points system, to focus family-sponsored immigration on spouses and minor children, to eliminate the Diversity Visa Program, to set a limit on the number of refugees admitted annually to the United States, and for other purposes.</official-title></form><legis-body id="H56F9EAD510814726877F07A6687A4835" style="OLC"><section id="H2110675038204F428E8EDCCAD308C786" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Migration, Addressing Reform, and Talent Retention Act</short-title></quote> or the <quote><short-title>SMART Act</short-title></quote>.</text></section><section id="H62C9E3A135D845E0AA1A7291A11E6DA1"><enum>2.</enum><header>Elimination of Diversity Visa Program</header><subsection id="H83F9A1551F84438FB97F29722224CDDA"><enum>(a)</enum><header>In general</header><text>Section 203 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>) is amended by striking subsection (c).</text></subsection><subsection id="HF21A745029AF4BAE9FC5E574A344CDDC"><enum>(b)</enum><header>Technical and conforming amendments</header><paragraph id="H4FE6EEB1E4B246E6BB35B6DB84BF86AD"><enum>(1)</enum><header>Immigration and Nationality Act</header><text>The Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended—</text><subparagraph id="HED3F6A90C7614E40B875E98E21CDBE01"><enum>(A)</enum><text>in section 101(a)(15)(V), by striking <quote>section 203(d)</quote> and inserting <quote>section 203(c)</quote>;</text></subparagraph><subparagraph id="H6A7F68643BD04EFAB1A6A09E120A7C2A"><enum>(B)</enum><text>in section 201—</text><clause id="HFAB8C823CFB947FAA2F9F31B151A881C"><enum>(i)</enum><text>in subsection (a)—</text><subclause id="H524AE41F19A746309D1FB93D1A55A1B6"><enum>(I)</enum><text>in paragraph (1), by adding <quote>and</quote> at the end; and</text></subclause><subclause id="H87FF11DCD2B2474086E2CBE383D65F27"><enum>(II)</enum><text>by striking paragraph (3); and</text></subclause></clause><clause 203(c)</quote>.</text></subparagraph></paragraph><paragraph id="H3841CD97A91243F1B98E2E1AA583002E"><enum>(2)</enum><header>Immigrant investor pilot program</header><text>Section 610(d) of the Departments of Commerce, Justice, and State, the Judiciary, and Related Agencies Appropriations Act, 1993 (<external-xref legal-doc="public-law" parsable-cite="pl/102/395">Public Law 102–395</external-xref>) is amended by striking <quote>section 203(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(e)</external-xref>)</quote> and inserting <quote>section 203(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(d)</external-xref>)</quote>.</text></paragraph></subsection><subsection id="HCC74DC37F03A42F7A3C02744F843A2E8"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first fiscal year beginning on or after the date of the enactment of this Act.</text></subsection></section><section id="HED7AB273F37F4F369CF2F23165378050"><enum>3.</enum><header>Annual admission of refugees</header><text display-inline="no-display-inline">Section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>) is amended—</text><paragraph id="HC57580DAB6EC4B0898579B23A3478649"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsections (a) and (b);</text></paragraph><paragraph id="HCC731CD3C0054943BD74E3E250FB7180"><enum>(2)</enum><text>by redesignating subsection (e) as subsection (a);</text></paragraph><paragraph id="HC83770ADB1B54812B72AB861FDD09025"><enum>(3)</enum><text>by redesignating subsection (f) as subsection (e);</text></paragraph><paragraph id="H6144505D6A40450E8582EB1ECDA8E497"><enum>(4)</enum><text>by inserting after subsection (a), as redesignated, the following:</text><quoted-block display-inline="no-display-inline" id="HB0A6AF9A24404A188086A13DCDF7B724" style="OLC"><subsection id="H08CB5EED51C84F99BB1844BB854079F1"><enum>(b)</enum><header>Maximum number of admissions</header><paragraph id="HF9BDA08C371441EC8B0BA539EC554180"><enum>(1)</enum><header>In general</header><text>The number of refugees who may be admitted under this section in any fiscal year may not exceed 50,000.</text></paragraph><paragraph id="H79E8E5506431458C9DC870E9BD0429A6"><enum>(2)</enum><header>Asylees</header><text>The President shall annually enumerate the number of aliens who were granted asylum in the previous fiscal year.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HC57A4B4738A942AFA632F22DEBA472D8"><enum>(5)</enum><text>by striking <quote>Attorney General</quote> each place such term appears and inserting <quote>Secretary of Homeland Security</quote>.</text></paragraph></section><section id="HDF3A7AF2A2DD40809434E591F41F7B5D"><enum>4.</enum><header>Family-Sponsored immigration priorities</header><subsection id="H0252EAEE9FB742E4A3044158196292AE"><enum>(a)</enum><header>Immediate relative redefined</header><text display-inline="yes-display-inline">The Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended—</text><paragraph id="H43C866709FDE4248B4CA0AB4CCD16B4B"><enum>(1)</enum><text display-inline="yes-display-inline">in section 101(b)(1) (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(b)(1)</external-xref>), in the matter preceding subparagraph (A), by striking <quote>under twenty-one years of age who</quote> and inserting <quote>who is younger than 18 years of age and</quote>; and</text></paragraph><paragraph id="H3AD100E8135F4EB1A91D7E1566E0A7C3"><enum>(2)</enum><text display-inline="yes-display-inline">in section 201 (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>)—</text><subparagraph id="H6EA458B0632B4686884A7939C840C5E7"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b)(2)(A)—</text><clause id="HB636957677324FB997A3D0861F870BB7"><enum>(i)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>children, spouses, and parents of a citizen of the United States, except that, in the case of parents, such citizens shall be at least 21 years of age.</quote> and inserting <quote>children and spouse of a citizen of the United States.</quote>; and</text></clause><clause id="HD855A94F66ED4BFE9F0AA60006B0E840"><enum>(ii)</enum><text>in clause (ii), by striking <quote>such an immediate relative</quote> and inserting <quote>the immediate relative spouse of a United States citizen</quote>;</text></clause></subparagraph><subparagraph id="H1C15FF48AC4048588062D1E143DE236D"><enum>(B)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H59D2BA1980E44B569FDDBD48A3821165" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H306B2B4DBAC040F1AA2AF268488D975B"><enum>(c)</enum><header display-inline="yes-display-inline">Worldwide level of family-Sponsored immigrants</header><paragraph commented="no" display-inline="yes-display-inline" id="HCE6FB67EBD0E4E33A68C6A12111978DC"><enum>(1)</enum><text>The worldwide level of family-sponsored immigrants under this subsection for a fiscal year is equal to 88,000 minus the number computed under paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2B0E6A28C3574495A774C738EC5B77A4" indent="up1"><enum>(2)</enum><text>The number computed under this paragraph for a fiscal year is the number of aliens who were paroled into the United States under section 212(d)(5) in the second preceding fiscal year who—</text><subparagraph id="H3217454EAC6541D7AF86FB10FFE5770A"><enum>(A)</enum><text>did not depart from the United States (without advance parole) within 365 days; and</text></subparagraph><subparagraph id="H1109E34A1F444D629188F6D6FDB83C5E"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H8B636095274E487EB6557E5E78E00A92"><enum>(i)</enum><text>did not acquire the status of an alien lawfully admitted to the United States for permanent residence during the two preceding fiscal years; or</text></clause><clause id="H5840E5B0F83842A098CEFC309127FF8E" indent="up1"><enum>(ii)</enum><text>acquired such status during such period under a provision of law (other than subsection (b)) that exempts adjustment to such status from the numerical limitation on the worldwide level of immigration under this section.