<section id="H01D359E1A7634B048EC815A7D36FFEDA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Research Advancing to Market Production for Innovators Act</short-title></quote>.</text></section> <section id="H67BF1E3FD4A6437299B503F944D233A8" changed="not-changed"><enum>2.</enum><header>Improvements to commercialization selection</header> <subsection id="HBC5CA758CA6340F699920A107364D1CA" changed="not-changed"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended—</text> 
<paragraph id="HA657E624B19542799EA1A27A7DBBA50A" changed="not-changed"><enum>(1)</enum><text>in subsection (g)—</text> <subparagraph id="H702ED38509FA411E812039616F8F0450" changed="not-changed"><enum>(A)</enum><text>in paragraph (4)(B)(i), by striking <quote>1 year</quote> and inserting <quote>180 days</quote>;</text></subparagraph> 
<subparagraph id="H2CEFB357CFB9482AB23BE91B67A4B81A" changed="not-changed"><enum>(B)</enum><text>in paragraph (16), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="H6D58EF50358747C9BBBEC4E663BD0004" changed="not-changed"><enum>(C)</enum><text>in paragraph (17), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H00C5512B75C64E209C09B34E00F9D321" changed="not-changed"><enum>(D)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HB99BDBDB95404CBD938E1E3E75B838D6" changed="not-changed"> <paragraph id="HC4801C59A93C4828BA81278376CF7EF5" changed="not-changed"><enum>(18)</enum><text>with respect to peer review carried out under the SBIR program, to the extent practicable, include in the peer review—</text> 
<subparagraph id="H69CA858D1DED4E49A2EAAC3797B48A5B" changed="not-changed"><enum>(A)</enum><text>the likelihood of commercialization in addition to scientific and technical merit and feasibility; and</text></subparagraph> <subparagraph id="HBD13A3B1E11E4A93BDAA29D52DE033D7" changed="not-changed"><enum>(B)</enum><text>not less than 1 reviewer with commercialization expertise who is capable of assessing the likelihood of commercialization.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H901F229549F748DD9D7CD954CA976ABF" changed="not-changed"><enum>(2)</enum><text>in subsection (o)—</text> <subparagraph id="H293C90E62AE54632B0293A72EA1F4842" changed="not-changed"><enum>(A)</enum><text>in paragraph (4)(B)(i), by striking <quote>1 year</quote> and inserting <quote>180 days</quote>;</text></subparagraph>

<subparagraph id="H9F80A7E79E3B4A909D303AE917242F34" changed="not-changed"><enum>(A)</enum><text>the likelihood of commercialization in addition to scientific and technical merit and feasibility; and</text></subparagraph> <subparagraph id="HB420139AC77E4967A429C91E24638720" changed="not-changed"><enum>(B)</enum><text>not less than 1 reviewer with commercialization expertise who is capable of assessing the likelihood of commercialization.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section> 
<section changed="not-changed" commented="no" display-inline="no-display-inline" id="HE63F9A08070C482A8695AC525D4ECCC9"><enum>3.</enum><header>Improvements to phase flexibility</header> 
<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="H09C538C76B9B425ABBE3AC499221934F"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 9(cc) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(cc)</external-xref>) is amended—</text> <paragraph id="HA66B9DFA030043EB86C4B265362056AA" changed="not-changed"><enum>(1)</enum><text>by striking <quote>During fiscal years 2012 through 2025, the National Institutes of Health, the Department of Defense, and the Department of Education may each</quote> and inserting the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H27DF7D9F272A4307B86F27683410592A" changed="not-changed"> 
<paragraph id="H9A9B7732B9E549BE99F30C60282BD651" changed="not-changed"><enum>(1)</enum><header>In general</header><text>During fiscal years 2025, 2026, and 2027, each Federal agency with an SBIR or STTR program may</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="H668DF4516A4848D9905975ED11F69335"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block id="H9D5586385B7244E0A837195C47E3F01A" style="OLC">
