<official-title display="yes">To amend the Age Discrimination in Employment Act of 1967 and other laws to clarify appropriate standards for Federal employment discrimination and retaliation claims, and for other purposes.</official-title>

<section id="H3BC5F49AC7F74001A3A6B753A406E302" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Older Workers Against Discrimination Act of 2025</short-title></quote>.</text></section> <section id="H949521EFA8824CA0889077B789C9E1FA"><enum>2.</enum><header>Standards of proof</header> <subsection id="HF29A28F8B0AD443FBC79251CA2CA7C79"><enum>(a)</enum><header>Age Discrimination in Employment Act of 1967</header> <paragraph id="H9000944206174A7EA26CC68ED368C3C4"><enum>(1)</enum><header>Clarifying prohibition against impermissible consideration of age in employment practices</header><text>Section 4 of the Age Discrimination in Employment Act of 1967 (<external-xref legal-doc="usc" parsable-cite="usc/29/623">29 U.S.C. 623</external-xref>) is amended by inserting after subsection (f) the following:</text>

<subsection id="H1BD394793BEB4D62B9AC9360B32A5BA1"><enum>(g)</enum><text>Except as otherwise provided in this chapter, an unlawful practice is established under this chapter when the complaining party demonstrates that age or an activity protected by subsection (d) was a motivating factor for any practice, even though other factors also motivated the practice.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H52A52BC2DE5A43E884B8481BD56F2AB8"><enum>(2)</enum><header>Remedies</header><text>Section 7 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/626">29 U.S.C. 626</external-xref>) is amended—</text>
<subparagraph id="H659D5D894A8748759097C05B172F4BFC"><enum>(A)</enum><text>in subsection (b)—</text> <clause id="HB820D90581BF4C61A0C5CC50B3A4C585"><enum>(i)</enum><text>in the first sentence, by striking <quote>The</quote> and inserting <quote>(1) The</quote>;</text></clause>
<clause id="HAD03FE92ECC845ECA50CD88609797787"><enum>(ii)</enum><text>in the third sentence, by striking <quote>Amounts</quote> and inserting the following:</text> <quoted-block id="H31EBD2FD980B4F3A9EC4E988C6761E43" style="OLC"> <paragraph id="HD1E4E1023BFB4B88B9FD0CE52E1DDE53"><enum>(2)</enum><text>Amounts</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause>
<clause id="HB215282AD7FC435AB4F8703E4FE7A8F5"><enum>(iii)</enum><text>in the fifth sentence, by striking <quote>Before</quote> and inserting the following:</text> <quoted-block id="H8793AB02CEAE434E9DC21A76AEFA41A4" style="OLC"> <paragraph id="HCDC43BC136104306BD56A522CFB5B1B8"><enum>(4)</enum><text>Before</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause>
<clause id="HE9F4C6BA0C8C43AC966A7CB882619B06"><enum>(iv)</enum><text>by inserting before paragraph (4), as designated by clause (iii) of this subparagraph, the following:</text> <quoted-block id="H6279F6DFB80F47C38E0AA2228F6418E0" style="OLC"> <paragraph id="HFCC6BCA794094F258C7917A756B37A71"><enum>(3)</enum><text>On a claim in which an individual proves a violation under subsection (g) of section 623 of this title, and a respondent demonstrates that the respondent would have taken the same action in the absence of the impermissible motivating factor, the court—</text>
<subparagraph id="H92607C8550C7462FB22679A6FC1C6E41"><enum>(A)</enum><text>may grant declaratory relief, injunctive relief (except as provided in subparagraph (B)), and attorney’s fees and costs demonstrated to be directly attributable only to the pursuit of a claim under subsection 4(g) of section 623 of this title; and</text></subparagraph> <subparagraph id="HE6157FBBD29144E688B35A7B994BD99C"><enum>(B)</enum><text>shall not award damages or issue an order requiring any admission, reinstatement, hiring, promotion, or payment.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph>
<paragraph id="H819012D777914DDD9CCBB4ABE7D58CF8"><enum>(3)</enum><header>Definitions</header><text>Section 11 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/630">29 U.S.C. 630</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H97978403300C470497914176D4D5AD91" style="OLC"> <subsection id="H617CB49A8DDB4E0B8CE084E4CD9CDDB2"><enum>(m)</enum><text>The term <quote>demonstrates</quote> means meets the burdens of production and persuasion.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H737CDE70E39543B6B41018C881781D07"><enum>(4)</enum><header>Federal employees</header><text>Section 15 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/633a">29 U.S.C. 633a</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="HBAEB07311BE64BCBAE6531AA519ED949" style="OLC"> <subsection id="HBCF5DE69947A4A5689EB6EAB3B4125EA"><enum>(h)</enum><text>The provisions of 623(g) and 626(b)(3) of this title shall apply to claims brought under the provisions of this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H89B4858586CE44C18FF296EF539A8ED3"><enum>(b)</enum><header>Title vII of the Civil Rights Act of 1964</header>
<paragraph id="H2A50374421434452B12A45AD12C1EAB2"><enum>(1)</enum><header>Clarifying prohibition against impermissible consideration of race, color, religion, sex, or national origin in employment practices</header><text>Section 703 of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-2">42 U.S.C. 2000e–2</external-xref>) is amended by striking subsection (m) and inserting the following:</text> <quoted-block id="HEF9A0AC1892446E0B5844C5997822BBF" style="OLC"> <subsection id="H22620C1AC42B4C6AAF0CF3DFFA50E465"><enum>(m)</enum><text>Except as otherwise provided in this title, an unlawful practice is established when the complaining party demonstrates that race, color, religion, sex, national origin, or an activity protected by section 2000e–(3)a of this title was a motivating factor for any practice, even though other factors also motivated the practice.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H91BEA5C56BEA4366833FC9BB96B02A40"><enum>(2)</enum><header>Federal employees</header><text>Section 717 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000e-16">42 U.S.C. 2000e–16</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H4D93610CA864439AB92456EA13B80667" style="OLC"> <subsection id="H1B487123C15544CD99B59EC0E71C94CC"><enum>(g)</enum><text>Sections 2000e–2(m) and 2000e–5(g)(2)(B) of this title shall apply to claims brought under the provisions of this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HA0F9403A89824C10BA7CAF44165AC3E0"><enum>(c)</enum><header>Americans With Disabilities Act of 1990</header>
<paragraph id="H44995917A61E4DFCA33CCD0993C7D728"><enum>(1)</enum><header>Definitions</header><text>Section 101 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H7D87493BF65F486CA454E02F6FEA65EF" style="OLC"> <paragraph id="H5C205C1C91D34341A4D3D909288ABA73"><enum>(11)</enum><header>Demonstrates</header><text>The term <quote>demonstrates</quote> means meets the burdens of production and persuasion.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="HA373BFF7B14349DAA5EE958618D6358D"><enum>(2)</enum><header>Clarifying prohibition against impermissible consideration of disability in employment practices</header><text>Section 102 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12112">42 U.S.C. 12112</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H942EFF44D71A4F1A957207D673B3D03E" style="OLC"> <subsection id="H4D6301D980EC4224881E38A5E4450A3F"><enum>(e)</enum><header>Proof</header> <paragraph id="H5FD8B9A08E4E4E9499FF3147889A711B"><enum>(1)</enum><header>Establishment</header><text>Except as otherwise provided in this chapter, a discriminatory practice is established under this chapter when the complaining party demonstrates that disability or an activity protected by subsection (a) or (b) of section 12203 of this title was a motivating factor for any practice, even though other factors also motivated the practice.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H18E3723A4D5B45E9B03FA52B6E838433"><enum>(3)</enum><header>Certain anti-retaliation claims</header><text>Section 503(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12203">42 U.S.C. 12203(c)</external-xref>) is amended—</text> <subparagraph id="H1680FE2FD42A404D93C1BD9F43A42E83" indent="subparagraph"><enum>(A)</enum><text>by striking <quote>The remedies</quote> and inserting the following:</text>