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H304358463ACE44C492FE84F15A102F69"><enum>(C)</enum><text>in subsection (f)—</text><clause id="HE2C1E9E94A9D48B38BF9DBEED0098130"><enum>(i)</enum><text>in paragraph (2), by striking <quote>section 203(a)(2)(A)</quote> and inserting <quote>section 203(a)</quote>;</text></clause><clause id="H3FD6B210D81649E99683934A4684402F"><enum>(ii)</enum><text>by striking paragraph (3);</text></clause><clause id="HA7FC496A141541D4834AC083F090067E"><enum>(iii)</enum><text>by redesignating paragraph (4) as paragraph (3); and</text></clause><clause id="HE09A061A74724B068D8579E908D0E3A6"><enum>(iv)</enum><text>in paragraph (3), as redesignated, by striking <quote>(1) through (3)</quote> and inserting <quote>(1) and (2)</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="H6F72B3C7BA0D4A24ADFDACE8E9CFF94F"><enum>(b)</enum><header>Family-Based visa preferences</header><text display-inline="yes-display-inline">Section 203(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(a)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HE54E904AA215419689601E6E538FF82F" style="OLC"><subsection id="H168861C1D8BA4E8E9E4255CD78A1552A"><enum>(a)</enum><header>Spouses and minor children of permanent resident aliens</header><text display-inline="yes-display-inline">Family-sponsored immigrants described in this subsection are qualified immigrants who are the spouse or a child of an alien lawfully admitted for permanent residence.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HBD64C3C13AC34F11B95F7EB1BC530D7F"><enum>(c)</enum><header>Conforming amendments</header><paragraph id="HEC199868B82042DE866C34D0B13131F5"><enum>(1)</enum><header>Definition of V nonimmigrant</header><text>Section 101(a)(15)(V) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(V)</external-xref>) is amended by striking <quote>section 203(a)(2)(A)</quote> each place such term appears and inserting <quote>section 203(a)</quote>.</text></paragraph><paragraph id="H34E348396D7B49328773417CE6AABCCE"><enum>(2)</enum><header>Numerical limitation to any single foreign state</header><text>Section 202 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152</external-xref>) is amended—</text><subparagraph id="H682DC7BC3ACE4B56B04F3DA606DF8E06"><enum>(A)</enum><text>in subsection (a)(4)—</text><clause id="H7C796E564ECB4507A3A1AB89B7670FDA"><enum>(i)</enum><text>by striking subparagraphs (A) and (B) and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H8E362BC68E8B4EEF96416F92CFCCA18C" style="OLC"><subparagraph id="H1D5E36D527674345A349C0A9E2479F68"><enum>(A)</enum><header>75 percent of family-sponsored immigrants not subject to per country limitation</header><text>Of the visa numbers made available under section 203(a) in any fiscal year, 75 percent shall be issued without regard to the numerical limitation under paragraph (2).</text></subparagraph><subparagraph id="HB53E3845D3BE42038BBC8C1CD31D5997"><enum>(B)</enum><header>Treatment of remaining 25 percent for countries subject to subsection <enum-in-header>(e)</enum-in-header></header><clause id="HD2EF74553FC141BD9708C5D8A2D8C8C2"><enum>(i)</enum><header>In general</header><text>Of the visa numbers made available under section 203(a) in any fiscal year, 25 percent shall be available, in the case of a foreign state or dependent area that is subject to subsection (e) only to the extent that the total number of visas issued in accordance with subparagraph (A) to natives of the foreign state or dependent area is less than the subsection (e) ceiling.</text></clause><clause id="HE520FC04317749EC866BEF17B065DBEA"><enum>(ii)</enum><header>Subsection <enum-in-header>(e)</enum-in-header> ceiling defined</header><text>In clause (i), the term <term>subsection (e) ceiling</term> means, for a foreign state or dependent area, 77 percent of the maximum number of visas that may be made available under section 203(a) to immigrants who are natives of the state or area, consistent with subsection (e).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="HDAEEDDBB064F45B78358E627103CEAAC"><enum>(ii)</enum><text>by striking subparagraphs (C) and (D); and</text></clause></subparagraph><subparagraph id="H4DE907D7AB524CE880950B40D2C19D57"><enum>(B)</enum><text>in subsection (e)—</text><clause id="H7814851671464C33B269F4C1D60E5E90"><enum>(i)</enum><text>in paragraph (1), by adding <quote>and</quote> at the end;</text></clause><clause id="H16F32BEDE1DA4553885A05DE654076F3"><enum>(ii)</enum><text>by striking paragraph (2);</text></clause><clause id="H1D1B7A85946C4565B487553B14926F69"><enum>(iii)</enum><text>by redesignating paragraph (3) as paragraph (2); and</text></clause><clause id="H58F4E33FAF624F31A155859B2A21E35F"><enum>(iv)</enum><text>in the undesignated matter after paragraph (2), as redesignated, by striking <quote>, respectively,</quote> and all that follows and inserting a period.</text></clause></subparagraph></paragraph><paragraph id="H210DEED41EB348C59B5CFC74FE21301B"><enum>(3)</enum><header>Rules for determining whether certain aliens are children</header><text>Section 203(h) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(h)</external-xref>) is amended by striking <quote>(a)(2)(A)</quote> each place such term appears and inserting <quote>(a)(2)</quote>.</text></paragraph><paragraph id="H8949284C42D04109A1EE229CC463C1D1"><enum>(4)</enum><header>Procedure for granting immigrant status</header><text>Section 204 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154</external-xref>) is amended—</text><subparagraph id="H38261F941F504F5E8CCBB5DCE07CBA68"><enum>(A)</enum><text>in subsection (a)(1)—</text><clause id="H9F3FE011E97C4B86AFF445695E1EC0FE"><enum>(i)</enum><text>in subparagraph (A)(i), by striking <quote>to classification by reason of a relationship described in paragraph (1), (3), or (4) of section 203(a) or</quote>;</text></clause><clause id="H0F9778CD1373404785E7DD9A81176AE8"><enum>(ii)</enum><text>in subparagraph (B)—</text><subclause id="HB37C2D989EB04D43837B1B1109F99992"><enum>(I)</enum><text>in clause (i), by redesignating the second subclause (I) as subclause (II); and</text></subclause><subclause id="HB1A7C5AD7A5B4E7E8D555122E482F992"><enum>(II)</enum><text>by striking <quote>203(a)(2)(A)</quote> each place such terms appear and inserting <quote>203(a)</quote>; and</text></subclause></clause><clause id="HD06BFD16585149E88BA348521189D622"><enum>(iii)</enum><text>in subparagraph (D)(i)(I), by striking <quote>a petitioner</quote> and all that follows through <quote>(a)(1)(B)(iii).</quote> and inserting <quote>an individual younger than 21 years of age for purposes of adjudicating such petition and for purposes of admission as an immediate relative under section 201(b)(2)(A)(i) or a family-sponsored immigrant under section 203(a), as appropriate, notwithstanding the actual age of the individual.</quote>;</text></clause></subparagraph><subparagraph id="H1C16718054AE4BDB89D399CEEB6FB2E9"><enum>(B)</enum><text>in subsection (f)(1), by striking <quote>, 203(a)(1), or 203(a)(3), as appropriate</quote>; and</text></subparagraph><subparagraph id="H9FC0683E07EA4427A9CC4F305DC0A5B4"><enum>(C)</enum><text>by striking subsection (k).</text></subparagraph></paragraph><paragraph id="H686C7015FDC64916B6F614D6A004A541"><enum>(5)</enum><header>Waivers of inadmissibility</header><text>Section 212 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) is amended—</text><subparagraph id="HF3653440F917457F94A0DB4AAD4D9E41"><enum>(A)</enum><text>in subsection (a)(6)(E)(ii), by striking <quote>section 203(a)(2)</quote> and inserting <quote>section 203(a)</quote>; and</text></subparagraph><subparagraph id="H27A81D24C79046DE9BF994DC78338121"><enum>(B)</enum><text>in subsection (d)(11), by striking <quote>(other than 1184</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HEDF7539AB2DB45669AFB2CBE6800DF91"><subsection id="HE6C26ABCA2D84A21A8FE970CE9BD2623"><enum>(s)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HFA6DBF9C29584C2B9018843468EBE1FD"><enum>(1)</enum><text>The initial period of authorized admission for a nonimmigrant described in section 101(a)(15)(W) shall be 5 years, but may be extended by the Secretary of Homeland Security for additional 5-year periods if the United States citizen son or daughter of the nonimmigrant is still residing in the United States.</text></paragraph><paragraph id="H1712DB412B864EB2BBE7E1AB5FA78EB9" indent="up1"><enum>(2)</enum><text>A nonimmigrant described in section 101(a)(15)(W)—</text><subparagraph id="HAB4D343BEDC0477A821F8885C66C9ADD"><enum>(A)</enum><text>is not authorized to be employed in the United States; and</text></subparagraph><subparagraph id="H268625270FB049F3BFC7E3582AB8678D"><enum>(B)</enum><text>is not eligible for any Federal, State, or local public benefit.</text></subparagraph></paragraph><paragraph id="H05FFD770016C4F3EA68E1F76DEA6B37F" indent="up1"><enum>(3)</enum><text>Regardless of the resources of a nonimmigrant described in section 101(a)(15)(W), the United States citizen son or daughter who sponsored the nonimmigrant parent shall be responsible for the nonimmigrant’s support while the nonimmigrant resides in the United States.