which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food Security Act of 1985 with respect to the feral swine eradication and control program, and for other purposes.</official-title></form><legis-body id="H251963EDB05F4AE2B469AB63E8256F9D" style="OLC"><section id="H5D834F6CADC44BA597B8A630DBF259DB" section-type="section-one"><enum>1.</enum><header>Feral swine eradication and control program</header><subsection id="HD98E5A2C147D4BCA85E02BD20D26C184"><enum>(a)</enum><header>Feral swine eradication and control program</header><text display-inline="yes-display-inline">Chapter 5 of subtitle D of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839bb">16 U.S.C. 3839bb et seq.</external-xref>) is amended by inserting after section 1240M the following:</text><quoted-block style="OLC" id="HFEEC73636BE84EF78B03AF0C3D51E5B3" display-inline="no-display-inline"><section id="H28D18C259A39401AAFB2C0EFA133CD90"><enum>1240N.</enum><header>Feral swine eradication and control program</header><subsection id="HD9E36874798545F9B2867F82C4680015"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish a feral swine eradication and control program (in this section referred to as the <quote>program</quote>) to respond to the threat feral swine pose to agriculture, native ecosystems, and human and animal health.</text></subsection><subsection id="HE6908596F553408D97C4C44A41AC43DB"><enum>(b)</enum><header>Duties of the Secretary</header><text>In carrying out the program, the Secretary shall—</text><paragraph id="H85961B913A73476F89461BBE8FD9C4AF"><enum>(1)</enum><text>study and assess the nature and extent of damage to the threatened areas caused by feral swine;</text></paragraph><paragraph id="HFDB82E484EAB4ECFA064C7206D21B06A"><enum>(2)</enum><text>develop methods to eradicate or control feral swine in the threatened areas;</text></paragraph><paragraph id="H12001E47B9884039926DF84D1C056ED1"><enum>(3)</enum><text>develop methods to restore damage caused by feral swine; and</text></paragraph><paragraph id="H2EC68A26A9B441FC8CFCE39020C8A818"><enum>(4)</enum><text>provide financial assistance to agricultural producers in threatened areas.</text></paragraph></subsection><subsection id="HB62FC797DD2C4F89876536C6189165BB"><enum>(c)</enum><header>Assistance</header><text>The Secretary may provide financial assistance to agricultural producers under the program to implement methods to—</text><paragraph id="HF03BA00104B5472DBB9424F3A8F754E7"><enum>(1)</enum><text>eradicate or control feral swine in the threatened areas; and</text></paragraph><paragraph id="H60DD1DAC93EB429DB69151103829AEDE"><enum>(2)</enum><text>restore damage caused by feral swine.</text></paragraph></subsection><subsection id="H2786C81084404084AF50992813FA7B02"><enum>(d)</enum><header>Coordination</header><text>The Secretary shall ensure that the Natural Resources Conservation Service and the Animal and Plant Health Inspection Service coordinate for purposes of this section through State technical committees established under section 1261(a).</text></subsection><subsection id="H56E604A3537A40889754E7522F397808"><enum>(e)</enum><header>Contracts with land-Grant colleges and universities</header><paragraph id="HEEC2C8791718464B96F61ADB9B7E19F8"><enum>(1)</enum><header>In general</header><text>The Secretary shall direct the Natural Resources Conservation Service and the Animal and Plant Health Inspection Service to enter into a contract with 1 or more land-grant colleges or universities to carry out activities under the program.</text></paragraph><paragraph id="HD85AD9144BD34F1DAC53087C5BC7465E"><enum>(2)</enum><header>Eligible land-grant colleges and universities</header><text display-inline="yes-display-inline">A land-grant college or university is eligible to enter into a contract under paragraph (1) if such college or university—</text><subparagraph id="H5C231AEA279943949081E5AD05BB7263"><enum>(A)</enum><text display-inline="yes-display-inline">has developed and implemented a system of evaluating damages from feral swine and the effectiveness of control and eradication efforts;</text></subparagraph><subparagraph id="H3564B98E5FE345ECB4D392E88246E5E4"><enum>(B)</enum><text display-inline="yes-display-inline">shows evidence of a strong working relationship with the Animal and Plant Health Inspection Service, Wildlife Services; and</text></subparagraph><subparagraph id="HFB3C28B1688B476D83FB79375CB6FE65"><enum>(C)</enum><text display-inline="yes-display-inline">has maintained a State-funded, non-Federal Wildlife Services program that has in place an active cooperative agreement with the Animal and Plant Health Inspection Service, Wildlife Services.