<section id="H7FDB41D91CCD465186F9109ED1F99CA3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending Medicaid Discrimination Against the Most Vulnerable Act</short-title></quote>.</text></section> <section id="H654CE5FA8CA7406880BB989734243D22"><enum>2.</enum><header>Phase-out of enhanced Federal match for medical assistance provided to low-income individuals under Medicaid</header> <subsection commented="no" display-inline="no-display-inline" id="H545026828F01421FADC03E6B83EE6DBA"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1905(y) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(y)</external-xref>) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H2867877807D34D27B3FADE055D21A630"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H55939450363242A69F16F8FDFECE0BCF"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by inserting <quote>and subject to paragraph (4)</quote> after <quote>Notwithstanding subsection (b)</quote>;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE85C80103154406298D6175EAC722FD1"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H847CEE440CF547FD93DAAD30BA23B414"><enum>(C)</enum><text>in subparagraph (E), by striking <quote>and each year thereafter.</quote> and inserting <quote>through 2026;</quote>; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H624CBDA57F9347EA87063504C80F4E6B"><enum>(D)</enum><text>by adding at the end the following new subparagraphs:</text> <quoted-block id="HDFA91836D27141DDA2451F89E0F50ECE" style="OLC" act-name=""> <subparagraph id="H10E1DA543DDC4FEC908517A875B380CF"><enum>(F)</enum><text> for calendar quarters in each of calendar years 2027 through 2034, the percentage that applied under this subsection for calendar quarters in the preceding calendar year minus the applicable number of percentage points determined for the State under paragraph (3) or, if higher, the Federal medical assistance percentage otherwise determined for the State and year under subsection (b) (without regard to this subsection); and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0AE385788F4D4E86A74FBFD84FF56C6C"><enum>(G)</enum><text display-inline="yes-display-inline">for calendar quarters in 2035 and each year thereafter, the Federal medical assistance percentage otherwise determined for the State and year under subsection (b) (without regard to this subsection).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HA9EAE4B290F849169248C153C6F7158A"><enum>(2)</enum><text>by adding at the end the following new paragraphs:</text>

<paragraph id="H26A6125C15AE4A0FB12B56374C2D241D"><enum>(3)</enum><header>Applicable number of percentage points</header><text>For purposes of paragraph (1)(F), the applicable number of percentage points for a State is the number of percentage points equal to—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HF38ACAD07C884E4EA21B1ABF2A57FDCE"><enum>(A)</enum><text display-inline="yes-display-inline">the percentage points difference between—</text> 
<clause commented="no" display-inline="no-display-inline" id="H30FAE6816C144BF0933B0182A6FD2104"><enum>(i)</enum><text display-inline="yes-display-inline">90 percent; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H341F9F46938F49CFB86BFD70A06D97B3"><enum>(ii)</enum><text display-inline="yes-display-inline">the Federal medical assistance percentage determined for the State under subsection (b) (without regard to this subsection) for fiscal year 2026; divided by</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF1B4E56DE7524B7A88CB0C1F71C4ADD6"><enum>(B)</enum><text display-inline="yes-display-inline">8.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HE793863877C74E389C5FEDB77BAA3645"><enum>(4)</enum><header>Rules of application for calendar years after 2024</header> <subparagraph commented="no" display-inline="no-display-inline" id="H973593B8C03D45E291B7179CA2DF3898"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, for calendar years after 2024—</text> 
<clause commented="no" display-inline="no-display-inline" id="H0E8177F920D94BB094ABEAA8182E3F6F"><enum>(i)</enum><text display-inline="yes-display-inline">paragraph (1) shall not apply to a non-expansion State (as defined in subparagraph (B)); </text></clause> <clause commented="no" display-inline="no-display-inline" id="H71900664B2704DC7BBEE75EA39077719"><enum>(ii)</enum><text display-inline="yes-display-inline">if a non-expansion State elects on or after the date of enactment of this paragraph to expend amounts for all or any individuals described in section 1902(a)(10)(A)(i)(VIII), the Federal medical assistance percentage otherwise determined for the State and year under subsection (b) (without regard to this subsection) shall apply to amounts expended by such State for medical assistance for such individuals; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H0C470E4437744BCD9434AEADBF8E55CE"><enum>(iii)</enum><text>an expansion State (as defined in such subparagraph) may, at the option of the State, elect to only expend amounts for medical assistance for newly eligible individuals described in section 1902(a)(10)(A)(i)(VIII) whose income does not exceed 100 percent of the Federal poverty line (as defined for purposes of such section) and continue to receive the Federal medical assistance percentage specified under paragraph (1) for such amounts.</text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HAEC25B9FB1324E839C9EFF1E17B12FC4"><enum>(B)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this paragraph:</text> 
<clause commented="no" display-inline="no-display-inline" id="H4D3AFF0EE5B9456ABE6B433A08DA2AC6"><enum>(i)</enum><header>Expansion State</header><text>The term <term>expansion State</term> means a State that is not a non-expansion State.</text></clause> <clause commented="no" display-inline="no-display-inline" id="HD7EEEC7CDB134759A1134FBA88887BF2"><enum>(ii)</enum><header display-inline="yes-display-inline">Non-expansion State</header><text display-inline="yes-display-inline">The term <term>non-expansion State</term> means a State that has not expended amounts for all individuals described in section 1902(a)(10)(A)(i)(VIII) before the date of the enactment of this paragraph.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

        <enum>(b)</enum>
        <header display-inline="yes-display-inline">Eliminating temporary FMAP increase for States
          that begin To provide medical assistance for low-Income adults</header>
 <text>Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended by striking subsection (ii).</text>
