<section id="H8C600BABEF944155A2B4A92B38B1A65E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Self-Determination and Co-Management in Forestry Act of 2025</short-title></quote>.</text></section> <section id="H35803DA50C804DE7B1525B644BC6A9DA" display-inline="no-display-inline"><enum>2.</enum><header>Tribal Co-Management Plans of the Department of the Interior</header> <subsection id="H1E9BD33C659347218394C591CE1F8A95"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (c), not later than 1 year after the date of enactment of this Act, the head of each Federal land management agency, in consultation with the Secretary of the Interior and the Tribal Advisory Committee, shall develop a plan, to be known as the <quote>Tribal Co-Management Plan</quote> of the agency, that includes any activity (including a permissive activity), service, or function (including the management decisions related to such activity, service, or function) of the Federal land management agency that—</text> 
<paragraph id="HD62F6E97549947B8840F642C75E39A8F" display-inline="no-display-inline"><enum>(1)</enum><text>is to be carried out on lands administered by the Federal land management agency that the Secretary determines are in need of such activity (including restoration activity), service, or function;</text></paragraph> <paragraph id="H104DBDAC54C5444AB8CB48555A5FC5EF"><enum>(2)</enum><text>is consistent with each land management plan of the Federal land management agency;</text></paragraph> 
<paragraph id="H6DDA46A3D44F43AC8465220C33F1F07F"><enum>(3)</enum><text>is to be carried out on land that the Secretary, in consultation with each applicable Indian Tribe, identifies as being historically, culturally, or geographically related to such Indian Tribe; and</text></paragraph> <paragraph id="H96BF16DCE0904216A73437E7A6133CEE"><enum>(4)</enum><text>is to be carried out in accordance with applicable laws, including environmental laws and regulations.</text></paragraph></subsection> 
<subsection id="H5229476A21664B4BB396C519FDF4BE17">
        <enum>(b)</enum>
        <header>Existing Tribal co-Management plans</header>
 <text display-inline="yes-display-inline">If a plan substantially similar to a plan required under subsection (a) already exists within a Federal land management agency, then not later than 120 days after the date of enactment of this Act, the head of the Federal land management agency shall—</text>
        <paragraph id="H13E5CE578AD64A86BCB469B3D1F13B68">
          <enum>(1)</enum>
 <text>adopt such plan as the Tribal Co-Management Plan of the agency; and</text> </paragraph> <paragraph id="H54C20892402748B5B2B8DB6D7FF40192"> <enum>(2)</enum> <text display-inline="yes-display-inline">update the plan as necessary to limit, to the maximum extent practicable, any administrative burden such plan may place on Indian Tribes.</text>
        </paragraph>
      </subsection> 
<subsection id="H911EAC3E8DE04144851D4F0A863FF9B4"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H2FC618F60FC94A7781121895F876C3B9"><enum>(1)</enum><header>Federal land management agency</header><text display-inline="yes-display-inline">The term <term>Federal land management agency</term> means—</text> 
<subparagraph id="H73E88FFE843640208A214F31751A2279"><enum>(A)</enum><text>the Bureau of Land Management;</text></subparagraph> <subparagraph id="H9C307A45396941CEBD2BF7948CC4A315"><enum>(B)</enum><text>the United States Fish and Wildlife Service;</text></subparagraph> 
<subparagraph id="HD30D76FDD361421EB4B055E0F471FF9F"><enum>(C)</enum><text>the National Park Service; and</text></subparagraph> <subparagraph id="HF140027C404E4133917B7D46C1EFAE76"><enum>(D)</enum><text>the Bureau of Indian Affairs.</text></subparagraph></paragraph> 
<paragraph id="H7C237F12289C47FA917870DA5B9A0E99"><enum>(2)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given the term under section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>).</text></paragraph> <paragraph id="H77C7FAFE73FA4C7EA74A2B590138408A"><enum>(3)</enum><header>Permissive activity</header><text display-inline="yes-display-inline">The term <term>permissive activity</term> includes—</text> 
