Drinking water assistance to colonias.</toc-entry></toc></subsection></section><section commented="no" id="H4E355A1499774298841AFE80EBC32380"><enum>2.</enum><header>Water Affordability, Transparency, Equity, and Reliability Trust Fund</header><subsection id="H98B5323E9C7C444AB351C98385DF6419"><enum>(a)</enum><header>Establishment</header><paragraph id="H12E9F9AEBF504B75A63DAA74D679A230"><enum>(1)</enum><header>In general</header><text>Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/98">chapter 98</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block id="H6FB3CD2B95624405BFE67B2B656BFF91" style="OLC"><section commented="no" id="H1F2708B2DA424D308CA65869F614E09A"><enum>9512.</enum><header>Water Affordability, Transparency, Equity, and Reliability Trust Fund</header><subsection commented="no" id="H24643106F7C54356AB47615879B494E1"><enum>(a)</enum><header>Creation of trust fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a trust fund to be known as the <quote>Water Affordability, Transparency, Equity, and Reliability Trust Fund</quote> (referred to in this section as the <quote>Trust Fund</quote>), consisting of such amounts as may be appropriated or credited to such Trust Fund as provided in this section or section 9602(b).</text></subsection><subsection commented="no" id="H39F45890ABE1486585871A0B9480EE78"><enum>(b)</enum><header>Transfers to fund</header><paragraph id="H3D582F79FB7C403F96EC47926A74C38A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There are hereby appropriated to the Trust Fund such amounts as the Secretary from time to time estimates are equal to the increase in Federal revenues attributable to the amendment made by section 2(b) of the <short-title>Water Affordability, Transparency, Equity, and Reliability Act of 2025</short-title>.</text></paragraph><paragraph id="H1112D833DA5B40CB8B411D224BBB73FE"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">The sum of the amounts appropriated under paragraph (1) during any fiscal year shall not exceed the larger of—</text><subparagraph id="H702B939D04FA49F991199B0C0D7BB9D5"><enum>(A)</enum><text>$35,000,000,000, and</text></subparagraph><subparagraph id="H1A3B29CD38A343C5B36AC13E171C742F"><enum>(B)</enum><text>one-twentieth of the sum of—</text><clause id="HCE6651A97E8746788A35E4E5BB63EB14"><enum>(i)</enum><text display-inline="yes-display-inline">the 20-year need identified in the most recent assessment conducted by the Administrator of the Environmental Protection Agency in accordance with section 1452(h) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-2">42 U.S.C. 300j–2(h)</external-xref>), plus</text></clause><clause id="H924C203732544133A7B8434D673FEB65"><enum>(ii)</enum><text display-inline="yes-display-inline">the 20-year need identified in the most recent needs survey submitted by the Administrator pursuant to sections 205(a), 516, and 609 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1285">33 U.S.C. 1285(a)</external-xref>, 1375, 1389).</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="HB069975CB4704AF2A420A83168B6CB1F"><enum>(c)</enum><header>Expenditures</header><text display-inline="yes-display-inline">Amounts in the Trust Fund are available, without further appropriation and without fiscal year limitation, for the purposes described in section 2(c) of the <short-title>Water Affordability, Transparency, Equity, and Reliability Act of 2025</short-title>.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HBAF6CB2E9EB04EDFB4A142A607252010"><enum>(2)</enum><header>Clerical amendment</header><text>The table of parts for subchapter A of chapter 98 of such Code is amended by inserting after the item relating to section 9511 the following new item:</text><quoted-block display-inline="no-display-inline" id="HF60E551EE4CB4C2DB2A8BC3CBBD60A31" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 9512. Water Affordability, Transparency, Equity, and Reliability Trust Fund.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2E031C161DBE47C9A11362A321AF5A57"><enum>(b)</enum><header>Increase in corporate tax rate</header><paragraph id="H54F9FB73AF30485F922D987BF44A5EE6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/11">Section 11(b)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>21</quote> and inserting <quote>24.5</quote>.</text></paragraph><paragraph id="HAC0AA0CD85D943BC9D6C0823EDD7B4BD" commented="no"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this subsection shall apply to taxable years beginning after December 31, 2024.