</text></paragraph><paragraph id="H3B6245A2F51445648A999C54C15BC02D" indent="up1"><enum>(4)</enum><text>An alien is ineligible to receive a visa or to be admitted into the United States as a nonimmigrant described in section 101(a)(15)(W) unless the alien provides satisfactory proof that the United States citizen son or daughter has arranged for health insurance coverage for the alien, at no cost to the alien, during the anticipated period of the alien’s residence in the United States.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAA5DA78CDE17499BBA142BB8E0E8765B"><enum>(e)</enum><header>Effective date; applicability</header><paragraph id="H622D0851C6CC42D7A705E9BB9EBB2E69"><enum>(1)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the first day of the first fiscal year that begins after the date of the enactment of this Act.</text></paragraph><paragraph id="H0C498CB3871E4DDFB4F87F4EC522451A"><enum>(2)</enum><header>Invalidity of certain petitions and applications</header><text display-inline="yes-display-inline">Excepted as provided in paragraph (3), any petition under section 204 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154</external-xref>) seeking classification of an alien under a family-sponsored immigrant category that was eliminated by the amendments made by this section and filed after the date on which this Act was introduced and any application for an immigrant visa based on such a petition shall be considered invalid.</text></paragraph><paragraph id="HC559A520F613401782CB47B4BC3124B2"><enum>(3)</enum><header>Valid offer of admission</header><text>Notwithstanding the termination by this Act of the family-sponsored and employment-based immigrant visa categories, any alien who was granted admission to the United States under subsection (a) or (b) of section 203 of the Immigration and Nationality Act, as in effect on the day before the date of the enactment of this Act, and is scheduled to receive an immigrant visa in the applicable preference category not later than 1 year after the date of the enactment of this Act, shall be entitled to such visa if the alien enters the United States within 1 year after such date of enactment.</text></paragraph></subsection></section><section id="H9467B53E0974451DB014F6F5722B9CDE"><enum>5.</enum><header>Creation of immigration points system</header><subsection id="H083527CDD2A340C79F99BED1F2A82BFE"><enum>(a)</enum><header>Worldwide level of immigration</header><text>Section 201 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>) is amended—</text><paragraph id="H993C25AA93E94CA0A4A58566302A7E33"><enum>(1)</enum><text>in subsection (a), as amended by section 2(b)(1)(B), by amending paragraph (2) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H4870271B72914578AC003E7C4ED43DE0" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="H11BD5AA37227458482303F1C29473209"><enum>(2)</enum><text display-inline="yes-display-inline">points-based immigrants described in section 203(b), in a number not to exceed the number specified in subsection (d) during any fiscal year.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H4860EFE0D3994B0489B576B6AAB7B2F4"><enum>(2)</enum><text>by amending subsection (d) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H908F372190EC46EA98AF5A3BFBE7C428" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="H059686A706FD47F383DB98AF59090380"><enum>(d)</enum><header>Worldwide level of points-Based immigrants</header><paragraph commented="no" display-inline="no-display-inline" id="H5A85E195FCB9431DB44146C875CDC7E2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The worldwide level of points-based immigrant visas issued during any fiscal year may not exceed the sum of—</text><subparagraph id="H98591543EA744C47A8C43B4683BFE681" commented="no"><enum>(A)</enum><text>193,000; and</text></subparagraph><subparagraph id="HFC80E5B52632490E8708BC4C72BC62E0" commented="no"><enum>(B)</enum><text>the allocation adjustment calculated under paragraph (3); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF123DA7CCCC44D5C85EAF30B7B6DF864"><enum>(2)</enum><header>Effect of visas issued to spouses and children</header><text display-inline="yes-display-inline">The numerical limitation set forth in paragraph (1) shall include any visas issued pursuant to section 203(b)(3).</text></paragraph><paragraph id="HA2CE8D2584F4436BA6A4FE61C38ED177" display-inline="no-display-inline"><enum>(3)</enum><header>Allocation adjustment</header><subparagraph id="H774020C43B5A4B38AB6D338CDE8BDDBA" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text>If the number of cap-subject immigrant visa petitions approved under section 203(b) during the first 45 days petitions may be filed for a fiscal year is equal to the base allocation for such fiscal year, an additional 20,000 such visas shall be made available beginning on the 46th day on which petitions may be filed for such fiscal year.</text></subparagraph><subparagraph id="H6DC3F99030D74FAD9C71E3D6DFB6C9F1" display-inline="no-display-inline"><enum>(B)</enum><text>If the base allocation of cap-subject immigrant visa petitions approved under section 203(b) for a fiscal year is reached during the 15-day period ending on the 60th day on which petitions may be filed for such fiscal year, an additional 15,000 such visas shall be made available beginning on the 61st day on which petitions may be filed for such fiscal year.</text></subparagraph><subparagraph id="H4E46AE3F4A0841768769EA278DD6396C" display-inline="no-display-inline"><enum>(C)</enum><text>If the base allocation of cap-subject immigrant visa petitions approved under section 203(b) for a fiscal year is reached during the 30-day period ending on the 90th day on which petitions may be filed for such fiscal year, an additional 10,000 such visas shall be made available beginning on the 91st day on which petitions may be filed for such fiscal year.</text></subparagraph><subparagraph id="H7569E895CD4E433ABBB59F84EC5E352C" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">If the base allocation of cap-subject immigrant visa petitions approved under section 203(b) for a fiscal year is reached during the 185-day period ending on the 275th day on which petitions may be filed for such fiscal year, an additional 5,000 such visas shall be made available beginning on the date on which such allocation is reached.</text></subparagraph><subparagraph id="H25613F46519B4189B56648553CC45D1F" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">If the number of cap-subject immigrant visa petitions approved under section 203(b) for a fiscal year is at least 5,000 fewer than the base allocation, but is not more than 9,999 fewer than the base allocation, the allocation adjustment for the following fiscal year shall be −5,000.</text></subparagraph><subparagraph id="H9E36F318B4DF4538BCFFB4E07F847568" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">If the number of cap-subject immigrant visa petitions approved under section 203(b) for a fiscal year is at least 10,000 fewer than the base allocation, but not more than 14,999 fewer than the base allocation, the allocation adjustment for the following fiscal year shall be −10,000.</text></subparagraph><subparagraph id="H48B1877C486A47698E0F77534526C2CB" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">If the number of cap-subject immigrant visa petitions approved under section 203(b) for a fiscal year is at least 15,000 fewer than the base allocation, but not more than 19,999 fewer than the base allocation, the allocation adjustment for the following fiscal year shall be −15,000.</text></subparagraph><subparagraph id="HA4186B855B8746ADB05E4C9F8EC1C0D6" display-inline="no-display-inline"><enum>(H)</enum><text display-inline="yes-display-inline">If the number of cap-subject immigrant visa petitions approved under section 203(b) for a fiscal year is at least 20,000 fewer than the base allocation, the allocation adjustment for the following fiscal year shall be −20,000.