which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Aquifer Recharge Flexibility Act to clarify a provision relating to conveyances for aquifer recharge purposes.</official-title></form><legis-body id="HBF57B4494B094E84B002C72A6D1C6FA5" style="OLC"><section id="H200F11E87C17453F84F4160E647CA03B" section-type="section-one"><enum>1.</enum><header>Conveyance for aquifer recharge purposes</header><subsection commented="no" display-inline="no-display-inline" id="H31756ED490794E3C9380B7306A7B4932"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subsection (c)(3) of the Aquifer Recharge Flexibility Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390g-9">43 U.S.C. 390g–9</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H74026922630F434E92C41651CA2FE695"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The holder</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC7B4251A8A694E20803FD4EAB0A6BE11"><subparagraph commented="no" display-inline="no-display-inline" id="H574A32EB2D054CFCAD83F9499B032235"><enum>(A)</enum><header>In general</header><text>The holder</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB02946D961194CE79FEFA1C93749C1E2"><enum>(2)</enum><text>in subparagraph (A) (as so designated), by striking <quote>may transport water for aquifer recharge purposes without requiring additional authorization from the Secretary where the use does not expand or modify the operation</quote> and inserting <quote>may, acting for the holder or on behalf of a State, political subdivision of a State, Indian Tribe, or public entity and subject to subparagraphs (B) and (C), use the existing right-of-way, easement, permit, or other authorization for the purpose of aquifer recharge and the transport and use of water rights for aquifer recharge without requiring additional authorization from the Secretary, which use shall not be considered an expansion, modification, major Federal action, or substantial deviation</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2A15520F6EFB4C8E95854C819255BAD5"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5CB40AC9671F44D19E007536E98037AF"><subparagraph id="HF664A5EC5A524467BD0DCCABA28564FA"><enum>(B)</enum><header>Notice required</header><clause commented="no" display-inline="no-display-inline" id="HC4AB42661B49472C94C3E0FEF067E17A"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not less than 30 days before using an existing right-of-way, easement, permit, or other authorization for the purpose of aquifer recharge under subparagraph (A), the holder of the right-of-way, easement, permit, or other authorization shall submit to the Bureau of Land Management notice of the intended use, in accordance with clause (ii).</text></clause><clause commented="no" display-inline="no-display-inline" id="HEE6687F4D8774321BE1DA33AE10502E0"><enum>(ii)</enum><header>Requirements</header><text>A notice submitted under clause (i) shall— </text><subclause id="HCBD38C4638F543D28C1466342CD4ADFA"><enum>(I)</enum><text>identify the State, political subdivision of the State, Indian Tribe, or public entity intending to use the existing right-of-way, easement, permit, or other authorization for the purpose of aquifer recharge;</text></subclause><subclause id="H53806D56F7444141912CF5FA0320DB4C"><enum>(II)</enum><text>identify the existing right-of-way, easement, permit, other authorization, or recognized authorized use for ditches and canals constructed on public land before or on October 21, 1976, under the authority of sections 2339 and 2340 of the Revised Statutes (<external-xref legal-doc="usc" parsable-cite="usc/43/661">43 U.S.C. 661</external-xref>) intended to be used; </text></subclause><subclause id="H0E6D001E69FF4D7DBD39A5B26F7732D3"><enum>(III)</enum><text>provide details on the intended use and scope of use for the purpose of aquifer recharge of the existing right-of-way, easement, permit, or other authorization; and</text></subclause><subclause id="H023B1E8578C14B39B74751B006BD7513"><enum>(IV)</enum><text>provide a copy of the agreement between the State, political subdivision of the State, Indian Tribe, or public entity and the holder of the right-of-way, easement, permit, or other authorization to use the existing right-of-way, easement, permit, or other authorization for the purpose of aquifer recharge.</text></subclause></clause></subparagraph><subparagraph id="HDBE98224A69843F09807C974A0F69AB8"><enum>(C)</enum><header>Exemption from payment of additional rent</header><clause commented="no" display-inline="no-display-inline" id="H41D2D01E8D4A466D9C04D0997E8137F5"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), any use of an existing right-of-way, easement, permit, or other authorization for the purpose of aquifer recharge under subparagraph (A) shall be exempt from the payment of additional rent to the Bureau of Land Management.</text></clause><clause id="HBCF3A09F96B948D5B74D1170762DF60F"><enum>(ii)</enum><header>For-profit uses and entities</header><text>Clause (i) shall not apply to—</text><subclause commented="no" display-inline="no-display-inline" id="HE8CF2E99AA44435FA793A0B51149C100"><enum>(I)</enum><text display-inline="yes-display-inline">any for-profit uses of aquifer recharge; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="H43269B480EDC434DB0A4FD065D96F7F9"><enum>(II)</enum><text display-inline="yes-display-inline">any for-profit entities.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H83E47C24C75246208DC1C62404703D85"><enum>(b)</enum><header>Effect</header><text>Subsection (c)(4) of the Aquifer Recharge Flexibility Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390g-9">43 U.S.C. 390g–9</external-xref>) is amended—</text><paragraph id="HC2C8119465504B039CE3D88A88A1EB1A"><enum>(1)</enum><text>by striking <quote>Act creates</quote> and inserting </text><quoted-block style="OLC" display-inline="yes-display-inline" id="H18B43C191CA540D1B27508E8856A16CC"><text>section—</text><subparagraph id="H4716C0C581FB42F5847B863F80966B51"><enum>(A)</enum><text>creates</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD168EB1E296D4AEC9DB06FF6B5ED5263"><enum>(2)</enum><text>in subparagraph (A) (as so designated), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1442C5D28C78457DA31A31716ACFE6FE"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end of the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4046F5ECA168475DA49E480FBC343E41"><subparagraph id="H003E056FDB2A49C6BEF666EDB3E7CC42"><enum>(B)</enum><text>waives the obligation of the holder of a right-of-way, easement, permit, or other authorization described in paragraph (3)(A) to comply with—</text><clause id="H9FE9C9B1CDCC4070852FD46679E55E8D"><enum>(i)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>); </text></clause><clause id="HADB642750DB14A3191CA4963D5F29A92"><enum>(ii)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or</text></clause><clause commented="no" display-inline="no-display-inline" id="HFF06804076ED477E865E9FA14C6AA982"><enum>(iii)</enum><text display-inline="yes-display-inline">the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271 et seq.</external-xref>); or</text></clause></subparagraph><subparagraph id="HC382272885DE4AF38F22980960F9A3A0"><enum>(C)</enum><text>provides authority to construct, modify, or expand any existing infrastructure covered under subsection (c)(3).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7446399AC691436B90713404A9704332"><enum>(c)</enum><header>Technical amendments</header><text>The Aquifer Recharge Flexibility Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390g-9">43 U.S.C. 390g–9</external-xref>) is amended in each of subsections (a) and (c)(5) by striking <quote>Act</quote> each place it appears and inserting <quote>section</quote>.</text></subsection></section></legis-body></bill>
