which was referred to the <committee-name committee-id="HED00">Committee on Education and Workforce</committee-name>, and in addition to the Committees on <committee-name committee-id="HGO00">Oversight and Government Reform</committee-name>, and <committee-name committee-id="HHA00">House Administration</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To improve family and medical leave for military families, and for other purposes.</official-title></form><legis-body id="H05789A698063439ABC310F850F8FB486" style="OLC"><section section-type="section-one" id="H3FC4C0DE35AB4D12A37A10A3D2315AF7"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Making It Likely for Families of the Military to Live with Leave Access Act</short-title></quote> or the <quote><short-title>MIL FMLA Act</short-title></quote>.</text></section><title id="H330DFD4CC10745B1A97E4C4F65D668CE"><enum>I</enum><header>Amendments to Family and Medical Leave Act of 1993</header><section commented="no" display-inline="no-display-inline" id="HB1361A36491E4F7687BB8CF5EA7809E5"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 101 of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H3914FD62AEF04C8A91FD3C7DB6B07092"><enum>(1)</enum><text>in paragraph (7), by striking <quote>employee</quote> each place it appears and inserting <quote>employee or covered servicemember</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD5C400C124A74FFCAACE6C679E489E66"><enum>(2)</enum><text>by amending paragraph (12) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H570A5AB40DAE40CB80FDFC4825432FA1"><paragraph id="H80B187FF96F944AE9ADF63D84405D5BF"><enum>(12)</enum><header>Son or daughter</header><subparagraph id="H1078F7FC580F448787CE504008B5B724"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the term <term>son or daughter</term> means a biological, adopted, or foster child, a stepchild, a legal ward, or a child of a person standing in loco parentis, who is—</text><clause id="HE47579AD00284634AC6A8435D35345FA"><enum>(i)</enum><text>under 18 years of age; or</text></clause><clause id="HF1B5D2F74F0C49E7948C3F359E68F488"><enum>(ii)</enum><text>18 years of age or older and incapable of self-care because of a mental or physical disability.</text></clause></subparagraph><subparagraph id="H0212ACA8BFD4490685799A0627019230"><enum>(B)</enum><header>Servicemember and veteran leave</header><text display-inline="yes-display-inline">For the purposes of leave under paragraphs (1)(E) and (3) of section 102(a), the term <term>son or daughter</term> means, regardless of age, a biological, adopted, or foster child, a stepchild, a legal ward, a child of a person standing in loco parentis, or the child of a covered servicemember’s domestic partner.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE869159D08884BF6827EA7BC2FF8DFCD"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (14), by amending subparagraph (B) to read as follows: </text><quoted-block style="OLC" id="HBF9AC5BE8FBB467698E11E3B77FE8399" act-name=""><subparagraph id="HDFAD50897DE342B38ABF27471A63EB61"><enum>(B)</enum><text>in the case of a member of a reserve component of the Armed Forces—</text><clause commented="no" display-inline="no-display-inline" id="H381DA11A1D154F31B5297BF9BA171FD3"><enum>(i)</enum><text display-inline="yes-display-inline">duty during the deployment of the member with the Armed Forces under a call or order to active duty under a provision of law referred to in section 101(a)(13)(B) of title 10, United States Code;</text></clause><clause commented="no" display-inline="no-display-inline" id="HE895932290A145F1BCF6A0628066254C"><enum>(ii)</enum><text display-inline="yes-display-inline">duty pursuant to title 32, United States Code; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H1FB68B9E93CB4BD283D88E86978A1582"><enum>(iii)</enum><text display-inline="yes-display-inline">covered State active duty.