which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 40, United States Code, to direct the Administrator of General Services to incorporate practices and strategies to reduce bird fatalities resulting from collisions with certain public buildings, and for other purposes.</official-title></form><legis-body id="H84C7CE82648D41ECB82C98D113E98C3C" style="OLC"><section id="H9C5609CB946C44F6ACDC5F1B9E05C9AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Bird Safe Buildings Act of 2025</short-title></quote>.</text></section><section id="H0AC65D5A408B4758820864A8E54DC1BE"><enum>2.</enum><header>Use of bird-safe features, practices, and strategies in public buildings</header><subsection id="HC779A26786DA476DB3178379666FB5BC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/33">Chapter 33</external-xref> of title 40, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H48C4A55E438A46E5901473312BEE3DC1" display-inline="no-display-inline"><section id="HE6B68F9150134AD09B47B7CF905828B1"><enum>3319.</enum><header>Use of bird-safe features, practices, and strategies in public buildings</header><subsection id="H14AA34DD1B1346B3AAE09FF93EFDBA04"><enum>(a)</enum><header>Construction, alteration, and acquisition of public buildings</header><text display-inline="yes-display-inline">The Administrator of General Services shall incorporate, to the extent practicable, features, practices, and strategies to reduce bird fatality resulting from collisions with public buildings for each public building—</text><paragraph id="H5FEF3E27D9D04780B170330D5476B30D"><enum>(1)</enum><text>constructed;</text></paragraph><paragraph id="H90413E4586DB431481E737F602DE5353"><enum>(2)</enum><text>acquired; or</text></paragraph><paragraph id="H632D5FA2CA42438999E2C08F6B2AD492"><enum>(3)</enum><text>of which more than 50 percent of the facade is substantially altered (in the opinion of the Commissioner of Public Buildings).</text></paragraph></subsection><subsection id="H590DEE7DE7B8416B81631FB4D4DABE26"><enum>(b)</enum><header>Design guide</header><text display-inline="yes-display-inline">The Administrator shall develop a design guide to carry out subsection (a) that includes the following:</text><paragraph id="H3723BCCABE9E4A8BA733656E3FA0D573"><enum>(1)</enum><text display-inline="yes-display-inline">Features for reducing bird fatalities resulting from collisions with public buildings throughout all construction phases, taking into account the risks and available information on bird fatalities that occur at different types of public buildings.</text></paragraph><paragraph id="H74DC0BF17E9141D5B351793D484F38EB"><enum>(2)</enum><text display-inline="yes-display-inline">Methods and strategies for reducing bird fatalities resulting from collisions with public buildings during the operation and maintenance of such buildings, including installing interior, exterior, and site lighting.</text></paragraph><paragraph id="HBC33C78A875349939518C8A540E3C5B7"><enum>(3)</enum><text display-inline="yes-display-inline">Best practices for reducing bird fatalities resulting from collisions with public buildings, including—</text><subparagraph id="HEC77E89872E241EF847F9581A72A7A8B"><enum>(A)</enum><text>a description of the reasons for adopting such practices; and</text></subparagraph><subparagraph id="H1088A240DD5B46E799A67434C4DE0674"><enum>(B)</enum><text>an explanation for the omission of a best practice identified pursuant to subsection (c).</text></subparagraph></paragraph></subsection><subsection id="H365ABE3662054ED6A7AD937AB9BF6353"><enum>(c)</enum><header>Identifying best practices</header><text display-inline="yes-display-inline">To carry out subsection (b)(3), the Administrator may identify best practices for reducing bird fatalities resulting from collisions with public buildings, including best practices recommended by—</text><paragraph id="H75DD30F2701E4E6CB376E67262046ADD"><enum>(1)</enum><text>Federal agencies with expertise in bird conservation;</text></paragraph><paragraph id="H95F883C3B2B747BB81F304763E839C8F"><enum>(2)</enum><text>nongovernmental organizations with expertise in bird conservation; and</text></paragraph><paragraph id="H70F783D73C184B89AA4C54FE78D258D2"><enum>(3)</enum><text>representatives of green building certification systems.</text></paragraph></subsection><subsection id="H198DDA7C4E0E4A38B1FB4791A0CABDD1"><enum>(d)</enum><header>Dissemination of design guide</header><text display-inline="yes-display-inline">The Administrator shall disseminate the design guide developed pursuant to subsection (b) to all Federal agencies, subagencies, and departments with independent leasing authority from the Administrator.</text></subsection><subsection id="H3F0D60E9672747EDBCDD7D6D4A412D1D"><enum>(e)</enum><header>Update to design guide</header><text display-inline="yes-display-inline">The Administrator shall, on a regular basis, update the design guide developed pursuant to subsection (b) with respect to the priorities of the Administrator for reducing bird fatalities resulting from collisions with public buildings.</text></subsection><subsection id="HAA6E8DA3E64542E1A410589603328D60"><enum>(f)</enum><header>Exempt buildings</header><text>This section shall not apply to—</text><paragraph id="HA97B77D842984321B6D56C5E6CFE9986"><enum>(1)</enum><text display-inline="yes-display-inline">any building or site listed, or eligible for listing, on the National Register of Historic Places;</text></paragraph><paragraph id="H0D6BE60CBB5D459AA01C29C6A9E50AE9"><enum>(2)</enum><text display-inline="yes-display-inline">the White House and the grounds of the White House;</text></paragraph><paragraph id="HCA604BD738024521B8517F76F3E0AC9C"><enum>(3)</enum><text display-inline="yes-display-inline">the Supreme Court building and the grounds of the Supreme Court; or</text></paragraph><paragraph id="H5282F5C52DF44666A126A0145FEE6C8A"><enum>(4)</enum><text display-inline="yes-display-inline">the United States Capitol and any building on the grounds of the Capitol.</text></paragraph></subsection><subsection id="H842DCAFF55FB4070ABAABE317BDADC79"><enum>(g)</enum><header>Compliance</header><text display-inline="yes-display-inline">Not later than October 1 of each fiscal year, the Administrator, acting through the Commissioner, shall gather information on compliance with and certify to Congress that the Administrator uses the design guide developed pursuant to subsection (b) for each public building described in subsection (a).</text></subsection><subsection id="H9C28E33BA247448D997198BEAF10447B"><enum>(h)</enum><header>Report</header><text>Not later than October 1 of each fiscal year, the Administrator shall submit to Congress a report that includes—</text><paragraph id="H9274CFB7D12D4A8FB87242B46732C2DB"><enum>(1)</enum><text>the information under subsection (g);</text></paragraph><paragraph id="H54279B480F4F4905967DD5D6F0B94557"><enum>(2)</enum><text display-inline="yes-display-inline">to the extent practicable, an assessment of bird fatalities that occurred as a result of a collision with the public buildings occupied by the respective head of each Federal agency; and</text></paragraph><paragraph id="H500593594D484E50AE6171CBF281A463"><enum>(3)</enum><text>any recommendations to reduce the risk of bird fatalities in and around public buildings occupied by Federal agencies.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC838D5A0255945F3929CDE6FB1CAE000"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/33">chapter 33</external-xref> of title 40, United States Code, is amended by adding at the end the following new item:</text><quoted-block style="OLC" id="HAF7803918EC14D839869686A57E2DDF1" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">3319. Use of bird-safe features, practices, and strategies in public buildings.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