</text></paragraph></subsection><subsection id="HEBCB456F4ED0474E8B8068D73F379096" commented="no"><enum>(c)</enum><header>Allocation of funds</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency, the Secretary of Agriculture, the Secretary of Health and Human Services, and the Secretary of Labor shall allocate, for a fiscal year, the funds available, at the beginning of such fiscal year, in the Water Affordability, Transparency, Equity, and Reliability Trust Fund, established by <external-xref legal-doc="usc" parsable-cite="usc/26/9512">section 9512</external-xref> of the Internal Revenue Code of 1986, as follows:</text><paragraph id="HD0887E4AB51642BCBF07020F1D25E024" commented="no"><enum>(1)</enum><header>Clean water programs</header><text>Of such amount, the Administrator shall make available—</text><subparagraph id="H6720A7DC3DB7423EA9174C82F671CEAB" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">0.5 percent for making grants under section 104(b)(8) of the Federal Water Pollution Control Act;</text></subparagraph><subparagraph id="H29F6CF7F8C9C455B89972014BB5AA7AE" commented="no"><enum>(B)</enum><text>1.5 percent for making grants under section 106 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1256">33 U.S.C. 1256</external-xref>);</text></subparagraph><subparagraph id="HFFBE58C795D245E5AC6E94A9CFBA8292" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">2.5 percent for making grants under section 226 of such Act;</text></subparagraph><subparagraph id="H17230B2F0E6A40829F95DD599E6E71FB" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">2.5 percent for making grants under section 319 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1329">33 U.S.C. 1329</external-xref>); and</text></subparagraph><subparagraph id="H5DAD6014DB954487B48919F951A2BAC1" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">42 percent for making capitalization grants under section 601 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381</external-xref>).</text></subparagraph></paragraph><paragraph id="H36BB3001A9E24319A6076C25F4808199" commented="no"><enum>(2)</enum><header>Safe drinking water funding</header><text>Of such amount, the Administrator shall make available—</text><subparagraph id="HA3E3E7CCE60D406BBFE9D5E43D722E5A" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">0.5 percent for providing technical assistance under section 1442(e) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-1">42 U.S.C. 300j–1(e)</external-xref>);</text></subparagraph><subparagraph id="HF1B46482CE8D4693AD0D6A77ECADD871" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">42 percent for making capitalization grants under section 1452 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>);</text></subparagraph><subparagraph id="H5A7E246A18274F84BD0FC7DD38A2E8F0" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">3 percent for making grants under section 1465 of such Act; and</text></subparagraph><subparagraph id="H280DE7DD21844318BA64FADA5604887D" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">0.5 percent for making grants under section 1456 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-16">42 U.S.C. 300j–16</external-xref>) and for making grants under section 307 of the Safe Drinking Water Act Amendments of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/33/1281">33 U.S.C. 1281</external-xref> note).</text></subparagraph></paragraph><paragraph id="HF98C087159E64046B78104D7F4392C3C" commented="no"><enum>(3)</enum><header>Household water well systems</header><text>Of such amount, the Secretary of Agriculture shall make available 1 percent for making grants under section 306E of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926e">7 U.S.C. 1926e</external-xref>).</text></paragraph><paragraph id="H18D93008D92C49F7AB7C7FD735D72402" commented="no"><enum>(4)</enum><header>Colonias</header><text>Of such amount, the Secretary of Agriculture shall make available 0.5 percent for making grants under section 306C of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926c">7 U.S.C. 1926c</external-xref>) described in subsection (c) of such section.</text></paragraph><paragraph id="H5690975D383743C99FDA28433F6364D4" commented="no"><enum>(5)</enum><header>Indian health services</header><text>Of such amount, the Secretary of Health and Human Services, acting through the Director of the Indian Health Service, shall make available 3 percent for making grants for the planning, design, construction, modernization, improvement, and renovation of water, sewer, and solid waste sanitation facilities that are funded, in whole or part, by the Indian Health Service—</text><subparagraph id="HCCADCDBEC182407A831F4C840A43261A" commented="no"><enum>(A)</enum><text>through, or provided for in, a contract or compact with the Indian Health Service under the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5301">25 U.S.C. 5301 et seq.</external-xref>);</text></subparagraph><subparagraph id="HA7D67239A5A84F61AC2FE1A14655F297" commented="no"><enum>(B)</enum><text>pursuant to section 7 of the Act of August 5, 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2004a">42 U.S.C. 2004a</external-xref>); or</text></subparagraph><subparagraph id="H15550458953541D896FABFD7736340DA" commented="no"><enum>(C)</enum><text>pursuant to section 302 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1632">25 U.S.C. 1632</external-xref>).</text></subparagraph></paragraph><paragraph id="HFD8DA0626B78487096804D1304AF216D" commented="no"><enum>(6)</enum><header>Water operators job training grants</header><text display-inline="yes-display-inline">Of such amount, the Secretary of Labor shall make available 0.5 percent for providing job training grants under section 414(f) of the American Competitiveness and Workforce Improvement Act of 1988.