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5C1757470E7F47209FADC821400E9F25"><enum>(4)</enum><text>in paragraph (15)(B), by striking <quote>and who was a member of the Armed Forces</quote> and all that follows through the period at the end of the subparagraph and inserting a period;</text></paragraph><paragraph id="H2217B784142F4151A349C0B84E272F9B"><enum>(5)</enum><text>in paragraph (18)—</text><subparagraph id="H0A44157F20AC4D60891A6ADD4F107D3E"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>; and</quote> and inserting a semicolon; </text></subparagraph><subparagraph id="H839102D8EBE54524A816411E0E8A03A7"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="H2D947C7C5BCC48BA882243D296CA0386"><enum>(i)</enum><text>by striking <quote>at any time during a period described in paragraph (15)(B)</quote> ; and</text></clause><clause id="HFA3E87D0D1C246E6A9A2F28E714A8577"><enum>(ii)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></clause></subparagraph><subparagraph id="HBCF5AC7BEDC5403B8B7625CB1FCAB986"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5BF870939B89429BA9FDFDC8A38FC6E7"><subparagraph id="HEE9E8A43DB034432BE4644621A5BF49A"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of either a member of the Armed Forces (including a member of the National Guard or Reserves), or a veteran who was such a member, a serious health condition that was incurred by the member in line of duty on active duty in the Armed Forces (or existed before the beginning of the member’s active duty and was aggravated by service in line of duty on active duty in the Armed Forces).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8EAFE169E72F49F7A74CC023613ABE56"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H569A2D66D5DB47C1ABF23DF78844FFC7"><paragraph id="HB335C72C12144F7B96D031B3ECBBC200"><enum>(20)</enum><header>Any other individual whose close association is the equivalent of a family relationship</header><text display-inline="yes-display-inline">The term <term>any other individual whose close association is the equivalent of a family relationship</term>, used with respect to a covered servicemember, means any person with whom the covered servicemember has a significant personal bond that is or is like a family relationship, regardless of biological or legal relationship.</text></paragraph><paragraph commented="no" id="H8B7A2C71E25849438F9AC09E067BC970"><enum>(21)</enum><header>Domestic partner</header><text display-inline="yes-display-inline">The term <term>domestic partner</term>, used with respect to an employee or covered servicemember, means an adult in a committed relationship with the employee or covered servicemember, including same-sex and opposite-sex relationships.</text></paragraph><paragraph commented="no" id="HF884812BB8F94AC38C5747E77ED56D45"><enum>(22)</enum><header>Grandchild</header><text>The term <term>grandchild</term>, used with respect to a covered servicemember, means the son or daughter of the covered servicemember.</text></paragraph><paragraph commented="no" id="HB0C8C303DAEA42B3A6AC5E8B15DB8FCD"><enum>(23)</enum><header>Grandparent</header><text>The term <term>grandparent</term>, used with respect to a covered servicemember, means a parent of a parent of the covered servicemember. </text></paragraph><paragraph commented="no" id="HE41F7563CB6D445492753FA2FE8324D8"><enum>(24)</enum><header>Nephew; niece</header><text>The terms <term>nephew</term> and <term>niece</term>, used with respect to a covered servicemember, mean a son or daughter of the sibling of the covered servicemember. </text></paragraph><paragraph commented="no" id="H3AFD649E893741918C94E8B1FA26DFE2"><enum>(25)</enum><header>Parent-in-law</header><text> The term <term>parent-in-law</term>, used with respect to a covered servicemember, means a parent of the spouse or domestic partner of the covered servicemember.</text></paragraph><paragraph id="HD0D4F90E19654172A2CE697D609D77FC"><enum>(26)</enum><header>Sibling</header><text>The term <term>sibling</term>, used with respect to a covered servicemember, means any person who is a son or daughter of parent of the covered servicemember (other than the covered servicemember).</text></paragraph><paragraph id="HB58DE59273AD42E8A21EA5311B786319"><enum>(27)</enum><header>Son-in-law; daughter-in-law</header><text>The terms <term>son-in-law</term> and <term>daughter-in-law</term>, used with respect to a covered servicemember, mean any person who is a spouse or domestic partner of a son or daughter, as the case may be, of the covered servicemember.</text></paragraph><paragraph id="H9F8C6BD7902E48668CDC06BFC01AD2F2"><enum>(28)</enum><header>Uncle; aunt</header><text>The terms <term>uncle</term> and <term>aunt</term>, used with respect to a covered servicemember, mean the son or daughter, as the case may be, of the grandparent of the covered servicemember (other than the parent of the covered servicemember).