<section id="H815C10543A7E4280AF1A20007D68AE1D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commission to Study Acts of Antisemitism in the United States Act</short-title></quote>.</text></section> <section id="HF0790A0F4E1E48AA8861A67803A17F51"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H84179BA27411411E8EDB41BB487C2E0C"><enum>(1)</enum><text>Since Hamas deadly invasion of the nation of Israel on October 7, 2023, there has been a disturbing rise of antisemitism in the United States.</text></paragraph> <paragraph id="H55ECE486A6F641E9A0D28E69A8F63529"><enum>(2)</enum><text display-inline="yes-display-inline">On April 12, 2024, a California protester was arrested for threatening death upon members of Bakersfield City Council.</text></paragraph> 
<paragraph id="HB2620940112D48A2A259A7487F651842"><enum>(3)</enum><text display-inline="yes-display-inline">The Anti-Defamation League reported 9,354 antisemitic incidents in 2024 alone, the highest number recorded in the organization’s history.</text></paragraph> <paragraph id="H643F98FFEC5E4D328CF97010683163E9"><enum>(4)</enum><text display-inline="yes-display-inline">College and university campuses have experienced an 84 percent increase in antisemitic incidents compared to 2023.</text></paragraph>
<paragraph id="H0126643504EA4998A583E3F64E5C36B6"><enum>(5)</enum><text display-inline="yes-display-inline">Assaults have increased 21 percent to 196 incidents and vandalism has increased 20 percent to 2,606 incidents since 2023.</text></paragraph></section> <section id="HAD8CD1CBBFD84495AB4D0A9B02D4A83F"><enum>3.</enum><header>Establishment</header><text display-inline="no-display-inline">There is established in the legislative branch a commission to be known as the <quote>Commission to Study Acts of Antisemitism in the United States</quote> (in this Act referred to as the <quote>Commission</quote>).</text></section> 
<section id="H003A136B43484F09B02EB5D804F8D9B6" commented="no"><enum>4.</enum><header>Duties of Commission</header><text display-inline="no-display-inline">Without making any predetermined or political findings, the Commission shall—</text> <paragraph id="H6678D181FB28471AB3211344DB032C50" commented="no"><enum>(1)</enum><text>investigate the facts and causes of antisemitism in the present day;</text></paragraph> 
<paragraph id="H8DA8086E59334304B34A5C887F92D8E6" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">examine and evaluate evidence developed by relevant Federal, State, and local governments regarding the facts and circumstances of antisemitic attacks within the United States, except that such examination and evaluation shall not interfere with ongoing law enforcement activities and investigations; and</text></paragraph> <paragraph id="H3B6CD512226E428AB47B7C37F5862239" commented="no"><enum>(3)</enum><text>report to the President and Congress regarding its findings, conclusions, and recommendations for legislation or administrative actions as the Commission considers appropriate.</text></paragraph></section> 
<section id="H880EF8B89C19460E97560E951CEFEDE7"><enum>5.</enum><header>Membership</header> 
<subsection id="H9E0DDAA7279C4012B96FB723317EF42F"><enum>(a)</enum><header>Members</header> 
<paragraph id="H07CC2BDCC7FA4B80AEB03CEF6F23CB27"><enum>(1)</enum><header>Number and appointment</header><text display-inline="yes-display-inline">The Commission shall be composed of 8 members appointed as follows:</text> <subparagraph id="H2D40D1D02DF64703A30988E9FA687057"><enum>(A)</enum><text>2 members appointed by the Speaker of the House of Representatives.</text></subparagraph> 
<subparagraph id="HFE7D7DA0B0F24D92A447E49F9511941A"><enum>(B)</enum><text>2 members appointed by the minority leader of the House of Representatives.</text></subparagraph> <subparagraph id="H4CC8B180A34E4355B66E1770C7BF27A9"><enum>(C)</enum><text>2 members appointed by the majority leader of the Senate.</text></subparagraph> 
<subparagraph id="H3ECD5B98FF3F4376A255BD9C9CDB2520"><enum>(D)</enum><text>2 members appointed by the minority leader of the Senate.</text></subparagraph></paragraph> <paragraph id="H2E5A21A616784894827EC09A04E244A4" display-inline="no-display-inline"><enum>(2)</enum><header>Chairperson; Vice Chairperson</header><text display-inline="yes-display-inline">The Chairperson and Vice Chairperson of the Commission shall be designated jointly by the Speaker of the House of Representatives and the minority leader of the House of Representatives at the time of the appointment.</text></paragraph> 
<paragraph id="H8CF69F8C140C48CFBBF31AF775B73D3F"><enum>(3)</enum><header>Political affiliation</header><text display-inline="yes-display-inline">Not more than 4 members appointed under paragraph (1) may be of the same political party.</text></paragraph> <paragraph id="H6DDDD5D6DA9F4B3F89487816C1C9A462"><enum>(4)</enum><header>Timing for appointment</header><text display-inline="yes-display-inline">All members of the Commission shall be appointed not later than 10 days after the date of enactment of this Act.</text></paragraph></subsection> 
<subsection id="H7AF860D5771546008254413BC5E35741"><enum>(b)</enum><header>Terms</header> 
