        the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles 10 and 38, United States Code, to make improvements to certain programs for a member nearing separation, or for a veteran who recently separated, from the Armed Forces, and for other purposes.</official-title></form><legis-body id="H637D794262D54C69B2AA01B08BE8AD2B" style="OLC"> 
<section id="H64250F56EB724D418D55674ED6B6646C" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing the Transitioning Servicemember’s Experience Act</short-title></quote> or the <quote><short-title>ETS Act</short-title></quote>.</text></section> 
<section id="H32E7CD42C240412D947139AB85053889" section-type="subsequent-section"><enum>2.</enum><header>Transition Assistance Program: amendments; pilot program; reports</header> 
<subsection id="H3168FE1B353A460A9115AB19A97F7949" commented="no"><enum>(a)</enum><header>Special operations forces</header><text display-inline="yes-display-inline">Subsection (a) of section 1142 of title 10, United States Code, is amended, in paragraph (1), by inserting <quote>(including each member of the special operations forces)</quote> after <quote>armed forces</quote>.</text></subsection> <subsection id="HABE3AAB4A5FC45A9857C59D72E7700B7"><enum>(b)</enum><header>Requirement of preseparation counseling: number of days</header><text display-inline="yes-display-inline">Such subsection is further amended, in paragraph (1)—</text> 
<paragraph id="H994A823F26B944CC9FE126C176A72BA7"><enum>(1)</enum><text>by inserting <quote><header-in-text level="subparagraph" style="USC"><enum-in-header>(A)</enum-in-header></header-in-text></quote> before <quote>Within</quote>; and</text></paragraph> <paragraph id="H9F3B06DE70FD441793954B1CB37B3B5E"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="USC" id="H36FCB4E8205148BAB3F7B477EEC550E5" display-inline="no-display-inline"> 
<subparagraph id="H0C0ED83CE7BC4CDDA429AEDD9F74AE61" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary concerned shall ensure that a member described in subparagraph (A) receives preseparation counseling in the following amounts:</text> <clause id="H2A51FDA1547540789D116AC81AA538AB"><enum>(i)</enum><text display-inline="yes-display-inline">In the case of a member who has accepted an offer of full-time employment, or has enrolled in a program of education or vocational training, that shall commence after the member separates, retires, or is discharged, not fewer than three days.</text></clause> 
<clause id="H1F50C44FA9964FF6A0F181F2F0D3EFAE"><enum>(ii)</enum><text>In the case of a member other than a member described in clause (i), not fewer than five days.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H022D0DD21C334D949CA5D24354661AAA"> <enum>(c)</enum> <header>Provision of preseparation counseling: third party counselors; in-Person to the extent practicable</header> <text display-inline="yes-display-inline">Such subsection is further amended, in paragraph (2)—</text>
        <paragraph id="HB2C179C745824392A67A5FFD6E4F4C2D">
          <enum>(1)</enum>
 <text>by inserting <quote><header-in-text level="subparagraph" style="USC" ><enum-in-header>(A)</enum-in-header></header-in-text></quote> before <quote>In carrying</quote>; and</text>
        </paragraph>
        <paragraph id="H5E04D06766B44363AD74263E37006990">
          <enum>(2)</enum>
 <text>by adding at the end the following new subparagraphs:</text> <quoted-block style="USC" id="H3CEB42BB4DDE4EFDA3AD7646A6E5C51F" display-inline="no-display-inline"> <subparagraph id="H4CACD0C2BA074F58BB3783300E7C0C7C" indent="up2"> <enum>(B)</enum> <text display-inline="yes-display-inline">Preseparation counseling may not be provided by an individual responsible for the retention of members in the armed force concerned.</text>
            </subparagraph>
            <subparagraph id="H1525319D089C4A539F08D4DAC5242FD4" indent="up2">
              <enum>(C)</enum>
 <text display-inline="yes-display-inline">Preseparation counseling shall be provided in person to the extent practicable. If the Secretary concerned determines that a member cannot attend such counseling in person, such member may receive such counseling remotely.</text>
