<section id="H811CDFC38A9D456D8DBA8C3A7AE4D821" section-type="section-one"><enum>1.</enum><header>Rural surface transportation grant program</header><text display-inline="no-display-inline">Section 173 of title 23, United States Code, is amended—</text> <paragraph id="H263BE564FDF7445882A6BC315587B921"><enum>(1)</enum><text>in subsection (a) by adding at the end the following:</text> 
<quoted-block style="USC" id="HDECEC33A074D4F828BD4563DBCD14A21" display-inline="no-display-inline"> 
<paragraph id="HDA4FA0F52E994E41828987ADC4478E64"><enum>(3)</enum><header>Covered county</header><text>The term <quote>covered county</quote> means a county that has an annual gross agricultural production value of at least $1,000,000,000 and agricultural production of at least $500,000 per square mile, for all crops and livestock sold, adjusted annually for inflation in accordance with the Consumer Price Index published by the Bureau of Labor Statistics of the Department of Labor.</text></paragraph> <paragraph id="HA1EFB35F48064E27A9896ECBA2BCDEF5"><enum>(4)</enum><header>Farm-to-market road</header><text display-inline="yes-display-inline">The term <quote>farm-to-market road</quote> means a road located within a covered county.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2FE844281BAC489BAC23CA9576BC825E"><enum>(2)</enum><text>in subsection (i) by striking <quote>subsection (k)(1)</quote> and inserting <quote>paragraphs (1) and (4) of subsection (k)</quote>;</text></paragraph> <paragraph id="H244A3E93AB21403E8A4C4E5B5014AAC8"><enum>(3)</enum><text>in subsection (k)—</text> 
<subparagraph id="HE676B4FA73444BB9B0B5FCE5BBFB867B"><enum>(A)</enum><text>by redesignating paragraph (4) as paragraph (5);</text></subparagraph> <subparagraph id="H004BFE5C2AD34907A988CD00CF2BEABB"><enum>(B)</enum><text>by inserting after paragraph (3) the following:</text>

<paragraph id="HCB90D849B15A44789E8A0E065A70E352"><enum>(4)</enum><header>Farm-to-market roads</header><text display-inline="yes-display-inline">The Secretary shall reserve 10 percent of the amounts made available for the program for each fiscal year to provide grants for eligible projects located on farm-to-market roads in any amount.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HF4299BFE65D34775961B83D6681FED50"><enum>(C)</enum><text>in paragraph (5) (as so redesignated) by striking <quote>or (3)</quote> and inserting <quote>(3), or (4)</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HF9DACA55BAE5440FB6E14215C0073F81"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block style="USC" id="H4109E23836404B25985A132E761B9AED" display-inline="no-display-inline"> <subsection id="HC6615F10656144C5A2A397AC6A6642A3"><enum>(p)</enum><header>Eligible covered counties</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of Agriculture, shall create, and annually update, a list of covered counties.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