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5D4DAAB4EB8C4639B3FFD8C36516CBBD"><enum>(b)</enum><header>Numerical limitations on individual foreign states</header><text>Section 202(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152(a)</external-xref>) is amended—</text><paragraph id="H81311703981242A38E3A48C9F98AA581"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="H4ACB80FAD5534B8F88A9B653DF92EBF7"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">and employment-based</header-in-text></quote>;</text></subparagraph><subparagraph id="HB5AEA85DF75044ECAE2A9C9D3A0D0F58"><enum>(B)</enum><text>by striking <quote>paragraphs (3), (4), and (5)</quote> and inserting <quote>paragraphs (3) and (4)</quote>; and</text></subparagraph><subparagraph id="H371C19944B004AF78A37F30ED17D7ACA"><enum>(C)</enum><text>by striking <quote>subsections (a) and (b)</quote> and inserting <quote>subsection (a)</quote>;</text></subparagraph></paragraph><paragraph id="H77C41F726AF247A98D61665E95DB870A"><enum>(2)</enum><text>in paragraph (3), by striking <quote>both subsections (a) and (b)</quote> and inserting <quote>subsection (a)</quote>; and</text></paragraph><paragraph id="HF9B3DBA5E6E54213BABFFEABE53F5810"><enum>(3)</enum><text>by striking paragraph (5).</text></paragraph></subsection><subsection id="HC81CF4B992094D58B920847ABF29F0E2"><enum>(c)</enum><header>Application process for points-Based immigrants</header><text>Section 203 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>) is amended—</text><paragraph id="H1E17C0F3122E444AA08163CCA85346F5"><enum>(1)</enum><text>by amending subsection (b) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H2F12CDDDF29B473F904612582A84D97F" style="OLC"><subsection id="H84D0D503456049B2B5D04C5787AA628B"><enum>(b)</enum><header>Application process for points-Based immigrant visas</header><paragraph id="H5BFC4131B3374D34A67DA73097FD69BF"><enum>(1)</enum><header>Eligibility screening</header><subparagraph id="HBCC957B61076409487CB215B4DB6DC28"><enum>(A)</enum><header>Application submission</header><text>Any alien seeking to immigrate to the United States who believes that he or she meets the points requirement set forth in section 220 may submit an online application to U.S. Citizenship and Immigration Services for placement in the eligible applicant pool.</text></subparagraph><subparagraph id="H55A2E1653033439DB11C37BE29558C55"><enum>(B)</enum><header>Application elements</header><text>Each application submitted under subparagraph (A) shall include—</text><clause id="HBB73DE6AC3A04E02A8A3BDA6D6E4AEE4"><enum>(i)</enum><text>the identification of the points for which the applicant is eligible under section 220;</text></clause><clause id="H3B7F62BB614148058F420F8CD8E901FE"><enum>(ii)</enum><text>an attestation by the applicant, under penalty of disqualification, that the applicant has sufficient documentation to verify the points claimed under clause (i);</text></clause><clause id="H002674BE5AA241CF92DF5D7BFF9574D8"><enum>(iii)</enum><text>the electronic submission of an application fee in the amount of $160; and</text></clause><clause id="HCE7217E584BD4E7EB0C097A6B40289CB"><enum>(iv)</enum><text>any other information required by the Director of U.S. Citizenship and Immigration Services, by regulation.</text></clause></subparagraph><subparagraph id="H422E16D4F291457FB8679E397966527A"><enum>(C)</enum><header>Eligible applicant pool</header><clause id="HD04A04546A314FC6A72F0D110D1A7A2D"><enum>(i)</enum><header>In general</header><text>Each application that meets the points requirement set forth in section 220 shall be placed in an eligible applicant pool, which shall be sorted by total points.</text></clause><clause id="HE5C92CB0B56B455DAAFDFA0778417998"><enum>(ii)</enum><header>Tie-breaking factors</header><text>Applications with equal points will be sorted based on the following tie-breaking factors:</text><subclause id="H23D116FDEF0B4E40BEBB789969DD331B"><enum>(I)</enum><text>Applicants whose highest educational degree is a doctorate degree (or equivalent foreign degree) shall be ranked higher than applicants whose highest educational degree is a professional degree (as defined in section 220(a)) or equivalent foreign degree, who shall be ranked higher than applicants whose highest educational degree is a master’s degree (or equivalent foreign degree), who shall be ranked higher than applicants whose highest educational degree is a bachelor’s degree (or equivalent foreign degree), who shall be ranked higher than applicants whose highest educational degree is a high school diploma (as defined in section 220(a)) or equivalent foreign diploma, who shall be ranked higher than applicants without a high school diploma, with United States degrees ranked higher than their foreign counterparts.</text></subclause><subclause id="H083DD7D80844402E92DBFD4B8DE1476A"><enum>(II)</enum><text>Applicants with equal points and equal educational attainment shall be ranked according to their respective English language proficiency test rankings (as defined in section 220(a)).</text></subclause><subclause id="HA8433333C2164C188959EB832D3EABFA"><enum>(III)</enum><text>Applicants with equal points, equal educational attainment, and equal English language proficiency test rankings shall be ranked according to their age, with applicants who are nearest their 25th birthdays being ranked higher.</text></subclause></clause></subparagraph><subparagraph id="H0356C67449D44DCE876847C35779BACE"><enum>(D)</enum><header>Duration</header><text>Applications shall remain in the eligible applicant pool for 12 months. An applicant who is not invited to apply for a point-based immigrant visa during the 12-month period in which the application remains in the eligible applicant pool may reapply for placement in the eligible applicant pool.</text></subparagraph></paragraph><paragraph id="H6005DC2D11F14D858CE586A9768069EC"><enum>(2)</enum><header>Visa petition</header><subparagraph id="H9A952206C9D042F8B717885398C8EA3B"><enum>(A)</enum><header>Invitation</header><text>Every 6 months, the Director of U.S. Citizenship and Immigration Services shall invite the highest ranked applicants in the eligible applicant pool, in a number that is expected to yield 50 percent of the point-based immigrant visas authorized under section 201(d) for the fiscal year, including spouses and dependent children accompanying or following to join the principle alien, to file a petition for a points-based immigrant visa.</text></subparagraph><subparagraph id="H2DF0464B2B4F43ADADCC60B6CF394E01"><enum>(B)</enum><header>Petition elements</header><text>Subject to subparagraph (C), the Director of U.S. Citizenship and Immigration Services shall award a points-based immigrant visa to any applicant invited to file a petition under subparagraph (A) who, not later than 90 days after receiving such invitation, files a petition with the Director that includes—</text><clause id="HE4A1A9233716404299622CD08317C4A6"><enum>(i)</enum><text>valid documentation proving that the applicant is entitled to all of the points claimed in the application submitted pursuant to paragraph (1);</text></clause><clause id="HE0298A691F52479E8562315FCB522890"><enum>(ii)</enum><text>an attestation from the prospective employer, if applicable—</text><subclause id="H18065629895949608D245501E745E46A"><enum>(I)</enum><text>of the annual salary being offered to the applicant; and</text></subclause><subclause id="H54F94276490847C487135B89CDF9915C"><enum>(II)</enum><text>that the job being offered to the applicant is a new or vacant position that does not displace a United States worker;</text></subclause></clause><clause id="HAC29CF0B7C094391A3E08B2BDE05FC12"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H6529E82BFB524784A55B171862FC61D9"><enum>(I)</enum><text>proof that the applicant’s United States employer has secured health insurance that meet all applicable regulations; or</text></subclause><subclause id="HBA2C1A1B7E3F4BF3A53FCD822739C26A" indent="up1"><enum>(II)</enum><text>evidence that the applicant has posted a bond to be used to purchase the health insurance described in subclause (I); and</text></subclause></clause><clause id="H64DC4BF4FACB465C81CAD31D3F55A1F0"><enum>(iv)</enum><text>a fee in the amount of $345.</text></clause></subparagraph><subparagraph id="HEBDAC23BD48046ACA1126F360741AD1D"><enum>(C)</enum><header>Disposition of petitions exceeding the annual numerical limitation</header><text>If the Director receives a petition that complies with the requirements under subparagraph (B) after the numerical limitation set forth in section 201(d) has been reached for the applicable fiscal year, the Director shall—</text><clause id="HFFE1CC5B33AF4234A237D8CD146F2C08"><enum>(i)</enum><text>issue a points-based immigrant visa to the petitioner;</text></clause><clause id="H9F6D227C244C48CC8C5F88AA1591BD2D"><enum>(ii)</enum><text>delay the admission into the United States of the petitioner and his or her spouse and children, if applicable, until the first day of the following fiscal year; and</text></clause><clause id="HE38DC1D65F904402B34B95BCD9DDF75E"><enum>(iii)</enum><text>reduce the number of points-based immigrant visas that may be issued during the following fiscal year accordingly.