</text></paragraph></subsection><subsection id="H4E5D0F0C06C64D58B666F2D58CE82078" commented="no"><enum>(d)</enum><header>Prohibition</header><text display-inline="yes-display-inline">None of the funds allocated pursuant to subsection (c) may be used for any activity described in paragraphs (1) through (5) of section 203(a) of the Labor-Management Reporting and Disclosure Act of 1959 (<external-xref legal-doc="usc" parsable-cite="usc/29/433">29 U.S.C. 433(a)</external-xref>).</text></subsection></section><section id="H52496C93237E4406AC651B6F9916F968"><enum>3.</enum><header>Report on affordability, discrimination and civil rights violations, public participation in regionalization, and data collection</header><subsection id="H89B6961D40AF45F5A07F141A7301EA7D"><enum>(a)</enum><header>Study</header><paragraph id="H9B9393FD46654EA6A0CC27B4B2F7131F"><enum>(1)</enum><header>In general</header><text>The Administrator of the Environmental Protection Agency shall conduct a study on water and sewer services, in accordance with this subsection.</text></paragraph><paragraph id="H9AA1832CE19B47A6AE8D3A150FA0F304"><enum>(2)</enum><header>Affordability</header><text>In conducting the study under paragraph (1), the Administrator shall study water affordability nationwide, including—</text><subparagraph id="H19055ADB7C38433485A9A379C6E70DF6"><enum>(A)</enum><text display-inline="yes-display-inline">rates for water and sewer services, increases in such rates during the ten-year period preceding such study, and water service disconnections due to unpaid water service charges; and</text></subparagraph><subparagraph id="HF4656911A97349F9A2C4E1B60862CFDE"><enum>(B)</enum><text display-inline="yes-display-inline">the effectiveness of funding under section 1452 of the Safe Drinking Water Act and under section 601 of the Federal Water Pollution Control Act for promoting affordable, equitable, transparent, and reliable water and sewer service.</text></subparagraph></paragraph><paragraph id="HF8B13DBAC1EE4145A54565DAC63F6CA7"><enum>(3)</enum><header>Discrimination and civil rights</header><text display-inline="yes-display-inline">In conducting the study under paragraph (1), the Administrator, in collaboration with the Civil Rights Division of the United States Department of Justice, shall study—</text><subparagraph id="HB35A141105BD4C13A0F89F882B67B6F4"><enum>(A)</enum><text>discriminatory practices of water and sewer service providers;</text></subparagraph><subparagraph id="H309E2CC6180848189EF8F539D8927FC2" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">discriminatory practices of State program administrators in allocating funding; and</text></subparagraph><subparagraph id="H5840BAC01882407CB38518C97472C855"><enum>(C)</enum><text display-inline="yes-display-inline">violations by such service providers and program administrators that receive Federal assistance of civil rights under title VI of the Civil Rights Act of 1964 with regard to equal access to water and sewer services.</text></subparagraph></paragraph><paragraph id="H4DA078CA8B1346DC876B469A9937B497"><enum>(4)</enum><header>Public participation in regionalization</header><text display-inline="yes-display-inline">In conducting the study under paragraph (1), the Administrator shall evaluate efforts to regionalize public water systems, as defined in section 1401(4) of the Safe Water Drinking Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f(4)</external-xref>), and sewer services with respect to public participation in—</text><subparagraph id="HDBFF559CCAD04EEABEA067BE666297B1"><enum>(A)</enum><text>the decision to undergo such regionalization; and</text></subparagraph><subparagraph commented="no" id="H44D79FCE83CB4840BEE8629538E94CB7"><enum>(B)</enum><text>decision making by the board of directors (or other governing body) of the entity that provides, or oversees or coordinates the provision of, water by the public water systems subject to such regionalization.</text></subparagraph></paragraph><paragraph id="HC0151336DD3C43BD9315D5FCA214267A"><enum>(5)</enum><header>Data collection</header><text display-inline="yes-display-inline">In conducting the study under paragraph (1), the Administrator shall collect information, assess the availability of information, and evaluate the methodologies used to collect information, related to—</text><subparagraph id="H7CBDFAE07F8346278A7B0EA005A31297"><enum>(A)</enum><text>people living without water or sewer services;</text></subparagraph><subparagraph id="H4D73CFEE872B43ABB4C33A3A098E08C1"><enum>(B)</enum><text display-inline="yes-display-inline">water service disconnections due to unpaid water service charges, including disconnections experienced by households containing children, elderly persons, disabled persons, chronically ill persons, or other vulnerable populations;</text></subparagraph><subparagraph id="HC9E14341580E4E75B30726460A1EBCC4"><enum>(C)</enum><text>tax liens and foreclosures due to unpaid water service charges; and</text></subparagraph><subparagraph id="H00DCBC2AD6B046A0A9A48B53F24CF52B"><enum>(D)</enum><text display-inline="yes-display-inline">disparate effects, on the basis of race, gender, or socioeconomic status, of water service disconnections, tax liens and foreclosures due to unpaid water service charges, and the lack of public water service.