<subparagraph id="H2E80A6462FAD4E2993783735F15AC37F" display-inline="no-display-inline"><enum>(A)</enum><text>forest and grassland planning and management activities;</text></subparagraph> <subparagraph id="H619EF3DCCA3C450DAF82A602CBB6EEF6" display-inline="no-display-inline"><enum>(B)</enum><text>research and development activities;</text></subparagraph> 
<subparagraph id="H3F52F8DBA82846BC836B90BADB218324"><enum>(C)</enum><text>a restoration activity; and</text></subparagraph> <subparagraph id="HC33D41CE4DA64873978CC081B058258D"><enum>(D)</enum><text>recreational services.</text></subparagraph></paragraph> 
<paragraph id="H9E69D6C313354B5BB8FC6448F0AB6335"><enum>(4)</enum><header>Tribal Advisory Committee</header><text display-inline="yes-display-inline">The term <term>Tribal Advisory Committee</term> means Secretary’s Tribal Advisory Committee of the Department of the Interior (chartered on November 11, 2021).</text></paragraph></subsection></section> <section id="H8494F678268444B4966C7FA90817EEBD"><enum>3.</enum><header>Tribal co-management training</header> <subsection id="HA44DE5D4B50B4120B9FA8655FAD4D5D6"><enum>(a)</enum><header>Training</header><text display-inline="yes-display-inline">The Secretary of the Interior shall ensure that each employee of the Department of the Interior who is involved in developing and carrying out a Tribal Co-Management Plan established under section 2 receives such training as the Secretary determines necessary to—</text> 
<paragraph id="H41B7BF92E26A41E8B150E57A27EF4089"><enum>(1)</enum><text>train the employee to incorporate indigenous knowledge and practices into the execution of the plan;</text></paragraph> <paragraph id="HB747D87294DF4BB7A3E24465FFFD4A81"><enum>(2)</enum><text display-inline="yes-display-inline">educate the employee on the Tribal history of each area in which a project on which the employee is expect to work and which is approved to be carried out in accordance with the plan is located; and</text></paragraph> 
<paragraph id="HE03D9F34EF04422CBFBEF925619002BC"><enum>(3)</enum><text>provide the employee with a general understanding of the trust relationship between the United States (including all agencies of the Federal Government) and Indian Tribes.</text></paragraph></subsection> <subsection id="HF490D2B31FD9416DA5689FF045C55F26"><enum>(b)</enum><header>Consultation</header><text>In carrying out this section, the Secretary is authorized to consult with Indian Tribes.</text></subsection> 
<subsection id="H7966A229C25D47669FBD0F38DF5A486E"><enum>(c)</enum><header>Indian Tribe defined</header><text>In this section, the term <term>Indian Tribe</term> has the meaning given the term under section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>).</text></subsection></section> <section id="HA6D0674CF9704F13A639F350725E43A3"><enum>4.</enum><header>Authority to enter into agreements with Indian Tribes and Tribal organizations to carry out certain Forest Service activities</header> <subsection id="HEB371F22DCBC4B9AA58360FF1F3C8B6B"> <enum>(a)</enum> <header>Authority To enter into agreements with Indian Tribes and Tribal organizations</header> <paragraph id="HBFD5DE96258E4CC6A39102202F4C25D5" commented="no"> <enum>(1)</enum> <header>Authority to enter into agreements</header> <subparagraph id="HD3B6D1A7DF374C3E9C01D5F48866CDC1" commented="no"> <enum>(A)</enum> <header>In general</header> <text>Subject to subparagraph (B) and paragraph (3), the Secretary may enter into agreements with an Indian Tribe or Tribal organization for the performance of activities of the Forest Service described in paragraph (2).</text>
          </subparagraph>
          <subparagraph id="H16FC1922F1A642728EE1280607AA15DA">
            <enum>(B)</enum>
            <header>Minimum number of agreements</header>
 <text>During the 4-year period beginning on the date of the enactment of this Act, the Secretary shall enter into at least 5 agreements under subparagraph (A).</text>
          </subparagraph>
          <subparagraph id="HF573A9402885460096431E0E67C0162A" commented="no">
            <enum>(C)</enum>
            <header>Agreement and contract authority</header>
