<section id="H3099335A5C7F4D70B62CAFCEB23473F9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Just USDA Standards and Transparency Act of 2025</short-title></quote> or the <quote><short-title>JUST Act of 2025</short-title></quote>.</text></section> <section id="H394795EC628B4A7F9A4BBD8E4E6DE915"><enum>2.</enum><header>Civil rights accountability for USDA employees</header> <subsection id="H73B7BC5BB07F4B458BB181586FEE4A43"><enum>(a)</enum><header>In general</header><text>The Secretary of Agriculture shall ensure that appropriate corrective action is taken with respect to any official or employee of the Department of Agriculture who has been found to have engaged in any of the actions, violations, or misconduct referred to in subsection (b) while in the course of such official’s or employee’s employment or in administering a Department of Agriculture program or service—</text> 
<paragraph id="H6641ABF819664E09B7790CDEC7412B65"><enum>(1)</enum><text>in any administrative finding by the Department of Agriculture, including any final agency decision issued by the Assistant Secretary of Agriculture for Civil Rights and any civil rights compliance review or misconduct investigation conducted by the Department of Agriculture;</text></paragraph> <paragraph id="H29A761AD045747CFA93FB52E1A5D56F7"><enum>(2)</enum><text>in any Federal administrative or judicial proceeding;</text></paragraph> 
<paragraph id="HBD352F6BDF504A258886F2BDB4BEBB03"><enum>(3)</enum><text>in any settlement with respect to civil rights;</text></paragraph> <paragraph id="H6E05C0E54BAA4FDABCC41C24DE5BC04D"><enum>(4)</enum><text>in any audit or investigation conducted by the Office of the Inspector General of the Department of Agriculture; or</text></paragraph> 
<paragraph id="HCE6D931229F74FA9BE20DE371A93B0F4"><enum>(5)</enum><text>in any investigation conducted by the Office of the Special Counsel.</text></paragraph></subsection> <subsection id="H10FF533F5D724C39ADDA2763E0B896D7"><enum>(b)</enum><header>Covered actions, violations, or misconduct</header><text display-inline="yes-display-inline">The actions, violations, or misconduct referred to in this subsection are discriminatory actions, retaliatory actions, harassment, civil rights violations, or related misconduct, including the following:</text> 
<paragraph id="H0F65920546C149BE895708DF3DF8A3AE"><enum>(1)</enum><text>Failure to provide a receipt for service in accordance with section 2501A(e) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279-1">7 U.S.C. 2279–1(e)</external-xref>) to any current or prospective applicants of, or participants in, Department of Agriculture programs.</text></paragraph> <paragraph id="H61AF6FFEAD9E4F68BDC292D7F345FF72"><enum>(2)</enum><text>Providing an inaccurate receipt for service under such section 2501A(e) to any such current or prospective applicants or participants.</text></paragraph> 
<paragraph id="H167218C7F3F34323ACF47E8E3712EC6E"><enum>(3)</enum><text>Failure to provide appropriate information regarding relevant programs and services at the Department of Agriculture, when requested by any such current or prospective applicants or participants.</text></paragraph> <paragraph id="H203DC4A638AC4AB0AA6AE675EDAFBBFC"><enum>(4)</enum><text>Failure to timely process applications or otherwise delaying program services to any such current or prospective applicants or participants.</text></paragraph></subsection> 
<subsection id="HE2D5033A9CDF4B4393A89DD07324D10D"><enum>(c)</enum><header>Corrective action defined</header><text>In this section, the term <term>corrective action</term> means any action taken to respond to any of the actions, violations, or misconduct referred to in subsection (b) that—</text> <paragraph id="H5A2D3D2E371040F2A6ECE279D57B6D00"><enum>(1)</enum><text>would enhance civil rights at the Department of Agriculture, including any policy or programmatic changes to prevent similar misconduct from occurring in the future; and</text></paragraph> 
<paragraph id="H424755EEDCDA4F3681A9D2A1F1229821"><enum>(2)</enum><text>may include disciplinary actions, including—</text> <subparagraph id="H2B37FF199555465D9923A08E9CFBEBB4"><enum>(A)</enum><text>removal from Federal service;</text></subparagraph> 
<subparagraph id="H037132EE3C5D4FD0A62425FA3E972E6F"><enum>(B)</enum><text>suspension without pay;</text></subparagraph> <subparagraph id="H6886771A4C3C4F7AAA6BE173D5FEC72C"><enum>(C)</enum><text>any reduction in grade or pay; and</text></subparagraph> 