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H156DB8730B404BC5B1A9A7604F06A5E8"><enum>(3)</enum><header display-inline="yes-display-inline">Visas for spouses and children</header><subparagraph commented="no" display-inline="no-display-inline" id="H62C988DAC56C4F67A01F3B025A12BE93"><enum>(A)</enum><header>Spouse</header><text display-inline="yes-display-inline">The legal spouse of an applicant under this subsection who is accompanying or following to join the applicant in the United States shall be issued a points-based immigrant visa under this section upon the approval of the spouse’s petition under paragraph (2).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8B05DCDEB1DD4FC7BC4590C2A826359F"><enum>(B)</enum><header>Minor children</header><text display-inline="yes-display-inline">Any children of an applicant under this subsection who have not reached 18 years of age as of the date on which a petition is filed under paragraph (2) and are accompanying or following to join the applicant in the United States shall be issued a points-based immigrant visa under this section upon the approval of the parent’s petition under paragraph (2).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H695CA69334D444CFAF62FB11C57CDC36"><enum>(C)</enum><header>Dependent adult children</header><text>Any adult child of an applicant under this subsection who is unable to care for himself or herself may be admitted into the United States, on a temporary basis, until he or she is capable to care for himself or herself, but may not be authorized to work in the United States or to receive any other benefits of permanent residence.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0C780D52730340DAA71542ABAA74F821"><enum>(4)</enum><header>Inflation adjustments</header><text display-inline="yes-display-inline">The Director shall adjust the amount of the fees required under paragraphs (1)(B)(iii) and (2)(B)(iv) every 2 years, as appropriate, to reflect inflation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0747855836204235A6AB419D15770E2F"><enum>(5)</enum><header>Ineligibility for public benefits</header><text display-inline="yes-display-inline">An alien who has been issued a points-based immigrant visa under this subsection, and every member of the household of such alien, shall not be eligible for any Federal means-tested public benefit (as defined and implemented in section 403 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1613">8 U.S.C. 1613</external-xref>)) during the 5-year period beginning on the date on which such visa was issued.</text></paragraph><paragraph id="H75EFBA0A7F2B41EAA76BF8B3A402642D"><enum>(6)</enum><header>Fee for expedited processing</header><text display-inline="yes-display-inline">The procedures under this subsection shall permit the expedited processing of visas for admission of aliens covered under a petition under this subsection upon the payment of a fee in an amount to be determined by the Secretary. </text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H8046427458574574BCDDE0D0ECF56F68"><enum>(2)</enum><text>in subsection (d)(1), as redesignated by section 2(b)(1)(C)(ii), by striking <quote>or (b)</quote>.</text></paragraph></subsection><subsection id="H283C8CDE4F674B29A56C634F16B79731"><enum>(d)</enum><header>Establishment of immigration points system</header><paragraph id="H52C767EC29E7421D802CDA637513F6AC"><enum>(1)</enum><header>In general</header><text>Chapter 2 of title II of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1181">8 U.S.C. 1181 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HC01B21912267467294632A7C739A307B" style="OLC"><section id="H623CF39160CB4C749D0278116A845139"><enum>220.</enum><header>Immigration points system</header><subsection id="H5BA01AC0B75640139B18641C472733BB"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H3C54FE609CD0461C83F8FFB54A91E1AB"><enum>(1)</enum><header>English language proficiency test</header><text>The term <term>English language proficiency test</term> means—</text><subparagraph id="H8E05F876CA8B454386C66E2473AFCAD0"><enum>(A)</enum><text>the International English Language Testing System (IELTS), as administered by a partnership between the British Council, IDP Education, and Cambridge English Language Assessment;</text></subparagraph><subparagraph id="H6A32AE2B3C4A49518A73E01EBBBDED26"><enum>(B)</enum><text>the Test of English as a Foreign Language (TOEFL), as administered by the Educational Testing Service; or</text></subparagraph><subparagraph id="H80BB13F36F7E42FE997AA825605A78E5"><enum>(C)</enum><text>any other test to measure English proficiency that has been approved by the Commissioner of U.S. Citizenship and Immigration Services for purposes of subsection (e) that meets the standards of English language ability measurement and anti-fraud integrity set by the IELTS or the TOEFL.</text></subparagraph></paragraph><paragraph id="H59DA070BB56643CFB41923D361490968"><enum>(2)</enum><header>English language proficiency test ranking</header><subparagraph id="H69C2384A425147ACBAAEB4E2E5409083"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term <term>English language proficiency test ranking</term> means the decile rank of the applicant’s English language proficiency test score, when compared with all of the other people who took the same test during the same period.</text></subparagraph><subparagraph id="H8359AD811D104F73874F97657529B697"><enum>(B)</enum><header>Adjustment</header><text>The Commissioner of U.S. Citizenship and Immigration Services, in consultation with the Secretary of Education, may adjust the decile rank of an applicant’s English language proficiency test score if the number of people taking such test is too small or unusually skewed to make such decile rank inconsistent with the decile rank the applicant would have received if he or she had taken the IELTS or TOEFL.</text></subparagraph></paragraph><paragraph id="HD612CE69416E494A8BD3BB264116D04D"><enum>(3)</enum><header>High school</header><text>The term <term>high school</term> has the meaning given such term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="H33D366E6F76C4C7885EB58730B9C309B"><enum>(4)</enum><header>IELTS</header><text>The term <term>IELTS</term> means the International English Language Testing System.</text></paragraph><paragraph id="HFE92312D6EB64FC5A1D54647167F8396"><enum>(5)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the same meaning given that term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="H7D03A3BDEB3442B0B1EEB8522BEADAD4"><enum>(6)</enum><header>Professional degree</header><text>The term <term>professional degree</term> includes the following degrees:</text><subparagraph commented="no" id="H62C388A9F8264B1D948498B32C27D246"><enum>(A)</enum><text>Master's of Business Administration.</text></subparagraph><subparagraph commented="no" id="H6D37E7ECE1354D59ABEA1A73CB78D921"><enum>(B)</enum><text>Doctor of Jurisprudence.</text></subparagraph><subparagraph commented="no" id="H59AE83A8A66E4D66A913CDDABDD96072"><enum>(C)</enum><text>Doctor of Medicine.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H25660D230C8149FEADADB4AF923E85ED"><enum>(7)</enum><header display-inline="yes-display-inline">STEM</header><text display-inline="yes-display-inline">The term <term>STEM</term> means the academic discipline of science, technology, engineering, or mathematics.</text></paragraph><paragraph id="HC6A9AE1CEEDC4A5C8B64326DE7205768"><enum>(8)</enum><header>TOEFL</header><text>The term <term>TOEFL</term> means the Test of English as a Foreign Language.</text></paragraph></subsection><subsection id="H068F79EE52A34FF5A824170F772F0E98"><enum>(b)</enum><header>In general</header><text>An alien is eligible to submit an application for placement in the eligible applicant pool under section 203(b)(1) if the applicant has accrued a total of 30 points under this section.