 <text>The Secretary may carry out subparagraph (A)—</text> <clause id="H12BA85C9DB3947DA9E791E7FF4F7E381" commented="no"> <enum>(i)</enum> <text>through an agreement pursuant to this section;</text>
            </clause>
            <clause id="HC5D227DCD5C8475AB5094E8226C55411" commented="no">
              <enum>(ii)</enum>
 <text>through a contract entered into under the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304 et seq.</external-xref>) in a substantially similar manner as a contract entered into pursuant to section 8703 of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/25/3115b">25 U.S.C. 3115b</external-xref>); or</text>
            </clause>
            <clause id="HBD9EFD840B544C38AF95487F95E36A68" commented="no">
              <enum>(iii)</enum>
 <text display-inline="yes-display-inline">through any other agreement authority provided to the Secretary under Federal law or regulations.</text>
            </clause>
          </subparagraph>
        </paragraph>
        <paragraph id="H4B79558E997C436EA02CA1061BEF28A2">
          <enum>(2)</enum>
          <header>Allowable activities</header>
          <subparagraph id="H9412FC0F40D44082AC00D7373CD58685">
            <enum>(A)</enum>
            <header>In general</header>
 <text display-inline="yes-display-inline">An activity described in this paragraph is any activity (including a permissive activity), service, or function (including the management decisions related to such activity, service, or function) of the Forest Service that—</text>
            <clause id="HFDC779958A5143FAA5EAAE2816CEE76F" commented="no">
              <enum>(i)</enum>
 <text>is carried out on National Forest System lands that the Secretary determines are in need of such activity (including restoration activity), service, or function;</text>
            </clause>
            <clause id="HAB0C444968444B15A98CC53ECAA50BD8" commented="no">
              <enum>(ii)</enum>
 <text>is consistent with each land management plan applicable to such National Forest System lands;</text>
            </clause>
            <clause id="H7666B1212A7D4E8798808487026B4C7D" commented="no">
              <enum>(iii)</enum>
 <text>is carried out on land that the Secretary, in consultation with each applicable Indian Tribe, identifies as being historically, culturally, or geographically related to such Indian Tribe; and</text>
            </clause>
            <clause id="H5FF9AFCD44864F08BFF3216C656859BF">
              <enum>(iv)</enum>
 <text>is carried out in accordance with applicable laws, including environmental laws and regulations.</text>
            </clause>
          </subparagraph>
          <subparagraph id="HA81040ABC3E046ABBA8609CE34CD97E8">
            <enum>(B)</enum>
            <header>Permissive activity</header>
 <text>For purposes of subparagraph (A), the term <term>permissive activity</term> includes—</text>
            <clause id="H3487010741D3492C82387C84E3ABE81F">
              <enum>(i)</enum>
 <text>forest and grassland planning and management activities;</text> </clause> <clause id="HE334FBE77C82414EBF358005422B2D37"> <enum>(ii)</enum> <text>research and development activities;</text>
            </clause>
            <clause id="H7CC6F325169549958814706E9027B2B5">
              <enum>(iii)</enum>
 <text>a restoration activity;</text> </clause> <clause id="HE784B37BB3C94C778C7D474AE74F4AA3"> <enum>(iv)</enum> <text>activities of the Heritage Program of the Forest Service; and</text>
            </clause>
            <clause id="H000468E6CFC34AA1A141481A0F10684D">
              <enum>(v)</enum>
 <text>recreational services.</text> </clause> </subparagraph> </paragraph> <paragraph id="H392A649217504C44AD3F65A33670E5EE" commented="no"> <enum>(3)</enum> <header>Limitations</header> <text display-inline="yes-display-inline">The Secretary may not enter into an agreement under paragraph (1)(A) that—</text>
          <subparagraph id="HE3357168E36A483F814CF2671A211A5B" commented="no">
            <enum>(A)</enum>
 <text>delegates any nondelegable function to an Indian Tribe or Tribal organization;</text>
          </subparagraph>
          <subparagraph id="H299C0FB1B12447549CCA71D58EDC67FF" commented="no">
            <enum>(B)</enum>