<paragraph id="HD87C8CB0DEE94249967A1EA1D37D78D3"><enum>(1)</enum><header>In general</header><text>Each member shall be appointed for the life of the Commission.</text></paragraph> <paragraph id="H27FFC71EC5E54067AB5ECFD16A60BB6F"><enum>(2)</enum><header>Vacancies</header><text display-inline="yes-display-inline">A vacancy in the Commission shall be filled in the manner in which the original appointment was made.</text></paragraph></subsection> 
<subsection id="HCC1D664165884333885D3BB5038591A4"><enum>(c)</enum><header>Basic pay</header> 
<paragraph id="HF75BE3FBF90B465CA047F1885CA7CB31"><enum>(1)</enum><header>Compensation</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), members shall each be paid at a rate not to exceed the daily equivalent of the annual rate of basic pay for level III of the Executive Schedule for each day (including travel time) during which they are engaged in the actual performance of duties vested in the Commission.</text></paragraph> <paragraph id="H345A2C9D73DF4C98ADE37A034033D0AF"><enum>(2)</enum><header>Prohibition of compensation of Federal employees</header><text display-inline="yes-display-inline">Members of the Commission who are full-time officers or employees of the United States or Members of Congress may not receive additional pay, allowances, or benefits by reason of their service on the Commission.</text></paragraph> 
<paragraph id="H237D45EDFCF647DDB5C8956724B230D9"><enum>(3)</enum><header>Travel expenses</header><text display-inline="yes-display-inline">Each member shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code.</text></paragraph></subsection> <subsection id="H5020375C1171410CA3F197AA05D45710"><enum>(d)</enum><header>Quorum</header><text display-inline="yes-display-inline">6 members of the Commission shall constitute a quorum but a lesser number may hold hearings.</text></subsection> 
<subsection id="H14EC36B71FE14E3C9AE00EE2CAF68539"><enum>(e)</enum><header>Meetings</header><text display-inline="yes-display-inline">As soon as practicable after all members are appointed, but not earlier than 15 days after the date of enactment of this Act, the Commission shall meet and begin the initial operation of the Commission. The Commission shall meet monthly thereafter.</text></subsection></section> <section id="H9AE0D8F536674F97A4D287074539820F" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header>Experts; staff of Federal agencies</header> <subsection id="HADA616BCCBB94C14948F99BAFC3D1C7C" commented="no"> <enum>(a)</enum> <header>Experts</header> <text display-inline="yes-display-inline">The Commission may procure temporary and intermittent services under section 3109(b) of title 5, United States Code, but at rates for individuals not to exceed the daily equivalent of the annual rate of basic pay for GS–15 of the General Schedule. The services of an expert or consultant may be procured without compensation if the expert or consultant agrees to such an arrangement, in writing, in advance.</text>
            </subsection> 
<subsection id="HAB3CFF513A834D35B3DF35B5470D955D"><enum>(b)</enum><header>Staff of Federal agencies</header><text display-inline="yes-display-inline">Upon request of the Commission, the head of any Federal department or agency may detail, on a reimbursable basis, any of the personnel of that department or agency to the Commission to assist it in carrying out its duties under this Act.</text></subsection></section> <section id="H94E89DAA5A1149B7A1360599A7CD53D6"><enum>7.</enum><header>Powers of Commission</header> <subsection id="H2276A8904C144C33B1381C77FBCB959E" display-inline="no-display-inline"><enum>(a)</enum><header>Hearings and sessions</header><text>The Commission may, for the purpose of carrying out this Act, hold hearings, sit and act at times and places, take testimony, and receive evidence as the Commission considers appropriate. The Commission may administer oaths or affirmations to witnesses appearing before it.</text></subsection> 
<subsection id="HB266D465720D405A97377AAC5E54A194"><enum>(b)</enum><header>Powers of members and agents</header><text>Any member or agent of the Commission may, if authorized by the Commission, take any action which the Commission is authorized to take by this section.</text></subsection> <subsection id="HCCA7E1867B7841F4A539B1A810ED59F0"><enum>(c)</enum><header>Obtaining official data</header><text display-inline="yes-display-inline">The Commission may secure directly from any department or agency of the United States information necessary to enable it to carry out this Act. Upon joint request of the Chairperson and Vice Chairperson of the Commission, the head of that department or agency shall furnish that information to the Commission.</text></subsection> 
<subsection id="H3A3BB41326484DE09E94CDD6F6398884"><enum>(d)</enum><header>Subpoena power</header> 