            </subparagraph>

          </quoted-block>
        </paragraph>
      </subsection> 
<subsection id="HD126328FBE3A4504BA00BFC816A0C630"><enum>(d)</enum><header>Period of eligibility: expansion</header><text display-inline="yes-display-inline">Such subsection is further amended, in paragraph (3)—</text> <paragraph id="H95B5BAE80722455D8A641546E506C7E1"><enum>(1)</enum><text>by striking <quote>365</quote> each place it appears and inserting <quote>540</quote>; and</text></paragraph> 
<paragraph id="H18DE159F1F634C62AA8630F9EBAE75DB"><enum>(2)</enum><text>by striking <quote>365-day</quote> and inserting <quote>540-day</quote>.</text></paragraph></subsection> <subsection id="H46EABDDD676644F7BA7089BB18640664"><enum>(e)</enum><header>Waiver for certain members of the reserve components</header><text display-inline="yes-display-inline">Such subsection is further amended, in paragraph (4), by adding at the end the following new subparagraph:</text> 
<quoted-block style="USC" id="H0E0A38F5755246AF83F2561B236BB814" display-inline="no-display-inline"> 
<subparagraph id="H46A7D0CCB2AF4B61A7C0CE8B9F01B9DB" indent="up2"><enum>(D)</enum><text display-inline="yes-display-inline">The Secretary concerned may waive the requirement for preseparation counseling under paragraph (1) in the case of a member of the reserve components if—</text> <clause id="H46A8C673AADF471B8D222F9BC5E4B9A4"><enum>(i)</enum><text>the member requests such a waiver;</text></clause> 
<clause id="H3E52348A3BD3428A9F3C1B2A3D36A8A8"><enum>(ii)</enum><text>the member received preseparation counseling during the period of three years preceding the date of such request; and</text></clause> <clause id="HB10EE16D807A43A9868AD7A7AFDD2C4A"><enum>(iii)</enum><text>matters covered by such counseling, specified in subsection (b), have not changed since the member last received such counseling.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8B8B5F1C385A46599AE65FD9570F8468">
        <enum>(f)</enum>
        <header>Eligibility of a member who reenlists To receive preseparation counseling</header>
 <text>Such subsection is further amended by adding at the end the following new paragraph:</text>

          <paragraph id="H149E3624001443E5AB44866E8ABF6DCD" indent="up1">
            <enum>(5)</enum>
 <text display-inline="yes-display-inline">The commanding officer of a member described in this subsection may, on a space available basis, authorize such member to receive preseparation counseling, regardless of whether such member reenlists or agrees to a new period of obligated service.</text>
          </paragraph>

        </quoted-block>
      </subsection> 
<subsection id="H8F54D9765F354CE2A37ED258B8EDAD58"><enum>(g)</enum><header>Repeat attendance</header><text>Such subsection is further amended by adding at the end the following new paragraph:</text> <quoted-block style="USC" id="H0602795CD29049D597ED52BFC7015D3D" display-inline="no-display-inline"> <paragraph id="H65DACFBC16744ED582B11F89DB58AD4D" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">A member who received preseparation counseling under this section may, before separation, retirement, or discharge, request to receive, on a space-available basis, such preseparation counseling a second time.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA73FC38A540246B2A57B072F6292991E"><enum>(h)</enum><header>Elective inclusion of the spouse of a member</header><text display-inline="yes-display-inline">Such section is further amended, in subsection (b), in paragraph (5), by striking <quote>regarding the matters covered by paragraphs (9), (10), and (16)</quote>.</text></subsection> <subsection id="H8E8FD9B14F1D4F89BD69B9D4173827A5"><enum>(i)</enum><header>Minimum amount of counseling regarding financial planning</header><text display-inline="yes-display-inline">Such subsection is further amended, in paragraph (9)—</text> 
<paragraph id="H3853AD68591B4F2297658922182C5949"><enum>(1)</enum><text>by striking <quote>Financial</quote> and inserting <quote><header-in-text level="subparagraph" style="USC">(A)</header-in-text> General financial</quote>;</text></paragraph> <paragraph id="HB67EEAD473664E12A22C561AC8ECB2C7"><enum>(2)</enum><text>by striking <quote>loans</quote> and inserting <quote>loans and other debt, investing</quote>; and</text></paragraph> 
