<section section-type="section-one" id="HDEEF09C58B804413A77A9203F657F316"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safer Shrimp Imports Act</short-title></quote>.</text></section> <section id="H32CEFDDCD57D41D6AE1F8C8348FF9274"><enum>2.</enum><header>Shrimp manufactured, processed, packed, or held at overseas facilities</header> <subsection commented="no" display-inline="no-display-inline" id="HC4F54B7C4E5F425FAF15C983CBCF9EDC"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Section 807 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/384c">21 U.S.C. 384c</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HFD328174E8114A01AD13B1F14C3DA3FE"><enum>(c)</enum><header>Requirements for foreign shrimp facilities</header>
<paragraph commented="no" display-inline="no-display-inline" id="H03F9E015D7DB43A2994C01BFEF79627B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Notwithstanding any other provision of law, not later than 180 days after the date of enactment of this subsection, the Secretary shall seek to enter into arrangements and agreements under subsection (a)(1) with the foreign government of each foreign country with 1 or more foreign facilities registered under section 415 that manufacture, process, pack, or hold shrimp for consumption in the United States.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H8EC2FA34327B40ECAC4CE197A737299F"><enum>(2)</enum><header>Requirements for shrimp</header><text display-inline="yes-display-inline">Beginning on the date that is 1 year after the date of enactment of this subsection, shrimp shall be refused admission into the United States if it is manufactured, processed, packed, or held in a foreign country—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H2549CF2261404B0AA9F1CC0CBE2EFE76"><enum>(A)</enum><text display-inline="yes-display-inline">the government of which does not enter into an arrangement or agreement with the Secretary under paragraph (1); or</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H316E654C6ED446D09204BE4ECFBBAF2A"><enum>(B)</enum><text>the food inspection system of which does not meet the criteria described in paragraph (3).</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H682FB00CC12246BDB8DF7C4817BD7264"><enum>(3)</enum><header>Criteria</header><text display-inline="yes-display-inline">The criteria described in this paragraph with respect to a food inspection system is that the food inspection system (as demonstrated to the Secretary by the applicable foreign government) is equivalent to the food inspection system of the Food and Drug Administration with respect to shrimp, including by providing—</text> <subparagraph id="HD298206CB7834E46BAF8DEA730BE6E03"><enum>(A)</enum><text>staffing that ensures uniform enforcement of applicable laws and regulations; and</text></subparagraph>
<subparagraph id="HC3C53A4747C1472E85401A1F9D145C65"><enum>(B)</enum><text>enforcement of laws and regulations that address the conditions under which shrimp is raised and transported to processing establishments.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HDB68DBF2CD984C0FA331EEBE0015440D"><enum>(4)</enum><header display-inline="yes-display-inline">Demonstration</header><text>A foreign government seeking to demonstrate that its food inspection system meets the criteria described in paragraph (3) shall provide to the Secretary copies of all laws, regulations, and other information pertaining to such food inspection system.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HF28443A561F74081AA758466F603B07A"><enum>(b)</enum><header>Adulteration</header><text>Section 402 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/342">21 U.S.C. 342</external-xref>) is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H9AC4BD4159A6423FA32627AEE63478AA"> <subsection commented="no" display-inline="no-display-inline" id="HB23FBEDE5B9F4F8AB764B85055068467"><enum>(j)</enum><text>If it is shrimp imported or offered for import into the United States and the shrimp has been manufactured, processed, packed, or held in a foreign country the government or food inspection system of which does not comply with the applicable requirements of section 807(c).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="HF00E1E978D024E8293F44CDAF6E642EE"><enum>(c)</enum><header>Report to congress</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary of Health and Human Services shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that describes the implementation of the amendments made by subsections (a) and (b).</text></subsection></section> </legis-body></bill>