 <text display-inline="yes-display-inline">would make an Indian Tribe or Tribal organization reliant on a State Government for the receipt of funds or other resources necessary to carry out any term of the agreement; or</text>
          </subparagraph>
          <subparagraph id="HF8E3D83C3C6E4FAEB8D0EAB2690A3089" commented="no">
            <enum>(C)</enum>
 <text display-inline="yes-display-inline">provides for the performance of an activity covered by a stewardship contract or other instrument such that the agreement would present a conflict with respect to National Forest System lands subject to the agreement.</text>
          </subparagraph>
        </paragraph>
      </subsection> 
<subsection id="H4FB0F567704C44888368769409BC1C05" commented="no"><enum>(b)</enum><header>Request for agreement</header><text display-inline="yes-display-inline">To request to enter into an agreement under subsection (a)(1)(A), an Indian Tribe or Tribal organization shall submit to the Secretary a proposal at such time and in such manner as the Secretary may require, including—</text> <paragraph id="H687D96842EB04FE483C59947EB608E21" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">a description of each activity that the Indian Tribe or Tribal organization proposes to carry out under the agreement;</text></paragraph> 
<paragraph id="H821FF19BB4744AA4B98EAF9F170CF574" commented="no"><enum>(2)</enum><text>an identification of the National Forest System lands on which such activities are proposed to be carried out; and</text></paragraph> <paragraph id="HB7865C39EE084A84B9797CEF0A8FF2FB" commented="no"><enum>(3)</enum><text>any other information the Secretary may require.</text></paragraph></subsection> 
<subsection id="H59ABF4C5EAFB47A3AF737EC890073F8F"><enum>(c)</enum><header>Criteria for evaluating requested agreements</header> 
<paragraph id="H16F0836F7DCD4428AA30711DA4F4E934"><enum>(1)</enum><header>Required considerations</header><text display-inline="yes-display-inline">Before entering into an agreement under subsection (a)(1)(A), the Secretary shall consider—</text> <subparagraph id="H62D1D827F85C406AA35F423E2AD44097"><enum>(A)</enum><text display-inline="yes-display-inline">the expected effects of the agreement on the interests of other Indian Tribes; and</text></subparagraph> 
<subparagraph id="H3839A6919FD6438D8EF1E3EF64199338"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to lands described in subsection (a)(2)(A), any valid existing rights and permits—</text> <clause id="HA979CADAA14F4C599B0CC75389D9412C"><enum>(i)</enum><text display-inline="yes-display-inline">of each Indian Tribe proposed to be subject to the agreement;</text></clause> 
<clause id="H94785E6D71DC4ADD8370373F226D5D66"><enum>(ii)</enum><text>of other Indian Tribes;</text></clause> <clause id="H5234BAB83BD944BAA10078EAE95F47A6"><enum>(iii)</enum><text>of private parties; and</text></clause> 
<clause id="HD8C324290C0A4A6F9B4348B29ACCFA15"><enum>(iv)</enum><text>of the Federal Government.</text></clause></subparagraph></paragraph> <paragraph id="HE3AE661B41FF4A1B89830D43B8EBE94A" commented="no"><enum>(2)</enum><header>Allowable evaluation and considerations</header><text display-inline="yes-display-inline">In determining whether to enter into an agreement under subsection (a)(1)(A), the Secretary may—</text> 
<subparagraph id="HCF4E246C1EFA4845A1189B2E6BE07B18" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">evaluate using a best-value basis the proposal submitted pursuant subsection (b) with respect to the agreement; and</text></subparagraph> <subparagraph id="H0F0AC941C9DD4AB9927D787524FA4B4D" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">give special consideration to factors implicated by such proposal and related to the Indian Tribe proposed to be subject to the agreement, including—</text> 
<clause id="HDF7CA6449A6D4BAFA2B71F4AB4E4467D" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">if applicable, the status of the Tribal organization that requested the agreement as a Tribal organization;</text></clause> <clause id="HED5B10415A0B49D9B499EF0D687E1553" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the historical, cultural, and traditional affiliation of the Indian Tribe with the land proposed to be subject to the agreement;</text></clause> 