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H51CB1652DECA45709074E585397CDEAA"><enum>(29)</enum><header>Covered State active duty</header><text>The term <term>covered State active duty</term> means State active duty for a period of 14 days or more, State active duty in response to a national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>), or State active duty in response to a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8923867108654451A938CE2B715D26DD"><enum>(30)</enum><header>State active duty</header><text display-inline="yes-display-inline">The term <term>State active duty</term> has the same meaning given the term in section 4303(15) of title 38, United States Code.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section commented="no" display-inline="no-display-inline" id="H2B2B6376FE824627A93AA5D3BB25D196"><enum>102.</enum><header>Leave requirement</header><subsection commented="no" display-inline="no-display-inline" id="H165B76E61AFB4103AC6C6ACE5D523E51"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Section 102(a) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HA8C874ABE53F4EC3BC45A2754C84220F"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(E), by inserting <quote>or domestic partner</quote> after <quote>spouse</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8EEE52A1421D411C9BA09EC6FDE1212B"><enum>(2)</enum><text display-inline="yes-display-inline">by amending paragraph (3) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H79DCFDB74BEA451784C132FBCCD7500E"><paragraph id="H5BC83DBE18AA4CD2ABB20508C865E79E"><enum>(3)</enum><header>Servicemember family leave</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1) and subject to section 103, an eligible employee who is the spouse or domestic partner, son or daughter, son-in-law or daughter-in-law, parent, parent-in-law, grandparent, sibling, uncle or aunt, nephew or niece, or next of kin of a covered servicemember, or any other individual whose close association is the equivalent of a family relationship with a covered servicemember, shall be entitled to a total of 26 workweeks of leave during a 12-month period to care for the servicemember.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC479B9C124D4491BB662F97DD0F0FE42"><enum>(3)</enum><text display-inline="yes-display-inline">by amending paragraph (4) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H62CE24ADB85A41DA8364450961CEED2E"><paragraph commented="no" display-inline="no-display-inline" id="H79EF2A786EE046698F9F406E8D5CB6CA"><enum>(4)</enum><header>Combined leave total</header><text display-inline="yes-display-inline">Subject to subsection (d)(3), an eligible employee shall be entitled to not more than a combined total of 26 workweeks of leave under paragraphs (1), (3), and (6) during any 12-month period.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAEBDD4BEAFC5424DB0A16C27E8C04371"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF4D09A82CAD646629AC2AAF29119F209"><paragraph commented="no" id="HF0B9FEA37B024F3CACCA6F880A77B76D"><enum>(6)</enum><header>Veteran leave</header><text>Notwithstanding paragraph (1) and subject to section 103, an eligible employee who is a covered servicemember described in section 101(15)(B) shall be entitled to a total of 26 workweeks of leave during a 12-month period because of a serious injury or illness that makes the employee unable to perform the functions of the position of such employee.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA16F16D269F845E5B9A0C546C10BC754"><enum>(b)</enum><header>Leave Taken Intermittently or on a Reduced Leave Schedule</header><paragraph id="HA7480F5C5E344DBCA3B417C8964A6EE3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 102(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(b)(1)</external-xref>) is amended by striking <quote>subsection (a)(3)</quote> and inserting <quote>paragraph (3) or (6) of subsection (a)</quote>.