<section section-type="section-one" id="H4E2B08B5778A4C7C8ECF6AC7060E3938"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Leadership in Critical and Emerging Technologies Act</short-title></quote> or the <quote><short-title>Leadership in CET Act</short-title></quote>.</text></section> <section id="H718236B2B55C40208B9EA8FD9A101FA4"><enum>2.</enum><header>Pilot program for expediting examination of certain critical and emerging technology patent applications</header> <subsection id="HA49566808FEC455F8CCD9C493631AC94"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H2AD18D6E9C324D15A08FE39AD325CBAA"><enum>(1)</enum><header>Covered application</header><text>The term <term>covered application</term> means an application for patent that contains at least 1 claimed invention directed to an eligible critical or emerging technology.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HB9C1BA1151B6488D8528562FF4286DB7"><enum>(2)</enum><header display-inline="yes-display-inline">Director</header><text>The term <term>Director</term> means the Under Secretary of Commerce for Intellectual Property and Director of the Office.</text></paragraph> 
<paragraph id="H761ABBB956084B0E807858DA24C766AC"><enum>(3)</enum><header>Eligible critical or emerging technology</header><text>The term <term>eligible critical or emerging technology</term> means—</text> <subparagraph id="HB9285E091770461EA5BD6B60FDBF4B22"><enum>(A)</enum><text>an artificial intelligence capability relating to—</text> 
<clause commented="no" display-inline="no-display-inline" id="H682ED1968E954915B5E48D867B176CBF"><enum>(i)</enum><text display-inline="yes-display-inline">machine learning;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H6DBD7DBDAFE34335B297CCA1CD5C9A6E"><enum>(ii)</enum><text>deep learning;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H09D07FA8902E4ED58D45F5BEC8E6FB0A"><enum>(iii)</enum><text>reinforcement learning;</text></clause> <clause commented="no" display-inline="no-display-inline" id="HD9D7A2A48E924EE3803E4E0FDD97118F"><enum>(iv)</enum><text>sensory perception or recognition;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HD0805AD480634896A7902EEA9646BEDC"><enum>(v)</enum><text>an artificial intelligence assurance or assessment technique;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H94AC36B132954CA381E28242D4EE42AB"><enum>(vi)</enum><text>a foundation model;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H0855ED9063AE4BCE91BCB2D2B2BFE16D"><enum>(vii)</enum><text>a generative artificial intelligence system or multimodal or large language model;</text></clause> <clause commented="no" display-inline="no-display-inline" id="HA2F27585AC22408696DE941B6AFB36DA"><enum>(viii)</enum><text>a synthetic data approach for training, tuning, or testing;</text></clause> 
<clause id="HC596355B73DF4C558B87A7DD802E2BBC"><enum>(ix)</enum><text>planning, reasoning, or decision making; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="HAA7C424351E0479C92DA831EFE991E47"><enum>(x)</enum><text>the improvement of artificial intelligence safety, trust, security, or responsible use;</text></clause></subparagraph> 
<subparagraph id="H9E0808A38B1B4CB0B65F7D50B87DDAAC"><enum>(B)</enum><text>semiconductor design or an electronic design automation tool; or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H7B48063B68F1451787E671F82A8248A0"><enum>(C)</enum><text>a quantum information science capability relating to—</text> 
<clause commented="no" display-inline="no-display-inline" id="H74CCDCBE717348E8B3BF3D4A3336FD88"><enum>(i)</enum><text display-inline="yes-display-inline">quantum computing;</text></clause> <clause commented="no" display-inline="no-display-inline" id="H86E39880323240F2AF7712CFC51803C3"><enum>(ii)</enum><text>materials, isotopes, or fabrication techniques for quantum devices;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HA6DE0FD764624EE1AF8E08A796DE9C35"><enum>(iii)</enum><text>quantum sensing; or</text></clause> <clause commented="no" display-inline="no-display-inline" id="H9E8C16B714194CBEA64E1C6E68303083"><enum>(iv)</enum><text>quantum communications or networking.</text></clause></subparagraph></paragraph> 
<paragraph id="H2032699B94BB472090FFCF47FF2EEEB3"><enum>(4)</enum><header>Expedite</header><text>The term <term>expedite</term> means, with respect to a covered application, to advance that covered application out of turn through the use of a petition to make special.</text></paragraph> <paragraph id="HE6BB6B631DDB4DEB82F907021043E27F"><enum>(5)</enum><header>Office</header><text>The term <term>Office</term> means the United States Patent and Trademark Office.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7C3EE66CB5774C8CA93DBA7CE6A90CC6"><enum>(6)</enum><header display-inline="yes-display-inline">Pilot program</header><text>The term <term>pilot program</term> means the pilot program established under subsection (b).</text></paragraph></subsection> <subsection id="H88067BF9A2414526BBCD1D38FE22F1D3"><enum>(b)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Director shall establish a pilot program to expedite the examination, under section 131 of title 35, United States Code, of covered applications.</text></subsection> 
