which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to remove silencers from the definition of firearms, and for other purposes.</official-title></form><legis-body id="H11E0E3241B2340B38200071EE19B1C72" style="OLC"><section id="HC4221C59C0D3496ABE03BF21935A3973" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Constitutional Hearing Protection Act</short-title></quote>.</text></section><section id="H0AEC48B3D14045169BEAADDDE7DDDB6C"><enum>2.</enum><header>Equal treatment of silencers and firearms</header><subsection id="H7E5A9BC44BEE4A34A1C1FF6B770D64A8"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/5845">Section 5845(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>(7) any silencer</quote> and all that follows through <quote>; and (8)</quote> and inserting <quote>and (7)</quote>.</text></subsection><subsection id="HC9D41D5A0D414B59AA2E0CA2B39DB5EE"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to calendar quarters beginning more than 90 days after the date of the enactment of this Act.</text></subsection></section><section id="H332A8A0C8C364116BDDCF06F55F26DF6"><enum>3.</enum><header>Treatment of certain silencers</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/5841">Section 5841</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block id="H83AB86AEB9F34C77BB94683F8C78718C" style="OLC"><subsection id="H0D76A1FCA10A44218EACF32C93E3E99E"><enum>(f)</enum><header>Firearm silencers</header><text>A person acquiring or possessing a firearm silencer in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, shall be treated as meeting all registration and licensing requirements of the National Firearms Act with respect to such silencer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H3A81F3B30ECF451AA798DB0B14448972"><enum>4.</enum><header>Preemption of certain State laws in relation to firearm silencers</header><text display-inline="no-display-inline">Section 927 of title 18, United States Code, is amended by adding at the end the following: <quote>Notwithstanding the preceding sentence, a law of a State or a political subdivision of a State that imposes a tax, other than a generally applicable sales or use tax, on making, transferring, using, possessing, or transporting a firearm silencer in or affecting interstate or foreign commerce, or imposes a marking, recordkeeping or registration requirement with respect to such a firearm silencer, shall have no force or effect.</quote>.</text></section><section id="H4A9A6340FB6149A5B47ADC93A4B12234"><enum>5.</enum><header>Destruction of records</header><text display-inline="no-display-inline">Not later than 365 days after the date of the enactment of this Act, the Attorney General shall destroy any registration of a silencer maintained in the National Firearms Registration and Transfer Record pursuant to <external-xref legal-doc="usc" parsable-cite="usc/26/5841">section 5841</external-xref> of the Internal Revenue Code of 1986, any application to transfer filed under <external-xref legal-doc="usc" parsable-cite="usc/26/5812">section 5812</external-xref> of the Internal Revenue Code of 1986 that identifies the transferee of a silencer, and any application to make filed under <external-xref legal-doc="usc" parsable-cite="usc/26/5822">section 5822</external-xref> of the Internal Revenue Code of 1986 that identifies the maker of a silencer.</text></section><section id="HDB6A13CAFC5844BF950B1EE456E8AE7A"><enum>6.</enum><header>Amendments to title 18, United States Code</header><text display-inline="no-display-inline">Title 18, United States Code, is amended—</text><paragraph id="HF13323ADF6E94D7881BB66C88EE17EF9"><enum>(1)</enum><text>in section 921(a), by striking paragraph (25) and inserting the following:</text><quoted-block id="H69AEC3134DDB44AFA5B99ACC6ED05A4A" style="OLC"><paragraph id="H8222438D5D6B4A0A856EF78796C567FC"><enum>(25)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H192BBB623E104764B6E23B7354B91207"><enum>(A)</enum><text>The terms <term>firearm silencer</term> and <term>firearm muffler</term> mean any device for silencing, muffling, or diminishing the report of a portable firearm, including the <quote>keystone part</quote> of such a device.</text></subparagraph><subparagraph id="H1E7AD9EDC4A04214A4F76EFCA0BD5F05" indent="up1"><enum>(B)</enum><text>The term <term>keystone part</term> means, with respect to a firearm silencer or firearm muffler, a single externally visible part of a firearm silencer or firearm muffler, without which a device capable of silencing, muffling, or diminishing the report of a portable firearm cannot be assembled, but the term does not include any interchangeable parts designed to mount a firearm silencer or firearm muffler to a portable firearm.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HA13392DFA58B4943A6F9B177F92C8E44"><enum>(2)</enum><text>in section 922(b)—</text><subparagraph id="HBF6C127659E94718A2F15E99F1EC530B"><enum>(A)</enum><text>in paragraph (1), by striking <quote>shotgun or rifle</quote> the first place it appears and inserting <quote>shotgun, rifle, firearm silencer or firearm muffler</quote>; and</text></subparagraph><subparagraph id="H9D148D7A720642D6AF4523DCF73D7C4E"><enum>(B)</enum><text>in paragraph (3), by striking <quote>rifle or shotgun</quote> and inserting <quote>shotgun, rifle, firearm silencer or firearm muffler</quote>; and</text></subparagraph></paragraph><paragraph id="H7672D0B917E349C59D902EA63F5D66D0"><enum>(3)</enum><text>in section 923(i)—</text><subparagraph id="H4742B81D1ED74038996528E38177A01F"><enum>(A)</enum><text>by striking <quote>Licensed</quote> and inserting the following:</text><quoted-block id="HD19613C109664818BEE9BC3BAADF73B1" style="OLC"><paragraph id="H40B708591D804D4F8E0D7F60816476EB"><enum>(1)</enum><text>In the case of a firearm other than a firearm silencer or firearm muffler, licensed</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HB2C6B08CE1CD4C7B9B00C1A5D7C8CF1F"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="H5EDB703D8BD449BA9D627047EB4E5A23" style="OLC"><paragraph id="H40CEEBF455E848FF955D3351D568BB44"><enum>(2)</enum><text>In the case of a firearm silencer or firearm muffler, licensed importers and licensed manufacturers shall identify by means of a serial number engraved or cast on the single keystone part of the firearm silencer or firearm muffler, in such manner as the Attorney General shall by regulations prescribe, each firearm silencer or firearm muffler imported or manufactured by such importer or manufacturer, except that, if a firearm silencer or firearm muffler does not have a clearly identifiable keystone part or has multiple keystone parts, licensed importers or licensed manufacturers shall submit a request for a marking variance to the Attorney General. The Attorney General shall grant such a request except on showing good cause that marking the firearm silencer or firearm muffler as requested would not further the purposes of this chapter.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H4E38313E76FF49E1949BFC437D6C035A"><enum>7.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act, or the amendments made by this Act, shall be construed to place any firearms formerly regulated under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/53">chapter 53</external-xref> of the Internal Revenue Code of 1986 (the National Firearms Act) under the jurisdiction of the United States Consumer Product Safety Commission.</text></section></legis-body></bill>