<clause id="HD6BAAD3A354241D0AE485FE884A441E1" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">the features of the landscape of such land, including watersheds and vegetation types, that are expected to be affected if the proposal is carried out;</text></clause> <clause id="H7BB3B4A023114D1A857641648EA7CE40" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">with respect to the coordination of activities, the working relationship, if any, between the Indian Tribe or Tribal organization that submitted the proposal and the Forest Service;</text></clause> 
<clause id="H49CE4544082B43DBB3766CF5CA9A038F" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">access by members of the Indian Tribe proposed to be subject to the agreement to land proposed to be subject to the agreement; and</text></clause> <clause id="H8DF888DC72F64A268DF9D48A4561613C" commented="no"><enum>(vi)</enum><text display-inline="yes-display-inline">the indigenous knowledge and skills of the Indian Tribe and members of the Indian Tribe.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H74F9DE0C154149A49DB5150845ED140B" commented="no"><enum>(d)</enum><header>Notice of denial</header><text>Not later than 90 days after the Secretary denies a request by an Indian Tribe or a Tribal organization pursuant to subsection (b), the Secretary shall issue to the Indian Tribe or Tribal organization a notice of denial that includes—</text> <paragraph id="H110A7E73A87840BD8AD6A27FB54F1D91" commented="no"><enum>(1)</enum><text>an identification of each specific reason for the denial, including any criteria the Secretary considered pursuant to paragraphs (1) and (2) of subsection (c) that contributed to the denial;</text></paragraph> 
<paragraph id="H4D4608B5FDE94F919B6ECF16AE7BDBE9" commented="no"><enum>(2)</enum><text>an identification of the potential courses of action, if any, that the Indian Tribe or Tribal organization may take to overcome each such specific reason; and</text></paragraph> <paragraph id="H57DFAAADF9B34696A36984CB29C3D373" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">a proposed schedule for communication with the Indian Tribe or Tribal organization to provide technical assistance to the Indian Tribe or Tribal organization to overcome each such specific reason.</text></paragraph></subsection> 
<subsection id="H4084B9C0D62D4D1CBE81144750474147"><enum>(e)</enum><header>Payments to Indian Tribes or Tribal organizations</header> 
<paragraph id="H475554E7D259458F952DF4577FF0EB6E" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In entering into an agreement under subsection (a)(1)(A)—</text> <subparagraph id="HA8018E01C6F64F2DBB4750F8708BFA2D" commented="no"><enum>(A)</enum><text>the Secretary may include terms and conditions with respect to payments to the Indian Tribe or Tribal organization party to the agreement for use carrying out the agreement; and</text></subparagraph> 
<subparagraph id="HEAB2B5A63FAC48BF8BAEF471BD4BBDCE" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the Indian Tribe or Tribal organization may elect to receive any such payments on an annual or semi-annual basis.</text></subparagraph></paragraph> <paragraph id="H7817754637B54116A6F064E0162CBF17"><enum>(2)</enum><header>Source of funds</header><text>The Secretary shall—</text> 
<subparagraph id="HF1665EA568A44F6499C4DA04ADC288B2"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of an activity to be carried out pursuant to an agreement under subsection (a)(1)(A), from the amounts appropriated to carry out such activity, use the unobligated amounts to make a payment under paragraph (1) with respect to such activity; or</text></subparagraph> <subparagraph id="H7CA8E1CE11D543A4A995AB6ECC1C0BEA"><enum>(B)</enum><text>if no such amounts are available, use the amounts made available pursuant to subsection (m) to make such a payment.</text></subparagraph></paragraph> 