</text></paragraph><paragraph id="H4DA3DD8646F74BEAB2AD1BB828A57460"><enum>(2)</enum><header>Alternative position</header><text>Section 102(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(b)(2)</external-xref>) is amended by striking <quote>subsection (a)(3)</quote> and inserting <quote>paragraph (3) or (6) of subsection (a)</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAB495AF250274A05BA6742041DBA90C8"><enum>(c)</enum><header>Relationship to paid leave</header><text>Section 102(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HEEB7A34A7BEC484497227C89EAD5FDD8"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1) by striking <quote>under subsection (a)(3))</quote> and inserting <quote>under paragraph (3) or (6) of subsection (a))</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8165FC5A0F6048D98436693A0F2E7270"><enum>(2)</enum><text>in paragraph (2)(B), by striking <quote>subsection (a)(3)</quote> and inserting <quote>paragraph (3) or (6) of subsection (a)</quote>. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0FE22EEDC2C744D59CC20E127EC0C5AF"><enum>(d)</enum><header>Notice</header><text>Section 102(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD2F108D9E50F4DE39C25E8492CC33A6E" act-name=""><paragraph id="HA09DB010E03E4562A0546A055EAF8474"><enum>(4)</enum><header>Notice for veteran leave</header><text>In any case in which the necessity for leave under subsection (a)(6) is foreseeable, the employee shall provide such notice to the employer as is reasonable and practicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H701D123CF7F94A7CAAAE45D7AB777C3E"><enum>(e)</enum><header>Certification</header><text>Section 103(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613(a)</external-xref>) is amended by inserting <quote>or (6)</quote> after <quote>paragraph (3)</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HC386D3423B464479ACF494BA451862BF"><enum>(f)</enum><header>Maintenance of health benefits</header><text>Section 104(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2614">29 U.S.C. 2614(c)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H02C9A4A30E604537BDAD0F3A03265A10"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(B)(i)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H0F0953F1E8BB4DE7A654C565525EE4BD"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>or a serious injury or illness, as the case may be,</quote> after <quote>serious health condition</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H54E21D59B64848B6BE8B82CFD6DB603C"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>section 102(a)(3)</quote> and inserting <quote>paragraph (3) or (6) of section 102(a)</quote>; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE3AE05355BC44ABE9C0D7E5EA257EE14"><enum>(2)</enum><text>in paragraph (3)—</text><subparagraph commented="no" display-inline="no-display-inline" id="H0D4D1AED66604BFF92A4E588A298C744"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="H546F32AE14E5436B88C6F8EB951D04D0"><enum>(i)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>or</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="H1E20E9331DEF46099425142E619974AF"><enum>(ii)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; or</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HD462FC3FA22F43FE9605009EBFB82FC9"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H822905A167CA4DCD9828B9E1BAC9A714"><clause commented="no" display-inline="no-display-inline" id="H90A1DC1C1D0E49D59D97D4C2E298EBCC"><enum>(iv)</enum><text>a certification issued by the health care provider of the eligible employee, in the case of an employee unable to return to work because of a serious injury or illness specified in section 102(a)(6).</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H3558D311F8AA402A9B53242F9CCA03BC"><enum>(B)</enum><text>in subparagraph (C), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H071F528831A14F97A66B5D2CA7BC14CF"><clause commented="no" display-inline="no-display-inline" id="HC78D114A895E44D28CE7D7DC879A3DC1"><enum>(iii)</enum><header>Leave due to a serious injury or illness of employee</header><text>The certification described in subparagraph (A)(iv) shall be sufficient if the certification states that a serious injury or illness prevented the employee from being able to perform the functions of the position of the employee on the date that the leave of the employee expired.