</text></subparagraph></paragraph></subsection><subsection id="H950080479C01464B99BD383B878EBC08"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Administrator of the Environmental Protection Agency shall submit to Congress a report that contains—</text><paragraph id="HBABD490F51424B1C9ADC42F44961F969"><enum>(1)</enum><text>the results of the study conducted under subsection (a)(1); and</text></paragraph><paragraph id="HA4AAB4F55403433A9C743EBE52E7F117"><enum>(2)</enum><text display-inline="yes-display-inline">recommendations for utility companies, Federal agencies, and States relating to such results.</text></paragraph></subsection></section><section id="H4FFC859B4FD049169D1A9E27990C6CEB"><enum>4.</enum><header>Household water well systems</header><text display-inline="no-display-inline">Section 306E(d) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1926e">7 U.S.C. 1926e(d)</external-xref>) is amended by striking <quote>$20,000,000 for each of fiscal years 2019 through 2023</quote> and inserting <quote>$348,500,000 for each fiscal year</quote>.</text></section><section id="H56E40765E6E94D028A90BA9BDBF81DFB"><enum>5.</enum><header>State water pollution control revolving funds</header><subsection id="HA01DD8BA4DE24215BF2A93572871B3FA"><enum>(a)</enum><header>Specific requirements</header><text display-inline="yes-display-inline">Section 602(b) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1382">33 U.S.C. 1382(b)</external-xref>) is amended—</text><paragraph id="H6C47D808F3A746C280F86EEBBF8E8E1E"><enum>(1)</enum><text>in paragraph (2), by striking <quote>will be made to the State with funds to be made available</quote> and inserting <quote>were made to the State with funds made available for fiscal year 2021</quote>;</text></paragraph><paragraph id="HA0B81C0226CA4F808D03B7082ACB779B"><enum>(2)</enum><text>in paragraph (13), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HE399F3FB16494EBF8BC77991A588AF30"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (14), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph id="H1C85A01157234DD2842963AE6A307531"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HD1792B4F8ACA424892ED7C4B007D573A" style="OLC"><paragraph id="H508A8EDA1D7C468A872D87869F740F9F"><enum>(15)</enum><text display-inline="yes-display-inline">the State will not provide financial assistance using amounts from the fund for any project that will provide substantial direct benefits to new communities, lots, or subdivisions, other than a project to construct an advanced decentralized wastewater system; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection display-inline="no-display-inline" id="HB1C3147AE7924AC18811F1E629106F39"><enum>(b)</enum><header>Projects and activities eligible for assistance</header><text display-inline="yes-display-inline">Section 603(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(c)</external-xref>) is amended—</text><paragraph id="HB9CD6E82F49642E8AD90B7F96DE86B83"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (11)(B), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HFE44BB5F6D48446680C4579DF885EC0F"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (12)(B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HAAB4641F7FF442D7877B4568FB304E4F"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H2A1532741BA84802823C616EB27F6178" style="OLC"><paragraph commented="no" id="H76BF708C17524161B6A714959A2A3EC6"><enum>(13)</enum><text display-inline="yes-display-inline">to any municipality or intermunicipal, interstate, or State agency for—</text><subparagraph commented="no" id="H341C5772CD3B45DB977F312BF2A2507F"><enum>(A)</enum><text>purchasing from a willing or unwilling seller a privately owned treatment works; and</text></subparagraph><subparagraph commented="no" id="H15BB1EED3455415280B41F314B2F2C20"><enum>(B)</enum><text display-inline="yes-display-inline">expenses related to canceling a contract for the operation or management of a publicly owned treatment works.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H424F77A7345A46E1B4BE5F6AF142BD88"><enum>(c)</enum><header>Increasing the amount of additional subsidization by the State</header><text display-inline="yes-display-inline">Section 603(i)(3)(B) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(i)(3)(B)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H4764D233B2DF4A1DBD4BAF0ADB4629F3" style="OLC"><subparagraph id="H98CD7D4824F34F2DA3E89111109A92F6"><enum>(B)</enum><header>Additional limitation</header><text display-inline="yes-display-inline">A State may use not less than 50 percent of the total amount received by the State in capitalization grants under this title for a fiscal year for providing additional subsidization under this subsection.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H12AE806D1A3D4BFA9B9BCE14809F4A9F"><enum>6.