<section id="H75AED42C9FBB47DB8260C22252C08B54" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Local Communities &amp; Bird Habitat Stewardship Act of 2025</short-title></quote>.</text></section> <section id="HA69D1F796FE84D71B7141FF613D8650F" section-type="subsequent-section"><enum>2.</enum><header>Urban Bird Treaty Program</header> <subsection id="HCBFA91BB83A44F66BDB2CE440039EADE"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text> 
<paragraph id="H2CD160DA055F42BEA8B1C540569D6E08"><enum>(1)</enum><text display-inline="yes-display-inline">According to the 2025 State of Birds Report, bird populations continue to decline and have resulted in a 50 percent loss of tipping point bird population species in the last 50 years. The report found that policies to reverse bird declines carry benefits such as healthier working lands, cleaner water, and more resilient landscapes that can withstand fires, floods, and drought.</text></paragraph> <paragraph id="H3B1860ADE1CA4C9185D23C57D600471C"><enum>(2)</enum><text display-inline="yes-display-inline">Nearly 96 million Americans—more than a third of United States adults—engage in birdwatching every year, generating $279,000,000,000 in annual economic output from these birder expenditures—including spending $108,000,000,000 annually on birding-related trips and equipment, directly supporting local businesses and 1.4 million American jobs.</text></paragraph> 
<paragraph id="H79CA6570072B4037B13D388CD77C650F"><enum>(3)</enum><text display-inline="yes-display-inline">Maintaining an abundance of healthy, well-distributed green spaces and bird habitats in and near communities reduces the risk of cross-transmission between wild birds and domestic poultry by dispersing bird populations, minimizing overlap at concentrated feeding or resting areas, and enabling earlier disease detection and response through coordinated monitoring.</text></paragraph> <paragraph id="H42D2B64443D945E3995EF115075FAE76"><enum>(4)</enum><text display-inline="yes-display-inline">Enhancing bird habitat and stewardship in populated areas serves not only to conserve bird populations and connect people to nature, but also to strengthen the ecological infrastructure necessary to mitigate the spread of wildlife-borne diseases such as Highly Pathogenic Avian Influenza.</text> </paragraph></subsection> 
<subsection id="HECCAA309F25D40A4A19632BA50D89EB2"><enum>(b)</enum><header>Urban Bird Treaty Program</header> 
<paragraph id="H0F5EE16FA53D4C41BC2084C4D621B960"><enum>(1)</enum><header>In general</header><text>The Director shall establish a program for the voluntary conservation of birds and the habitats of such birds in urban areas, to be known as the <quote>Urban Bird Treaty Program</quote>.</text></paragraph> <paragraph id="H40EB6E50F6444EF18668C3129CFA290E"><enum>(2)</enum><header>Program duties</header><text display-inline="yes-display-inline">In carrying out the Program, the Director shall—</text> 
<subparagraph id="HCDB8028DB0C14B1498F2B982E57386C2"><enum>(A)</enum><text display-inline="yes-display-inline">work with and support covered entities to—</text> <clause id="HBA3366C6F674445E9E00FA998E6998D4"><enum>(i)</enum><text>protect, restore, or enhance urban habitats for birds, including through the control of invasive species and restoration of native plant species;</text></clause> 
<clause id="H01E7ABE4D5D44B74BE0E89CB0D6AC9E6"><enum>(ii)</enum><text>reduce urban hazards to birds;</text></clause> <clause id="HB97F91C75171457CB5819E0D0501E4C9"><enum>(iii)</enum><text>engage communities in scientific activities involving the monitoring of birds and the habitats of such birds in urban areas; and</text></clause> 
<clause id="HB909809BE2E64EB496B92A7FFBA88119"><enum>(iv)</enum><text display-inline="yes-display-inline">educate and engage communities in caring about and conserving birds and the habitats of such birds in urban areas;</text></clause></subparagraph> <subparagraph id="HE4FE468A92C7400AA371E3A2ED35F84B"><enum>(B)</enum><text>provide technical and financial assistance through partnerships with covered entities to build capacity for, plan, and carry out projects related to activities described in subparagraph (A); and</text> </subparagraph> 
<subparagraph id="HF45E3122088041B294DEB68B62A4734D"><enum>(C)</enum><text>facilitate collaboration and information sharing among covered entities and the public with respect to best management practices for the conservation, restoration, and enhancement of urban bird habitats.</text></subparagraph></paragraph> <paragraph id="H5E377AC8D32F4E99866E65CA4DA21F43"><enum>(3)</enum><header>Grant program</header> <subparagraph id="HEE532F8C585A4714B3A32AE352414DE9"><enum>(A)</enum><header>In general</header><text>The Director shall establish a competitive grant program to award amounts to eligible entities for the purposes of conducting research, planning, assessments, management, building capacity, monitoring, collaboration and information sharing, workforce training, and accomplishing related activities as described in paragraph (2) with respect to the conservation, restoration, enhancement or management of urban birds and the habitats of urban birds.</text></subparagraph> 