</text></clause><clause id="H3E65530411D7458E9BA08D24F0B9EB11"><enum>(iv)</enum><header>Leave due to a serious injury or illness of a family member who is a servicemember</header><text display-inline="yes-display-inline">The certification described in subparagraph (A)(i) shall be sufficient if the certification states that the employee is needed to care for covered servicemember on the date that the leave of the employee expired.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" id="H4F520B9ABEC44BDA836AEC91718541DF"><enum>(g)</enum><header>Enforcement</header><text>Section 107(a)(1)(A)(i)(II) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2617">29 U.S.C. 2617(a)(1)(A)(i)(II)</external-xref>) is amended by striking <quote>section 102(a)(3)</quote> and inserting <quote>paragraph (3) or (6) of section 102(a)</quote>.</text></subsection></section></title><title id="H82E8C9C4218E464CB52B61040011054F"><enum>II</enum><header>Federal Civilian Employees</header><section id="H9749070C5C264E638BE5DF1FD4B79AD3"><enum>201.</enum><header>Employees covered by title 5, United States Code</header><subsection id="HABDCCC6CAF3D4CF79CC7E3E5627C21D8"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 6381 of title 5, United States Code, is amended—</text><paragraph id="HD5A4EDAB4A054291B5964C77BBA0B0AE"><enum>(1)</enum><text>in paragraph (3), by striking <quote>employee</quote> each place it appears and inserting <quote>employee or covered servicemember</quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H28A7E6196C454CEAA4C0A433D3A14C41"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraphs (6) and (7) and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H975ABE05640D4E09A9F57A9F275C3D31"><paragraph id="H460059511F2B4D09A81B4384FFEB6E63"><enum>(6)</enum><text>the term <term>son or daughter</term> means a biological, adopted, or foster child, a stepchild, a legal ward, or a child of a person standing in loco parentis—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB8F7E15A280948ABB7D3DBAC6B2E8DD8"><enum>(A)</enum><text display-inline="yes-display-inline">who is—</text><clause id="H4F257D7917464AA4B0AE025DA193D6EA"><enum>(i)</enum><text>under 18 years of age; or</text></clause><clause id="HCD505026061E41F892A2EA8E7D71B6FD"><enum>(ii)</enum><text>18 years of age or older and incapable of self-care because of a mental or physical disability; or</text></clause></subparagraph><subparagraph id="H6527E00BBC28413F8D0BBE531C31EDB0"><enum>(B)</enum><text display-inline="yes-display-inline">for the purposes of leave under section 6382(a)(1)(e) or section 6382(a)(3)(A), includes (regardless of age) any child, stepchild, legal ward, or child of a person standing in loco parentis;</text></subparagraph></paragraph><paragraph id="HF32427B1E6D444B39B4F4DAFCC1BDFB5"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>covered active duty</term> means—</text><subparagraph id="HA69A953BC7D0482680A9310AE391F9AF"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a member of a regular component of the Armed Forces, duty during the deployment of the member with the Armed Forces to a foreign country; and</text></subparagraph><subparagraph id="H5229E31314944250AA0C4BC70A39C699"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a member of a reserve component of the Armed Forces—</text><clause id="H127F36FA05D8463D8003ADF6B5286FC0"><enum>(i)</enum><text>duty during the deployment of the member with the Armed Forces under a call or order to active duty under a provision of law referred to in section 101(a)(13)(B) of title 10;</text></clause><clause id="H04DA1CC7AFBA4D928CFFD434CDCF5A05"><enum>(ii)</enum><text display-inline="yes-display-inline">duty pursuant to title 32; or</text></clause><clause commented="no" id="H6E315D5BDE3945CB9C02C19EA991319E"><enum>(iii)</enum><text display-inline="yes-display-inline">State active duty (defined for purposes of this clause as having the meaning of such term in section 4303(15) of title 38) for a period of 14 days or more, State active duty in response to a national emergency declared by the President under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>), or State active duty in response to a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>);</text></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H7FB57774E42842629CB560A358CB53A1"><enum>(3)</enum><text>in paragraph (8)(B), by striking <quote>and who was</quote> through <quote>therapy;</quote> and inserting a