</enum><header>Use of State revolving loan funds under the Safe Drinking Water Act</header><text display-inline="no-display-inline">Section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) is amended—</text><paragraph commented="no" id="H18F7A2F9B7224025A05DB3A5B2126814"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph commented="no" id="HF5C03D25A91D4803B71F2713A026DB56"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="H2B2E8F528FA1434AA8F3B41A675A6C2F"><enum>(i)</enum><text>in subparagraph (A), by inserting <quote>publicly owned, operated, and managed</quote> before <quote>community water systems</quote>; and</text></clause><clause commented="no" id="H6AA0CDEE33A844D1B6607E1369283F06"><enum>(ii)</enum><text>in subparagraph (E), by striking <quote>The funds under this section shall not be used for the acquisition of real property or interests therein, unless the acquisition is integral to a project authorized by this paragraph and the purchase is from a willing seller.</quote> and inserting <quote>The funds under this section may also be used for purchasing from a willing or unwilling seller a privately owned community water system, or for the expenses related to canceling a contract for the operation or management of a community water system.</quote>; and</text></clause></subparagraph><subparagraph id="HA50A71DDB0314086B11870CCD0F6AB26"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HD3164CF8B1404FE786CF771C4789EE61" style="OLC"><paragraph commented="no" id="HE5F737B3F9374A5EAE4E1B16B2251B14"><enum>(6)</enum><header>Exception to public ownership, operation, and management requirement</header><text display-inline="yes-display-inline">Notwithstanding paragraph (2)(A), public water systems that regularly serve fewer than 10,000 persons, and which are not owned, operated, or managed by any person who owns, operates, or manages any other public water system, may receive assistance under this section.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="H98A0C2D0BD7D42ED9984AC1C3D2F3790"><enum>(2)</enum><text>by amending subsection (d)(2) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H96DBE112F0DB41AEBA819A814D9F45A1" style="OLC"><paragraph commented="no" display-inline="no-display-inline" id="HEA4237F8519C4A1EA272367796733383"><enum>(2)</enum><header>Total amount of subsidies</header><text>To the extent that there are sufficient applications for loans to communities described in paragraph (1), of the amount of the capitalization grant received by a State in a fiscal year, the total amount of loan subsidies made by the State in the fiscal year pursuant to paragraph (1) may not be less than 50 percent.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H4EFAB00415EA4803A58C2E2E64A41E06" commented="no"><enum>(3)</enum><text>in subsection (e), by striking <quote>to be made to the State</quote> and inserting <quote>that was made to the State in fiscal year 2021</quote>;</text></paragraph><paragraph id="H14B0A5CDFCC047108282E3FDB22FA59D"><enum>(4)</enum><text>in subsection (g)(3)—</text><subparagraph id="HD7A918F73E214A3090AF1C05FD36C460"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (B), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HD6988BD3406F49268EB1188127956B9E"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (C), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H1A439C5C3D0748F7A56B148CD8C5CFE4"><enum>(C)</enum><text>by inserting after subparagraph (C) the following:</text><quoted-block id="HBA153243F466499897D802883E63F9A1" style="OLC"><subparagraph id="H0F90DE420A7947F682C9E6B395A4C917"><enum>(D)</enum><text display-inline="yes-display-inline">guidance to ensure affordable, equitable, transparent and reliable water service provision, to provide protections for households facing service disconnection due to unpaid water service charges, and to promote universal equal access to water services.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="H72CED2D96CC24CC7B91309DF9CBE84BF"><enum>(5)</enum><text display-inline="yes-display-inline">in subsection (k)(1), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H051BB16D285D4FE0A4CF0DFD8453C1B5" style="OLC"><subparagraph commented="no" id="HC350F1D7DE744D21A760688211DF802B"><enum>(E)</enum><text display-inline="yes-display-inline">Provide assistance in the form of a grant to a publicly owned, operated, and managed community water system, for the purpose of replacing a lead service line (as defined in section 1459B) on private or public property with a copper service line that is lead-free (as defined in section 1417(d)) at no cost to the owner of the property.</text></subparagraph><subparagraph commented="no" id="H819DBFE8F42F4860A8CDBE96CD715401"><enum>(F)</enum><text display-inline="yes-display-inline">Provide assistance to a publicly owned, operated, and managed community water system for the purpose of updating treatment plants or switching water sources due to contamination from a perfluoroalkyl or polyfluoroalkyl substance that contains at least one fully fluorinated carbon atom.</text></subparagraph><subparagraph commented="no" id="HAF500EB1715B429F8911BCF4D914D4DE"><enum>(G)</enum><text display-inline="yes-display-inline">Provide assistance in the form of a grant to owners of a household water well that has been contaminated by a perfluoroalkyl or polyfluoroalkyl substance that contains at least one fully fluorinated carbon atom, for the purpose of purchasing and installing a household filtration system.