<section id="H88AD1E8887E546A5BF882F9A19F4F975" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing America’s Critical Minerals Supply Act</short-title></quote>.</text></section> <section id="HB9F911AA53674FF3B50076D396AA4BBC"><enum>2.</enum><header>Amendment to the Department of Energy Organization Act</header><text display-inline="no-display-inline">The Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7101">42 U.S.C. 7101 et seq.</external-xref>) is amended—</text> 
<paragraph id="H8C365277E1954D7881D63D6009BBA55C"><enum>(1)</enum><text display-inline="yes-display-inline">in section 2, by adding at the end the following:</text> <quoted-block style="OLC" id="H68EBB92FF38D40DA9309EA4A9A57647A" display-inline="no-display-inline"> <subsection id="HECEA0B5C3B084112BAD248F557181C8F"><enum>(d)</enum><text display-inline="yes-display-inline">As used in sections 102(20) and 203(a)(12), the term <term>critical energy resource</term> means any energy resource—</text> 
<paragraph id="H6957169090F54563AEC547BB2F05C4FF"><enum>(1)</enum><text display-inline="yes-display-inline">that is essential to the energy sector and energy systems of the United States; and</text></paragraph> <paragraph id="H2BBF6F3D2C194AC39EF3A81DD06979B4"><enum>(2)</enum><text>the supply chain of which is vulnerable to disruption.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H73BCABC772974137805173377C027565"><enum>(2)</enum><text>in section 102, by adding at the end the following:</text> <quoted-block style="OLC" id="H1D3748A169C0433DA1C045304AE28704" display-inline="no-display-inline"> <paragraph id="HA7BAC4B354054CF7ABF1D8EAFD8886CC"><enum>(20)</enum><text display-inline="yes-display-inline">To ensure there is an adequate and reliable supply of critical energy resources that are essential to the energy security of the United States.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HFDED210A684D439C94CBEF0A55AC89B6"><enum>(3)</enum><text>in section 203(a), by adding at the end the following:</text> <quoted-block style="OLC" id="H44BD65B2616143BFAF5BBB6A76A06AED" display-inline="no-display-inline"> <paragraph id="H151D50513857438AB1086BAB99A18748"><enum>(12)</enum><text display-inline="yes-display-inline">Functions that relate to securing the supply of critical energy resources, including identifying and mitigating the effects of a disruption of such supply on—</text> 
<subparagraph id="H2835DD48A74B467586C0E2F563B3E017"><enum>(A)</enum><text>the development and use of energy technologies; and</text></subparagraph> <subparagraph id="HCC735C4F88D948ACB68187A82888D50F"><enum>(B)</enum><text>the operation of energy systems.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H0943AFD5ACCD45BCA6FF18F9EE4D7E21"><enum>3.</enum><header>Securing critical energy resource supply chains</header> 
<subsection id="HADAC41BFBC644B6F8D20CFB6B39D220D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out the requirements of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7101">42 U.S.C. 7101 et seq.</external-xref>), the Secretary of Energy, in consultation with the appropriate Federal agencies, representatives of the energy sector, States, and other stakeholders, shall—</text> <paragraph id="H2C11B3682F3D4D49883369BE2416FFAF"><enum>(1)</enum><text>conduct ongoing assessments of—</text> 
<subparagraph id="H5EE60BA965D04669B329AE86C026FCD3"><enum>(A)</enum><text display-inline="yes-display-inline">energy resource criticality based on the importance of critical energy resources to the development of energy technologies and the supply of energy;</text></subparagraph> <subparagraph id="H7B78E0E3D9124F328C86D7BC8D769CE3"><enum>(B)</enum><text display-inline="yes-display-inline">the critical energy resource supply chain of the United States;</text></subparagraph> 
<subparagraph id="HFEDC620DDA5C401FA8204180F836C6C2"><enum>(C)</enum><text>the vulnerability of such supply chain;</text></subparagraph> <subparagraph id="HD4172718C08948B496273D35646DD13B"><enum>(D)</enum><text display-inline="yes-display-inline">how the energy security of the United States is affected by the reliance of the United States on importation of critical energy resources; and</text></subparagraph> 
<subparagraph id="H68B873FF64E54C97AD457CD80C3E7645" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">how adversarial nations seek to exploit critical energy resource markets to undermine investment in the United States, which may include the extent to which adversarial nations employ anti-competitive practices, price manipulation, or human rights abuses in critical energy resource production and exportation;</text></subparagraph></paragraph> <paragraph id="HD3461F8B9D834E44B5CE48E67CDCE584"><enum>(2)</enum><text display-inline="yes-display-inline">facilitate development of strategies to strengthen critical energy resource supply chains in the United States, including by—</text> 
<subparagraph id="HF0A1714C95E645CAA4E66CD7F6FD6DF1"><enum>(A)</enum><text display-inline="yes-display-inline">diversifying the sources of the supply of critical energy resources; and</text></subparagraph> <subparagraph id="H879F0D92A8274DA2AB914AAE3750623F"><enum>(B)</enum><text display-inline="yes-display-inline">increasing domestic production, separation, and processing of critical energy resources;</text></subparagraph></paragraph> 
<paragraph id="H6CA21AA314084D289EC6DB7E4C018818"><enum>(3)</enum><text display-inline="yes-display-inline">develop substitutes and alternatives to critical energy resources; and</text></paragraph> <paragraph id="HC1C80D8909194B6BBEA2250D67FB06A5"><enum>(4)</enum><text display-inline="yes-display-inline">improve technology that reuses and recycles critical energy resources.</text></paragraph></subsection> 
<subsection id="H95745D4591C2467EBCDD63B283EDD7CB" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Critical energy resource defined</header><text display-inline="yes-display-inline">In this section, the term <term>critical energy resource</term> has the meaning given such term in section 2 of the Department of Energy Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7101">42 U.S.C. 7101</external-xref>).</text></subsection></section> </legis-body></bill>