<paragraph id="H9BA8FD96A840468C9D50A12CE1227C5C"><enum>(2)</enum><header>Limitation</header><text>The total value of awards provided by a Federal agency under this subsection in a fiscal year shall be—</text> <subparagraph id="H1014AD9C684A4AC3A687891477B6117C"><enum>(A)</enum><text>except as provided in subparagraph (B) and (C), not more than 10 percent of the total funds allocated to the SBIR and STTR programs of the Federal agency during that fiscal year;</text></subparagraph>
<subparagraph id="H09D965FD24DF4CBC9D84D43A382FF3CA"><enum>(B)</enum><text>with respect to the National Institutes of Health, not more than 30 percent of the total funds allocated to the SBIR and STTR programs of the National Institutes of Health during that fiscal year; and</text></subparagraph> <subparagraph id="HF31418253C324080AB66D1AC1F72763B"><enum>(C)</enum><text>The limitation under subparagraph (A) shall not apply with respect to the Department of Defense.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="H57A59C34F2BB449E8A4D5CA4DB1FAF20"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator of the Small Business Administration shall provide a briefing to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives regarding the authority provided under section 9(cc) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(cc)</external-xref>), as amended by paragraph (1).</text></subsection></section> <section changed="not-changed" commented="no" display-inline="no-display-inline" id="H5012CB50BED54B0B942B0B377C749516"><enum>4.</enum><header>Technology commercialization official</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H9FC5362BBAC5485D89DD205AE4BC3523" changed="not-changed"> 
<subsection id="HACB933044AD7446C95E9366DD6200D80" changed="not-changed"><enum>(aaa)</enum><header>Technology Commercialization Official</header><text>Each Federal agency participating in the SBIR or STTR program shall—</text> <paragraph changed="not-changed" commented="no" display-inline="no-display-inline" id="HCDFB0482110D4E83882098334DAEE9F0"><enum>(1)</enum><text display-inline="yes-display-inline">designate an existing official within the Federal agency as the Technology Commercialization Official of the Federal agency, who shall—</text> 
<subparagraph id="H2FF6E381A48F4A51A8434BDDBB9CBC2F" changed="not-changed"><enum>(A)</enum><text>have sufficient commercialization experience;</text></subparagraph> <subparagraph id="H4EAFFC49597D40BCBDA2CA439D77B5C8" changed="not-changed"><enum>(B)</enum><text>provide guidance to SBIR and STTR program awardees in commercializing and transitioning technologies;</text></subparagraph> 
<subparagraph id="H82C0F3AE371C46138EAB2F8F46C526B4" changed="not-changed"><enum>(C)</enum><text>identify and advocate for SBIR and STTR program technologies with sufficient technology and commercialization readiness to advance to Phase III awards or other non-SBIR or STTR program contracts;</text></subparagraph> <subparagraph id="HD8289BD87B0348EBB83A9D34C7DAB1BE" changed="not-changed"><enum>(D)</enum><text>coordinate with the Administration and Technology Commercialization Officials of other Federal agencies to identify additional markets and commercialization pathways for promising SBIR and STTR program technologies;</text></subparagraph> 
<subparagraph id="H3ECCD887A9AF49399B5A2AF0E1B50639" changed="not-changed"><enum>(E)</enum><text>submit to the Administration an annual report on the number of technologies from the SBIR or STTR program that have advanced commercialization activities, including information required in the commercialization impact assessment under subsection (ccc);</text></subparagraph> <subparagraph id="HD83B1CA5FE424742A6C057FA37D6CFAB" changed="not-changed"><enum>(F)</enum><text>submit to the Administration an annual report on actions taken by the Federal agency, and the results of those actions, to simplify, standardize, and expedite the application process and requirements, procedures, and contracts as required under subsection (hh); and</text></subparagraph> 