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H5F9C0D1392E34BB895F02ED25379C54D"><enum>7.</enum><header>Drinking water grant programs</header><subsection commented="no" display-inline="no-display-inline" id="H0A70BC4829A04173898D44820537D8E8"><enum>(a)</enum><header>School drinking water improvement</header><text display-inline="yes-display-inline">Section 1465 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-25">42 U.S.C. 300j–25</external-xref>) is amended—</text><paragraph commented="no" id="HE3FFF84B91D0487795E16BC64C2A8022"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by striking <quote><header-in-text level="section" style="OLC">fountain</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">infrastructure</header-in-text></quote>;</text></paragraph><paragraph commented="no" id="H491749DFFB3C4CCB8201A156B3D4A7FA"><enum>(2)</enum><text>in subsection (a), by striking <quote>fountains manufactured prior to 1988</quote> and inserting <quote>infrastructure</quote>;</text></paragraph><paragraph commented="no" id="HFB7633EAF42049CBBAE392B2355332D0"><enum>(3)</enum><text>by amending subsection (b) to read as follows:</text><quoted-block display-inline="no-display-inline" id="H9B3E84EDB47E4EF0A001B9AA17C1313E" style="OLC"><subsection commented="no" id="HA1AAB602FBE04430ADAF468CDB0B804F"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Funds awarded under the grant program may be used to pay costs associated with—</text><paragraph commented="no" id="HC500DF3E62F54B1082BA6293834AEF7E"><enum>(1)</enum><text>installing, repairing, or replacing the infrastructure necessary to ensure that drinking water fountains, drinking water coolers, and bottle filling stations at schools are lead free; and</text></paragraph><paragraph commented="no" id="HCC3A9E1EFE0E476F91762F3B70CC2B0C"><enum>(2)</enum><text display-inline="yes-display-inline">monitoring and reporting of lead levels in the drinking water of schools, as determined appropriate by the Administrator.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HE66598E92E9B4F99B783CD70AEF10A24"><enum>(4)</enum><text>in subsection (d)—</text><subparagraph id="HDFA7FEEE511046C58A295FDAA5CB0419"><enum>(A)</enum><text>by striking <quote>$5,000,000</quote> and inserting <quote>$1,050,000,000</quote>; and</text></subparagraph><subparagraph id="H50452856452340E0A7CD924F6867B52A" commented="no"><enum>(B)</enum><text>by striking <quote>2021</quote> and inserting <quote>2027</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H1CC3B677CCD44CA781E4EF838426B2C4"><enum>(b)</enum><header>Tribal drinking water</header><text display-inline="yes-display-inline">Section 1452(i)(1) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12(i)(1)</external-xref>) is amended, in the first sentence—</text><paragraph commented="no" id="H8747B96EC7304E35981865DC24222CBE"><enum>(1)</enum><text>by striking <quote>1½</quote> and inserting <quote>Three</quote>; and</text></paragraph><paragraph commented="no" id="H85F09568E0C245268A821E883C0914C5"><enum>(2)</enum><text>by striking <quote>may</quote> and inserting <quote>shall</quote>.</text></paragraph></subsection></section><section id="HBFB4A5727F964D87820A773DEFF49811"><enum>8.</enum><header>Labor provisions</header><subsection id="H4DBA4F0750244F93B389413958E1EC97"><enum>(a)</enum><header>Prevailing rate of wage</header><text display-inline="yes-display-inline">Nothing in this Act shall affect the applicability of the requirements relating to labor standards of sections 513 and 602(b)(6) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1372">33 U.S.C. 1372</external-xref>, 1382(b)(6)) and section 1450(e) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-9">42 U.S.C. 300j–9(e)</external-xref>) to projects carried out under those Acts.</text></subsection><subsection id="HE7CBE64CABBD45E7A5BBB63DEFDE517B"><enum>(b)</enum><header>Project labor agreements</header><paragraph commented="no" id="H0E6061AD94A2424A9B3990F760DE1932"><enum>(1)</enum><header>Clean water revolving funds</header><text display-inline="yes-display-inline">Section 602(b) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1382">33 U.S.C. 1382(b)</external-xref>), as amended by section 7, is further amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1F46319A70D445008F6F10FE79FAAC55" style="OLC"><paragraph commented="no" id="H17900EA7EC7542FC8D2371508D03C99D"><enum>(16)</enum><text display-inline="yes-display-inline">the State will—</text><subparagraph commented="no" id="H96F7A088F1E34D69BCE307D644E19831"><enum>(A)</enum><text display-inline="yes-display-inline">permit recipients of assistance under this title to enter into agreements authorized under section 8(f) of the National Labor Relations Act (commonly known as <quote>project labor agreements</quote>) with respect to projects for building or construction carried out with such assistance; and</text></subparagraph><subparagraph commented="no" id="H03B669382A6849C79A53C0A34677AEB1"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that, to the maximum extent practicable, recipients of assistance under this title carry out such projects through the use of such agreements.