<subparagraph id="HDA08AA70F0D94938AB18F3D444DFC524"><enum>(D)</enum><text>a letter of reprimand.</text></subparagraph></paragraph></subsection></section> <section id="H60CDFDB1EDDF4B32BC378921772BBEA9"><enum>3.</enum><header>Improvements to the Office of the Assistant Secretary for Civil Rights</header> <subsection id="H133D417920C94C1BBCB54E8158468944"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6912">7 U.S.C. 6912 et seq.</external-xref>) is amended by inserting after section 218 (<external-xref legal-doc="usc" parsable-cite="usc/7/6918">7 U.S.C. 6918</external-xref>) the following:</text> 
<quoted-block style="OLC" id="HC5F4E3511BA344DCAAE5425AF4DA0F23" display-inline="no-display-inline"> 
<section id="H9E4A4BCD6C25407FB6C37FC283423CED"><enum>218A.</enum><header>Assistant Secretary of Agriculture for Civil Rights</header> 
<subsection id="H4C9BC0C923D6425E8DEADCF04DECBBCB"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish in the Department the position of Assistant Secretary of Agriculture for Civil Rights (referred to in this section as the <quote>Assistant Secretary</quote>).</text></subsection> <subsection id="HA0F8676F089641F78DF93EE257E3C903"><enum>(b)</enum><header>Appointment</header><text display-inline="yes-display-inline">The Assistant Secretary shall be appointed by the President, by and with the advice and consent of the Senate.</text></subsection> 
<subsection id="H780FA862E9854F179357742A192BE83C"><enum>(c)</enum><header>Duties</header> 
<paragraph id="H1B35378088C84811B90743CF0919B175"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall delegate to the Assistant Secretary responsibility for—</text> <subparagraph id="HF0F9C3348E284718B1F100F970E91E0B"><enum>(A)</enum><text display-inline="yes-display-inline">ensuring compliance with all civil rights and related laws by all agencies and under all programs of the Department;</text></subparagraph> 
<subparagraph id="H4F9C89370C644D5F82B587A3AA3787F3"><enum>(B)</enum><text display-inline="yes-display-inline">coordinating administration of civil rights laws (including regulations) within the Department for employees of, and participants in, programs of the Department; and</text></subparagraph> <subparagraph id="HFF24DAD68B6D4507B9D87500FBD1A511"><enum>(C)</enum><text display-inline="yes-display-inline">ensuring that necessary and appropriate civil rights components are properly incorporated into all strategic planning initiatives of the Department and agencies of the Department.</text></subparagraph></paragraph> 
<paragraph id="H020E0D6EB957486A93E0226132C6D786"><enum>(2)</enum><header>Office of Legal Advisor for Civil Rights</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this section, the Secretary shall establish an Office of Legal Advisor for Civil Rights that shall—</text> <subparagraph id="HB98E5D4FA13A4D12A803E54225D77391"><enum>(A)</enum><text display-inline="yes-display-inline">be the sole office within the Department responsible for providing legal advice to the Assistant Secretary to—</text> 
<clause id="HD9778F7CFE2C4966A785B01564F7F17D"><enum>(i)</enum><text display-inline="yes-display-inline">ensure compliance with all civil rights and related laws and regulations by all agencies and under all programs of the Department; and</text></clause> <clause id="H17B8694E4CF04621BAABA4051F7FB157"><enum>(ii)</enum><text display-inline="yes-display-inline">carry out fair and impartial investigations of civil rights complaints;</text></clause></subparagraph> 
<subparagraph id="HDA7BF1DB28564E3396A9875AA137A793"><enum>(B)</enum><text display-inline="yes-display-inline">report directly to the Assistant Secretary; and</text></subparagraph> <subparagraph id="H58EFE1B0C79D40A6BC58A09E1D103BE9"><enum>(C)</enum><text display-inline="yes-display-inline">not represent or defend the Department or any of its agencies with respect to any claims of program or employment discrimination.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE693CEF1990F405DA182A0F7C7B949A3"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="H93791D5DCDDA4652AB2606BC4218A8A1"><enum>(1)</enum><header>Assistant Secretaries of Agriculture</header><text>Section 218 of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6918">7 U.S.C. 6918</external-xref>) is amended—</text> <subparagraph id="H1848D2560BF44591A27EE7AD5E6B4B4B"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)—</text> 
<clause id="H66B7C1D5652749ED8AFFE7BD047BECB6"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1), by adding <quote>and</quote> at the end;</text></clause> <clause id="HAB8B90708EE84B7BA8340385B5519739"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>; and</quote> at the end and inserting a period; and</text></clause> 
