          <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and
        in addition to the Committee on <committee-name committee-id="HVR00">Veterans'
          Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in
        each case for consideration of such provisions as fall within the jurisdiction of the
        committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Housing Act and title 38, United States
 Code.</official-title></form><legis-body id="HECDB75460EAC48AE94750479FB70279D" style="OLC"><section id="H8E06806684A34647A4AA1A7045D7624E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housing Stability for Dreamers Act</short-title></quote>.</text></section><section id="H1FE9217C78C94BFE86BC4B1BD9E4C51A"><enum>2.</enum><header>DACA recipient eligibility</header><subsection id="H7ED3E160165D4D30BAFECDA86E450E75"><enum>(a)</enum><header>FHA</header><text display-inline="yes-display-inline">Section 203 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709</external-xref>) is amended by inserting after subsection (h) the following:</text><quoted-block display-inline="no-display-inline" id="HDA2EFF2BE1094DEAA3F3D6DF21036932" style="OLC"><subsection id="H63FF99318C1C4B04B4FF70ECC4D73D43"><enum>(i)</enum><header>DACA recipient eligibility</header><paragraph id="HCB032CF19EDB4023A2C2FD0BF979EC95"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may not—</text><subparagraph id="HA310EEE1B5E94C55917D55B9BE856D42"><enum>(A)</enum><text>prescribe terms that limit the eligibility of a single family mortgage for insurance under this title based in whole or in part on the status of the mortgagor as a DACA recipient; or</text></subparagraph><subparagraph id="H05EF05E29485472E8660C2549B97A894"><enum>(B)</enum><text display-inline="yes-display-inline">issue any limited denial of participation in the program for such insurance based in whole or in part on the status of the mortgagor as a DACA recipient.</text></subparagraph></paragraph><paragraph id="HB90FB068681040D585B66D9BD3201DFE"><enum>(2)</enum><header>DACA recipient defined</header><text display-inline="yes-display-inline">For the purposes of this subsection, the term <term>DACA recipient</term> means an alien who, on the date of the enactment of this Act, is the recipient of deferred action pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children’ issued on June 15, 2012</quote>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HBE67A74BD5DE4A2486E7080609D46D47"><enum>(b)</enum><header>Rural Housing Service</header><text display-inline="yes-display-inline">Section 501 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1472">42 U.S.C. 1472</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H22EDBF1ADA404BF190B91CCE2A23F31F" style="OLC"><subsection id="H594D185F531143FDA2DF8075054A62C4"><enum>(k)</enum><header>DACA recipient eligibility</header><paragraph id="H53E50CD11B1D4EE1880353D9C7411755"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may not prescribe terms that limit eligibility for a single family mortgage made, insured, or guaranteed under this title because of the status of the mortgagor as a DACA recipient.</text></paragraph><paragraph id="HF2D9B761F30B4B6E8D342197419CD8AE"><enum>(2)</enum><header>DACA recipient defined</header><text display-inline="yes-display-inline">For the purposes of this paragraph, the term <term>DACA recipient</term> means an alien who, on the date of the enactment of this Act, is the recipient of deferred action pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7E943C0C77B4446681256BC54C166599"><enum>(c)</enum><header>Fannie Mae</header><text>Section 302(b) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1717">12 U.S.C. 1717(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H103D24DA7CE84C6DABE7CDFB11795415" style="OLC"><paragraph id="H65259516CA4343A5B775CB9299BB8502" indent="up1"><enum>(8)</enum><header>DACA recipient eligibility</header><subparagraph id="HC3D6A4829F7E407693B0CF57C6E07F3E"><enum>(A)</enum><header>In general</header><text>The corporation may not condition purchase of a single-family residence mortgage by the corporation under this subsection on the status of the borrower as a DACA recipient.</text></subparagraph><subparagraph id="H365E361234DB4BC88CBD1C0A791A18E7"><enum>(B)</enum><header>DACA recipient defined</header><text display-inline="yes-display-inline">For the purposes of this paragraph, the term <term>DACA recipient</term> means an alien who, on the date of the enactment of this Act, is the recipient of deferred action pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9A8D2B2F00A449AB915DC62CE9A6E2D1"><enum>(d)</enum><header>Freddie Mac</header><text>Section 305(a) of the Federal Home Loan Mortgage Corporation Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1454">12 U.S.C. 1454</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H5D625E9BC2974A6D9B8AA58520D60D53" style="OLC"><paragraph id="HC8C22104CE444291BF6D898D84FDBEED" indent="up1"><enum>(6)</enum><header>DACA recipient eligibility</header><subparagraph id="HA040D1E200A341A082DE31CFA0A01F69"><enum>(A)</enum><header>In general</header><text>The Corporation may not condition purchase of a single-family residence mortgage by the corporation under this subsection on the status of the borrower as a DACA recipient.</text></subparagraph><subparagraph id="H7616AFA94B2F486582BA52C3E2C70F21"><enum>(B)</enum><header>DACA recipient defined</header><text display-inline="yes-display-inline">For the purposes of this subsection, the term <term>DACA recipient</term> means an alien who, on the date of the enactment of this Act, is the recipient of deferred action pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H98F3FE662B0F449C8FD45D8199739F10" section-type="subsequent-section"><enum>3.</enum><header>DACA recipient eligibility</header><text display-inline="no-display-inline">Section 214(a) of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a</external-xref>) is amended—</text><paragraph id="H3546C8B418614D0FAE7661EDFD95659D"><enum>(1)</enum><text>in paragraph (6), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="HEEB825394B3E4B7A99D137A501233A16"><enum>(2)</enum><text>in paragraph (7), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H1E07237CC24245AD910DAD5E1F9D184E"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HC69B4DE8F5C245FFBF0DB237E983B614" display-inline="no-display-inline"><paragraph id="HDE3883139183461F95447057CFEBB17C"><enum>(8)</enum><text display-inline="yes-display-inline">an alien who, on the date of the enactment of this Act, is the recipient of deferred action pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H4F4304E6D41143E2AD492626ABAD870E"><enum>4.</enum><header>Clarification of eligibility of a veteran who is a DACA recipient for a housing loan guaranteed by the Secretary of Veterans Affairs</header><text display-inline="no-display-inline">Section 3702(a) of title 38, United States Code, is amended by adding at the end the following new paragraph:</text><quoted-block style="USC" id="H2FDF8FEBE4F64CEFB74EB33B706792E7" display-inline="no-display-inline"><paragraph id="H2AF5EB0B5B1848CE9E11A1420273763B" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">Whether a veteran described in paragraph (2) is a DACA recipient (as such term is defined in section 203 of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709</external-xref>)) shall not affect the veteran’s entitlement to housing loan benefits under this chapter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