<subparagraph id="H5AA9A13ACDC1405E9A0BB8C922ADEAF4" changed="not-changed"><enum>(G)</enum><text>carry out such other duties as the Federal agency determines necessary; or</text></subparagraph></paragraph> <paragraph id="H5F4AA024BB674ADEAEE909CACD587262"><enum>(2)</enum><text>identify an official carrying out substantially similar responsibilities as those described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HFAEBBE7E757D407591AA4E7066C708D5" changed="not-changed"><enum>5.</enum><header>Improvements to technical and business assistance</header><text display-inline="no-display-inline">Section 9(q) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638(q)</external-xref>) is amended—</text> <paragraph id="H9248A8DB35824CC3AD8CAD5D6DB9ED79" changed="not-changed"><enum>(1)</enum><text>in paragraph (1), in the matter preceding subparagraph (A)—</text> 
<subparagraph id="H9BADDFCC07274C2C9FB5DE2BD290C3E0" changed="not-changed"><enum>(A)</enum><text>by striking <quote>may enter into an agreement with 1 or more vendors selected under paragraph (2)(A) to provide small business concerns engaged in SBIR or STTR projects with technical and business assistance services</quote> and inserting <quote>shall authorize recipients of awards under the SBIR or STTR program to select, if desired, technical and business assistance provided under subparagraph (A), (B), or (C) of paragraph (2) with respect to SBIR or STTR projects</quote>;</text></subparagraph> <subparagraph id="H77C243E45AE043FA9A21C8C2BF7047F6" changed="not-changed"><enum>(B)</enum><text>by inserting <quote>cybersecurity assistance,</quote> after <quote>intellectual property protections,</quote>; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H4C68FAF1F1EF4A639696425F39D4CC1E" changed="not-changed"><enum>(C)</enum><text>by striking <quote>such concerns</quote> and inserting <quote>such recipients</quote>;</text></subparagraph></paragraph> <paragraph id="H2B586B55E94149DABAF5A6E8198B298B" changed="not-changed"><enum>(2)</enum><text>in paragraph (2), by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HED4177F8F31A4AEF8440D32EC9E164CF" changed="not-changed"> 
<subparagraph id="HDAAAF0710DB34D8FB95A16DAB092CA32" changed="not-changed"><enum>(C)</enum><header>Staff</header><text>A small business concern may, by contract or otherwise, use funding provided under this section to hire new staff, augment staff, or direct staff to conduct or participate in training activities consistent with the goals listed in paragraph (1).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="HE3247B3D580A4211A7EB8F3E9DFD7936" changed="not-changed"><enum>(3)</enum><text>in paragraph (3), by striking subparagraphs (A) and (B) and inserting the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HA33E620811F949399C1104890E3ED0FC" changed="not-changed"> 
<subparagraph id="H8444F1B56B23449483D491ECA00C8A35" changed="not-changed"><enum>(A)</enum><header>Phase I</header><text>A Federal agency described in paragraph (1) shall authorize a recipient of a Phase I SBIR or STTR award to utilize not more than $6,500 per project, included as part of the award of the recipient or in addition to the amount of the award of the recipient as determined appropriate by the head of the Federal agency, for the services described in paragraph (1)—</text> <clause id="HE3F6E5FDB16E423A87C9DFEBBBB862BC" changed="not-changed"><enum>(i)</enum><text>provided through a vendor selected under paragraph (2)(A);</text></clause> 
