<section id="H5C8AC674106A4E169E435E463CFDFB3A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Kidney Donation Anti-Discrimination Act</short-title></quote>.</text></section> <section id="HE54A1E1D8B7A412C821891481A913689"><enum>2.</enum><header>Discrimination based on living kidney donor status</header> <subsection id="H0F4B9D117A454685B83FFC7C3F005288"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be unlawful to discriminate against a living kidney donor, in the offering, issuance, cancellation, price or conditions of a life insurance policy, or in the amount of coverage provided under a life insurance policy, based solely on the status of such person as a living kidney donor, without evidence of additional actuarial risks, unrelated to their donation.</text></subsection> 
<subsection id="HA94E3975BAA64C8C8FBE68EA64EE0C74"><enum>(b)</enum><header>Private right of action</header><text display-inline="yes-display-inline">A person who suffers harm as a result of a violation of subsection (a) may bring an individual action against the entity who discriminated against such person in the appropriate district court of the United States for damages and attorney’s fees.</text></subsection> <subsection id="H0666E513855D46DB86A1A50730F4FB70"><enum>(c)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to preempt any State or local law that provides greater protection to living kidney donors with respect to life insurance than this section does.</text></subsection> 
<subsection id="H0F4A5B53A33E4477B367469A09A21EFB"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H36D81B543E5B45EBBDE12ABC97BC3108"><enum>(1)</enum><header>Life insurance policy</header><text>The term <term>life insurance policy</term> means a contract under which an entity promises to pay a designated beneficiary a sum of money upon the death of the insured.</text></paragraph> 
<paragraph id="H61A9623AE2DD4064970059E05C03A542"><enum>(2)</enum><header>Living kidney donor</header><text display-inline="yes-display-inline">The term <term>living kidney donor</term> means an individual who has donated a kidney and is not deceased.</text></paragraph></subsection></section> </legis-body></bill>
