<section id="H94FA1AA534554481B877D25B48861BF2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Maintaining Authority and Restoring Security to Halt the Abuse of Law</short-title></quote> or the <quote><short-title>MARSHALS Act</short-title></quote>.</text></section> <section id="H3340A97E3C364945A67A881E7AF66D46"><enum>2.</enum><header>United States Marshals Service</header> <subsection commented="no" display-inline="no-display-inline" id="HE40284D6A3D945F89B2477B9977D7451"><enum>(a)</enum><header display-inline="yes-display-inline">Transfer</header><text display-inline="yes-display-inline">Title 28, United States Code, is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H785195C6EDC3491D91E28B7A94C643EE"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating chapter 37 as chapter 59; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H4C38C510F3794AB5AD58434664A7552E"><enum>(2)</enum><text display-inline="yes-display-inline">by transferring chapter 59, as so redesignated, from part II to part III so as to appear after chapter 58.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H7438AB76089648CFAC42C0AAC8DF2DFE"><enum>(b)</enum><header>Court officers and employees</header><text>Chapter 59, as redesignated by subsection (a), of title 28, United States Code, is amended—</text> <paragraph commented="no" display-inline="no-display-inline" id="H6133F150BA704D4DA40AF90CE98C4814"><enum>(1)</enum><text display-inline="yes-display-inline">in section 561—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H24D9962AE8B04909BEFAD95B9179E7A3"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subsections (a) through (d) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H05D2DDF12BEA43BAAF1D20048B7D50F9"> <subsection id="H1F6FA2237B024B14B7720A32104BF5F7"><enum>(a)</enum><text>There is hereby established a United States Marshals Service as a bureau within the judicial branch of the United States. There shall be at the head of the United States Marshals Service (hereafter in this chapter referred to as the <quote>Service</quote>) a Director (hereafter in this chapter referred to as the <quote>Director</quote>) who shall be appointed by the Chief Justice, in consultation with the Board established under subsection (i) (hereafter in this chapter referred to as the <quote>Board</quote>). The Director may be removed by the Board.</text></subsection> 
<subsection id="H2CB25CBE70D94DAABB33FF46EB3A5F71"><enum>(b)</enum><text>The Chief Justice of the United States shall appoint, in consultation with the Board, a United States marshal for each judicial district of the United States and for the Superior Court of the District of Columbia, except that any marshal appointed for the Northern Mariana Islands may at the same time serve as marshal in another judicial district. Each United States marshal shall be an official of the Service and shall serve under the direction of the Director.</text></subsection> <subsection id="H9E6DFE1D9A024AA98130A7EE9A227846"><enum>(c)</enum><text>Each marshal shall be appointed for a term of four years. A marshal shall, unless that marshal has resigned or been removed by the Chief Justice of the United States, in consultation with the Board, continue to perform the duties of that office after the end of that 4-year term until a successor is appointed and qualifies.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H039945CC577E448CBBD1432D754552BD"><enum>(B)</enum><text>by redesignating subsections (e) through (i) as subsections (d) through (h), respectively; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H52D18F4377834B419F69E3CFB77B9702"><enum>(C)</enum><text>by adding at the end the following:</text>

<subsection commented="no" display-inline="no-display-inline" id="H065980C1888648549976DC47B4E62862"><enum>(i)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HDAB0A1BFE7A2496F9C2ADB59E10F521E"><enum>(1)</enum><text>The activities of the Director shall be supervised by a Board to be composed of—</text> <subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="H396D44A435144023ACE4C7F02CEFE5E0"><enum>(A)</enum><text>the Chief Justice of the United States;</text></subparagraph> 
<subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="H651CF73BD8414E6EAA0E467DE6B26B98"><enum>(B)</enum><text>the Judicial Conference of the United States; and</text></subparagraph> <subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="H962B53B814D2402BACE75A7A72434156"><enum>(C)</enum><text>the Director, who shall be an ex officio, nonvoting member.</text></subparagraph></paragraph> 
<paragraph id="H3614AE2AC4D74AA9AF4767B0C5486B77" indent="up1"><enum>(2)</enum><text>The Board shall establish general goals and objectives covering the major functions and operations of the Service to improve the efficiency and effectiveness of the operations of the Service.</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H9B184CAB4BB141019C33B62541375C26"><enum>(2)</enum><text>in section 562, by striking subsections (a) and (b) and inserting the following:</text>