<clause id="HA5A745BB394346698BDF3A2C15503CBD" changed="not-changed"><enum>(ii)</enum><text>provided through a vendor other than a vendor selected under paragraph (2)(A);</text></clause> <clause id="H3FCA841C9531409D931C25A2F6A60747" changed="not-changed"><enum>(iii)</enum><text>achieved through the activities described in paragraph (2)(C); or</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H1D738DA7B2CA4E9188091BBA1B82CA01" changed="not-changed"><enum>(iv)</enum><text display-inline="yes-display-inline">provided or achieved through any combination of clauses (i), (ii), and (iii).</text></clause></subparagraph> <subparagraph id="H45F1CBA5FADF42F4BF6588D6ED8C9E5B" changed="not-changed"><enum>(B)</enum><header>Phase II</header><text>A Federal agency described in paragraph (1) shall authorize a recipient of a Phase II SBIR or STTR award to utilize not more than $50,000 per project, included as part of the award of the recipient or in addition to the amount of the award of the recipient as determined appropriate by the head of the Federal agency, for the services described in paragraph (1)—</text> 
<clause id="H63A5F167AEB442C3A008FB0DD480F017" changed="not-changed"><enum>(i)</enum><text>provided through a vendor selected under paragraph (2)(A);</text></clause> <clause id="HE2B092D7295F4742B7A32BE8033A3C14" changed="not-changed"><enum>(ii)</enum><text>provided through a vendor other than a vendor selected under paragraph (2)(A);</text></clause> 
<clause id="HC5DF973A5ADD41D2A093519EC303F056" changed="not-changed"><enum>(iii)</enum><text>achieved through the activities described in paragraph (2)(C); or</text></clause> <clause id="HE7671E6248DD4DEE9982AFEC54A183B4" changed="not-changed"><enum>(iv)</enum><text>provided or achieved through any combination of clauses (i), (ii), and (iii).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HD2F9B95AC57E42C7A61A0B2B46E8BB17" changed="not-changed"><enum>(4)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H9865885BF9E74DBB8334D083BADF6460" changed="not-changed"> <paragraph id="HE16EF7EF1FF4482AB926CCEF5DC3E1A9" changed="not-changed"><enum>(5)</enum><header>Targeted review</header><text>A Federal agency may perform targeted reviews of technical and business assistance funding as described in subsection (mm)(1)(F).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section changed="not-changed" commented="no" display-inline="no-display-inline" id="HE9445CA24E2E4738AB0578BDCE39498E"><enum>6.</enum><header>I-Corps Participation</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as amended by section 4, is amended by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H6889A4648C1449AD91431A38A73BE3D4"> <subsection id="HAE65E47945264E739554D49179D9480F" changed="not-changed"><enum>(bbb)</enum><header>I-Corps participation</header> <paragraph id="H182AC23AD53A459BBDB1697E29C6A9D4" changed="not-changed"> <enum>(1)</enum> <header>In general</header> <text>Each Federal agency that is required to conduct an SBIR or STTR program with an Innovation Corps (commonly known as <quote>I-Corps</quote>) program shall—</text>
            <subparagraph id="H77FA85F927804F9090A9DF0F2FA81C2E" changed="not-changed">
              <enum>(A)</enum>
 <text>provide an option for participation in an I-Corps teams course by recipients of an award under the SBIR or STTR program; and</text>
            </subparagraph>
            <subparagraph id="HF942480EEF184563A42DE942FC70F489" changed="not-changed">
              <enum>(B)</enum>
 <text>authorize the recipients described in subparagraph (A) to use an award provided under subsection (q) to provide additional technical assistance for participation in the I-Corps teams course.</text>
            </subparagraph>
          </paragraph> 
<paragraph id="HE4601243AB184F7AA82B8888439E8810" changed="not-changed"><enum>(2)</enum><header>Cost of participation</header><text>The cost of participation by a recipient described in paragraph (1)(A) in an I-Corps course may be provided by—</text> <subparagraph id="H24905F3CA8C743BA8FC8B35DED9A6C21" changed="not-changed"><enum>(A)</enum><text>an I-Corps team grant;</text></subparagraph> 
<subparagraph id="HC3F3BE89B78D405BA0B175DC774548AE" changed="not-changed"><enum>(B)</enum><text>funds awarded to the recipient under subsection (q);</text></subparagraph> <subparagraph id="HA76F2EA2B4A444D2BDE55C7C83E3D876" changed="not-changed"><enum>(C)</enum><text>the participating teams or other sources as appropriate; or</text></subparagraph> 