<clause id="HA590EB79A6264E6784E869E4AF01A050"><enum>(iii)</enum><text display-inline="yes-display-inline">by striking paragraph (3);</text></clause></subparagraph> <subparagraph id="H6C8D515F46414234AB5479DE86E6B1AD"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>any position of Assistant Secretary authorized under paragraph (1) or (3) of subsection (a)</quote> and inserting <quote>the position of Assistant Secretary of Agriculture for Congressional Relations and Intergovernmental Affairs under subsection (a)(1)</quote>; and</text></subparagraph> 
<subparagraph id="HF9371E46E88E4AC6AB76D1F36A79E218"><enum>(C)</enum><text display-inline="yes-display-inline">by striking subsection (c).</text></subparagraph></paragraph> <paragraph id="H7C06483131B243DC975B1B7AC459545E"><enum>(2)</enum><header>Termination of authority</header><text display-inline="yes-display-inline">Section 296(b)(5) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/7014">7 U.S.C. 7014(b)(5)</external-xref>) is amended to read as follows:</text>

<paragraph id="HBBC54AAB7CD645F5B069B3117A073BB3"><enum>(5)</enum><text display-inline="yes-display-inline">The authority of the Secretary to carry out section 218A.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="H0EE29A872AA344629244D061BD97DA29"><enum>4.</enum><header>Equitable relief</header> <subsection id="H22D42B9BFD614B2CA870EC7A1345E0BA"><enum>(a)</enum><header>Equitable relief from ineligibility for loans, payments, or other benefits</header><text display-inline="yes-display-inline">Section 1613 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7996">7 U.S.C. 7996</external-xref>) is amended—</text> 
<paragraph id="H91D8EDA4A1AC4B2A9DF1B19EDF53695B"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (f) through (j) as subsections (g) through (k), respectively;</text></paragraph> <paragraph id="H49EE6FCB3B5948C085E5D4B9AD4E5794"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (e) the following:</text>

<subsection id="H7601D3BDF8E849999C510DB149D81A13"><enum>(f)</enum><header>Equitable relief by the Assistant Secretary of Agriculture for Civil Rights</header> 
<paragraph id="H10FB57C6DDF34E2FB10B3CA8AC687829"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary of Agriculture for Civil Rights (or a designee of the Secretary in the Office of the Assistant Secretary for Civil Rights, if no Assistant Secretary of Agriculture for Civil Rights is appointed and confirmed in accordance with section 218A(b) of the Department of Agriculture Reorganization Act of 1994) may grant relief in accordance with subsections (b) through (d) to a participant who files a civil rights program complaint.</text></paragraph> <paragraph id="H5F7BA0D115DD462486EDA00E2AAA591A"><enum>(2)</enum><header>Decisions</header><text display-inline="yes-display-inline">The decision by the Assistant Secretary of Agriculture for Civil Rights (or the designee of the Secretary) to grant relief under this subsection—</text> 
<subparagraph id="H501305A0CAFD4CBBA9FC75B74D19FE02"><enum>(A)</enum><text display-inline="yes-display-inline">shall not require prior approval by any officer or employee of the Department of Agriculture; and</text></subparagraph> <subparagraph id="H6BFB5A75B3A849E5A46F5776AF84CD87"><enum>(B)</enum><text display-inline="yes-display-inline">is subject to reversal only by the Secretary (who may not delegate the reversal authority).</text></subparagraph></paragraph> 
<paragraph id="H5B2B9D00D8AB42A5A4F647B8F77DD0BB"><enum>(3)</enum><header>Other authority</header><text display-inline="yes-display-inline">The authority provided to the Assistant Secretary of Agriculture for Civil Rights (or the designee of the Secretary) under this subsection is in addition to any other applicable authority and does not limit other authority provided by law or the Secretary.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H762D9B5216B24AD4B65830E5E5DEF8B1"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (g), as so redesignated, by striking <quote>or the State Conservationist</quote> and inserting <quote>the State Conservationist, or the Assistant Secretary of Agriculture for Civil Rights (or the designee of the Secretary)</quote>; and</text></paragraph> 