semicolon;</text></paragraph><paragraph id="HBDE7CC88F4CD4DEC997E1593A95F1C60"><enum>(4)</enum><text>in paragraph (11)—</text><subparagraph id="H7FE8B05765B44EB0AB89FA16842B4D2A"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (A);</text></subparagraph><subparagraph id="HBAE0A33C7EA647BEB0DAD4150E9EF486"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="H1EEF05B67A434EE5A86E867FD9D50D44"><enum>(i)</enum><text>by striking <quote>at any time during a period described in paragraph (8)(B)</quote>; and</text></clause><clause id="HC7D6203FCC65465EA21C1D66631E03A4"><enum>(ii)</enum><text>by striking <quote>and</quote> at the end; and</text></clause></subparagraph><subparagraph id="H1637B84F55E24A17ABDBCB3487836D61"><enum>(C)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HEFE6112B604047E7945C20A220519ED3"><subparagraph id="H267C3C455A8A45DA84DE8657313BDCA8"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of either a member of the Armed Forces (including a member of the National Guard or Reserves), or a veteran who was such a member, a serious health condition that was incurred by the member in line of duty on active duty in the Armed Forces (or existed before the beginning of the member’s active duty and was aggravated by service in line of duty on active duty in the Armed Forces);</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H658B2AC8A30144A1A35938B53DDFD6AD"><enum>(5)</enum><text>in paragraph (12), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HB1C9C9EC06384209B2BBB260D8AFF05C"><enum>(6)</enum><text>by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HE0CEE8FF4DA64851976751F03F6E41BF"><paragraph id="H76FEA28DCFF54F0FA2076D907F0048E7"><enum>(13)</enum><text display-inline="yes-display-inline">the term <quote>spouse</quote>, used with respect to an employee for leave under section 6382(a)(1)(E), includes a domestic partner (defined as an adult in a committed relationship with another adult, including same-sex and opposite-sex relationships).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H94890E1C189544F1BFE056EA819B0CFB"><enum>(b)</enum><header>Servicemember care and veteran leave</header><text>Section 6382 of title 5, United States Code, is amended—</text><paragraph id="H1C2885ACE6C44DDD88BCD1ADF7F58EC7"><enum>(1)</enum><text>by striking subsection (a)(3) and inserting the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HD04A8F381EB947FBA3A0D7439AE0897E"><paragraph id="H26A0D8A6A6404B88A1F7F62A5AC0725E"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H5BB614E662F844CDA306C2F9AA3E1F33"><enum>(A)</enum><text display-inline="yes-display-inline">Subject to section 6383, an employee who is the spouse, son or daughter, son-in-law or daughter-in-law, parent, parent-in-law, grandparent, sibling, uncle or aunt, nephew or niece, or next of kin of a covered servicemember, or any other individual whose close association is the equivalent of a family relationship with a covered servicemember, shall be entitled to a total of 26 workweeks of leave during a 12-month period to care for the servicemember. </text></subparagraph><subparagraph id="HC4D59831EC7A40DC8C8F62BA27947369" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Subject to section 6383, an employee who is a covered servicemember shall be entitled to a total of 26 workweeks of leave during a 12-month period because of a serious injury or illness that makes the employee unable to perform the functions of the position of such employee. </text></subparagraph><subparagraph id="H9C313034A13E4B1DAF2653FDDD75FD54" indent="up1"><enum>(C)</enum><text>For the purposes of subparagraph (A), the following definitions apply:</text><clause id="H9D37DEC864874CD1AF8B6E933248CC99"><enum>(i)</enum><header>Any other individual whose close association is the equivalent of a family relationship</header><text display-inline="yes-display-inline">The term <term>any other individual whose close association is the equivalent of a family relationship</term>, used with respect to a covered servicemember, means any person with whom the covered servicemember has a significant personal bond that is or is like a family relationship, regardless of biological or legal relationship.