<paragraph id="HF672BC3051DD4DE7887512681900711B"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the remedies</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="ide1d75cfd095d4b31ae52b50f6e1b3ad5"><enum>(B)</enum><text>by adding at the end the following:</text>

<paragraph id="HD0626EA9F9344268BEEB9AA4D9F7CE71"><enum>(2)</enum><header>Certain anti-retaliation claims</header><text>Section 12117(c) shall apply to claims under section 12112(e)(1) with respect to title I.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H685FF9F32B3E492FA77619FB47B72F50"><enum>(4)</enum><header>Remedies</header><text>Section 107 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12117">42 U.S.C. 12117</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H57A6037F8CE6493580A798E1F92321DD"><enum>(c)</enum><header>Discriminatory motivating factor</header><text>On a claim in which an individual proves a violation under section 12112(e)(1) of this title, and a respondent demonstrates that the respondent would have taken the same action in the absence of the impermissible motivating factor, the court—</text> <paragraph id="HCAF0B2E96FCC498FBEEE833345B91809"><enum>(1)</enum><text>may grant declaratory relief, injunctive relief (except as provided in paragraph (2)), and attorney’s fees and costs demonstrated to be directly attributable only to the pursuit of a claim under section 12112(e)(1); and</text></paragraph>
<paragraph id="H9E7E72BBA86C4D849393C160566CEC85"><enum>(2)</enum><text>shall not award damages or issue an order requiring any admission, reinstatement, hiring, promotion, or payment.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HDABA2EFBD41B4AFFB47E274468CF823A"><enum>(d)</enum><header>Rehabilitation Act of 1973</header> <paragraph id="H51C7F88E7EFF405298E4DF0262201E40"><enum>(1)</enum><header>In general</header><text>Sections 501(f), 503(d), and 504(d) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/791">29 U.S.C. 791(f)</external-xref>, 793(d), and 794(d)), are each amended by adding after <quote>title I of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12111">42 U.S.C. 12111 et seq.</external-xref>)</quote> the following: <quote>, including the standards of causation or methods of proof applied under section 102(e) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12112">42 U.S.C. 12112(e)</external-xref>),</quote>.</text></paragraph>
<paragraph id="H4974C6A835B84BE28BAA0473FC55951E"><enum>(2)</enum><header>Federal employees</header><text>The amendment made by paragraph (1) to section 501(f) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/791">29 U.S.C. 791(f)</external-xref>) shall be construed to apply to all employees covered by section 501 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/29/791">29 U.S.C. 791</external-xref>).</text></paragraph></subsection></section> <section id="HE937216D0CBC43D9B4AE0C694D840EDE"><enum>3.</enum><header>Application</header><text display-inline="no-display-inline">This Act, and the amendments made by this Act, shall apply to all claims pending on or after the date of enactment of this Act.</text></section>
<section id="H44E77BBF65604C97A9AA823AD6279DC3"><enum>4.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, an amendment made by this Act, or the application of such provision or amendment to any person or circumstance is held to be unconstitutional, the remainder of this Act, the amendments made by this Act, and the application of the provisions of such to any person or circumstance shall not be affected thereby.</text></section> </legis-body> </bill>