<subparagraph id="HC89D94D3453C400BA4C73EA030CD438E" changed="not-changed"><enum>(D)</enum><text>any combination of sources described in subparagraphs (A), (B), and (C).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> <section changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HA12CA0DA1D1B49A8995A1B9966F8F0E7"><enum>7.</enum><header>Commercialization impact assessment</header><text display-inline="no-display-inline">Section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), as amended by sections 4 and 6, is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H4256F212B0294864BFBE3DA09876CBD0"> 
<subsection id="HEDC9BB8C6D2043DCB012F161A2D03478" changed="not-changed"><enum>(ccc)</enum><header>Commercialization impact assessment</header> 
<paragraph id="HCAAEA7B1F15D46D19FF91FE6EB743EF1" changed="not-changed"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall coordinate with each Federal agency with an SBIR or STTR program to develop an annual commercialization impact assessment report, which shall measure, for each small business concern that has received not less than 50 Phase II awards on or after October 1 of the ninth fiscal year before the fiscal year in which the report is submitted—</text> <subparagraph id="H638FCF659F43494398FC24B4CEC343E7"><enum>(A)</enum><text>total dollar value of Federal awards, contracts, and subcontracts, other than SBIR or STTR awards, received by the small business concern over the preceding 9 fiscal years;</text></subparagraph> 
<subparagraph id="HEE0FC84F3EBB44DE9E57DC12AC42B0A6"><enum>(B)</enum><text>the total dollar value of all SBIR and STTR Phase I and Phase II awards received by the small business concern over the preceding 9 fiscal years;</text></subparagraph> <subparagraph id="H4E897F86BC7F4E629378DCD247C12097"><enum>(C)</enum><text>the average annual gross revenue of the small business concern over the preceding 9 fiscal years;</text></subparagraph> 
<subparagraph id="H27831BED167540E2BF83874D165AB433"><enum>(D)</enum><text>total revenue from the sale or licensing of new products and services resulting from the research conducted under the awards received in the preceding 9 fiscal years;</text></subparagraph> <subparagraph id="H72F583D5F9DE432DA76469191011F06C"><enum>(E)</enum><text>additional investment from any source other than Phase I or Phase II SBIR or STTR awards, to further the research and development conducted under the awards received in the preceding 9 fiscal years;</text></subparagraph> 
<subparagraph id="H10152091DDE341058256BC8E4159CD46"><enum>(F)</enum><text>mergers and acquisitions of award recipients during or after the completion of a Phase II award;</text></subparagraph> <subparagraph id="HA77BD688B8474F37B79B2F55F4A3E776"><enum>(G)</enum><text>new, unique spin-out companies resulting from research conducted under the awards received in the preceding 9 fiscal years;</text></subparagraph> 
<subparagraph id="HAA71BD28C2B648DCA2D5CE0A00A50D41"><enum>(H)</enum><text>patents acquired as a result of research conducted under the awards received in the preceding 9 fiscal years;</text></subparagraph> <subparagraph id="HDC29C6C755E64A43BD8177A5A464B6B4"><enum>(I)</enum><text>the year of first Phase II award and the total number of employees at the time of first Phase II award;</text></subparagraph> 
<subparagraph id="H7AB97FFE76C1472290E5C9F5B43AEABC"><enum>(J)</enum><text>the number of employees, as of the end of the most recent fiscal year; and</text></subparagraph> <subparagraph id="H1F16B4F123704B4F8EA23E7B51296C57"><enum>(K)</enum><text>the total number and value of Phase III awards received.</text></subparagraph></paragraph> 
<paragraph id="HD9856716E1774620A106D72E915D842E" changed="not-changed"><enum>(2)</enum><header>Publication</header><text>The commercialization impact assessment report described in paragraph (1) shall be—</text> <subparagraph id="HDB5B17668F85458495D931F1E4266025" changed="not-changed"><enum>(A)</enum><text>included in the annual report submitted under subsection (b)(7); and</text></subparagraph>