<subsection id="H21D1B22C33204AD685DF26B6C9E0BCAD"><enum>(c)</enum><header>Purpose</header><text>The purpose of the pilot program shall be to encourage innovation by, and the leadership of, the United States with respect to critical or emerging technologies by ensuring that covered applications receive prompt consideration.</text></subsection> <subsection id="H72746E521FB14C01878CA26F5080E6A0"><enum>(d)</enum><header>Implementation</header><text>In carrying out the pilot program, the Director may—</text> 
<paragraph id="HA7C329086E394073B1304A1081E27970"><enum>(1)</enum><text>by regulation, and in addition to the requirements under subsection (e), prescribe the conditions under which a covered application shall be accepted and examined under the pilot program, including—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HE40D83AD5A4F4D8E90C2CD33324C6267"><enum>(A)</enum><text display-inline="yes-display-inline">the requirements to participate in the pilot program;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H382F922F9631457E80DDE49B27504ED3"><enum>(B)</enum><text>internal processing by the Office of covered applications under the pilot program;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H7AE7E6795E804E7E8A273C08DAD648A0"><enum>(C)</enum><text>requirements for restriction or unity of inventions identified in covered applications;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H705E1E9A07B044EBA933C131BB813D7D"><enum>(D)</enum><text>the period during which the applicant submitting the covered application may reply with respect to an action taken by the Office with respect to the covered application;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H723F0C9168E746BD8F06A71951241E15"><enum>(E)</enum><text display-inline="yes-display-inline">standards relating to a reply described in subparagraph (D);</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H19C2D09A09D944658342F600E87083F3"><enum>(F)</enum><text>standards or procedures governing—</text> <clause commented="no" display-inline="no-display-inline" id="H04B2757939B34B71A614AF2A35016F43"><enum>(i)</enum><text display-inline="yes-display-inline">any amendment, affidavit, or other evidence filed after a final action taken by the Office with respect to the covered application; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HBAE26E692BC440738A2C7D0290F2D14B"><enum>(ii)</enum><text display-inline="yes-display-inline">any process for appeal with respect to a final action described in clause (i); and</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H7A3A192FF10C4831B6969CD856496020"><enum>(G)</enum><text>the withdrawal, by an applicant, of a covered application submitted under the pilot program;</text></subparagraph></paragraph> 
<paragraph id="H29E915C042CE4B14AAC8275DABE19CFE"><enum>(2)</enum><text>waive—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H86A778C381DF40DAB47FCE1E457EF9FB"><enum>(A)</enum><text display-inline="yes-display-inline">the petition fee described in section 1.102(d) of title 37, Code of Federal Regulations, or any successor regulation; or</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD36AE2529328471CA5FBA51A25909763"><enum>(B)</enum><text display-inline="yes-display-inline">any other requirement of the Office relating to the accelerated examination program or the prioritized examination program; and</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HCE9BB1C8CA4644E1A98E17A626310182"><enum>(3)</enum><text>consult with the Attorney General, the Secretary of Defense, the Secretary of State, the Secretary of the Treasury, the Director of National Intelligence, or the head of any other Federal agency, as may be appropriate to carry out the pilot program.</text></paragraph></subsection> 
<subsection id="H17FC7FA92A4546F59734839113A6DC51"><enum>(e)</enum><header>Qualifying applications</header><text>To best achieve the purpose of the pilot program, the Director shall ensure that a covered application satisfies the following requirements to qualify for the pilot program:</text> <paragraph id="H6806041C48C540BDB3C477FDED0FB583"><enum>(1)</enum><text>The applicant submitting the covered application—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H56BD46FEB8184B95BC117A2C9C21CBC5"><enum>(A)</enum><text display-inline="yes-display-inline">is not a foreign entity of concern, as defined in section 9901 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/4651">15 U.S.C. 4651</external-xref>); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC327BC5CB95245549C6E07E228013DB0"><enum>(B)</enum><text>certifies in the covered application that the inventor or any joint inventor with respect to any claimed invention in the covered application has not been named as the inventor or joint inventor with respect to more than 4 other covered applications submitted under the pilot program.</text></subparagraph></paragraph> 
