<section id="H4FC5B30ADECC42018C4729461F878EFD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defund Cities that Defund the Police Act of 2025</short-title></quote>.</text></section> <section id="HFBEFE1088A0441F693CC27997432784C"><enum>2.</enum><header>Defunding jurisdiction defined</header><text display-inline="no-display-inline">In this Act:</text>
<paragraph id="H080E792E745748F4A612FCFD7626A011"><enum>(1)</enum><header>Defunding State</header><text display-inline="yes-display-inline">The term <term>defunding State</term> means a State that—</text> <subparagraph id="HD71DE03E1CDE4D09B2FEB9BFDAF71999"><enum>(A)</enum><text>abolishes or disbands a State law enforcement agency with no intention of reconstituting the State law enforcement agency; or</text></subparagraph>
<subparagraph id="H9D903613D3404CB698A7560854FD98FD"><enum>(B)</enum><text>significantly reduces a State law enforcement agency’s budget, provided that the State did not face a significant decrease in revenues in the previous fiscal year.</text></subparagraph></paragraph> <paragraph id="H4BBC645D3D244B89844EA53114154481"><enum>(2)</enum><header>Defunding locality</header><text display-inline="yes-display-inline">The term <term>defunding locality</term> means a political subdivision of a State (other than a rural police department) that—</text>
<subparagraph id="HAA0F786753F64DA284F4D6D0A78CE17D"><enum>(A)</enum><text>is in an urbanized area, as defined by the United States Census Bureau; and</text></subparagraph> <subparagraph id="H16291159E4564F3B805C42A9C51223F5"><enum>(B)</enum> <clause id="H2DDA4670920D43C4BE78F70C269B3C0D" display-inline="yes-display-inline"><enum>(i)</enum><text>abolishes or disbands the police department with no intention of reconstituting the jurisdiction’s police department; or</text></clause>
<clause id="H0C6AEC3DD1D1493D9BBB0ED47118562E" indent="up1"><enum>(ii)</enum><text>significantly reduces the police department’s budget, provided that the jurisdiction did not face a significant decrease in revenues in the previous fiscal year.</text></clause></subparagraph></paragraph></section> <section id="H8902CBF1E0E945758C38C966B1076677"><enum>3.</enum><header>Defunding jurisdictions ineligible for certain Federal funds</header> <subsection id="HFA1228BB5B664256B6004FF7DF97E288"><enum>(a)</enum><header>Economic development administration grants</header> <paragraph id="HB2B4DCEFE181464F99CC93DB1F2ACF4C"><enum>(1)</enum><header>Grants for public works and economic development</header><text>Section 201(b) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3141">42 U.S.C. 3141(b)</external-xref>) is amended—</text>
<subparagraph id="H9ABE31D2543A4D3EB6B80792EB124169"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="HDAD7419A78A2449385D9754439CB99F7"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph>
<subparagraph id="H3236413ECEB248DCABBD67FE8798FA69"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="HF5F7557E708A4204ACA4D8E2E8E295D5" style="OLC"> <paragraph id="H9A70944E5BF4479E92AF3D87DED86C48"><enum>(4)</enum><text display-inline="yes-display-inline">the area in which the project is to be carried out is not a defunding State or defunding locality (as defined in section 2 of the <short-title>Defund Cities that Defund the Police Act of 2025</short-title>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="HCDFFEC964FCE40B4A3A414B689F8D092"><enum>(2)</enum><header>Grants for planning and administrative expenses</header><text>Section 203(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3143">42 U.S.C. 3143(a)</external-xref>) is amended by adding at the end the following: <quote>A defunding jurisdiction (as defined in section 2 of the <short-title>Defund Cities that Defund the Police Act of 2025</short-title>) may not be deemed an eligible recipient under this subsection.</quote>.</text></paragraph> <paragraph id="H06A57E43F1E342D78F2B7D590B7E519E"><enum>(3)</enum><header>Supplementary grants</header><text>Section 205(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3145">42 U.S.C. 3145(a)</external-xref>) is amended—</text>
<subparagraph id="H50C972D08C744474BD1C20857B648338"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H6BBA81C97C154558B8A1296549BB7907"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph>
<subparagraph id="H622E5E2E65B34B0BAEF7E16E5EBCD3EF"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block id="H4CFF379DE030444DB0A723FE2A62E819" style="OLC"> <paragraph id="HFBF3A196C151457989E9E06A7E5124C3"><enum>(4)</enum><text display-inline="yes-display-inline">will be carried out in an area that does not contain a defunding State or defunding locality (as defined in section 2 of the <short-title>Defund Cities that Defund the Police Act of 2025</short-title>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H1F8706EE95934769AC9D98A6C617722F"><enum>(4)</enum><header>Grants for training, research, and technical assistance</header><text>Section 207 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3147">42 U.S.C. 3147</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H0A204AECE51C4C6A8321C53366CBA1CE" style="OLC"> <subsection id="H576E34636B6440E0BDE7633EC2E7FFA3"><enum>(d)</enum><header>Ineligibility of defunding States or defunding localities</header><text display-inline="yes-display-inline">Grant funds under this section may not be used to provide assistance to a defunding State or defunding locality (as defined in section 2 of the <short-title>Defund Cities that Defund the Police Act of 2025</short-title>). If a State is a defunding State during the period for which it receives amounts under this section, the Secretary shall direct the State to immediately return to the Secretary any such amounts that the State received for that period, and shall reallocate amounts returned for grants under this section to localities within the same State that are not defunding localities.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HFDEE4082A541491C9D8B5D48E6A7F16D"><enum>(b)</enum><header>Community development block grants</header><text>Title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301 et seq.</external-xref>) is amended—</text> <paragraph id="H8471A1D0D93A479C8CBA1433D75D8296"><enum>(1)</enum><text>in section 102(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302(a)</external-xref>), by adding at the end the following:</text>