<paragraph id="H6BFFD21E1BED49698D970AD314F1E743"><enum>(3)</enum><text>by adding at the end the following new subparagraphs:</text> <quoted-block style="OLC" id="H9C8FFEC9D7114CD4B1FA1664603C621B" display-inline="no-display-inline"> <subparagraph id="H91F4750024EA46238BE4806A9184A5D8" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Individualized assistance regarding matters described in subparagraph (A).</text></subparagraph> 
<subparagraph id="HE87ACCAD98A540179C4DC290F4B16FD8" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Counseling under subparagraph (A) or (B) shall be provided by an individual who has significant experience in financial planning and may not be shorter than one hour.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HC5ED04BF37434295AF3EA39E1C12623D"><enum>(j)</enum><header>Pathways: standardization; establishment of pathway for members of the reserve components</header><text display-inline="yes-display-inline">Such section is further amended, in paragraph (1) of subsection (c), in the matter preceding subparagraph (A)—</text> 
<paragraph id="H9583062B8ADE44568E30074BE237E0C9"><enum>(1)</enum><text>by striking <quote>Each Secretary concerned</quote> and inserting <quote>The Secretaries of Defense and Homeland Security</quote>; and</text></paragraph> <paragraph id="H20C1282E257249289929F08DCEC403EA"><enum>(2)</enum><text>by striking <quote>pathways for members of the military department concerned</quote> and inserting <quote>pathways, standardized across the armed forces and including one pathway for members of the reserve components, for members</quote>.</text></paragraph></subsection> 
<subsection id="HCDD1606E57DE44D58F804E827536B39C"><enum>(k)</enum><header>Pathways: record of pathway assignment</header><text>Such subsection is further amended by adding at the end the following new paragraph:</text> <quoted-block style="USC" id="H0A6C5D828F834E8A8242564C74AAFE73" display-inline="no-display-inline"> <paragraph id="H1FE417DFCA854E51BCCDFFDB217CE4F7" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary concerned shall ensure that the pathway in which a member is placed, and the reasons for such placement, are noted in the service record of such member.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8C3D88FDAD354C07B6B78BCBB86575B4" commented="no"><enum>(l)</enum><header>Coordination between Departments of Defense, Veterans Affairs, and Labor</header><text display-inline="yes-display-inline">Such section is further amended, in subsection (d)—</text> <paragraph id="H5546FEA953FB4B1899F886D499044553" commented="no"><enum>(1)</enum><text>by striking the heading and inserting <quote><header-in-text level="subsection" style="USC">Transmission of certain information to other departments</header-in-text></quote>;</text></paragraph> 
<paragraph id="H864DD1078F6A473481BCD5AEAAEB7DBD" commented="no"><enum>(2)</enum><text>by inserting <quote><header-in-text level="paragraph" style="USC">(1)</header-in-text></quote> before <quote>In the case</quote>; and</text></paragraph> <paragraph id="H6F72C4D82AB64477B86CF99D8D070054" commented="no"><enum>(3)</enum><text>by adding at the end the following new paragraphs:</text>

<paragraph id="H97AABA183A894FBEBD91E5653589E324" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Before a member described in subsection (a) separates, retires, or is discharged, the Secretary concerned shall transmit to the Secretary of Veterans Affairs the following information:</text> <subparagraph id="HEC9FC65AC9C846A6BDEBB338BF7C337B" commented="no"><enum>(A)</enum><text>The contact information of such member.</text></subparagraph> 
<subparagraph id="H63D640F3295A475995128A69CCAB1B1A">
                <enum>(B)</enum>
 <text display-inline="yes-display-inline">The Department of Defense Form DD–2648 regarding such member.</text>
              </subparagraph></paragraph> 
<paragraph id="H9EC539985C6141C0AD426556326FE72B" indent="up1"><enum>(3)</enum> 