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H707FD410A2F84238B8AEB7C2A9E3A124"><enum>(2)</enum><header>Drinking water revolving funds</header><text display-inline="yes-display-inline">Section 1452 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-12">42 U.S.C. 300j–12</external-xref>) is amended—</text><subparagraph id="H548020F4BC7A42C3B64E0599D91A2FF0"><enum>(A)</enum><text>in subsection (a), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HB17255933F5D4A34AE37B5DF974F8CAE" style="OLC"><paragraph id="HBECAE56BD3504384BAB228679FAC2639"><enum>(7)</enum><header>Project labor agreements</header><text display-inline="yes-display-inline">Each agreement under this subsection shall require that the State permit recipients of assistance under this section to enter into agreements authorized under section 8(f) of the National Labor Relations Act (commonly known as <quote>project labor agreements</quote>) with respect to projects for building or construction carried out with such assistance.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H259DC96AB73245B5AC2EEA9FB5A5AF56"><enum>(B)</enum><text>in subsection (b)(3)(A)—</text><clause id="H4AA82D527B5946BC84FD800DE9F0C194"><enum>(i)</enum><text>in clause (ii), by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause id="HB8B6915572324FB3A0465D5D7AE0C890"><enum>(ii)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="HD9C86E3AE9894320AE5522001FC58F54"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF47003ADCE3B4CB18BE7CAF62CBBABDC" style="OLC"><clause id="H83E1BC7C98F04BA68AA27508DDB8E9D7"><enum>(iv)</enum><text display-inline="yes-display-inline">with respect to projects for building or construction, will be carried out through the use of agreements authorized under section 8(f) of the National Labor Relations Act.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection></section><section id="H61344FE43EE840D8BB44B8787AB01195" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header>Water operator jobs training grants</header><text display-inline="no-display-inline">Section 414 of the American Competitiveness and Workforce Improvement Act of 1998 is amended by adding at the end the following:</text><quoted-block style="OLC" id="H8B607C76E7B7475D8AEB69FAB21B35D7"><subsection id="H75CFAB5C26B7416697CFF9CA06FA2BFA" commented="no"><enum>(f)</enum><header>Water operator jobs training grants</header><paragraph id="H816E7021256845B7B3DD6E918C9BF28D" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than the date that is 1 year after the date of the enactment of this section, the Secretary of Labor shall award grants, on a competitive basis, to eligible entities to provide job training (including pre-apprenticeships and apprenticeships) and related activities, which are coordinated with the public workforce investment system, for workers to assist such workers in obtaining or upgrading employment in the drinking water, wastewater (including stormwater), and related sectors.</text></paragraph><paragraph id="H1F5F3876AA394CA7B412FBD981604B25" commented="no"><enum>(2)</enum><header>Uses of funds</header><text display-inline="yes-display-inline">Funds under this section may be used to provide jobs training services (including pre-apprenticeships and apprenticeships) and related activities that are designed to assist workers (including unemployed and employed workers) in gaining the skills and competencies needed to obtain or upgrade employment positions in the drinking water, wastewater (including stormwater), and related sectors.</text></paragraph><paragraph id="H821A7BBE645F46DBBE3C3AE6511D3980" commented="no"><enum>(3)</enum><header>Prioritization of funding</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law and to the extent that there are sufficient applications for this purpose, at least 50 percent of the funds awarded to eligible entities under this subsection shall be used to carry out the job training services (including pre-apprenticeships and apprenticeships) and related activities described in paragraph (2)—</text><subparagraph id="HFDEAB5B7063C42449F15F505F5A24E44" commented="no"><enum>(A)</enum><text>for low- and very low-income persons residing within the geographical boundaries of the geographical area to be served by such services and activities, which shall include high-poverty, high-unemployment ZIP Codes;</text></subparagraph><subparagraph id="H8B1850E0C0EC44A6BEA36C0511D52392" commented="no"><enum>(B)</enum><text>for low- and very low-income persons residing within the metropolitan area or nonmetropolitan county to be served by such services and activities;</text></subparagraph><subparagraph id="HB64E1318E1964A00A3719070AD773976" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">for low- and very low-income persons residing in a metropolitan area or nonmetropolitan county with significant representation of communities of color, low-income communities, or Tribal and indigenous communities, that experiences, or is at risk of experiencing, higher or more adverse human health or environmental effects than another such area or county; or</text></subparagraph><subparagraph id="H0DD9615DC3744E11B05CF04AADEFBBA3" commented="no"><enum>(D)</enum><text>for members of labor unions or worker organizations representing the individuals described in subparagraphs (A) through (C).