<paragraph id="H3DE43996BA61494EB0A3AE02EDEA0EC9"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission may issue subpoenas requiring the attendance and testimony of witnesses and the production of any evidence relating to any matter which the Commission is empowered to investigate under this Act. Such subpoenas shall be issued by agreement between the Chairperson and Vice Chairperson of the Commission, or by the vote of a majority of the members of the Commission. The attendance of witnesses and the production of evidence may be required from any place within the United States at any designated place of hearing within the United States.</text></paragraph> <paragraph id="H84A0A45E0B9E4BEDBBCD3117C6815EBB"><enum>(2)</enum><header>Failure to obey a subpoena</header><text>If a person refuses to obey a subpoena issued under paragraph (1), the Commission may apply to a United States district court for an order requiring that person to appear before the Commission to give testimony, produce evidence, or both, relating to the matter under investigation. The application may be made within the judicial district where the hearing is conducted or where that person is found, resides, or transacts business. Any failure to obey the order of the court may be punished by the court as civil contempt.</text></paragraph> 
<paragraph id="H4C23D39A2EB041D688FB188E83A61C28"><enum>(3)</enum><header>Service of subpoenas</header><text>The subpoenas of the Commission shall be served in the manner provided for subpoenas issued by a United States district court under the Federal Rules of Civil Procedure for the United States district courts.</text></paragraph> <paragraph id="HE027A5E068D44C41A9B16B3C728F04F4"><enum>(4)</enum><header>Service of process</header><text>All process of any court to which application is made under paragraph (2) may be served in the judicial district in which the person required to be served resides or may be found.</text></paragraph></subsection> 
<subsection id="H45E9786B1BFD40438627B77EED8264A1"><enum>(e)</enum><header>Immunity</header><text display-inline="yes-display-inline">Except as provided in this subsection, a person may not be excused from testifying or from producing evidence pursuant to a subpoena on the ground that the testimony or evidence required by the subpoena may tend to incriminate or subject that person to criminal prosecution. A person, after having claimed the privilege against self-incrimination, may not be criminally prosecuted by reason of any transaction, matter, or thing which that person is compelled to testify about or produce evidence relating to, except that the person may be prosecuted for perjury committed during the testimony or made in the evidence.</text></subsection> <subsection id="HDCA38EBC33AE409CA6574AF58AF9A7D6"><enum>(f)</enum><header>Contract authority</header><text display-inline="yes-display-inline">To the extent or in the amounts provided in advance in appropriation Acts, the Commission may enter into contracts to enable the Commission to discharge its duties under this Act.</text></subsection></section> 
<section id="HE8FEE5F57E374FF58722745FD35DD266" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header>Report; termination</header> 
<subsection id="H19E22D84C6964A1AA90F7E6308D293BC"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">The Commission shall transmit a report to the President and Congress not later than 1 year after the date of enactment of this Act. The report shall contain a detailed statement of the findings and conclusions of the Commission, together with its recommendations for legislation or administrative actions as the Commission considers appropriate.</text></subsection> <subsection id="H2E8F5E07F7D1429D85F8A5C41718BA07"><enum>(b)</enum><header>Termination</header> <paragraph id="H2915ED9EC9E84132969D68D4F622C5AB"><enum>(1)</enum><header>In general</header><text>The Commission shall terminate upon the expiration of the 120-day period which begins on the date on which the Commission submits the report under subsection (a).</text></paragraph> 
<paragraph id="H1F261F1C20A64D9381975DF0240385A1"><enum>(2)</enum><header>Administrative activities before termination</header><text display-inline="yes-display-inline">The Commission may use the 120-day period referred to in paragraph (1) for the purpose of concluding the activities of the Commission, including disseminating the report submitted under subsection (a) and providing testimony to committees of Congress concerning such report.</text></paragraph></subsection></section> <section id="H337FF3AB6C374E36A48F99D53A67E27B"><enum>9.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the term <quote>antisemitism</quote> means a certain perception of Jews, which may be expressed—</text> 
<paragraph id="HD12B882620804BB4B07E6A05E700F5BA"><enum>(1)</enum><text>as hatred toward Jews; and</text></paragraph> <paragraph id="H4F20685D9ED94E258648E47AD8D85367"><enum>(2)</enum><text>by rhetorical and physical manifestations directed toward—</text> 
<subparagraph id="H1D19443E0D4E4762B6CAF4F3096874C5">
                    <enum>(A)</enum>
 <text>Jewish or non-Jewish individuals;</text> </subparagraph> <subparagraph id="H3C2A42D109034145AFD1B3A8BE710F01"> <enum>(B)</enum> <text>the property of the individuals described under subparagraph (A);</text>
                </subparagraph> 
<subparagraph id="H57CF888657674AF3B1B2869BB0CC3AD7"><enum>(C)</enum><text>Jewish community institutions; or</text></subparagraph> <subparagraph id="H798CB9EA4D584E9B9D9B7CFE29767A4D"><enum>(D)</enum><text>Jewish religious facilities.</text></subparagraph></paragraph></section>
