which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Infrastructure Investment and Jobs Act to increase surface water and groundwater storage, and for other purposes.</official-title></form><legis-body id="H2CC1859E5DCF42AA996259BF81BD4D7B" style="OLC"><section id="H7104EE997D6743D89724D19E1C2CD540" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Every Drop Counts Act</short-title></quote>.</text></section><section id="H56A2C6C1760D4FEEBC8FE29980F08D97"><enum>2.</enum><header>Eligible water storage projects</header><subsection id="HF3097B61BEA64793905E633B487063B2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subparagraph (B) of section 40903(b)(1) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3203">43 U.S.C. 3203(b)(1)(B)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="HBAD6F7BE20D54953B025988372603BB3" display-inline="no-display-inline"><subparagraph id="H8E407A11EA1B4E1790311139A99E199B"><enum>(B)</enum><header>Eligible projects</header><text display-inline="yes-display-inline">The following projects shall be eligible for consideration for a grant under this section:</text><clause id="H15CB815209944E52AED62E045900F08D"><enum>(i)</enum><header>General acre-feet capacity</header><text>A project that—</text><subclause id="H1184FAABBC824EF09393747F902EE9FD"><enum>(I)</enum><text display-inline="yes-display-inline">has water storage capacity of not less than 200 acre-feet and not more than 30,000 acre-feet; and</text></subclause><subclause id="H99F6B874E8A34365B53543EA163441C5"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="HF6B10943D9ED4A088C8D3CABAE3835A6"><enum>(aa)</enum><text>increases surface water or groundwater storage; or </text></item><item id="H078599069D2649E693C521D20B6AAE2D" indent="up1"><enum>(bb)</enum><text>conveys water, directly or indirectly, to or from surface water or groundwater storage.</text></item></subclause></clause><clause id="H7F30C529C1824E22BDB0344FECC3AB7B"><enum>(ii)</enum><header>Average annual project life acre-feet capacity</header><text>A project that—</text><subclause id="HE9C8BEAA759046B5BBA7118E8E3915DB"><enum>(I)</enum><text display-inline="yes-display-inline">has water storage capacity of recharges not less than 200 acre-feet and not more than 150,000 acre-feet on an average annual basis over the life of the project for storage or use; and</text></subclause><subclause id="HB74E48CF8E9D4719B9D1D2A3483696C2"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="H04BDB49540FE4384B86C715EE54C8C9D"><enum>(aa)</enum><text>increases groundwater aquifer storage;</text></item><item id="H89C65407CC43420FAD0D782FDB8A5C74" indent="up1"><enum>(bb)</enum><text>conveys water, directly or indirectly, to or recovers water from groundwater storage;</text></item><item id="H453B23811AB4412F9D1FFD1200A12F32" indent="up1"><enum>(cc)</enum><text>both increases groundwater aquifer storage and conveys water, directly or indirectly, to or recovers water from groundwater storage; and</text></item><item id="H5F9BF23CBDC34CC9A3B1DACBC72F9C38" indent="up1"><enum>(dd)</enum><text>stabilizes groundwater levels.</text></item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H36B6EACF022346B7AE4A6778519C2833"><enum>(b)</enum><header>Authority</header><text display-inline="yes-display-inline">Section 40903(e) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/43/3203">43 U.S.C. 3203(e)</external-xref>) is amended by striking <quote>5</quote> and inserting <quote>10</quote>. </text></subsection></section><section id="H644412F145264103A442ABA392B583AA"><enum>3.</enum><header>Statutory construction</header><text display-inline="no-display-inline">Nothing in the amendment made by section 2 shall be construed—</text><paragraph id="HAA30507905064742A7586F7C7B9ACD93"><enum>(1)</enum><text display-inline="yes-display-inline">to supersede or in any manner affect or conflict with State water law, Federal water law, interstate compacts, or treaty obligations;</text></paragraph><paragraph id="HFA1048EFDAC34A9D8C6BEB15D314B05E"><enum>(2)</enum><text>to authorize any acquisition of water by the Federal Government; or</text></paragraph><paragraph id="H4C4A5D50B35B47D2ABA9FE2B88A882DC"><enum>(3)</enum><text display-inline="yes-display-inline">to supersede or infringe on any water rights.</text></paragraph></section></legis-body></bill>