<subparagraph id="HEA6C0BABB98A4D07B589D216FADA2771" display-inline="yes-display-inline"><enum>(A)</enum><text>In the case of a member described in subsection (a) whom the Secretary concerned determines is at risk for a difficult transition to civilian life, the Secretary concerned shall, before the member separates, retires, or is discharged, provide—</text> <clause id="HF6BE9B240BCB4ECD8A9DA080E969E262" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">such member with the contact information of an employee of the Department of Veterans Affairs and an employee of the Department of Labor; and</text></clause> 
<clause id="H389EF47B59DA429FB7295A2D7650D677" indent="up1"><enum>(ii)</enum><text>such employees with the contact information of such member.</text></clause></subparagraph> <subparagraph id="H6DE0C9FC11E940E6A5BCE1CAB1892C74" indent="up1" commented="no"><enum>(B)</enum><text>Each employee described in subparagraph (A) shall contact the member described in such subparagraph not later than 60 days after such member separates, retires, or is discharged.</text></subparagraph> 
<subparagraph id="HB2E95E263EF145C2ACC19CC93965513C" indent="up1"><enum>(C)</enum><text>The Secretary of Veterans Affairs and the Secretary of Labor shall each submit to the Committees on Armed Services and on Veterans’ Affairs of the Senate and House of Representatives an annual report that identifies the number of times, and reasons why, an employee of the department under the jurisdiction of such Secretary failed to carry out subparagraph (B) in the year preceding the date of the report.</text> </subparagraph> <subparagraph id="H09008BAF3DCA489FA39F591C49780969" indent="up1"><enum>(D)</enum><text>The Secretary of Defense and Secretary of Homeland Security shall prescribe regulations to ensure that, for purposes of this paragraph, each Secretary concerned uses the same definition of the term <quote>at risk for a difficult transition to civilian life</quote>.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H04EA9179A3D543BBA2A3D5F3AFF8CC20"><enum>(m)</enum><header>Contracting: standardization</header><text display-inline="yes-display-inline">Such section is further amended by adding at the end the following new subsection:</text> <quoted-block style="USC" id="H6662C85CB53D4A5DB38D094D607066C0" display-inline="no-display-inline"> <subsection id="H734E4EE06C954915A4184F027F1B760D"><enum>(f)</enum><header>Contracting</header><text display-inline="yes-display-inline">A Secretary concerned may enter into an agreement with an entity under which such entity shall provide preseparation counseling under this section. If more than one Secretary seeks to enter into such an agreement, such Secretaries concerned shall, to the extent practicable, seek to enter into such agreements with the same entity.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HAA9F545DB65D4A9C9DEDA0C106D19363" commented="no"><enum>(n)</enum><header>Yearly surprise audits</header><text display-inline="yes-display-inline">Such section is further amended by adding at the end the following new subsection:</text> <quoted-block style="USC" id="H2B4B267E8F4A47DB976DDCB1674636C2" display-inline="no-display-inline"> <subsection id="H8492604D60184993BF01023F00852933"><enum>(g)</enum><header>Audits</header> <paragraph id="H7F39788951814ADC98B573CB7645C1AB" display-inline="yes-display-inline"><enum>(1)</enum><text>Not less than once each year, an employee or contractor of the Department of Veterans Affairs, and an employee or contractor of the Department of Labor, shall make unannounced visits to preseparation counseling under this section in order to audit such counseling.</text></paragraph> 
<paragraph id="HB642373920144ACA8EFB6609FC3A03BA" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Not later than 90 days after such a visit, the employee or contractor shall submit to the Committees on Armed Services and on Veterans’ Affairs of the Senate and House of Representatives a report regarding such audit.</text></paragraph> <paragraph id="H9468C5C34BB646E99B18DC50D187DD3F" indent="up1"><enum>(3)</enum><text>Such employees or contractors shall have expertise regarding matters described in subsection (b).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H43A362D7A5534FE8B81643817987A355"><enum>(o)</enum><header>Information provided to State veterans agencies regarding members separating from the Armed Forces</header> 
