          Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to establish an online program through which an employee of the Department of Veterans Affairs may schedule an appointment for a covered veteran with a non-Department health care provider under the Veterans Community Care Program, and for other purposes.</official-title></form><legis-body id="HFDFFB4AE55B44769A9B18339D9364E1C" style="OLC"> 
<section id="H5D28FAEA766B4F16BD8E3297F1894204" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Community Care Scheduling Improvement Act</short-title></quote>.</text></section> <section id="HF35369F853BD4747A1F806285F55F322" section-type="subsequent-section"><enum>2.</enum><header>Scheduling of appointments under the Veterans Community Care Program</header> <subsection id="H271E8EC6169745479657D0B1F856B06A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3101 of the Johnny Isakson and David P. Roe, M.D. Veterans Health Care and Benefits Improvement Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/315">Public Law 116–315</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/1701">38 U.S.C. 1701</external-xref> note) is amended by striking subsection (d) and inserting the following new subsection (d):</text> 
<quoted-block style="OLC" id="H14F5E7B7635E434EBFC2F2C7AE6B84F0" display-inline="no-display-inline"> 
<subsection id="H9D7B5C59C2E5405AA38A2B2F883995F5"><enum>(d)</enum><header>Program on scheduling appointments with Community Care providers by employees of the Department through information technology system</header> 
<paragraph id="H696153242D564D8B801AED65D0E86BB1" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of the <short-title>Veterans Community Care Scheduling Improvement Act</short-title>, the Secretary shall, instead of the process under subsection (a), carry out a program through which a scheduler of the Department—</text> <subparagraph id="H652C7D2E2EF74D71B9730A4DF0BBC217" indent="up1"><enum>(A)</enum><text>may schedule, for a veteran, an appointment—</text> 
<clause id="H27912E0CE8D04E83A1AB663381E74DCC"><enum>(i)</enum><text>for health care furnished through the Veterans Community Care Program; and</text></clause> <clause id="HAFC4B914C5354350B6613FC8AD63E9CC"><enum>(ii)</enum><text display-inline="yes-display-inline">offered by a non-Department health care provider that participates in the Veterans Community Care Program and elects to participate in the program under this subsection; and</text></clause></subparagraph> 
<subparagraph id="HD31B7D4E59FA4198BC0A27299F33DF99" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">using an information technology system.</text> </subparagraph></paragraph> <paragraph id="HDC656BE8A1264A398FC071C484E0378B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall carry out the program under this subsection through an existing agreement if practicable.</text></paragraph> 
<paragraph id="H5890BB381C674CDA914E8C685ADEB099" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The program under this subsection shall, with regards to an appointment available with a Department provider or a non-Department provider that participates in the Veterans Community Care Program, allow a scheduler—</text> <subparagraph id="H46495BD18FD240ED9DC10ACD1E47271B"><enum>(A)</enum><text display-inline="yes-display-inline">to view, search, and sort such appointments by type of care, location, and date;</text></subparagraph> 
<subparagraph id="HDE02C4BA87C14826A2932F899FBE6071"><enum>(B)</enum><text display-inline="yes-display-inline">to schedule such an appointment;</text></subparagraph> <subparagraph id="H1C5920B60A4A44A38837EAB10F0DE544"><enum>(C)</enum><text>to provide referral or authorization documents directly to a non-Department provider; and</text></subparagraph> 
<subparagraph id="HF789773A618B4E41AC62DCC9FAB88AEA"><enum>(D)</enum><text>to perform any other function the Secretary determines necessary.</text></subparagraph></paragraph> <paragraph id="HA1B0775F416742F08289DEA49DE09E1F" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of the <short-title>Veterans Community Care Scheduling Improvement Act</short-title>, the Secretary shall prescribe regulations under this subsection. Such regulations shall include a directive to employees at medical centers of the Department to use the information technology system under this subsection to schedule appointments described in paragraph (1) instead of the process under subsection (a) whenever practicable.</text> </paragraph> 
<paragraph id="H4A95EC48C47A4EF99063927B75133B73" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of the <short-title>Veterans Community Care Scheduling Improvement Act</short-title>, the Secretary shall plan and carry out an outreach campaign to encourage non-Department providers that participate in the Veterans Community Care Program to participate in the program under this subsection. Such outreach shall include the publication of a publicly accessible website of the Department regarding—</text> <subparagraph id="HD9B0CF9FBDD94C98BADAC90381BDAB96"><enum>(A)</enum><text>details of the program;</text></subparagraph> 
<subparagraph id="HFD59D96592024DCC9F5BA0D5A490B6A6"><enum>(B)</enum><text>how a provider may elect to participate in the program; and</text></subparagraph> <subparagraph id="H2535717D83ED492E97BC04BB81CB1E3B"><enum>(C)</enum><text>a point of contact in the Department regarding the program.</text> </subparagraph></paragraph> 
<paragraph id="HCA10896A880E40F6926F1D9B612D26EA" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">The Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives the following documents regarding the program under this subsection:</text> <subparagraph id="H9620E063BA8040E4968E9A34771B0DC0"><enum>(A)</enum><text display-inline="yes-display-inline">Not later than 30 days after each determination described in paragraph (3)(D), a report regarding each function described in such subparagraph.</text></subparagraph> 