<paragraph id="H2B99AB55A8D54B3EAE96BC85D2BCCEE2" commented="no"><enum>(3)</enum><header>Transfer authority</header><text display-inline="yes-display-inline">Subsections (a) through (l) of section 408 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5368">25 U.S.C. 5368</external-xref>) shall apply to the Secretary of Agriculture with respect to an agreement under subsection (a)(1)(A) in the same manner as such subsections apply to the Secretary of the Interior with respect to a funding agreement.</text></paragraph> <paragraph id="H185B2905B10A4AEDB0596638B540C0D0" commented="no"><enum>(4)</enum><header>Reduction of paperwork burden</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall, to the maximum extent practicable—</text> 
<subparagraph id="H674EBD9043BE4852BDEC504200B4744B" commented="no"><enum>(A)</enum><text>reduce the reporting burden on Indian Tribes and Tribal organizations that receive funding pursuant to an agreement under this section, including by limiting report frequency, consolidating reporting requirements, and reducing required information; and</text></subparagraph> <subparagraph id="HAC6247B35ECD4E61AF16D92E0EAB39B3"><enum>(B)</enum><text>establish such mechanisms as are necessary to protect Tribal data sovereignty.</text></subparagraph></paragraph></subsection> 
<subsection id="H6AA8BB1370A0495FB0B8DB9341DE7B86"><enum>(f)</enum><header>Review and modification of agreement</header> 
<paragraph id="H71DFCBA07994468CA9C94830AA1E44A1"><enum>(1)</enum><header>Periodic review</header><text display-inline="yes-display-inline">With respect to an agreement under subsection (a)(1)(A) that is effective for a period of not fewer than 5 years, the Secretary shall, in the fifth year after the agreement takes effect and every 5 years thereafter during such period—</text> <subparagraph id="H24A270720668421BBD534CF06FC74CB9"><enum>(A)</enum><text display-inline="yes-display-inline">review the terms of the agreement with each Indian Tribe or Tribal organization party to the agreement; and</text> </subparagraph> 
<subparagraph id="HBEDFB233AA1B4E929CA63B1572D302BE" commented="no"><enum>(B)</enum><text>offer to modify any such terms or terminate the agreement, as the Secretary and each such Indian Tribe or the Tribal organization determines appropriate based on such review.</text></subparagraph></paragraph> <paragraph id="HDDEE72B13E6C4CA7B5FC63ACB162CA3E" commented="no"><enum>(2)</enum><header>Review due to natural disaster</header> <subparagraph id="HD3461BB75DF54D499F50571A7D9A23F2" commented="no"><enum>(A)</enum><header>Request to review</header><text display-inline="yes-display-inline">Not later than 90 days after a natural disaster occurs on National Forest System lands subject to an agreement under subsection (a)(1)(A), the Indian Tribe or Tribal organization party to the agreement may submit a request to the Secretary to—</text> 
<clause id="HAD27DDC739484299B44D7B1C7E734C0E" commented="no">
              <enum>(i)</enum>
 <text display-inline="yes-display-inline">identify any activities that could be carried out by the Indian Tribe or Tribal organization, in cooperation with the Forest Service and under the agreement, in response to the natural disaster; and</text>
            </clause> 
<clause id="H35B617664AAB4420A4D0F6733F7B16FE" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">review the terms and conditions of the agreement to identify any modifications necessary to facilitate or authorize such activities.</text></clause></subparagraph> <subparagraph id="H895EAF8362A64DB28100EF7CE7D7F526" commented="no"><enum>(B)</enum><header>Review; modification</header><text>The Secretary shall respond to a request under subparagraph (A) not later than 60 days after receiving such request.</text></subparagraph></paragraph></subsection> 
<subsection id="HDBC12C1BB5654CF4844D05BA78CCB574"><enum>(g)</enum><header>Publication of activities</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act and every 3 years thereafter, the Secretary, in consultation with Indian Tribes, shall publish in the Federal Register a non-exhaustive list describing the activities of the Forest Service that may be eligible for inclusion in an agreement under subsection (a)(1)(A).</text></subsection> <subsection id="H77ECB8785CCE4C96834A2375B8DB7777" commented="no"><enum>(h)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act and every 3 years thereafter, the Secretary shall submit to the relevant Congressional Committees a report containing a description of any progress or accomplishments made during the period covered by the report—</text> 