<paragraph id="H69AE0CB78D1242F2AB76DC2A7E5E5E1C"><enum>(1)</enum><header>Expansion</header><text>Section 570F of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/1142">10 U.S.C. 1142</external-xref> note) is amended, in subsection (a)—</text> <subparagraph id="H40D41088970A4247A6EB29F17EAD3C95"><enum>(A)</enum><text>by redesignating paragraph (8) as paragraph (9); and</text></subparagraph> 
<subparagraph id="H95C1D312C2C04068988B20F9430BC127"><enum>(B)</enum><text>by inserting, after paragraph (7), the following new paragraph (8):</text> <quoted-block style="OLC" id="H592166924CD24B42BC7AF56099496F71" display-inline="no-display-inline"> <paragraph id="HB0BA418BA3E74F5FB83D2DC944B27A53"><enum>(8)</enum><text display-inline="yes-display-inline">Benefits for low-income households, including the supplemental nutrition assistance program (as such term is defined in section 3 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/88/525">Public Law 88–525</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012</external-xref>)). </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HCFF16AF7230F4BE3BEF62EB62972790E"><enum>(2)</enum><header>Limitation of voluntary participation</header><text>Such section is further amended, in subsection (d), by striking <quote>Information</quote> and inserting <quote>Except for information related to whether an individual is eligible for benefits described in paragraph (8) of subsection (a), information</quote>.</text></paragraph></subsection> <subsection id="H6339D545385843619E813C6F83B6E556"><enum>(p)</enum><header>Pilot program for military spouses</header> <paragraph id="H8D3F629DB00D439C94CFE1509FA70046"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Defense shall establish a pilot program for spouses of members of the covered Armed Forces who are eligible to receive preseparation counseling under TAP.</text></paragraph> 
<paragraph id="HCE69B6E610B64C2BA94612D30663551E"><enum>(2)</enum><header>Voluntary basis</header><text>Participation in the pilot program shall be on a voluntary basis.</text></paragraph> <paragraph id="H810C27863C814FE7ABFD7DAEE09A0045"><enum>(3)</enum><header>Curriculum</header><text display-inline="yes-display-inline">The Secretary of Defense, in coordination with the Secretary of Veterans Affairs and the Secretary of Labor, shall establish a curriculum based on TAP for the pilot program.</text></paragraph> 
<paragraph id="HD88C807C2986426BB8805A13D52D0A62"><enum>(4)</enum><header>Counseling</header><text>Counseling under the pilot program shall—</text> <subparagraph id="H2529BB67B48840D997F4674BEEA0BE15"><enum>(A)</enum><text display-inline="yes-display-inline">be tailored to the military spouse and family;</text></subparagraph> 
<subparagraph id="H15877FE45C2D4920883604CE4BC8C78A"><enum>(B)</enum><text display-inline="yes-display-inline">be offered at least once per calendar quarter at each location selected under paragraph (5);</text></subparagraph> <subparagraph id="H053FEF1A8CC74F13BCEE612305D7BDCF"><enum>(C)</enum><text display-inline="yes-display-inline">be offered at times including nights and weekends; and</text></subparagraph> 
<subparagraph id="HC2130EA718C440AD969962BFF1945FED"><enum>(D)</enum><text>include at least one hour regarding benefits and assistance available to military families and veterans from each department under the jurisdiction of the Secretaries specified in subparagraph (C).</text></subparagraph></paragraph> <paragraph id="HB3306CC63BC84677BEDA2CBE3E1AE4B6" commented="no"><enum>(5)</enum><header>Locations</header><text>The Secretary of Defense shall carry out the pilot program at not fewer than five military installations of each of the covered Armed Forces. One such location shall be located outside the continental United States.</text></paragraph> 