</text></subparagraph></paragraph><paragraph id="HB9AC7EE4A0554DC58B3348B1ADE2D077"><enum>(3)</enum><header>Role of land-grant college or university</header><text>A land-grant college or university that enters into a contract under paragraph (1) shall provide educational support and assistance with control and eradication efforts under the program by—</text><subparagraph id="HFF4CCC588F5C4006880EE8A915397A77"><enum>(A)</enum><text display-inline="yes-display-inline">identifying, and carrying out research on, novel methods of feral swine control and eradication and land remediation;</text></subparagraph><subparagraph id="H64997AC87A7646EF8AE3DF176DFF3EAC"><enum>(B)</enum><text>assisting the Secretary in identifying threatened areas;</text></subparagraph><subparagraph id="HB442B99E35344FEB946B1E21D23324D1"><enum>(C)</enum><text>coordinating and collaborating with field staff, programmatic staff, and research staff within the Natural Resources Conservation Service and the Animal and Plant Health Inspection Service; and</text></subparagraph><subparagraph id="H73E6A146DC194F298AC5A9A664A033F8"><enum>(D)</enum><text>consulting with the Secretary on the establishment of goals and plans for research to be carried out under the program.</text></subparagraph></paragraph></subsection><subsection id="H306781013D2B4E39B49759D5F6B1D011"><enum>(f)</enum><header>Cost Sharing</header><paragraph id="HA085B654D285408697E5A5056A48162F"><enum>(1)</enum><header>Federal share</header><text>The Federal share of the costs of activities under the program may not exceed 75 percent of the total costs of such activities.</text></paragraph><paragraph id="H4BF1698F085840A28823562866964067"><enum>(2)</enum><header>In-kind contributions</header><text>The non-Federal share of the costs of activities under the program may be provided in the form of in-kind contributions of materials or services.</text></paragraph></subsection><subsection id="H160C78AB369A4282B4A9E189DDF33D05"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HDC12AC12414941E3BEAD1358B74C7353"><enum>(1)</enum><header>Land-grant college or university</header><text>The term <term>land-grant college or university</term> has the meaning given the term <term>land-grant colleges and universities</term> in section 1404 of the National Agricultural Research, Extension, and Teaching Policy Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/7/3103">7 U.S.C. 3103</external-xref>). </text></paragraph><paragraph id="HC361E0D461374FFD9F1111C82D3CF132" commented="no"><enum>(2)</enum><header>Threatened area</header><text>The term <term>threatened area</term> means an area of a State in which feral swine have been identified as a threat to agriculture, native ecosystems, or human and animal health, as determined by the Secretary.</text></paragraph></subsection><subsection id="H799C7B727D42457C93506D91D390AD80"><enum>(h)</enum><header>Funding</header><paragraph id="HD2201F9BDEC9474DA7964D88740781AB"><enum>(1)</enum><header>Mandatory funding</header><text>Of the funds made available under section 1241(a)(3)(A), the Secretary shall use to carry out this section $150,000,000 for the period of fiscal years 2026 through 2030.</text></paragraph><paragraph id="H3AAD8E607E9140A49DBAF10AE494EC85"><enum>(2)</enum><header>Distribution of funds</header><text>Of the funds made available under paragraph (1)—</text><subparagraph id="HB8F09EB04A2642FDAF079F293CE275D0"><enum>(A)</enum><text>40 percent shall be allocated to the Natural Resources Conservation Service to carry out the program, including the provision of financial assistance to producers for on-farm trapping and technology related to capturing and confining feral swine; and</text></subparagraph><subparagraph id="H70612F1346064333BE3CE194DF30963C"><enum>(B)</enum><text>60 percent shall be allocated to the Animal and Plant Health Inspection Service to carry out the program, including the use of established, and testing of innovative, population reduction methods.</text></subparagraph></paragraph><paragraph id="HA79EA109FBDC4C8D8152059F13D679C5"><enum>(3)</enum><header>Limitation on administrative expenses</header><text>Not more than 10 percent of funds made available under this section may be used for administrative expenses of the program.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H70520A81BB954D0FA3739F9F49D6BC2D"><enum>(b)</enum><header>Repeal</header><text display-inline="yes-display-inline">Section 2408 of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/7/8351">7 U.S.C. 8351</external-xref> note) is repealed.</text></subsection><subsection id="H475905327D5D4AA0B8D52C76755E3F00"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of the Agriculture Improvement Act of 2018 is amended by striking the item relating to section 2408.</text></subsection></section></legis-body></bill>