<paragraph id="H9701A4AA133449CAA9E4B46453C72570" commented="no"><enum>(1)</enum><text>with respect to the activities of the Forest Service described in subsection (a)(2); and</text></paragraph> <paragraph id="H44601A085FE64931AEAF87BFA1373F6B" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">attributable to an agreement under subsection (a)(1)(A).</text></paragraph></subsection> 
<subsection id="H7C858F131FF742F8A9A1E6EB66842547"><enum>(i)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall consult with Indian Tribes to—</text> <paragraph id="H7821383FAEE445B7B363E7FE95A0BA51"><enum>(1)</enum><text>ensure that indigenous knowledge is—</text> 
<subparagraph id="HB75F53823D3E4345BE69F7E7B22AF2D6"><enum>(A)</enum><text>when requested by an applicable Indian Tribe or Tribal organization thereof, integrated into decision-making processes related to the activities carried out under this section; and</text></subparagraph> <subparagraph id="H72F9DF2177C34E40999B3CA3C644DAC2"><enum>(B)</enum><text>when appropriate, considered best available science; and</text></subparagraph></paragraph> 
<paragraph id="H2BC309EDDCB745B888EFE75233F54BCE" commented="no"><enum>(2)</enum><text>ensure that appropriate safeguards exist to—</text> <subparagraph id="H18D85100968D4822AC97F3D7DE809E08" commented="no"><enum>(A)</enum><text>protect the integrity of indigenous knowledge; and</text></subparagraph> 
<subparagraph id="H1EDC3078EBFB457F96215F5A0FF0F4BE" commented="no"><enum>(B)</enum><text>respect the data sovereignty of Indian Tribes in accordance with Tribal law.</text></subparagraph></paragraph></subsection> <subsection id="H5F17594784854506974239B1B2241546" commented="no"><enum>(j)</enum><header>Federal Tort Claims Act applicability</header><text display-inline="yes-display-inline">While engaged in carrying out an activity of the Forest Service pursuant to an agreement with an Indian Tribe or Tribal organization under subsection (a)(1)(A), an employee of such Indian Tribe or Tribal organization shall be considered to be an employee of the Forest Service for purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code.</text></subsection> 
<subsection id="HC66965D7D8ED4C9B8B96AF6C0F8D0D79" commented="no"><enum>(k)</enum><header>FAR exemption</header><text display-inline="yes-display-inline">This Act, including any activity carried out pursuant to this section, is not subject to the requirements of the Federal Acquisition Regulation.</text></subsection> <subsection id="H5E34ECFCC964481EBBBD7DC970F0A7A1"><enum>(l)</enum><header>Effect</header><text>Nothing in this section—</text> 
<paragraph id="H4FF01E40E3F9406FB966D619B0688EAF"><enum>(1)</enum><text display-inline="yes-display-inline">enlarges, establishes, or diminishes the current or future rights of any Indian Tribe;</text></paragraph> <paragraph id="HAE49D45D2CDE4A669B879D10902AAB71" commented="no"><enum>(2)</enum><text>reduces or supersedes any authority of an Indian Tribe to enter into agreements;</text></paragraph> 
<paragraph id="H31A3C07AC0CD4C7CB994ECCA6DDAB041"><enum>(3)</enum><text display-inline="yes-display-inline">provides exclusive use of any area within National Forest System lands;</text></paragraph> <paragraph id="H94FE5EB916864EAFADD4EEE983445335"><enum>(4)</enum><text display-inline="yes-display-inline">limits the Secretary from entering into a separate agreement with any other Indian Tribe, or Tribal organization thereof, with treaty rights or a recognized legal interest in National Forest System lands; or</text></paragraph> 
<paragraph id="HB5F33ABFB2324E1D870631E9ED352070"><enum>(5)</enum><text>affects the authority of the Secretary (as in effect on the date of the enactment of this Act) to, acting through the Chief of the Forest Service, enter into agreements to enable or accommodate Tribal activities on lands administered by the Forest Service, including the exercise of Tribal Treaty, reserved, retained, or other similar rights.</text></paragraph></subsection> <subsection id="HDCB6D8450AF74A77B89DD765F6BAD47E"><enum>(m)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $50,000,000 for the period of fiscal years 2026 through 2030, to remain available until expended.</text></subsection> 