<paragraph id="H495AFDC3B7134C368554775C5D2427A8"><enum>(6)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year before the pilot program terminates, the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and House of Representatives a report to the regarding the pilot program. Such report shall include elements the Secretary determines appropriate, including whether the pilot program should be made permanent.</text></paragraph> <paragraph id="H4576432229FF44B6AA90A0B41BD4CC6C"><enum>(7)</enum><header>Termination</header><text>The pilot program shall terminate three years after the Secretary of Defense establishes the pilot program.</text></paragraph> 
<paragraph id="H3D8E667C6DED43B7A32C0D5300FE1E25"><enum>(8)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="HE5BBD979A2A04E1B8CC4BBFD216584A2"><enum>(A)</enum><text>The term <quote>covered Armed Force</quote> means the Army, Navy, Marine Corps, Air Force, or Space Force.</text></subparagraph> 
<subparagraph id="HE31C4E168EBF42CB8558E048ABB9C289"><enum>(B)</enum><text display-inline="yes-display-inline">The term <quote>TAP</quote> means the Transition Assistance Program under sections 1142 and 1144 of title 10, United States Code.</text></subparagraph></paragraph></subsection> <subsection id="HD8AFC19207674BC6938E2CF25D191E8F"><enum>(q)</enum><header>Reports; tracking system</header> <paragraph id="H91651986883B41CEA97173EFBBABB68B"><enum>(1)</enum><header>Annual report on TAP participation</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, and annually thereafter for four years, the Secretary of Defense shall submit to the Committees on Armed Services and on Veterans’ Affairs of the Senate and House of Representatives a report on the Transition Assistance Program at military installations where at least 250 members per year receive preseparation counseling under section 1142 of title 10, United States Code. Such report shall include the following elements with regards to the year preceding the date of such report, disaggregated by military installation:</text> 
<subparagraph id="H881C5E1D0C184DE5984D583DDA73607D"><enum>(A)</enum><text display-inline="yes-display-inline">The number of members described in subsection (a)(1)(B)(ii) of such section 1142, as added by subsection (a), who received fewer than five days of preseparation counseling under such section.</text></subparagraph> <subparagraph id="H1FF449A23D69409BB65AC8ACCA3BAE81"><enum>(B)</enum><text display-inline="yes-display-inline">The average period of time between when a member begins to receive preseparation counseling and the day the member separates, retires, or is discharged.</text></subparagraph> 
<subparagraph id="HB375777FB4C242B4909D3472E7AFE99D"><enum>(C)</enum><text display-inline="yes-display-inline">The number of members who began to receive preseparation counseling and then re-enlisted or agreed to a new period of obligated service.</text></subparagraph> <subparagraph id="HCCCD5C3E2B124510B735136F58C0023B"><enum>(D)</enum><text display-inline="yes-display-inline">The number of members who began to receive preseparation counseling and then were deployed.</text></subparagraph> 
<subparagraph id="H038AC2F63D0646DC979E7811B5403E7C"><enum>(E)</enum><text display-inline="yes-display-inline">The number of members assigned to each pathway under subsection (c) of such section.</text></subparagraph> <subparagraph id="H65BE88CC755449BFB446905D5E260ECD"><enum>(F)</enum><text display-inline="yes-display-inline">The number of members who, in the course of such preseparation counseling, were referred to another Federal agency or department.</text></subparagraph> 
<subparagraph id="H411AA79882954D6CBAC8C0E428BC6B97"><enum>(G)</enum><text>The Federal agencies or departments to which members were so referred.</text></subparagraph> <subparagraph id="HEC32BFB55D294EA0B17818EDA4C551DA"><enum>(H)</enum><text>The number of members who should have been, but were not, so referred, and reasons why such referrals did not occur.</text></subparagraph> 
