which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Government Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 5, United States Code, to provide limitations on Federal teleworking, and for other purposes.</official-title></form><legis-body id="H6D0E3EF15688412FBE4C9D93EFD55F90" style="OLC"><section id="H827318085FA240D3A55D40BE56379F4B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>Back to Work Act</short-title></quote>. </text></section><section commented="no" display-inline="no-display-inline" id="H2CE64AC8C5134925878FD906B9F0914A"><enum>2.</enum><header>Modification of telework requirements for Federal employees</header><subsection commented="no" display-inline="no-display-inline" id="H442B9789CC1B4F63913F808C02428125"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/65">Chapter 65</external-xref> of title 5, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HCF182DE0A0FB47A8B0D2D40A7F72B761"><enum>(1)</enum><text>in section 6502—</text><subparagraph commented="no" display-inline="no-display-inline" id="H34D7FDB8F75C4F32A8E2C8C9DE53198A"><enum>(A)</enum><text>in subsection (b)(2)—</text><clause commented="no" display-inline="no-display-inline" id="H07BF2B91E8FE496F9013446141C151E2"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HA8478DA611714569B9668B7672E82F5B"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block id="H909FE2378D054F5A8A30BC178940E75D" style="OLC" act-name=""><subparagraph id="H1E96A4345DCB44A58478C39335993383"><enum>(C)</enum><text>provides that, subject to subsection (d), an employee may not telework for more than 40 percent of the work days of the employee per pay period; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8AA0DF0EAF94472EBCC37DED9D246CB3"><enum>(D)</enum><text display-inline="yes-display-inline">shall be reviewed on an annual basis by, and be subject to the annual approval of, the head of the executive agency; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0D9E0A74CEDB4709AEA5E087B5151182"><enum>(E)</enum><text display-inline="yes-display-inline">provides that the executive agency, by using remote technical means and other appropriate methods, will monitor and evaluate the applicable employee when the employee is engaged in telework;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4B1AF3044ABB445FAD0065D5A9B17AE2"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="HB6D13413817B47119B15F8DD89B207BB" style="OLC" act-name=""><subsection id="HDA30949EC1514D64B5AF12602F771E23"><enum>(d)</enum><header>Adjustments to the permitted number of telework days</header><text>With respect to the limitation under subsection (b)(2)(C), the head of an executive agency may—</text><paragraph commented="no" display-inline="no-display-inline" id="H64115014EF4748BFA060F21895094818"><enum>(1)</enum><text display-inline="yes-display-inline">further limit the number of work days per pay period that an employee of the executive agency may telework based on the specific role of the employee or other circumstances determined appropriate by the head of the executive agency, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="H4AE3A291E8B848D88A346B373D1F1606"><enum>(A)</enum><text display-inline="yes-display-inline">the frequency with which the employee needs to access classified information;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H219FD43B43A64EA0BE08FA22CA0BA021"><enum>(B)</enum><text display-inline="yes-display-inline">whether the employee is newly appointed; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCD4F80BD2E774233922153149D69DCBD"><enum>(C)</enum><text display-inline="yes-display-inline">whether the employee occupies a managerial position within the executive agency; or</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3C30504211E14917A27E8EF391E2F596"><enum>(2)</enum><text display-inline="yes-display-inline">waive that limitation with respect to an employee of the executive agency if—</text><subparagraph commented="no" display-inline="no-display-inline" id="HFA39E0A1706A4435A912E538DC212C7B"><enum>(A)</enum><text display-inline="yes-display-inline">the employee is a spouse of— </text><clause commented="no" display-inline="no-display-inline" id="HC127D0022F3841E78B71EC53AB89E808"><enum>(i)</enum><text display-inline="yes-display-inline">a member of the Armed Forces; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HF0AD9F9D424248E5A7F04B2CEEBF20AC"><enum>(ii)</enum><text>a Federal law enforcement officer;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H03AA49DCB24D4EBA8F7A2D00134963F1"><enum>(B)</enum><text display-inline="yes-display-inline">the