<subsection id="H5950A1662D4A4ECBA99C33C1FEF11A35"><enum>(n)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H6D30F7FB55974C95A7934756389B607C" commented="no"><enum>(1)</enum><header>Agreement</header><text display-inline="yes-display-inline">The term <term>agreement</term> includes a contract, compact, or any other similar mechanism.</text></paragraph> 
<paragraph id="HE169B7A45B5F4D8C8C1F9C8AE769005B" commented="no"><enum>(2)</enum><header>Indian Tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given the term under section 102 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5130">25 U.S.C. 5130</external-xref>).</text></paragraph> <paragraph id="H5698DFC941EF4F0F9614BD7407BF65E5"><enum>(3)</enum><header>Indigenous knowledge</header><text display-inline="yes-display-inline">The term <term>indigenous knowledge</term> includes, with respect to biological, physical, social, cultural, or spiritual phenomena, a body of observations, oral knowledge, written knowledge, innovations, practices, and beliefs developed by an Indian Tribe and members of the Indian Tribe through experience and interactions with the environment.</text></paragraph> 
<paragraph id="HED1F740A261246219D2FAA54CA8FBC20"><enum>(4)</enum><header>National Forest System</header><text>The term <term>National Forest System</term> has the meaning given such term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1609">16 U.S.C. 1609</external-xref>).</text></paragraph> <paragraph id="H8FC50D29F1CA4499ADD58581BD68A209" commented="no"><enum>(5)</enum><header>Natural disaster</header><text>The term <term>natural disaster</term> includes—</text> 
<subparagraph id="H408412769CFF4D0390A8F59EC14A290E" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a wildfire, hurricane, typhoon, tornado, excessive wind, hail, landslide, mudslide, drought, freeze, ice storm, snowstorm, blizzard, excessive moisture, flood, earthquake, extreme temperature event, insect or pathogen infestation, and volcanic eruption or emission; and</text></subparagraph> <subparagraph id="H9BC9BC4FACA94832928881F0A096672C" commented="no"><enum>(B)</enum><text>any other natural hazard that result in severe property damage, death, or injury, as determined by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="HE04DAF71B6B74A48ABD3E68B07A5DABD"><enum>(6)</enum><header>Relevant Congressional Committees</header><text>The term <term>relevant Congressional Committees</term> means—</text> <subparagraph id="H71B4A536CDE04B7293D77E954A296C8E"><enum>(A)</enum><text>the Committees on Natural Resources and Agriculture of the House of Representatives; and</text></subparagraph> 
<subparagraph id="H18A3D3657FC34317B4A5CA7BBEFD2CBB"><enum>(B)</enum><text>the Committees on Indian Affairs, Energy and Natural Resources, and Agriculture, Nutrition, and Forestry of the Senate.</text></subparagraph></paragraph> <paragraph id="H45127B74256D4A69B87A4A35ED19EE60"><enum>(7)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Agriculture, acting through the Chief of the Forest Service.</text></paragraph> 
<paragraph id="H94F8372D525A41A7AEA7A221AB3BABE1" commented="no"><enum>(8)</enum><header>Tribal organization</header><text display-inline="yes-display-inline">The term <term>Tribal organization</term> means the recognized governing body of any Indian Tribe or any legally established organization of Indian Tribe members which is controlled, sanctioned, or chartered by such governing body or which is democratically elected by the adult members of the Indian community to be served by such organization and which includes the maximum participation of Indian Tribe members in all phases of its activities: Provided, That in any case where a contract is let or grant made to an organization to perform services benefitting more than one Indian Tribe, the approval of each such Indian Tribe shall be a prerequisite to the letting or making of such contract or grant.</text></paragraph></subsection></section> </legis-body></bill>