</text></subsection><subsection id="HEDD76FBCB645452299835D79B112DC4C"><enum>(c)</enum><header>Age</header><paragraph id="H7DFCF98FDB704216A4A65A544ECD567B"><enum>(1)</enum><header>In general</header><text>An applicant may accrue points for age under this subsection based on the age of the applicant on the date on which the applicant submits an application under section 203(b)(1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC8CDF48CB666442FA429FDFBDD9BB58D"><enum>(2)</enum><header display-inline="yes-display-inline">Ages 0 through 17</header><text display-inline="yes-display-inline">An alien who has not reached 18 years of age may not submit an application under section 203(b)(1).</text></paragraph><paragraph id="H6CA2671746C34978AB446B4844C2BE69"><enum>(3)</enum><header>Ages 18 through 21</header><text>An applicant who is at least 18 years of age and younger than 22 years of age shall accrue 6 points.</text></paragraph><paragraph id="H8EE87D6729DF41A28933A5D40231EA47"><enum>(4)</enum><header>Ages 22 through 25</header><text>An applicant who is at least 22 years of age and younger than 26 years of age shall accrue 8 points.</text></paragraph><paragraph id="HEEB507C564524433BF28AE36E3BE801B"><enum>(5)</enum><header>Ages 26 through 30</header><text>An applicant who is at least 26 years of age and younger than 31 years of age shall accrue 10 points.</text></paragraph><paragraph id="HA49481BFEEF1486BA1F2FA15BF384FCF"><enum>(6)</enum><header>Ages 31 through 35</header><text>An applicant who is at least 31 years of age and younger than 36 years of age shall accrue 8 points.</text></paragraph><paragraph id="H780B15CDBC124036BAA51717B5CAA594"><enum>(7)</enum><header>Ages 36 through 40</header><text>An applicant who is at least 36 years of age and younger than 41 years of age shall accrue 6 points.</text></paragraph><paragraph id="HD8D5251DFFF0469D993848D4DD0F15A1"><enum>(8)</enum><header>Ages 41 through 45</header><text>An applicant who is at least 41 years of age and younger than 46 years of age shall accrue 4 points.</text></paragraph><paragraph id="HC2B30BCD117E4FF1AC907734A49D7337"><enum>(9)</enum><header>Ages 46 through 50</header><text>An applicant who is at least 46 years of age and younger than 51 years of age shall accrue 2 points.</text></paragraph><paragraph id="HBBC3946CA3104188AC6324C2B1FF7736"><enum>(10)</enum><header>Age 51 and older</header><text>An applicant who is at least 51 years of age may submit an application under section 203(b), but shall not accrue any points on account of age.</text></paragraph></subsection><subsection id="H419CC2EE517943848F836E6271B121E3"><enum>(d)</enum><header>Education</header><paragraph id="H9079788B2DAF4FD5BAE188A47AE63E4F"><enum>(1)</enum><header>In general</header><text>An applicant may only accrue points for educational attainment under this section based on the highest degree obtained by the applicant as of the date on which the applicant submits an application under section 203(b).</text></paragraph><paragraph id="HF119D4C9D6B844019884203A238C9D7B"><enum>(2)</enum><header>United states or foreign high school degree</header><text>An applicant whose highest degree is a diploma from a high school in the United States, or the foreign equivalent of such a degree, as determined by the Secretary of Education, shall accrue 1 point.</text></paragraph><paragraph id="HC277E2C514D54C6690D56CD2B1115E41"><enum>(3)</enum><header>Foreign bachelor’s degree</header><text>An applicant who has received the foreign equivalent of a bachelor’s degree from an institution of higher education, as determined by the Secretary of Education, but has not received a degree described in paragraphs (5) through (8), shall accrue 5 points.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF8950B17D87E4209B9ABF7BAEDD1F9DF"><enum>(4)</enum><header display-inline="yes-display-inline">United states bachelor’s degree</header><text display-inline="yes-display-inline">An applicant who has received a bachelor’s degree from an institution of higher education, but has not received a degree described in paragraphs (5) through (8), shall accrue 6 points.</text></paragraph><paragraph id="H58ABA1530D8E4E7BA47B218460A9DCD7"><enum>(5)</enum><header>Foreign master’s degree in STEM</header><text>An applicant whose highest degree is a master’s degree in STEM from a foreign college or university, approved by the Secretary of Education, shall accrue 7 points.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6A7CE2D82262444E8D3C750F953AFD9E"><enum>(6)</enum><header display-inline="yes-display-inline">United states master’s degree in STEM</header><text display-inline="yes-display-inline">An applicant whose highest degree is a master’s degree in STEM from an institution of higher education shall accrue 8 points.</text></paragraph><paragraph id="H9B4EF4EBE6434491A9AE09A1036064BF"><enum>(7)</enum><header>Foreign professional degree or doctorate degree in STEM</header><text>An applicant whose highest degree is a foreign professional degree or a doctorate degree in STEM, approved by the Secretary of Education, shall accrue 10 points.</text></paragraph><paragraph id="H2A09B78F7D66498D9CECB662C0BD1EBB"><enum>(8)</enum><header>United States professional degree or doctorate degree in STEM</header><text>An applicant whose highest degree is a United States professional degree or a doctorate degree in STEM from an institution of higher education shall accrue 13 points.</text></paragraph><paragraph id="H3580A2670DCF4BC5974CA9571E1B8172"><enum>(9)</enum><header>Approved foreign educational institutions and degrees</header><text>The Director of U.S. Citizenship and Immigration Services, in cooperation with the Secretary of Education, shall maintain and regularly update a list of foreign educational institutions and degrees that meet accreditation standards equivalent to those recognized by major United States accrediting agencies and are approved for the purpose of accruing points under this subsection.</text></paragraph></subsection><subsection id="HC28E198E614E4DD9AE673BA72EC911AF"><enum>(e)</enum><header>English language proficiency</header><paragraph id="H8C7C80EE200C4ABCB058E9F5CEC79990"><enum>(1)</enum><header>In general</header><text>An applicant may accrue points for English language proficiency in accordance with this subsection based on the highest English language assessment test ranking of the applicant as of the date on which the applicant submits an application under section 203(b).</text></paragraph><paragraph id="H7ECC385FEAA14C26AB1330CD30A77636"><enum>(2)</enum><header>1st through 5th deciles</header><text>An applicant whose English language proficiency test score is lower than the 6th decile rank shall not accrue any points under this subsection.</text></paragraph><paragraph id="H1B651991600F4AE896BF99FBC9247570"><enum>(3)</enum><header>6th and 7th deciles</header><text>An applicant whose English language proficiency test score is in the 6th or 7th decile ranks shall accrue 6 points.</text></paragraph><paragraph id="H7CCDBD8229124858B9B594318A151034"><enum>(4)</enum><header>8th decile</header><text>An applicant whose English language proficiency test score is in the 8th decile rank shall accrue 10 points.</text></paragraph><paragraph id="H33E8671AE5B6434D8B362D3B691F0A16"><enum>(5)</enum><header>9th decile</header><text>An applicant whose English language proficiency test score is in the 9th decile rank shall accrue 11 points.</text></paragraph><paragraph id="H321F561403134DFA8D72A84C0E8FF34C"><enum>(6)</enum><header>10th decile</header><text>An applicant whose English language proficiency test score is in the 10th decile rank shall accrue 12 points.</text></paragraph></subsection><subsection id="H8468EAD2A4704A298B8936F0E8B7D131"><enum>(f)</enum><header>Extraordinary achievement</header><text display-inline="yes-display-inline">An applicant may accrue, for extraordinary achievement under this subsection 25 points if the applicant is a Nobel Laureate or has received comparable recognition in a field of scientific or social scientific study, as determined by the Commissioner of U.S. Citizenship an. d Immigration Services.