</text></subparagraph></paragraph><paragraph id="HBDB3EA521DB84A45B80517C2383858C1" commented="no"><enum>(4)</enum><header>No match required</header><text>The Secretary of Labor may not require the provision of specified levels of a matching share of cash or noncash resources from resources other than the funds provided under this section for projects funded under this section.</text></paragraph><paragraph id="H477A90438B11477EBBB073FE34931FFD" commented="no"><enum>(5)</enum><header>Performance accountability</header><text>The Secretary of Labor shall require grantees to report on the employment outcomes obtained by workers receiving training under this section using indicators of performance that are consistent with other indicators used for employment and training programs administered by the Secretary, such as entry into employment, retention in employment, and increases in earnings. The Secretary of Labor may also require grantees to participate in evaluations of projects carried out under this section.</text></paragraph><paragraph id="HBF88A413F6794AB88AD00F6DB281C2AC" commented="no"><enum>(6)</enum><header>Definitions</header><text>In this section:</text><subparagraph id="H315E3CF0379A46D0A485D6D5CC999740" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>apprenticeship</term> means an apprenticeship registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>).</text></subparagraph><subparagraph id="H88DB37D09CDC4AF8B0B0E9F9A62CF797" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>eligible entity</term> may include any of the following:</text><clause id="H65D7FB48477F450E97D083671AE31BDB" commented="no"><enum>(i)</enum><text>One or more local governments.</text></clause><clause id="H0524F65AA85F4017B9636A626CDB1532" commented="no"><enum>(ii)</enum><text>One or more State governments.</text></clause><clause id="H170136C4CA47484997D493C8A62CB5FC" commented="no"><enum>(iii)</enum><text>One or more nonprofit organizations.</text></clause><clause id="HE03DD2B732D642DAA9FF0B9E747A26C9" commented="no"><enum>(iv)</enum><text>One or more community-based organizations.</text></clause><clause id="HF041C90088B94D179AA00CA622E58742" commented="no"><enum>(v)</enum><text>One or more labor unions.</text></clause><clause id="H3A15C040360F405F9CE11902DF2677DC" commented="no"><enum>(vi)</enum><text display-inline="yes-display-inline">One or more joint labor-management partnerships.</text></clause><clause id="H83FF05199E78411D9E26EEAFE80953F7" commented="no"><enum>(vii)</enum><text display-inline="yes-display-inline">One or more worker organizations representing the individuals described in subparagraphs (A) through (C) of paragraph (3).</text></clause><clause id="H76151FC524EF4BC4B61582368BDD0B27" commented="no"><enum>(viii)</enum><text display-inline="yes-display-inline">One or more education and training providers, including community colleges, Historically Black Colleges and Universities, a Hispanic-serving institution, a Tribal College or University, and other minority-serving institutions listed in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></clause><clause id="HB104E910B8514A8DAE9AF8332E0D1E49" commented="no"><enum>(ix)</enum><text display-inline="yes-display-inline">One or more local boards or State boards (as such terms are defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>)).</text></clause><clause id="H5EB3A53EF28D4D2EAEC93266320DB5D5" commented="no"><enum>(x)</enum><text>One or more Native American Tribal governments to provide job training programs for publicly owned community water systems (as defined in section 1401(15) of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f(15)</external-xref>)) and publicly owned treatment works (as defined in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>)).</text></clause></subparagraph><subparagraph id="H45C49833CB314BEE8BA38785E2F8F3AA" commented="no"><enum>(C)</enum><text>The terms <term>low-income person</term> and <term>very low-income person</term> have the same meanings given the terms <term>low-income families</term> and <term>very low-income families</term>, respectively, in section 3(b) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>).</text></subparagraph><subparagraph id="HDB869ADCFB87486D9C4A6AE1BED328EE" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">The term <term>labor union</term> means a labor organization (as defined in section 2(5) of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/152">29 U.S.C. 152(5)</external-xref>)), and an organization representing public sector employees.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H5C44107F959D46B68BFAC46502B3978C" commented="no"><enum>10.</enum><header>Drinking water assistance to colonias</header><text display-inline="no-display-inline">Section 1456 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300j-16">42 U.S.C. 300j–16</external-xref>) is amended—</text><paragraph id="H66DFABA2F9DA4F248D93870968D8595D" commented="no"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H98D5409AC9EC4F0186193B514DC99ECE" commented="no"><enum>(A)</enum><text>by redesignating paragraph (2) as paragraph (3);