<subparagraph id="H6CAA584A186C4699B958C372FA912408"><enum>(B)</enum><text display-inline="yes-display-inline">Not later than 30 days after prescription, a copy of the regulations prescribed under paragraph (4).</text></subparagraph> <subparagraph id="HD047823A33254EF69BE7F1B5025CA509"><enum>(C)</enum><text display-inline="yes-display-inline">Not later than 30 days after the Secretary formulates the plan under paragraph (5), a copy of such plan.</text></subparagraph> 
<subparagraph id="H5C2A2ACC1E6644159078B13F82117551"><enum>(D)</enum><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of the <short-title>Veterans Community Care Scheduling Improvement Act</short-title> and every six months thereafter during the following five years, a report regarding operation of such program during the six months preceding the date of the report. Such a report shall include the following:</text> <clause id="H366BD64F59E6452994652C23D0716360" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">The number of non-Department health care providers who participated in such program.</text></clause> 
<clause id="H1237E9B77D2645548063DD8E101ADF3F"><enum>(ii)</enum><text display-inline="yes-display-inline">The number of appointments under the Veterans Community Care Program, scheduled by a scheduler of the Department, disaggregated by—</text> <subclause id="H6687ED41CA8243E9B91E6A20DCAC6025"><enum>(I)</enum><text display-inline="yes-display-inline">whether the appointment was scheduled under such program or by the process under subsection (a);</text></subclause> 
<subclause id="HC96C14CD2B38472CAAF129CE8F9F8CC5"><enum>(II)</enum><text display-inline="yes-display-inline">category of medical services provided; and</text></subclause> <subclause id="HACE555EC3F544E57BE67CE38D9EEB6E5"><enum>(III)</enum><text>month.</text></subclause></clause></subparagraph> </paragraph> 
<paragraph id="H95DA359E474E4C3F9350BE3AE59B68C7" indent="up1"><enum>(7)</enum><text>The program under this subsection shall terminate seven years after the date of the enactment of the <short-title>Veterans Community Care Scheduling Improvement Act</short-title>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HBC5157F056944591BA4F0BC96BDFF618"><enum>(b)</enum><header>Codification</header> <paragraph id="H5B04DCDB187C4517BB2FC3C220B93B50"><enum>(1)</enum><header>In general</header><text>Section 3101 of such Act, as amended by subsection (a), is transferred to subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code, inserted after section 1703G, and redesignated as section 1703H.</text></paragraph> 
<paragraph id="H470A8301607E4027B10C65DD14630A20"><enum>(2)</enum><header>Conforming amendments</header><text>Section 1703H of such title, as added by this section, is amended—</text> <subparagraph id="H66A42E3D1A5F4600865886FE6C3BAB90"><enum>(A)</enum><text display-inline="yes-display-inline">by striking any heading that is not a section heading or subsection heading and conforming the margins accordingly;</text></subparagraph> 
<subparagraph id="H72DA2875EFD54B72AA56922CC9043BD7"><enum>(B)</enum><text>by striking <quote>of title 38, United States Code</quote> both places it appears and inserting <quote>of this title</quote>;</text></subparagraph> <subparagraph id="H10293D74E0C6455DAEAC9C01FCE29EA4"><enum>(C)</enum><text>in subsection (a)(1)—</text> 
<clause id="H126D2476DD2C41329EF0D9222D4E8220"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>Not later than 60 days after the date of the enactment of this Act, the Secretary of Veterans Affairs</quote> and inserting <quote>The Secretary</quote>; and</text></clause> <clause id="HF890363EB074423A9E9EBDB803BB1DC2"><enum>(ii)</enum><text>in subparagraph (A), by striking <quote>Department of Veterans Affairs</quote> and inserting <quote>Department</quote>;</text></clause></subparagraph> 
<subparagraph id="H74754497BD964A5FAE34341D410F4F54"><enum>(D)</enum><text>in subsection (b)(1), by striking <quote>Not later than one year after the date of the enactment of this Act, the Secretary</quote> and inserting <quote>The Secretary</quote>;</text></subparagraph> <subparagraph id="HF91628BD32A24C8CA1B0DFF5E6ED0F61"><enum>(E)</enum><text>in subsection (c)—</text> 
<clause id="H5FD04580C29C4622BD3870A6AAE15350"><enum>(i)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>Not later than 180 days after the date of the enactment of this Act, the Secretary</quote> and inserting <quote>The Secretary</quote>; and</text></clause> <clause id="H1D821414FB174988BE22D20F4858F1A7"><enum>(ii)</enum><text>in paragraph (2), by striking subparagraphs (A) and (B) and inserting <quote>The Secretary shall require each medical facility of the Department to use the method or tool described in paragraph (1).</quote>;</text></clause></subparagraph> 
<subparagraph id="HD0238B6D961D4C6293426F8FBC72C286"><enum>(F)</enum><text>in the section enumerator, by striking <quote><header-in-text level="section" style="OLC">Sec.</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">§</header-in-text></quote>; and</text></subparagraph> <subparagraph id="H9EAD1E43426F4147B57BDD56E8FE5195"><enum>(G)</enum><text>in the section heading—</text> 
<clause id="H3516D844462B452AADE79EE8F41915F5"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="section" style="OLC">Process and requirements for scheduling appointments for health care from Department of Veterans Affairs and non-Department health care.</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Scheduling of appointments</header-in-text></quote>; and</text></clause> <clause id="HD82A8067D7F4450CA697823AE10071BD"><enum>(ii)</enum><text display-inline="yes-display-inline">by conforming the typeface and typestyle, including capitalization, to the typeface and typestyle used in the section heading of section 1703G of such title.</text></clause></subparagraph></paragraph> 
<paragraph id="H22815B0EC8BA447F8CFEA04E1773708D"><enum>(3)</enum><header>Table of sections</header><text>The table of sections at the beginning of such chapter is amended by inserting, after the item relating to section 1703G, the following new item:</text> <quoted-block style="USC" id="H0CA72AB262A44F2C9636A80820CCF134" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">1703H.