</text></subsection><subsection id="HDE61886F104745CCA409D629C0EF8864"><enum>(g)</enum><header>Job offer</header><paragraph id="H97CC1D6E1C444BB2A4005824938EC478"><enum>(1)</enum><header>In general</header><text>An applicant may accrue, for highly compensated employment under this subsection—</text><subparagraph id="H342BAF0BA3684521B2D8D240BE3E1D93"><enum>(A)</enum><text>5 points if the annual salary being offered by the applicant’s prospective employer is at least 150 percent of the median household income in the State in which the applicant will be employed, as determined by the Secretary of Labor, and less than 200 percent of such median household income;</text></subparagraph><subparagraph id="H2919CF5518FB4AE088618B733955B3C4"><enum>(B)</enum><text>8 points if the annual salary being offered by the applicant’s prospective employer is at least 200 percent of the median household income in the State in which the applicant will be employed, as determined by the Secretary of Labor, and less than 300 percent of such median household income; and</text></subparagraph><subparagraph id="HAE38C35F99B44F738DD7CB559EEC69DD"><enum>(C)</enum><text>13 points if the annual salary being offered by the applicant’s prospective employer is at least 300 percent of the median household income in the State in which the applicant will be employed, as determined by the Secretary of Labor.</text></subparagraph></paragraph><paragraph id="HDE44F3F4AF644E6486E9A83F954B7D60"><enum>(2)</enum><header>Requirement</header><text>An applicant may not be placed in the eligible applicant pool under section 203(b)(1) if—</text><subparagraph id="H26A9F19F0DBF4D949D62E6700A99FD11"><enum>(A)</enum><text>the applicant has not received a degree higher than a bachelor’s degree; and</text></subparagraph><subparagraph id="H6973E203C20248BFB77E7FC20D77A5C8"><enum>(B)</enum><text>the applicant does not accrue any points under paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="H6DB85FC7CE2146D1854B84466D4CED39"><enum>(h)</enum><header>Investment in, and active management of, new commercial enterprise</header><paragraph id="H7A9EE63918DA46A3839AE5B3B136B466"><enum>(1)</enum><header>In general</header><text>An applicant may accrue, for foreign investment under this subsection—</text><subparagraph id="HA0D8720BC5F5460B95B89B90FE48EA9C"><enum>(A)</enum><text>6 points if the applicant agrees to invest the equivalent of $1,350,000 in foreign currency in a new commercial enterprise in the United States, maintain such investment for at least 3 years, and play an active role in the management of such commercial enterprise as the applicant’s primary occupation; and</text></subparagraph><subparagraph id="HCA02D4361FCC4F4EBED3956202327682"><enum>(B)</enum><text>12 points if the applicant agrees to invest the equivalent of $1,800,000 in foreign currency in a new commercial enterprise in the United States, maintain such investment for at least 3 years, and play an active role in the management of such commercial enterprise as the applicant’s primary occupation.</text></subparagraph></paragraph><paragraph id="H60FC193DA06A41898B32249E5803A778"><enum>(2)</enum><header>Failure to maintain investment</header><text>A points-based immigrant visa issued under section 201(b) to an applicant who accrued points under this subsection shall be rescinded if the applicant fails to comply with the requirements under paragraph (1) for a period in excess of 1 year.</text></paragraph></subsection><subsection id="H5AE8B895C1B34ADF9042BDEC57DA5987"><enum>(i)</enum><header>Valid offer of admission under family preference category</header><text>Any alien who was granted admission to the United States under section 203(a) of the Immigration and Nationality Act, as in effect on the day before the date of enactment of this Act, shall be entitled to 2 points if—</text><paragraph id="H2C07EABC09EC4AF98A3B6242E887511A"><enum>(1)</enum><text>the applicant was scheduled to receive an immigrant visa under that preference category; and</text></paragraph><paragraph id="HD87BF972636F4A1F8BDE1265997A62DB"><enum>(2)</enum><text>the applicant did not receive an immigrant visa during the 1-year period beginning on the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H0D9735E7307642B19770266C6F03EA3F"><enum>(j)</enum><header>Dependent children</header><text>An applicant may accrue 2 points for each dependent child who will be accompanying or following to join the applicant in the United States.</text></subsection><subsection id="H09C1D6FBC3CA4C8DA00F6EA997C254B4"><enum>(k)</enum><header>Effect of spouse on accrual of points</header><paragraph id="H4EDFC36E0C674949AF7AF1C5B8D88E2D"><enum>(1)</enum><header>In general</header><text>If an applicant has a spouse who will be accompanying or following to join the applicant in the United States, the applicant will identify the points that the spouse would accrue under each of subsections (c) through (e) if he or she were applying for a points-based immigrant visa.</text></paragraph><paragraph id="HD16094BE6B0C464D9E052A6FFBEF7399"><enum>(2)</enum><header>Points adjustment</header><text>For each of the categories set forth in subsections (c) through (e)—</text><subparagraph id="HBCF92C94301A42138F085D4946A23B78"><enum>(A)</enum><text>if the number of points that would be accrued by the spouse is the same or higher as the points accrued by the applicant, the number of points shall not be adjusted;</text></subparagraph><subparagraph id="H3B084F58D2E340AC93C7127226CF249F"><enum>(B)</enum><text>if the number of points that would be accrued by the spouse is lower than the number of points accrued by the applicant, the number of points accrued by the applicant shall be adjusted so that it is equal to the sum of—</text><clause id="H572CAD22DD44459691CE33938E2D17AF"><enum>(i)</enum><text>the number of points accrued by the applicant under such category multiplied by 70 percent; and</text></clause><clause id="HDD2C6640DACF4BC0A3F88315C38B4ABD"><enum>(ii)</enum><text>the number of points accrued by the spouse under such category multiplied by 30 percent.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H984FFA497E3E42A688001C1E80CE26F1"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents for the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended by inserting after the item relating to section 219 the following:</text><quoted-block id="H37A9F4AE4980482AAA27D19B9DF269A2" style="OLC"><toc><toc-entry idref="H623CF39160CB4C749D0278116A845139" level="section">Sec. 220. Immigration points system.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE43447D977A44192B03656D972F91136"><enum>(e)</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, and annually thereafter, the Secretary of Homeland Security shall submit a report to Congress that includes, for the previous fiscal year—</text><paragraph id="HD8907789060A47E2A24A36DA0F51C55A"><enum>(1)</enum><text display-inline="yes-display-inline">the number of visas issued under section 203(b) of the Immigration and Nationality Act, as added by subsection (c), based on the Immigration Points System established under section 220 of such Act, as added by subsection (d);</text></paragraph><paragraph id="HEC02C373CF76487E8849C65A4B22DA5D"><enum>(2)</enum><text>with respect to the aliens placed in the eligible applicant pool under section 203(b)(1)(C) of such Act during the previous fiscal year—</text><subparagraph commented="no" display-inline="no-display-inline" id="H180DC60FC7FE4FFF8219EBE07A219113"><enum>(A)</enum><text display-inline="yes-display-inline">the percentage of such aliens seeking residence in each State;</text></subparagraph><subparagraph id="H2952F835B9E445EA98AAC1772304F1FB"><enum>(B)</enum><text>the percentage of such aliens in each of the educational attainment categories set forth in section 220(d) of such Act;</text></subparagraph><subparagraph id="HBE358BC0B608456A9029A06601BAFB40"><enum>(C)</enum><text>the percentage of such aliens in each of the English language proficiency categories set forth in section 220(e) of such Act;</text></subparagraph><subparagraph id="HB3C6C2A1D20F4F2584A28748D9DD14D9"><enum>(D)</enum><text>the initial United States employer of such aliens and the average starting annual salary offered by such employers in the United States; and</text></subparagraph><subparagraph id="H3B08F0BF3C4647D38601CD29A0E5A97F"><enum>(E)</enum><text>the number of such aliens agreeing to invest in a new commercial enterprise in the United States, and the percentage of such aliens in each of the categories set forth in section 220(h) of such Act; and</text></subparagraph></paragraph><paragraph id="HF60E1A67DA654359BBF7CA9F93858777"><enum>(3)</enum><text>with respect to the aliens invited to file a points-based immigrant visa petition pursuant to section 203(b)(2) of such Act, the statistics set forth in subparagraphs (A) through (E) of paragraph (2).