<subparagraph id="H708A56E0DE984FFEB460E5E5D934DE7E"><enum>(I)</enum><text display-inline="yes-display-inline">The number of members who receive such preseparation counseling and apply for unemployment compensation under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/85">chapter 85</external-xref> of title 5, United States Code.</text></subparagraph> <subparagraph id="HA17863C0D5DA45F5B3F96E44E4A61BF4"><enum>(J)</enum><text display-inline="yes-display-inline">The total amount of such unemployment compensation paid to members separating from the Armed Forces.</text></subparagraph> 
<subparagraph id="HB0A663C251594E788309F2E12207EB70"><enum>(K)</enum><text display-inline="yes-display-inline">The frequency with which the commander of the military installation received a briefing regarding attendance of members in accordance with statutory requirements of the Transition Assistance Program.</text></subparagraph></paragraph> <paragraph id="H1EDC5DD9778E4767BC9842063802B690"><enum>(2)</enum><header>Annual report on TAP curricula</header><text display-inline="yes-display-inline">Not less than once each year after the date of the enactment of this Act, the Secretaries of Defense, Veterans Affairs, and Labor shall—</text> 
<subparagraph id="H2B50AAFCC5DC46068D790822D3D56066"><enum>(A)</enum><text>review and update curricula under the Transition Assistance Program; and</text></subparagraph> <subparagraph id="H874DAA58D9A54DB2B3FBD183DB2C2801"><enum>(B)</enum><text>submit to Congress copies of such curricula.</text></subparagraph></paragraph> 
<paragraph id="HE5E581CBB62945D19E33E880EFE1C7F3"><enum>(3)</enum><header>Tracking of timeliness</header> 
<subparagraph id="HADF9DCB406FC4F54BE5A5D243503D540"><enum>(A)</enum><header>Implementation</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Defense shall implement a system to track how many, and what percentage of, members of the Armed Forces begin to receive preseparation counseling within the time periods established in section 1142 of title 10, United States Code.</text></subparagraph> <subparagraph id="H7C5AA75FC4424374899808F2FF56F0CA"><enum>(B)</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, and annually thereafter, the Secretary of Defense shall submit to the Committees on Armed Services, and the Committees on Veterans’ Affairs, of the Senate and House of Representatives, a report on data recorded with such tracking system during the year preceding the date of such report. Such report shall include a list of the seven military installations located inside the continental United States, and three military installations located outside the continental United States, where members are least likely to receive TAP preseparation counseling in accordance with such time periods.</text></subparagraph></paragraph></subsection></section> 
<section id="H24A8FDF0AA704C45A018CCCADAF5F714"><enum>3.</enum><header>Transitional health care for members being separated or recently separated: extension of availability</header><text display-inline="no-display-inline">Section 1145(a) of title 10, United States Code, is amended—</text> <paragraph id="H6007AD2677C44458843F2A79BB18A6EF"><enum>(1)</enum><text>in paragraph (4)—</text> 
<subparagraph id="HB6B4CE59EDAC4FB3A619817DED9947EF"><enum>(A)</enum><text>by striking <quote>180 days</quote> and inserting <quote>270 days</quote>; and</text></subparagraph> <subparagraph id="H94B4BA2B1E20406DA7FC61827A08EF62"><enum>(B)</enum><text>by striking <quote>180-day period</quote> and inserting <quote>270-day period</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H1FB9886E99234528AA0EDDC23B1E0B82"><enum>(2)</enum><text>in paragraph (7)—</text> <subparagraph id="HAD45A0FB7B9F4C6BA7BB9B5A14CD4DD5"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>180-day transition period</quote> and inserting <quote>270-day transition period</quote>; and</text></subparagraph> 
<subparagraph id="H0C72B5DCA13841178ED5CAF45361E49C"><enum>(B)</enum><text>by striking <quote>180 days</quote> both places it appears and inserting <quote>270 days</quote>.</text></subparagraph></paragraph></section> <section id="HF56A67AA0ABD44128F0686F33000F5D1"><enum>4.</enum><header>Skillbridge: GAO study</header> <subsection id="H40E16C0610C146E5B073E5B788485F63"><enum>(a)</enum><header>Study required</header><text>The Comptroller General of the United States shall conduct a study of the Skillbridge programs under section 1143(e) of title 10, United States Code.</text></subsection> 
