<section id="HFEFEF8317B0B4BA4840BAC7A396698E9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gold Star Spouses Health Care Enhancement Act</short-title></quote>.</text></section> <section id="H17215E5F153C41089DA8CBE11367EE2F"><enum>2.</enum><header>Expansion of health care benefits for Gold Star surviving spouses</header> <subsection id="HA83884CDDBDF4FAEA9683E4CE957933F"><enum>(a)</enum><header>Medical benefits</header><text display-inline="yes-display-inline">Section 1079(g) of title 10, United States Code, is amended—</text>
<paragraph id="H18634FECBFE84D55962B40FFE081F6FC"><enum>(1)</enum><text>in paragraph (2), by inserting <quote>except as provided by paragraph (5),</quote> after <quote>benefits under paragraph (1),</quote>; and</text></paragraph> <paragraph id="HEE37AFC51E134F00B60C7B25683BEB5E"><enum>(2)</enum><text>by striking paragraph (5) and inserting the following:</text>

<paragraph id="HBDE60E329ECD45CC80F3FFD8EC5A7ED0" indent="up1"><enum>(5)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="H2E390C728196440F9CDF1A12D6556101"><enum>(A)</enum><text>A dependent described in subparagraph (B) shall not be subject to the three-year time limit specified in paragraph (2) with respect to eligibility for benefits under TRICARE Prime.</text></subparagraph> <subparagraph id="H2C4B64BCF98341AE93A161CF0931827F" indent="up1"><enum>(B)</enum><text>A dependent described in this subparagraph is a dependent for purposes of section 1072 of this title by reason of being a surviving spouse of a member of the Armed Forces whose death is covered by section 1126.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H3F8C56A94C434A1EA8C1E45EC7EA7426"><enum>(b)</enum><header>Dental benefits</header><text>Section 1076a(k) of such title is amended—</text> <paragraph id="H8BC0EF1C1EA946D69FF6325E0F48D490"><enum>(1)</enum><text>in paragraph (3), by striking <quote>Such term</quote> and inserting <quote>Except as provided by paragraph (4), such term</quote>; and</text></paragraph>
<paragraph id="H01EA3E1E3EC245459243FCA046C9FEBD"><enum>(2)</enum><text>by adding after paragraph (3) the following:</text> <quoted-block style="USC" id="H7B6DFDDB00974D9386CC248226F53D59" display-inline="no-display-inline"> <paragraph id="HD0C0333C5CB647DD9792BEEF7A5CDAAC" indent="up1"><enum>(4)</enum> <subparagraph commented="no" display-inline="yes-display-inline" id="HD0D1129391BD486CA5330170629BBC84"><enum>(A)</enum><text>A dependent described in subparagraph (B) shall not be subject to the three-year time limit specified in paragraph (3).</text></subparagraph>
<subparagraph id="H7AEA5F9EA81F4A90A31EED5CE5BE92C0" indent="up1"><enum>(B)</enum><text>A dependent described in this subparagraph is a dependent for purposes of section 1072 of this title by reason of being a surviving spouse of a member of the Armed Forces whose death is covered by section 1126.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HB4C036BA99684B35AF6CE86A9622AAA4"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to a surviving spouse of a member of the Armed Forces whose death is covered by section 1126 of title 10, United States Code, regardless of whether such death occurred before the date of the enactment of this Act.</text></subsection></section>
