which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to limit the penalty for late enrollment under part B of the Medicare Program to 15 percent and twice the period of no enrollment, and to exclude periods of COBRA, retiree, and VA coverage from such late enrollment penalty.</official-title></form><legis-body id="HB8066B00EE6F43E98F817935F9603898" style="OLC"><section id="HAD56638BDCD54C199FB071AC2B7C41BD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Economic Security Solutions Act</short-title></quote>.</text></section><section id="HEBF0A84BDBE24F1AA3DF1E0A8910F346" section-type="subsequent-section"><enum>2.</enum><header>Limiting Medicare part B late enrollment penalty to 15 percent and twice the period of no enrollment</header><subsection id="H0C2D7ED5569E41C6ADB9B3554447CB82"><enum>(a)</enum><header>In general</header><text>The first sentence of section 1839(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395r">42 U.S.C. 1395r(b)</external-xref>) is amended by striking <quote>10 percent of the monthly premium so determined for each full 12 months</quote> and inserting <quote>15 percent of the monthly premium so determined for premiums paid during a period equal to twice the number of months in each of the full periods of 12 months</quote>.</text></subsection><subsection id="H49C2D93F45B942AB8C9C8DD8368244B0"><enum>(b)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Section 1818 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395i-2">42 U.S.C. 1395i–2</external-xref>) is amended—</text><paragraph id="H5D9DF90D069C43C9B861666693990D25"><enum>(1)</enum><text>in subsection (c)(6), by striking <quote>and shall only apply to premiums paid during a period equal to twice the number of months in the full 12-month periods described in that section and</quote>; and</text></paragraph><paragraph id="H498DA3AC8B2C459988398F27063BA171"><enum>(2)</enum><text>in subsection (g)(2)(B), by striking <quote>by substituting</quote> and all that follows and inserting the following: <quote>by substituting <quote>section 1818 (without any increase resulting from the application of section 1839(b) to such section 1818)</quote> for <quote>section 1839 (without any increase under subsection (b) thereof)</quote>.</quote>.</text></paragraph></subsection><subsection id="H86BDF62B8EDB48B5BCA8EA02BCD62F47"><enum>(c)</enum><header>Effective date</header><paragraph commented="no" display-inline="no-display-inline" id="H36C0A2AB02DE4CB19B603BDFE45347C3"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall apply to premiums paid for months beginning after the end of the 90-day period beginning on the date of the enactment of this Act.</text></paragraph><paragraph display-inline="no-display-inline" id="H2C4F16F8D1C3430B8FB87C86DF38762A"><enum>(2)</enum><header>Clarification</header><text>In applying these amendments, months (before, during, or after the month in which this Act is enacted) in which an individual was or is required to pay an increased premium shall be taken into account in determining the month in which the premium will no longer be subject to an increase.</text></paragraph></subsection></section><section id="H5B0470E2EB2E43A7A55F10C2C6C01EB4"><enum>3.</enum><header>Exclusion of periods of COBRA, retiree, and VA coverage from Medicare part B late enrollment penalty</header><subsection id="H8FB2D1D5D4694D6EA1E2B4DDB2642504"><enum>(a)</enum><header>In general</header><text>The second sentence of section 1839(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395r">42 U.S.C. 1395r(b)</external-xref>) is amended—</text><paragraph id="HAEC5D526F3B74196B78619E27B4F9DF4"><enum>(1)</enum><text>by striking <quote>by reason of the individual’s (or the individual’s spouse’s) current employment</quote>; and</text></paragraph><paragraph id="H3914E9E4B7504BDE8CD71A0C478E8E03"><enum>(2)</enum><text>by inserting <quote>or months for which the individual can demonstrate that the individual had coverage under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code</quote> before the period at the end.</text></paragraph></subsection><subsection id="HBD9B6E1ACEB44E18A0FBA29BF653DD1D"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to premiums paid for months beginning after the end of the 90-day period beginning on the date of the enactment of this Act.</text></subsection></section><section id="H191D9AF59C294BE280593EF1E3AD9117"><enum>4.</enum><header>Special enrollment period for individuals whose COBRA or retiree coverage terminates</header><subsection id="HA6E64D2DF5C54F78ACFD77FCEA403090"><enum>(a)</enum><header>In general</header><text>Section 1837(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p(i)</external-xref>) is amended—</text><paragraph id="HD17887A368074EC6B7B6C3E662D6BB9E"><enum>(1)</enum><text>in the first sentence of paragraph (1), by striking <quote>by reason of the individual's (or the individual’s spouse’s) current employment status</quote> in subparagraph (A);</text></paragraph><paragraph id="HC8614523B4F1439C87B1FB86768027F3"><enum>(2)</enum><text>in the first sentence of paragraph (2) by striking <quote>by reason of the individual's (or the individual’s spouse’s) current employment status</quote> each place it appears in subparagraphs (B) and (C); and</text></paragraph><paragraph id="HB5223E100F174DABBE8B69E2B317706F"><enum>(3)</enum><text>in paragraph (3)(A) by striking <quote>by reason of current employment status</quote>.</text></paragraph></subsection><subsection id="HB48C35CA70EE47AA82CF7B1057CF370B"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to terminations of coverage occurring after the end of the 90-day period beginning on the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
