<section id="H022BB913C9C34E5F8D36F0AD751DA380" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Electric Supply Chain Act</short-title></quote>.</text> </section> <section id="HDAAD14B880FE46B1832D51CB8EECB531"><enum>2.</enum><header>Assessment and report on the supply chain for the generation and transmission of electricity</header> <subsection id="H42AFE29E3AED41EBBF9AC79F0B7794F4"><enum>(a)</enum><header>Assessment</header><text display-inline="yes-display-inline">In carrying out the requirements of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7101">42 U.S.C. 7101 et seq.</external-xref>), the Secretary shall, for purposes of monitoring the supply chain for the generation and transmission of electricity and in consultation with relevant stakeholders, prepare periodic assessments on such supply chain that—</text> 
<paragraph id="HDB5BDC1D04544A78A68F91A393A48E03" commented="no"><enum>(1)</enum><text>include information on—</text> <subparagraph id="H970FB8FB79D440B89B80DE146AB30FAA" commented="no"><enum>(A)</enum><text>efforts and opportunities to strengthen, secure, and expand such supply chain;</text></subparagraph> 
<subparagraph id="H19D751F1F0184C6BA3E81C03D3960D0B"><enum>(B)</enum><text>any trends, risks, and vulnerabilities in the supply, demand, and availability of components for or related to generating or transmitting electricity, including components that are necessary for the construction or deployment of facilities that generate or transmit electricity;</text> </subparagraph> <subparagraph id="HE26E140AF2154547B5D11957EF6B0950"><enum>(C)</enum><text>national security and energy security considerations for strengthening, securing, and expanding such supply chain;</text> </subparagraph> 
<subparagraph id="H50850DC75DE94ABAA92E1B2C43AC1A1D" commented="no"><enum>(D)</enum><text>barriers to expanding the capacity to—</text> <clause id="H24063390C9C1416AAE000ABD05E920B0" commented="no"><enum>(i)</enum><text>manufacture components for or related to generating or transmitting electricity in the United States; and</text></clause> 
<clause id="H46E091C9F08942CD819FAE0A0F959306" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">process critical materials in the United States;</text></clause></subparagraph> <subparagraph id="H3257CBD54B954AAA81F8634D04FF6A05" commented="no"><enum>(E)</enum><text>domestic policies that deter or otherwise inhibit greater investment into such supply chain;</text> </subparagraph> 
<subparagraph id="H77C156A3309E4C82890DD25BEDBF85B7"><enum>(F)</enum><text>the effects of any reliance of the United States on any foreign entity of concern for—</text> <clause id="H23D41D0C12724001B4666B794964C6A7"><enum>(i)</enum><text>components for or related to generating or transmitting electricity; and</text></clause> 
<clause id="HF799E098BC974BF8AE2098E02182A1D3"><enum>(ii)</enum><text display-inline="yes-display-inline">the exploration, development, or production of critical materials necessary for manufacturing such components; and</text> </clause></subparagraph> <subparagraph id="HAE7032E97638482FBD0F4F202392C2EC"><enum>(G)</enum><text>workforce challenges affecting such supply chain;</text> </subparagraph></paragraph> 
<paragraph id="H6181CE1CC6BF42A2B242BA63E4B994FC"><enum>(2)</enum><text display-inline="yes-display-inline">identify emerging issues in such supply chain; and</text></paragraph> <paragraph id="HE0D60A310FF54A54AFFEED12708BC49F"><enum>(3)</enum><text>include recommendations to—</text> 
<subparagraph id="HD483E8339AB0467F800EFEFD42863D8C"><enum>(A)</enum><text>address any emerging issues identified under paragraph (2); and</text></subparagraph> <subparagraph id="H1E9F8A1641424943AB9EF9385F024551"><enum>(B)</enum><text>secure and expand such supply chain.</text></subparagraph></paragraph> </subsection> 
<subsection id="H79A82C022054477A8C94621DE16362C5"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this Act, and periodically thereafter, the Secretary shall submit to the appropriate committees of Congress a report on the most recent assessment prepared under subsection (a).</text> </subsection> <subsection id="HE2884001857D42A498A56AEFE7967EB9"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H3CC5106321314035A10ED2AA401711C1"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <quote>appropriate committees of Congress</quote> means—</text> <subparagraph id="H3BB8BFE2BABE43EAA946887C0F6D385F"><enum>(A)</enum><text>the Committee on Energy and Commerce of the House of Representatives; and</text></subparagraph> 
<subparagraph id="H36C48E3ADB404B9F87EAF559136ECD15"><enum>(B)</enum><text>the Committee on Energy and Natural Resources of the Senate.</text></subparagraph></paragraph> <paragraph id="H4FABB9D6E00549E0889A1015DC2F2836"><enum>(2)</enum><header>Critical material</header><text display-inline="yes-display-inline">The term <quote>critical material</quote> has the meaning given such term in section 7002(a) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(a)</external-xref>).</text></paragraph> 
<paragraph id="HF6DCE1FB27C04735B75D5FBC038678C3"><enum>(3)</enum><header>Electric Reliability Organization</header><text>The term <quote>Electric Reliability Organization</quote> has the meaning given such term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/42/824o">42 U.S.C. 824o(a)</external-xref>).</text></paragraph> <paragraph id="H121BE67D3E554A6CB26E022FBDDDCAED"><enum>(4)</enum><header>Electric utility</header><text display-inline="yes-display-inline">The term <quote>electric utility</quote> has the meaning given such term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></paragraph> 
<paragraph id="H566A906BF13D427A9F4ADCDBA6D044A8"><enum>(5)</enum><header>Foreign entity of concern</header><text display-inline="yes-display-inline">The term <quote>foreign entity of concern</quote> has the meaning given such term in section 40207(a) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18741">42 U.S.C. 18741(a)</external-xref>).</text></paragraph> <paragraph id="HC4B31D1B939A40328FEAD6703B69AB73"><enum>(6)</enum><header>Relevant stakeholder</header><text display-inline="yes-display-inline">The term <quote>relevant stakeholder</quote>—</text> 
<subparagraph id="H78F23FE16ADB42949EAAF72497C61EA5"><enum>(A)</enum><text>means a stakeholder that is involved in—</text> <clause id="HC395D84089D84C67A598A4C5F90D5ECD"><enum>(i)</enum><text>the generation, storage, transmission, or distribution of electricity; or</text></clause> 
<clause id="HE70904B2BA33407181E05B31650C2FF5"><enum>(ii)</enum><text display-inline="yes-display-inline">the supply chain for such generation, storage, transmission, or distribution; and</text></clause></subparagraph> <subparagraph id="H5AF8BFEA30504ED3AF01B2753455552A"><enum>(B)</enum><text>includes an electric utility, an electric grid component manufacturer, a person who constructs an electric generating facility, an electric power system cybersecurity expert, the Electric Reliability Organization, a ratepayer advocacy stakeholder, and any other related private sector stakeholder.</text> </subparagraph></paragraph> 
<paragraph id="H8AEE2BB3C3104965A31353A12D97E4D9"><enum>(7)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Energy.</text></paragraph> </subsection> </section> </legis-body></bill>