</text></clause><clause commented="no" id="H861961CB30DE45F4A98DA591356CE833"><enum>(ii)</enum><header>Grandchild</header><text>The term <term>grandchild</term>, used with respect to a covered servicemember, means the son or daughter of the covered servicemember.</text></clause><clause commented="no" id="H1E11F80A7960459296DE96FD406D26B1"><enum>(iii)</enum><header>Grandparent</header><text>The term <term>grandparent</term>, used with respect to a covered servicemember, means a parent of a parent of the covered servicemember. </text></clause><clause commented="no" id="HC57DE1AD83DC4C0C9FDA1BED9C0E0642"><enum>(iv)</enum><header>Nephew; niece</header><text>The terms <term>nephew</term> and <term>niece</term>, used with respect to a covered servicemember, mean a son or daughter of the sibling of the covered servicemember. </text></clause><clause commented="no" id="HBFA24ED6ADBD450881BCFD65387EF770"><enum>(v)</enum><header>Parent-in-law</header><text> The term <term>parent-in-law</term>, used with respect to a covered servicemember, means a parent of the spouse or domestic partner of the covered servicemember.</text></clause><clause id="H2DEEE32F1DF94686A2E8E0AFFD4A21CE"><enum>(vi)</enum><header>Sibling</header><text>The term <term>sibling</term>, used with respect to a covered servicemember, means any person who is a son or daughter of parent of the covered servicemember (other than the covered servicemember).</text></clause><clause id="HD661145B7790420C95B21F559256B8F1"><enum>(vii)</enum><header>Son-in-law; daughter-in-law</header><text>The terms <term>son-in-law</term> and <term>daughter-in-law</term>, used with respect to a covered servicemember, mean any person who is a spouse or domestic partner of a son or daughter, as the case may be, of the covered servicemember.</text></clause><clause id="H4F8655637C304EDAB121972A5E1648E4"><enum>(viii)</enum><header>Uncle; aunt</header><text>The terms <term>uncle</term> and <term>aunt</term>, used with respect to a covered servicemember, mean the son or daughter, as the case may be, of the grandparent of the covered servicemember (other than the parent of the covered servicemember).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H8190327FBA7045E88163967582B3F83C"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (e), by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H0857A86D7E1A4946B31EA993F3031F04"><paragraph id="H17083EFF0A9745EDBEEE461CC87BF8FB" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">In any case in which the necessity for leave under subsection (a)(3)(B) is foreseeable, the employee shall provide such notice to the employer as is reasonable and practicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0943D9DC14934BD3AD399023B887CE83"><enum>(c)</enum><header>Certification</header><text>Section 6383 of title 5, United States Code, is amended—</text><paragraph id="H3DFDAB06E8B942D79B0D66EE26DD4341"><enum>(1)</enum><text>in subsection (a), by striking <quote>subparagraph (C) or (D) of section 6382(a)(1)</quote> and inserting <quote>subparagraph (C) or (D) of paragraph (1) of section 6382(a) or subparagraph (A) or (B) of paragraph (3) of such section</quote>; and</text></paragraph><paragraph id="H4D8B27CEDF1D480EB944CA474E62BC5D"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HDCBEB5D9DCAE48E29A759749AE9A823E"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>or serious injury or illness, as the case may be,</quote> after <quote>serious health condition</quote>; and</text></subparagraph><subparagraph id="H3E983C4AAA9349BFB9B8C6280B2F16ED"><enum>(B)</enum><text>in paragraph (4)—</text><clause id="HAD48A73C2F8E46CA910727B4D47F35E7"><enum>(i)</enum><text>in subparagraph (A)—</text><subclause id="H0A43F7BF2DD4433C8F12155CF5AFAA59"><enum>(I)</enum><text>by striking <quote>section 6382(a)(1)(C)</quote> and inserting <quote>paragraph (1)(C) or paragraph (3)(A) of section 6382(a)</quote>; and</text></subclause><subclause id="HD560598909C74CE4B8AC9E70AACF9FE3"><enum>(II)</enum><text>by inserting <quote>covered servicemember,</quote> before <quote>son</quote> in each place it appears; and</text></subclause></clause><clause id="H6B1FBEA474A1433FA8B1C7E1CD0FBAA0"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>section 6382(a)(1)(D)</quote> and inserting <quote>paragraph (1)(D) or paragraph (3)(B) of section 6382(a)</quote>. </text></clause></subparagraph></paragraph></subsection></section></title></legis-body></bill>
