<section id="H5A90A4A48C7A4F0CB50266DA4C209EDE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Relief for Farm Workers Act</short-title></quote>.</text></section> <section id="HCEAB20097DFD4450BC8087D51B3DE41B"><enum>2.</enum><header>Emergency assistance for farm workers</header><text display-inline="no-display-inline">Section 2281 of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/5177a">42 U.S.C. 5177a</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HAFCA458C0E2C412EBD977D38FBEB558C"> 
<section id="HC50A814D328843F4B232949C4DA0E400" commented="no" display-inline="no-display-inline"><enum>2281.</enum><header>Emergency assistance for farm workers</header> 
<subsection id="HBAFBEE7AF0C4407FA24F5AF2D7E02C30" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Emergency relief</header><text display-inline="yes-display-inline">For fiscal year 2026 and each succeeding fiscal year, during any period where the Secretary determines there is a covered disaster, the Secretary, acting through the Under Secretary for Rural Development, shall make grants to eligible farm worker organizations to provide emergency relief to farm workers affected by such covered disaster.</text></subsection> <subsection id="H63CF433AB85F408AA07690BD53A51379" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">An eligible farm worker organization may use funds received pursuant to a grant awarded under subsection (a) to—</text> 
<paragraph id="HA6B524E0D5A74593A50C32D46763A52F"><enum>(1)</enum><text display-inline="yes-display-inline">provide emergency relief (including through direct distribution of funding) to farm workers to address loss and damage due to a covered disaster;</text></paragraph> <paragraph id="H04FBBA08E6B449DB927BBC7AADA0639A" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">build capacity to provide such emergency relief;</text></paragraph> 
<paragraph id="HB8DCD13A90F1474D90AAD947B8C45D48" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">build resiliency in farm worker communities to address future losses and damages due to covered disasters;</text></paragraph> <paragraph id="HA86798D950CD4D6DB33A3EBCB97C54AA" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">provide infrastructure support, including shelter; and</text></paragraph> 
<paragraph id="HCA1A1A84ADBA4E7F82BE567CAAF4300A"><enum>(5)</enum><text display-inline="yes-display-inline">provide emergency services (including such types of assistance the Secretary determines appropriate) to farm workers in response to a covered disaster.</text></paragraph></subsection> <subsection id="H51664D018EEA4B8CAB9983AB29C87598" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Availability of funds</header><text>Any funds provided to an eligible farm worker organization under this section shall remain available until expended.</text></subsection> 
<subsection id="H29207B8E986A45388835B3C92456A489"><enum>(d)</enum><header>Promotional plan</header><text display-inline="yes-display-inline">The Secretary shall develop and execute a promotional plan prior to, and throughout the distribution of, emergency relief grants under subsection (a).</text></subsection> <subsection id="HCD515CE86FAD41D5BE4CE1932B582068" commented="no"><enum>(e)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall consult with eligible farm worker organizations.</text></subsection> 
<subsection id="HF9CE0449F2874F0FAC8EC87580D5A92D" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> <paragraph id="H4BF66A39C1DA4A68B79F613DB00D97AA" commented="no"><enum>(1)</enum><header>Covered disaster</header><text display-inline="yes-display-inline">The term <term>covered disaster</term> means—</text> 
<subparagraph id="HAEEED2E19AA74A0C95AA96EA2063D079" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">an adverse weather event, such as a drought, wildfire, earthquake, hurricane, flood, derecho, excessive heat, tornado, winter storm, freeze, hail, polar vortex, smoke exposure, or excessive moisture;</text></subparagraph> <subparagraph id="H01288CB91DA74D1F9C62B8FE6C502D22" commented="no"><enum>(B)</enum><text>an unexpected health crisis, such as a pandemic; and</text></subparagraph> 
<subparagraph id="H4B60FEEDAA264741BBAF6B503C7FA064" commented="no" display-inline="no-display-inline">
                                <enum>(C)</enum>
 <text display-inline="yes-display-inline">such other event or condition that has caused farm workers to lose income, be unable to work, or stay home or return home in anticipation of work shortages.</text>
                            </subparagraph></paragraph> 
<paragraph id="HADFCF7DFADF14690B78DA199C2C58C4A"><enum>(2)</enum><header>Eligible farm worker organization</header><text display-inline="yes-display-inline">The term <term>eligible farm worker organization</term> means an organization that is—</text> <subparagraph id="H730981B42C8245528127EA82EED498AC"><enum>(A)</enum><text>a farm worker membership-based organization; or</text></subparagraph> 
<subparagraph id="H144F208D6D314D77A746ECF7001A00C1"><enum>(B)</enum><text display-inline="yes-display-inline">an organization that—</text> <clause id="HE7564A884E8149238909C5D3F24F3EF2"><enum>(i)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code; and</text></clause> 
<clause id="H5D6F5BE83072471DB081C9FB3276B93F"><enum>(ii)</enum><text>has experience in providing support or relief services to farm workers, including migrant or seasonal farm workers.</text></clause></subparagraph></paragraph> <paragraph id="H261D93BC2E314197A03C03DC8E05D54A"><enum>(3)</enum><header>Migrant or seasonal farm worker</header><text display-inline="yes-display-inline">The term <term>migrant or seasonal farm worker</term> means an individual—</text> 
<subparagraph id="H169127BD04EF4BC2A37DA18153D5CE46"><enum>(A)</enum><text>who has, during any consecutive 12-month period within the preceding 24-month period, performed farm work for wages; and</text></subparagraph> <subparagraph id="HCA9207143E5A40D088644D289351B861"><enum>(B)</enum><text>who has received not less than one-half of such individual’s total income, or been employed at least one-half of total work time in farm work.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