employee occupies a position—</text><clause commented="no" display-inline="no-display-inline" id="H09254CD2B0EA4FCBBD5D6402CBE2A1FB"><enum>(i)</enum><text display-inline="yes-display-inline">the duties of which require— </text><subclause commented="no" display-inline="no-display-inline" id="HC0DCDB42A77D46F7B726FF70FF1D50EF"><enum>(I)</enum><text display-inline="yes-display-inline">highly specialized expertise; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H79EBDEB107F14BD5855C73DF2AB99970"><enum>(II)</enum><text>frequent travel; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H37D85222708C40E19F1E73EAE2CC9C97"><enum>(ii)</enum><text display-inline="yes-display-inline">for which finding qualified candidates is challenging; or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDB3E34D9EC9B4F2698E35DC9703617E7"><enum>(C)</enum><text display-inline="yes-display-inline">inclement weather or other exigent circumstances prevent the employee from reaching the worksite of the employee during a pay period.</text></subparagraph></paragraph></subsection><subsection id="H38E3AA0773114F6091A93805EA976863"><enum>(e)</enum><header>Limitations on pay</header><text>With respect to any employee who has entered into a written agreement under subsection (b)(2), and notwithstanding any other provision of this title, such employee shall—</text><paragraph id="H4335350E89CD4A55B9B0DB98B8CC8316"><enum>(1)</enum><text>not be eligible for any adjustment to pay under section 5303; and</text></paragraph><paragraph id="H4C528DBABA1A48D9AD06F6F61E42F475"><enum>(2)</enum><text display-inline="yes-display-inline">receive locality-based comparability payments under section 5304 or 5304a at the percentage for the Rest of United States locality pay area.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE9FC676FC7B04042BADA449FBBEE791E"><enum>(2)</enum><text>in section 6506, by adding at the end the following:</text><quoted-block id="HC9B9FF764CC04AC3B8025E0636D25AD9" style="OLC" act-name=""><subsection id="H7B2D0E0901774FDC80708B515C1D112E"><enum>(e)</enum><header>Executive agency reports</header><paragraph commented="no" display-inline="no-display-inline" id="H7E56D68C013540B58A3C6C2AACBB466D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 1 year after the date of enactment of this subsection, and annually thereafter, the head of each executive agency shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives a report that describes, for the period covered by the report, the following:</text><subparagraph commented="no" display-inline="no-display-inline" id="H3926F38FF2124AB18B2706DFE015DA88"><enum>(A)</enum><text display-inline="yes-display-inline">What metrics and methods the executive agency uses to determine the productivity of employees who telework.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H94FBED7559ED4FFB8E7883C3058862CB"><enum>(B)</enum><text display-inline="yes-display-inline">What barriers, if any, prevent the executive agency from enforcing the limitation under section 6502(b)(2)(C) and any initiatives of the executive agency to address those barriers.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC4502398177B48809213EFD32575CE71"><enum>(C)</enum><text display-inline="yes-display-inline">Any negative effects of telework, including whether telework results in increased costs, security vulnerabilities, lower employee morale, decreased employee productivity, or waste, fraud, or abuse.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H90A3A4A07340444498B5F5589054FCD0"><enum>(D)</enum><text display-inline="yes-display-inline">Any actions taken by the executive agency (or a detailed justification for any lack of action) in response to any findings of, or recommendations made by, the Inspector General of the executive agency with respect to telework.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4E133E1A62E6423DA4B4E8BF867CECBD"><enum>(2)</enum><header>GAO report</header><text display-inline="yes-display-inline">With respect to each report submitted by the head of an executive agency under paragraph (1), the Comptroller General of the United States shall submit an accompanying report that evaluates the accuracy and thoroughness of the report submitted by the head of the executive agency with respect to the matters required to be included in the report of the executive agency under that paragraph.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H10851401D96A403884A97526B8699A80"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect on the date that is 180 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
