<section id="H08CF2D069938425DB0C1C27EF4C6BBB6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Outdoor Recreational Outfitting and Guiding Act</short-title></quote>.</text></section> <section id="HC341BA07C5564C9C8CA120583EDEC091"><enum>2.</enum><header>Exemption with respect to certain employees engaged in outdoor recreational outfitting or guiding services</header><text display-inline="no-display-inline">Section 13(a) of the Fair Labor Standards Act (<external-xref legal-doc="usc" parsable-cite="usc/29/213">29 U.S.C. 213(a)</external-xref>) is amended by inserting after paragraph (1) the following:</text> 
<quoted-block display-inline="no-display-inline" id="HC0B895D9852E440C8EE3F5B246835A5C" style="OLC"> 
<paragraph id="H415625DE1E8B47D2A268D4228B3B2209"><enum>(2)</enum><text display-inline="yes-display-inline">any employee primarily engaged in outdoor recreational outfitting (including equipment rentals) or guiding services, and employed by a business providing such outfitting or services, that—</text> <subparagraph id="HEE18EEAE403440928D0874BF91A2E68D"><enum>(A)</enum><text>does not operate for more than seven months in any calendar year; or</text></subparagraph> 
<subparagraph id="H9A7C6D70F3DA4B9FA8714633A0C040E8"><enum>(B)</enum><text display-inline="yes-display-inline">had average receipts for any six months of the preceding calendar year that were not more than 33<fraction>1/3</fraction> per centum of its average receipts for the other six months of such year; or</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H2DB6352B851845338F7D69026A0B73BC"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendment made by this Act shall apply with respect to wages and overtime compensation required to be paid for workweeks beginning on or after the date of enactment of this Act.</text></section>
