H9B114DE9D75C4CAC9464936975CF9AE3"><enum>(i)</enum><text display-inline="yes-display-inline">create a list of covered mine sites identified under subparagraph (A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H15D044D15DB245B796139A8B92BFF147"><enum>(ii)</enum><text display-inline="yes-display-inline">submit to the appropriate committees of Congress a report describing—</text><subclause commented="no" display-inline="no-display-inline" id="HB8F2FBE77B884551BD85CE50E3AFE9EA"><enum>(I)</enum><text display-inline="yes-display-inline">the methodology used to identify those covered mine sites under that subparagraph; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H198A8FB2E37747D78BA6DE382FD9FED0"><enum>(II)</enum><text display-inline="yes-display-inline">the status of cleanup actions carried out at covered mine sites on the list.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H13CE5369AA854D248BC71AA516E0A64C"><enum>(C)</enum><header display-inline="yes-display-inline">Coordination</header><text display-inline="yes-display-inline">The Administrator shall—</text><clause commented="no" display-inline="no-display-inline" id="HC75842ECE5034061978BA0A87FB6BAF3"><enum>(i)</enum><text display-inline="yes-display-inline">regularly coordinate with Regional Offices, Federal agencies, States, Indian Tribes, Alaska Native Corporations, and stakeholders to update the list of covered mine sites identified under subparagraph (A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="HF65953C6AAD448C092F14EDC7396241A"><enum>(ii)</enum><text display-inline="yes-display-inline">regularly coordinate with Regional Offices on cleanup actions and share best practices with respect to each covered mine site identified under subparagraph (A).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H81408973727F4AD0A36197D1CA0C73F6"><enum>(2)</enum><header display-inline="yes-display-inline">Process improvement</header><subparagraph commented="no" display-inline="no-display-inline" id="H4198C6C3156F4301A16BF408F02FB73A"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall, pursuant to existing authorities of the Administrator—</text><clause commented="no" display-inline="no-display-inline" id="HF1816346711847D3989E4F0FB2C76BFF"><enum>(i)</enum><text display-inline="yes-display-inline">identify best practices for developing, reviewing, and approving site assessments, remedial investigations, and feasibility studies for covered mine sites;</text></clause><clause commented="no" display-inline="no-display-inline" id="H8DB7279DAD2E40B39DCB19F3B11FF338"><enum>(ii)</enum><text display-inline="yes-display-inline">coordinate research relating to technologies and cleanup approaches that are the most successful in limiting the acute and chronic risks posed to human health and the environment by covered mine sites; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H646AD60DA92E4F9A950E21D0EC263464"><enum>(iii)</enum><text display-inline="yes-display-inline">support—</text><subclause commented="no" display-inline="no-display-inline" id="HC2214F38C10A488FAF284898C5029361"><enum>(I)</enum><text display-inline="yes-display-inline">government-to-government consultations with Indian Tribes with respect to a covered mine site located within Indian country; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HEE1A7EFF42604A1CBAE8716E7F6D5CBF"><enum>(II)</enum><text display-inline="yes-display-inline">efforts to provide regular updates to the Tribal governments involved in cleanup actions for a covered mine site located on Tribal land under the jurisdiction of the Indian Tribe.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3488751A77534B72A405CCA87AC497D5"><enum>(B)</enum><header display-inline="yes-display-inline">Tribal consultation</header><text display-inline="yes-display-inline">In supporting consultations with Indian Tribes under subparagraph (A)(iii)(I), the Administrator, in addition to existing applicable law and guidance, shall—</text><clause commented="no" display-inline="no-display-inline" id="HE375226A79154B48AF27099CFEB641E6"><enum>(i)</enum><text display-inline="yes-display-inline">as appropriate, invite potentially responsible parties, including Federal agencies, to participate in government-to-government consultations with Indian Tribes;</text></clause><clause commented="no" display-inline="no-display-inline" id="HC9C39D100E064136B346F0146457ED48" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">as appropriate, consult with Alaska Native Corporations in accordance with section 161 of division H of the Consolidated Appropriations Act, 2004 (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/108/199">Public Law 108–199</external-xref>); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H87DC993A9BA54578A86739B6F28D17B8"><enum>(iii)</enum><text display-inline="yes-display-inline">as appropriate, ensure consultations with Tribal allottees occur pursuant to section 2 of the Act of February 5, 1948 (62 Stat. 18, chapter 45; <external-xref legal-doc="usc" parsable-cite="usc/25/324">25 U.S.C. 324</external-xref>).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD9346CF686894A768C68BC1DED746D30"><enum>(3)</enum><header display-inline="yes-display-inline">Interagency plans for uranium contamination on the Navajo Nation; reports</header><subparagraph commented="no" display-inline="no-display-inline" id="H60E05FCA2032418A9ABAF6A28CBEEE6E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than September 30, 2028, and not less frequently than once every 10 years thereafter, the Administrator, in cooperation with other relevant Federal agencies, including, at a minimum, the Department of Energy, the Nuclear Energy Regulatory Commission, the Department of the Interior, the Indian Health Service, and the Agency for Toxic Substances and Disease Registry, and in consultation with affected Tribal governments, shall develop a 10-year interagency plan for the coordination of the Federal Government with States and Tribal governments to carry out cleanup actions at Navajo Nation abandoned uranium mine sites, including—</text><clause commented="no" display-inline="no-display-inline" id="H31B2914679404FB0BB1CD6828893D161"><enum>(i)</enum><text display-inline="yes-display-inline">goals for the assessment of, and cleanup actions at, Navajo Nation abandoned uranium mine sites;</text></clause><clause commented="no" display-inline="no-display-inline" id="H3B23B0A313D1408D8374EDE8F887BF89"><enum>(ii)</enum><text display-inline="yes-display-inline">target dates by which goals described in clause (i) are anticipated to be achieved, subject to appropriations and funding from potentially responsible parties;</text></clause><clause commented="no" display-inline="no-display-inline" id="H118295D01288438D9597A2B5216FBFF8"><enum>(iii)</enum><text display-inline="yes-display-inline">the projected appropriations necessary to achieve goals described in clause (i) by the target dates described in clause (ii); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H98506CC4813746319A2D68BAC6BE8964"><enum>(iv)</enum><text display-inline="yes-display-inline">the activities to be carried out by each Federal agency under the plan.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCD790573A1634C04937352BD36992A1C"><enum>(B)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which a plan is developed under subparagraph (A), the Administrator shall submit to the appropriate committees of Congress a report describing the applicable plan.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H844FD0BCC660497CB9D38F47B62CCDA4"><enum>(4)</enum><header display-inline="yes-display-inline">Administrative and technical assistance</header><text display-inline="yes-display-inline">The Administrator shall, pursuant to existing authorities of the Administrator, provide to States, units of local government, Indian Tribes, and other entities technical assistance with respect to cleanup actions on covered mine sites.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H450DEDF823DE4714BFFE6F63BD206450"><enum>(e)</enum><header display-inline="yes-display-inline">Savings provisions</header><text display-inline="yes-display-inline">Nothing in this section—</text><paragraph commented="no" display-inline="no-display-inline" id="H79311747693D41079468E17A24270634"><enum>(1)</enum><text display-inline="yes-display-inline">provides the Administrator with new regulatory authority not already established in law; or</text></paragraph><paragraph id="H40DF27F486A04839B932392D9B1E91A6"><enum>(2)</enum><text>shall be interpreted as establishing a default standard or authority to be used for cleanup actions at covered mine sites, including the definition of <quote>cleanup action</quote> in subsection (a).</text></paragraph></subsection></section></legis-body></bill>