<subparagraph id="H1F9D5EA29970406681CB6189BC1AB0C2"><enum>(B)</enum><header>Applications</header><text>To be eligible for a grant under this paragraph, an eligible entity shall submit to the Director an application in such form, at such time, and containing such information as the Director determines appropriate.</text></subparagraph> <subparagraph id="HD8B47461C61F4814912516646E98DE93"><enum>(C)</enum><header>Administration</header> <clause id="HE5E1A2BF6ED9493A918A8F31E4115A12"><enum>(i)</enum><header>Agreement</header><text display-inline="yes-display-inline">The Director shall enter into an agreement with the Foundation for the Foundation to administer the grant program established under subparagraph (A) pursuant to the National Fish and Wildlife Foundation Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3701">16 U.S.C. 3701 et seq.</external-xref>).</text></clause> 
<clause id="H0B8213070F444648BBCB98A26D280087"><enum>(ii)</enum><header>Application of National Fish and Wildlife Foundation Establishment Act</header><text>Section 10(a) of the National Fish and Wildlife Foundation Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3709">16 U.S.C. 3709(a)</external-xref>) shall not apply with respect to—</text> <subclause id="H5E7C1169ABB04F57A34AF7D21E57A3EE"><enum>(I)</enum><text>an agreement entered into under clause (i); or</text></subclause> 
<subclause id="H43EB5278446C48B1A8A1F6A3562F3127"><enum>(II)</enum><text>amounts made available to carry out this section.</text> </subclause></clause></subparagraph></paragraph></subsection> <subsection id="HADE73A3AC5174EFC86C37AD00063BBFB"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="H1764C40E9FE0416D8FF48513E268D82B"><enum>(1)</enum><header>Covered entity</header><text display-inline="yes-display-inline">The term <term>covered entity</term> means—</text> <subparagraph id="HE6EDDB8C60994C5B896915286A67DB5F"><enum>(A)</enum><text display-inline="yes-display-inline">a Federal, Tribal, State, or municipal agency;</text></subparagraph> 
<subparagraph id="HDAC6E299A26F46369135B09035587532"><enum>(B)</enum><text>a nongovernmental organization;</text></subparagraph> <subparagraph id="H507A181007B842E98645C1FCAA2442CD"><enum>(C)</enum><text>a community group; and</text></subparagraph> 
<subparagraph id="H4BB25CB067F1474C9E2E784E201B8D5F"><enum>(D)</enum><text>an academic institution.</text> </subparagraph></paragraph> <paragraph id="H40D901A34A2742E4B02ADE09577E808B"><enum>(2)</enum><header>Director</header><text>The term <term>Director</term> means the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service.</text></paragraph> 
<paragraph id="HB3B729187D8D45B6B480E7F4B78D523F"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text> <subparagraph id="H45AD5FA53A084E01BD67CFF71823DCDD"><enum>(A)</enum><text display-inline="yes-display-inline">a Tribal, State, or municipal agency;</text></subparagraph> 
<subparagraph id="H6407DDD582914A7CA6309F2E7000C88E"><enum>(B)</enum><text>a nongovernmental organization;</text></subparagraph> <subparagraph id="HA4E4D61ED728423699ADF9A3B457D0FC"><enum>(C)</enum><text>a community group; and</text></subparagraph> 
<subparagraph id="H73B926EF97FD43C5893D97611CD637F1"><enum>(D)</enum><text>an academic institution.</text></subparagraph></paragraph> <paragraph id="H876F38D395F146CEB375ECC53755AD4F"><enum>(4)</enum><header>Foundation</header><text display-inline="yes-display-inline">The term <term>Foundation</term> means the National Fish and Wildlife Foundation established by section 2(a) of the National Fish and Wildlife Foundation Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3701">16 U.S.C. 3701(a)</external-xref>).</text></paragraph> 
<paragraph id="H73788023701F4354966651A6C3D50172"><enum>(5)</enum><header>Program</header><text>The term <term>Program</term> means the Urban Bird Treaty Program established under subsection (b)(1).</text></paragraph> <paragraph id="H29AB8E2EFF484733B87D2032E6548E14"><enum>(6)</enum><header>Urban</header><text>The term <term>urban</term> has the meaning given the term <term>urban area</term> in section 101(a) of title 23, United States Code.</text></paragraph></subsection> 
<subsection id="H7196DD1C8A404F9CAFA6C9343130DB86"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Director to carry out this section $1,000,000 for each of fiscal years 2026 through 2032.</text> </subsection> </section> </legis-body></bill>