<paragraph id="HA75E20486C93471D83B1280E40EE6944"><enum>(25)</enum><text display-inline="yes-display-inline">The term <term>defunding State or locality</term> has the meaning given such term in section 2 of the <short-title>Defund Cities that Defund the Police Act of 2025</short-title>.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H85008FAFFF72440EB55D01EE2DAB594F"><enum>(2)</enum><text>in section 104 (<external-xref legal-doc="usc" parsable-cite="usc/42/5304">42 U.S.C. 5304</external-xref>)—</text>
<subparagraph id="H4C3C42B8CF204080A2B2328B830491FF"><enum>(A)</enum><text>subsection (b)—</text> <clause id="HA4922477911D42C6BCB3A5B7707468B3"><enum>(i)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></clause>
<clause id="HEE37797876424849B9EE9153BCC47A14"><enum>(ii)</enum><text>by redesignating paragraph (6) as paragraph (7); and</text></clause> <clause id="H432C3607D5DD4D7FA86F0D4B7C255221"><enum>(iii)</enum><text>by inserting after paragraph (5) the following:</text>

<paragraph id="H304DD9120D324F0E80BCD4B7CD5635C1"><enum>(6)</enum><text display-inline="yes-display-inline">the grantee is not a defunding State or locality and will not become a defunding State or locality during the period for which the grantee receives a grant under this title; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph> <subparagraph id="H97BB5143E5EC4438A8737751E1154A52"><enum>(B)</enum><text>by adding at the end the following:</text>

<subsection id="HAF3D54A615C34B9C9D965D525A9190FA"><enum>(n)</enum><header>Protection of individuals against crime</header>
<paragraph id="H0D20639235F14D6BB8A2BC8B089F392C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No funds made available to carry out this title may be obligated or expended for any State or unit of general local government that is a defunding State or locality.</text></paragraph> <paragraph id="H10116CE43354413A8C43C62F960B1E39"><enum>(2)</enum><header>Returned amounts</header> <subparagraph id="H6DB673F9DC1E4C06A4C3DD83A97A2A2C"><enum>(A)</enum><header>State</header><text>If a State is a defunding State during the period for which it receives amounts under this title, the Secretary—</text>
<clause id="HCFB67C7CE1884AAB97CCB947CE511EE3"><enum>(i)</enum><text>shall direct the State to immediately return to the Secretary any such amounts that the State received for that period; and</text></clause> <clause id="HE1A62CF2E07747379206CAF654FED338"><enum>(ii)</enum><text display-inline="yes-display-inline">shall reallocate amounts returned under clause (i) for grants under this title to localities within the same State that are not defunding localities.</text></clause></subparagraph>
<subparagraph id="H4A7DD2EE187C415DBDCC68D9EF83C668"><enum>(B)</enum><header>Unit of general local government</header><text>If a unit of general local government is a defunding locality during the period for which it receives amounts under this title, any such amounts that the unit of general local government received for that period—</text> <clause id="HB486E7C7368E450D9B536AE822CA1FB6"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a unit of general local government that is not in a nonentitlement area, shall be returned to the Secretary for grants under this title to States and other units of general local government that are not defunding localities; and</text></clause>
<clause id="HB511456332A04E0BB017BB565F86285C"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a unit of general local government that is in a nonentitlement area, shall be returned to the Governor of the State for grants under this title to other units of general local government in the State that are not defunding localities.</text></clause></subparagraph> <subparagraph id="H8EAF13FDE1E94A72B9C4491C629A39D8"><enum>(C)</enum><header>Reallocation rules</header><text>In reallocating amounts under subparagraphs (A) and (B), the Secretary shall—</text>
<clause id="H17186984F45E456B8C8BF6FE1FDF151D"><enum>(i)</enum><text display-inline="yes-display-inline">apply the relevant allocation formula under subsection (b) or (d) of section 106, with all defunding States and localities excluded; and</text></clause> <clause id="H0F4763C0C3CC441A8A40B1E24C261E48"><enum>(ii)</enum><text>shall not be subject to the rules for reallocation under section 106(c).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section>