<paragraph id="H9581A8E7432B4894AAE069E58406796C"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (1) of subsection (h), as so redesignated, by striking <quote>and (e)</quote> and inserting <quote>, (e), and (f)</quote>.</text></paragraph></subsection> <subsection id="H798A7D6D78AA43EEB12A23636FADAEC0"><enum>(b)</enum><header>Equitable relief for actions taken in good faith</header><text display-inline="yes-display-inline">Section 366 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/2008a">7 U.S.C. 2008a</external-xref>) is amended—</text> 
<paragraph id="H992A35A5BBF44F168CCE8122DB588C2E"><enum>(1)</enum><text>by amending subsection (b) to read as follows:</text> <quoted-block style="OLC" id="H6A37D960FD7D475481CAF35E5895C745" display-inline="no-display-inline"> <subsection id="H37F06FAD2F0A427CB98C8650795DF7BF"><enum>(b)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary may only provide relief to a farmer or rancher under subsection (a) if the Secretary determines that the farmer or rancher—</text> 
<paragraph id="H765355D141F94EB0885AE8CAE0460001"><enum>(1)</enum><text display-inline="yes-display-inline">acted in good faith and relied on an action of, or the advice of, the Secretary (including any authorized representative of the Secretary) to the detriment of the farming or ranching operation of the farmer or rancher; or</text></paragraph> <paragraph id="H5DD408C705CD473AA9E06ED3B61E463D"><enum>(2)</enum><text display-inline="yes-display-inline">failed to comply fully with the requirements to receive a loan described in subsection (a)(1), but made a good faith effort to comply with the requirements.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H429B34B3795B484C8A37AE7B01231B62"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (e) as subsection (f);</text></paragraph> <paragraph id="HA46F3A77E9D74DAEB2745B8065BE9C68"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (d) the following:</text>

<subsection id="H4E0B4A14D6184B4E81AEB0ED0F102475"><enum>(e)</enum><header>Equitable relief by the Assistant Secretary of Agriculture for Civil Rights</header> 
<paragraph id="HD6D3F6D98A374A3DAE3BD82F613DF901"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary of Agriculture for Civil Rights (or a designee of the Secretary in the Office of the Assistant Secretary for Civil Rights, if no Assistant Secretary of Agriculture for Civil Rights is appointed and confirmed in accordance with section 218A(b) of the Department of Agriculture Reorganization Act of 1994) may grant relief in accordance with subsections (a) through (d) to an individual who files a complaint with respect to civil rights regarding a direct farm ownership, operating, or emergency loan under this title.</text></paragraph> <paragraph id="HD5ACDDC0DF854DD19B72C70C92A71C72"><enum>(2)</enum><header>Decisions</header><text display-inline="yes-display-inline">The decision by the Assistant Secretary of Agriculture for Civil Rights (or the designee of the Secretary) to grant relief under this subsection—</text> 
<subparagraph id="H98CE3948B1FE4AC0ACA65AFEED7B9A53"><enum>(A)</enum><text display-inline="yes-display-inline">shall not require prior approval by any officer or employee of the Department of Agriculture; and</text></subparagraph> <subparagraph id="H2BB9500960A44898ACDADB399B495907"><enum>(B)</enum><text display-inline="yes-display-inline">is subject to reversal only by the Secretary (who may not delegate the reversal authority).</text></subparagraph></paragraph> 
<paragraph id="HB678F36AF56047FB8CC8A14C82B2B243"><enum>(3)</enum><header>Other authority</header><text display-inline="yes-display-inline">The authority provided to the Assistant Secretary of Agriculture for Civil Rights (or the designee of the Secretary) under this subsection is in addition to any other applicable authority and does not limit other authority provided by law or the Secretary.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H41D53D8F666D48D6AF6E484C365C9431"><enum>(4)</enum><text display-inline="yes-display-inline">in subsection (f), as so redesignated, by striking <quote>Secretary</quote> and inserting <quote>Secretary, or the Assistant Secretary of Agriculture for Civil Rights (or the designee of the Secretary),</quote>.</text></paragraph></subsection></section> 
<section id="H5A5A85E616A442608EA09F37FD8A4D26"><enum>5.</enum><header>Office of the Civil Rights Ombudsperson</header><text display-inline="no-display-inline">Title III of the Federal Crop Insurance Reform and Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/2231b">7 U.S.C. 2231b et seq.</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" id="H7FEF0D3DBD764809A21CF187F2E5CAE7" display-inline="no-display-inline"> <section id="H46F41CF077E64F0EAF4473896F8E0C96"><enum>310.</enum><header>Office of the Civil Rights Ombudsperson</header> <subsection id="HBF764929FD134E6399C76CF01174A3E0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this section, the Secretary shall establish an Office of the Civil Rights Ombudsperson (in this section referred to as the <quote>Office</quote>) within the Department. The Office shall be independent of Department agencies and offices.</text></subsection> 