</text></paragraph></subsection><subsection id="H4761E27B369C4BC0A2570D05BC599F93"><enum>(f)</enum><header>Quadrennial report</header><paragraph id="H4B0D67D58F564A83B54E9F5C81E85BE8"><enum>(1)</enum><header>In general</header><text>Not later than 4 years after the date of the enactment of this Act, and every 4 years thereafter, the Secretary of Homeland Security, in consultation with the Secretary of Labor, the Secretary of Commerce, and the Secretary of State, shall submit a report to the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> that includes any recommendations for revisions to the immigration points system set forth in section 220 of the Immigration and Nationality Act, as added by section 5(d)—</text><subparagraph id="H44A31155E4FA4CF7B1B2171A3ECB6B5C"><enum>(A)</enum><text>by reallocating points within or among the categories set forth in subsections (c) through (j) of such section; and</text></subparagraph><subparagraph id="H56748A1864D14BB4B5CC30F9BC85F320"><enum>(B)</enum><text>by adding or subtracting additional points categories.</text></subparagraph></paragraph><paragraph id="H3F736495F3954E538A2C8030D05C4ACC"><enum>(2)</enum><header>Criteria for recommendations</header><text>The recommendations included in the report required under paragraph (1) shall be designed to achieve the goals of—</text><subparagraph id="HB742348A191E4455A10B52F7043C9C51"><enum>(A)</enum><text>increasing per capita growth in the gross domestic product of the United States;</text></subparagraph><subparagraph id="H9961D87AA1224A73BD4B287B93573D04"><enum>(B)</enum><text>enhancing prospects for the economic success of immigrants issued points-based immigrant visas;</text></subparagraph><subparagraph id="H32D07CC485414FBF91C8CA0665D57131"><enum>(C)</enum><text>improving the fiscal health of the United States; Aliens who are subject to the numerical limitations of paragraph (1)(B)</quote>; and</text></clause></subparagraph><subparagraph id="HACFEF8ECABB64F5CB97DC4C222FB619D"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HFBBC2DE8ACCB41A58B8264096C1AF8AE" style="OLC"><paragraph id="HA6ACB87EFFD9429392CC0E3E8D62EA33" indent="up1"><enum>(12)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HC5541E7227F549FEA6CAE8B89FC0BF32"><enum>(A)</enum><text>The base allocation of nonimmigrant visas under section 101(a)(15)(H)(i)(b) for each fiscal year shall be equal to—</text><clause id="H2229ED6210014229A8C1F9860BEFBC56" indent="up1"><enum>(i)</enum><text>the sum of—</text><subclause id="H5961682A1BBB436587247042B10627F7"><enum>(I)</enum><text>the base allocation for the most recently completed fiscal year; and</text></subclause><subclause id="H194012F4F9C94F43AFF5930C2F96B747"><enum>(II)</enum><text>the allocation adjustment for the most recently completed fiscal year;</text></subclause></clause><clause id="HDEFA6879A55A4AA7856BB826400624CD" indent="up1"><enum>(ii)</enum><text>if the number calculated under clause (i) is less than 115,000, 115,000; or</text></clause><clause id="H7FEFFBFDA6954CF69D8E5B68B28EBA12" indent="up1"><enum>(iii)</enum><text>if the number calculated under clause (i) is more than 195,000, 195,000.</text></clause></subparagraph><subparagraph id="H5F2355A9492A421C8F7DB237CCFEBDE5" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H64D036BE17CA48019A6734DE30DFD2AA"><enum>(i)</enum><text>If the number of cap-subject nonimmigrant visa petitions approved under section 101(a)(15)(H)(i)(b) during the first 45 days petitions may be filed for a fiscal year is equal to the base allocation for such fiscal year, an additional 20,000 such visas shall be made available beginning on the 46th day on which petitions may be filed for such fiscal year.</text></clause><clause id="HC269DBAB4C914170B34A3D0B2CD48061" indent="up1"><enum>(ii)</enum><text>If the base allocation of cap-subject nonimmigrant visa petitions approved under section 101(a)(15)(H)(i)(b) for a fiscal year is reached during the 15-day period ending on the 60th day on which petitions may be filed for such fiscal year, an additional 15,000 such visas shall be made available beginning on the 61st day on which petitions may be filed for such fiscal year.</text></clause><clause id="HFC5B38C26A28479BBEED53532D6B9EC7" indent="up1"><enum>(iii)</enum><text>If the base allocation of cap-subject nonimmigrant visa petitions approved under section 101(a)(15)(H)(i)(b) for a fiscal year is reached during the 30-day period ending on the 90th day on which petitions may be filed for such fiscal year, an additional 10,000 such visas shall be made available beginning on the 91st day on which petitions may be filed for such fiscal year.</text></clause><clause id="H381C0E308A0D4B468F0F981E7C472E7E" indent="up1"><enum>(iv)</enum><text>If the base allocation of cap-subject nonimmigrant visa petitions approved under section 101(a)(15)(H)(i)(b) for a fiscal year is reached during the 185-day period ending on the 275th day on which petitions may be filed for such fiscal year, an additional 5,000 such visas shall be made available beginning on the date on which such allocation is reached.</text></clause><clause id="H5DA2569C93194D61ABE2E0290D93A0BC" indent="up1"><enum>(v)</enum><text>If the number of cap-subject nonimmigrant visa petitions approved under section 101(a)(15)(H)(i)(b) for a fiscal year is at least 5,000 fewer than the base allocation, but is not more than 9,999 fewer than the base allocation, the allocation adjustment for the following fiscal year shall be −5,000.</text></clause><clause id="HC93B6E659686416B9E249A3F5511C94C" indent="up1"><enum>(vi)</enum><text>If the number of cap-subject nonimmigrant visa petitions approved under section 101(a)(15)(H)(i)(b) for a fiscal year is at least 10,000 fewer than the base allocation, but not more than 14,999 fewer than the base allocation, the allocation adjustment for the following fiscal year shall be −10,000.</text></clause><clause id="H429264CBA526451DA2275991D93E1AC4" indent="up1"><enum>(vii)</enum><text>If the number of cap-subject nonimmigrant visa petitions approved under section 101(a)(15)(H)(i)(b) for a fiscal year is at least 15,000 fewer than the base allocation, but not more than 19,999 fewer than the base allocation, the allocation adjustment for the following fiscal year shall be −15,000.</text></clause><clause id="H7F2313297E2C47548A66F5C65E488BAF" indent="up1"><enum>(viii)</enum><text>If the number of cap-subject nonimmigrant visa petitions approved under section 101(a)(15)(H)(i)(b) for a fiscal year is at least 20,000 fewer than the base allocation, the allocation adjustment for the following fiscal year shall be −20,000.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H30A24CDC79094660B46D4F5311FE69E1"><enum>10.</enum><header>Gold-card immigrant visa program</header><subsection id="H004962C0CEF74590970C0A56B0387CBB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For each of fiscal years 2026 through 2035, 25,000 immigrant visas shall be made available for qualified immigrants seeking to enter the United States for the purpose of engaging in a new commercial enterprise (including a limited partnership)—</text><paragraph id="HCCB9D9867C7E406E99B00FED26B9E794"><enum>(1)</enum><text>in which such alien has invested (after the date of the enactment of this Act) or, is actively in the process of investing, capital in an amount not less than $5,000,000 and which is expected to remain invested for not less than 2 years; and</text></paragraph><paragraph id="HDB2172BF470848C69B69E6BBE0AC484E"><enum>(2)</enum><text>which will benefit the United States economy by creating full-time employment for not fewer than 10 United States citizens, United States nationals, or aliens lawfully admitted for permanent residence or other immigrants lawfully authorized to be employed in the United States (other than the immigrant and the immigrant's spouse, sons, or daughters).</text></paragraph></subsection><subsection id="HD66F5908E22F4023BB7BD8006B1309B7"><enum>(b)</enum><header>Numerical limitations </header><text display-inline="yes-display-inline">Visas described in this section are not subject to the worldwide levels or numerical limitations under the immigration laws.</text></subsection><subsection id="HA694172947634ED39963272DD084C1E8"><enum>(c)</enum><header>Definitions</header><text>In this section, the terms have the meanings given such terms in the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></subsection></section></legis-body></bill>