<paragraph id="H76A474EA3F0B47ACBBDF0BCB9FA58A86"><enum>(2)</enum><text>The covered application is a noncontinuing, nonprovisional application for an original utility patent filed under section 111(a) of title 35, United States Code, that does not claim any domestic benefit under section 120, 121, 365(c), or 386(c) of that title.</text></paragraph></subsection> <subsection id="H080E31516EBC4F36B43B77FBD9CC558A"><enum>(f)</enum><header>Termination</header> <paragraph id="HD9AA5213A0AF4EDCA0BF2096BFF721FC"><enum>(1)</enum><header>In general</header><text>The pilot program shall terminate on the earlier of the following:</text> 
<subparagraph id="H6DC149AD66464F89A67C053026BE0D13"><enum>(A)</enum><text>The date that is 5 years after the date on which the Director first accepts a covered application for participation in the pilot program.</text></subparagraph> <subparagraph id="H73C1E6CF91CA4111B771A045CF373763"><enum>(B)</enum><text>The date on which the Director has accepted 15,000 covered applications for participation in the pilot program, without regard to whether those covered applications have been expedited under the pilot program.</text></subparagraph></paragraph> 
<paragraph id="H00F2438ACF9143A6BC23489408CAD29C"><enum>(2)</enum><header>Renewal</header><text>If the pilot program terminates under paragraph (1)(B), the Director may renew the pilot program for the shorter of the following:</text> <subparagraph id="H4D05C50263624CDD9C0D1C67B0616A70"><enum>(A)</enum><text>An additional 5-year period, beginning on the date on which the pilot program terminates under paragraph (1)(B).</text></subparagraph> 
<subparagraph id="H35A1C19C31A34C4D85D6CDE06ACD7CE5"><enum>(B)</enum><text>An additional period—</text> <clause id="H1F7FF7DD49AB4B208B0F52BC9C0B7BBA"><enum>(i)</enum><text>beginning on the date on which the pilot program terminates under paragraph (1)(B); and</text></clause> 
<clause id="H164E2378BFBF4C229F5AA169D0A565D2"><enum>(ii)</enum><text>ending on the date on which the Director has accepted an additional 15,000 covered applications for participation in the pilot program, without regard to whether those covered applications have been expedited under the pilot program.</text></clause></subparagraph></paragraph> <paragraph id="H8EC20B90F3F64654B02FAF606BFB7DD7"><enum>(3)</enum><header>Notice of renewal</header><text>The Director shall notify the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives of the intent of the Director to renew the pilot program under paragraph (2) not later than the date that is the earlier of the following:</text> 
<subparagraph id="H1160A1975F96427EA687C32E25AB37A8"><enum>(A)</enum><text>The date that is 60 days before the date described in paragraph (1)(A).</text></subparagraph> <subparagraph id="HE753AB0B53BF4A1DA4D0F16E28EF1FFB"><enum>(B)</enum><text>The date that is 30 days after the date on which the Director has accepted 12,000 covered applications for participation in the pilot program, without regard to whether those covered applications have been expedited under the pilot program.</text></subparagraph></paragraph></subsection> 
<subsection id="H8880AA8E693B462D8CFF51AB75E44338"><enum>(g)</enum><header>Public availability of information</header><text>The Director shall make publicly available in an easily accessible location on the website of the Office information about the pilot program, including—</text> <paragraph id="HD0CCA7B868B24BCDA30884B537798042"><enum>(1)</enum><text>the number of covered applications submitted under the pilot program;</text></paragraph> 
<paragraph id="H34B8A69190F0410286ABCF77EB68BB98"><enum>(2)</enum><text>the number of covered applications described in paragraph (1) that the Director has accepted for participation in the pilot program; and</text></paragraph> <paragraph id="HB52A23ED52FE47369E4AA46EFB8E3F54"><enum>(3)</enum><text>the number of patents that have been issued for inventions claimed in covered applications expedited under the pilot program.</text></paragraph></subsection> 
<subsection id="H4DB4D1C3AE41429886E9EAAA1302057C"><enum>(h)</enum><header>Report to Congress</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HE7BE450288764E1C808AED7C55112088"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 180 days after the date on which the pilot program terminates (including any renewal of the pilot program under subsection (f)(2)), the Director shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report that assesses the impact and effectiveness of the pilot program based on all available data.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H8D6C7A7C5A0F4347BB9BDA55E94B1789"><enum>(2)</enum><header>Applicability</header><text display-inline="yes-display-inline">The collection of any data for the purposes of carrying out paragraph (1) shall be exempt from subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly referred to as the <quote>Paperwork Reduction Act</quote>).</text></paragraph></subsection></section>