<subsection id="H7C71370A3B9E4654B220AEED581706EB"><enum>(b)</enum><header>Ombudsperson designation</header><text display-inline="yes-display-inline">The Secretary shall designate a Civil Rights Ombudsperson (in this section referred to as the <quote>Ombudsperson</quote>) for the Office. The Ombudsperson shall be considered a senior official of the Department and have a background in civil rights enforcement.</text></subsection> <subsection id="H6E6A1164CC4A449C9D14F272CA14208B"><enum>(c)</enum><header>Office personnel</header><text display-inline="yes-display-inline">The Ombudsperson shall appoint such employees as are necessary to perform the functions of the Office and for the administration of the Office.</text></subsection> 
<subsection id="H28901A77F08A45D2A094EAE8C9EA4C06"><enum>(d)</enum><header>Functions</header><text display-inline="yes-display-inline">The functions of the Office shall be—</text> <paragraph id="HF5373686C98648588D9901A09C7DC28E"><enum>(1)</enum><text display-inline="yes-display-inline">to assist producers and other customers of Department programs in navigating the civil rights review process;</text></paragraph> 
<paragraph id="H48CE0AAE4AC14890A6380678C6D41C7D"><enum>(2)</enum><text display-inline="yes-display-inline">to ensure that participants (as defined in section 271) are aware of the appeals process under subtitle H of title II, including informal hearings under section 275;</text></paragraph> <paragraph id="HC023147266444803B31634408187F6C2"><enum>(3)</enum><text display-inline="yes-display-inline">to promote awareness of the Office and its responsibilities among producers and other customers of Department programs; and</text></paragraph> 
<paragraph id="HF9BDE2770B0A4F62BCAD7B20627575AC"><enum>(4)</enum><text display-inline="yes-display-inline">to raise issues and concerns with respect to, and make recommendations to the Secretary about, equitable access or implementation of Department programs.</text></paragraph></subsection> <subsection id="HAA63606DACC541C094A55C8C5704B25C"><enum>(e)</enum><header>Access to information</header> <paragraph id="HDCE8F2617E2B41E5843B730AB0706356"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Secretary shall establish procedures to provide the Office access to all departmental records necessary to execute the functions of the Office under subsection (d).</text></paragraph> 
<paragraph id="H5BE11CBA7BAE47768A779578421D0B56"><enum>(2)</enum><header>Timelines</header><text display-inline="yes-display-inline">The procedures described in paragraph (1) shall include a requirement that requests from the Office for departmental records shall be fulfilled not later than 60 days after the request is made.</text></paragraph></subsection> <subsection id="HDB47634362E54B9EAD2783913B579443"><enum>(f)</enum><header>Annual report</header><text display-inline="yes-display-inline">Beginning not later than 1 year after the date of the enactment of this section, and annually thereafter, the Ombudsperson shall prepare and submit to the House Committee on Agriculture and the Senate Committee on Agriculture, Nutrition, and Forestry a report on—</text> 
<paragraph id="HDE7AFCAB26E84E598919C9A6D8C3EDF4"><enum>(1)</enum><text display-inline="yes-display-inline">the activities carried out by the Office; and</text></paragraph> <paragraph id="H6632C380625F43D589B44F582DDC710B"><enum>(2)</enum><text display-inline="yes-display-inline">the findings and recommendations of the Office with respect to equitable access or implementation of Department programs.</text></paragraph></subsection> 
<subsection id="H3BFCE38CF69E4AA1BA3125083ACEBE2E"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated such sums as are necessary to carry out this section for each of fiscal years 2026 through 2028.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H93468AECCC074D8AA65AE8E513A888F9"><enum>6.</enum><header>Burden of proof for national appeals division hearings</header><text display-inline="no-display-inline">Section 277(c)(4) of the Department of Agriculture Reorganization Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/7/6997">7 U.S.C. 6997(c)(4)</external-xref>) is amended to read as follows:</text>