<subsection id="H38CF784668E247E2AC1154F9BDA06174"><enum/><text>In the case of a vacancy in the office of a United States marshal, the Chief Justice of the United States, shall appoint a United States marshal to serve the remainder of the 4-year term.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HBC2319A089904DE0A10E074E58142EAE"><enum>(3)</enum><text>by striking section 564;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H3467AC44B4EE4E6E92FD6A76041FE13F"><enum>(4)</enum><text>by redesignating sections 565 and 566 as sections 564 and 565, respectively;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HBE8387AF88C9440BA976E8559CC578AD"><enum>(5)</enum><text display-inline="yes-display-inline">in section 564, as so redesignated, by striking <quote>Attorney General</quote> and inserting <quote>Chief Justice of the United States, in consultation with the Board</quote>;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD44E41098B0E4C8E818245140FB92EAF"><enum>(6)</enum><text>in section 565, as so redesignated—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H7EE14BB671F4414DAE53AA2C909251E5"><enum>(A)</enum><text display-inline="yes-display-inline">by striking subsection (e) and inserting the following:</text>

<subsection id="H8B056AD8163142C2BF2FEB88399D1DB5"><enum>(e)</enum><text>The United States Marshals Service is authorized to provide for the personal protection of Federal jurists, court officers, witnesses, and other threatened persons in the interests of justice where criminal intimidation impedes on the functioning of the judicial process or any other official proceeding.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HA98BECC45389465FA90ED52FE9CEE5DD"><enum>(B)</enum><text>in subsection (h), by striking <quote>directed by the Attorney General</quote> and inserting <quote>requested by the Attorney General, and approved by the Director</quote>; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H3EF32DD90DCB47CA99B6161B2DA0B2D0"><enum>(C)</enum><text>in subsection (i), by striking the third sentence;</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H97692E5F4583463286AF8737669BB972"><enum>(7)</enum><text>by inserting after section 565, as so redesignated, the following:</text>

<section id="H99462F83A8A14C5094CA21B07954B049"><enum>566.</enum><header>Assistance in other law enforcement matters</header><text display-inline="no-display-inline">At the request of the Attorney General, and with the approval of the Director, the Service may assist the Department of Justice with the following tasks:</text> <paragraph id="H19B4F3AE4394448B9ACF6BEB4155208A"><enum>(1)</enum><text>Investigating such fugitive matters, both within and outside the United States, as directed by the Attorney General.</text></paragraph> 
<paragraph id="H3833A4944886455390ADD51BB2725618"><enum>(2)</enum><text>Issuing administrative subpoenas in accordance with section 3486 of title 18, solely for the purpose of investigating unregistered sex offenders (as defined in section 3486).</text></paragraph> <paragraph id="H2B5EAB5FDF91433E869D867538C665B2"><enum>(3)</enum><text>Assisting State, local, and other Federal law enforcement agencies, upon the request of such an agency, in locating and recovering missing children.</text></paragraph></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H6691ECFDE8574BB0AD35FBD31AD3A8E7"><enum>(8)</enum><text>in section 569(b), by striking <quote>President</quote> and inserting <quote>Chief Justice, in consultation with the Board</quote>.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H14C426CC86E54C72B503A44321691F98"><enum>(c)</enum><header>Technical and conforming amendments</header> <paragraph commented="no" display-inline="no-display-inline" id="H9B6AA81E0D9B4635A41AED935127F80A"><enum>(1)</enum><text display-inline="yes-display-inline">The table of chapters for part III of title 28, United States Code, is amended by adding at the end the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="H872F34633F6D4E7FBAE33E7D93688F00"><enum>(4)</enum><text>Section 210G(k)(3)(C) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n(k)(3)(C)(ii)</external-xref>) is amended—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HF77E19B4E6B345CAA656E50BD2BD32EA"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (ii), by striking subclause (I) and inserting the following:</text>