<subsection id="HA3B0F4AFAE92404CAB6D9D194A54FC13"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, the Comptroller General shall submit to the Committees on Armed Services, and the Committees on Veterans’ Affairs, of the Senate and House of Representatives, a report regarding such study. Such report shall include observations and recommendations of the Comptroller regarding, with respect to members and employers who participate in Skillbridge—</text> <paragraph id="H94905830EF134F96B537A15323A157CE"><enum>(1)</enum><text display-inline="yes-display-inline">differences in criteria for participation between the Armed Forces;</text></paragraph> 
<paragraph id="HEC1DD83CDB494D259CBF91D95BAC1BE1"><enum>(2)</enum><text display-inline="yes-display-inline">other differences in Skillbridge programs between the Armed Forces;</text></paragraph> <paragraph id="H3CEC9F07116942E6A88D119C0831EA94"><enum>(3)</enum><text display-inline="yes-display-inline">best practices in Skillbridge programs across the Armed Forces, including—</text> 
<subparagraph id="H2B3F0D4AB8F44ADAB3DD811416CF597C"><enum>(A)</enum><text>the selection of employers; and</text></subparagraph> <subparagraph id="H28E97E76D06E43F094F27509503A4036"><enum>(B)</enum><text>the development of contracts; and</text></subparagraph></paragraph> 
<paragraph id="H3599141ED4094415AD6BDDFDE747162F"><enum>(4)</enum><text display-inline="yes-display-inline">the feasibility of making Skillbridge programs uniform across the Armed Forces.</text></paragraph></subsection></section> <section id="HF9F7122534EC4C22917CE341A632335E"><enum>5.</enum><header>Website of the Department of Veterans Affairs regarding programs for new veterans</header><text display-inline="no-display-inline">Section 523 of title 38, United States Code, is amended by adding at the end the following new subsection:</text>

<subsection id="H72D4E4048F604136A4B6E3C805639C0E"><enum>(c)</enum><text display-inline="yes-display-inline">The Secretary shall maintain a publicly available website of the Department through which a veteran or dependent of a veteran may search by ZIP code for programs for veterans who recently separated from active military, naval, air, or space service, or dependents of such veterans.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H56A9BF0D875143AFA4BE0A4C2F7F5750" section-type="subsequent-section" display-inline="no-display-inline"><enum>6.</enum><header>Expansion of eligibility for a certain program of job counseling, training, and placement service for veterans</header> <subsection id="HA81B60D99A5A48C3A69E30902EA95888"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 4101 of title 38, United States Code, is amended in paragraph (5)—</text> 
<paragraph id="H6627306CEE854EAA8E59243BB2D45949"><enum>(1)</enum><text>in subparagraph (A), by striking the comma at the end and inserting a semicolon;</text></paragraph> <paragraph id="H5E34656C7DED427DA5EBB21095723FE4"> <enum>(2)</enum> <text>in subparagraph (B), by striking <quote>power, or</quote> and inserting <quote>power;</quote>;</text>

<paragraph id="H553245E9B0D349DEB40AFDF3D720C2CD"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by inserting <quote>and certain eligible persons</quote> after <quote>eligible veterans</quote>;</text></paragraph> <paragraph id="HD24049832B584D7E8ED4ECA654C87CB3"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (C) as subparagraph (D); and</text></paragraph>

<subsection id="H360CD56C8671483DABE4257D7AC0BD12" display-inline="no-display-inline"><enum>(a)</enum><header>Clarification of reference to TAP</header><text display-inline="yes-display-inline">Subsection (b) of section 6320 of title 38, United States Code, is amended, in of paragraph (1), by striking <quote>transition classes or separation</quote> and inserting <quote>TAP classes or preseparation counseling</quote>.</text></subsection> <subsection id="HB10C65A41D13480499E22ADEFB9A7319"><enum>(b)</enum><header>Provision of TAP materials</header><text display-inline="yes-display-inline">Such paragraph is further amended—</text>
