R. 3225</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20250507">May 7, 2025</action-date><action-desc><sponsor name-id="S000522">Mr. Smith of New Jersey</sponsor> (for himself, <cosponsor name-id="K000375">Mr. Keating</cosponsor>, and <cosponsor name-id="W000795">Mr. Wilson of South Carolina</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committees on <committee-name committee-id="HBA00">Financial Services</committee-name>, and <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reauthorize and modify the Belarus Democracy Act of 2004.</official-title></form><legis-body id="HF2FF2882028148BE8BB1E4E1A2ACAD1F"><section id="H0E8A89B025AB4BFF883000ED0A9DB6CB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Belarus Democracy, Human Rights, and Sovereignty Act of 2025</short-title></quote>.</text></section><section id="H1B4FEF378A3B47008A7C1496D28B2022"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Section 2 of the Belarus Democracy Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/347">Public Law 108–347</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/5811">22 U.S.C. 5811</external-xref> note) is amended to read as follows:</text><quoted-block id="H7EB5E63770BC46ECA73CA514DECB58BC" style="OLC"><section id="H11EE2092BE934FADA42EFA5551B6F150"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H97AD55D2B664464DA6243C0A2F0116D0"><enum>(1)</enum><text>The International Covenant on Civil and Political Rights, done in New York December 19, 1966, was ratified by Belarus in 1973, guaranteeing Belarusians the freedom of expression and the freedom of association.</text></paragraph><paragraph id="HD7FD47FE49FE401CB17CF55F1F55AC83"><enum>(2)</enum><text>Alyaksandr Lukashenka has ruled Belarus as an undemocratic dictatorship since the first presidential election in Belarus in 1994, and subsequent presidential elections have been neither free nor fair, failing to meet minimal international electoral standards.</text></paragraph><paragraph id="HB5E3206A54614CC09D29CDEB6EE71165"><enum>(3)</enum><text>In response to the repression and violence during the 2006 presidential election, Congress passed the Belarus Democracy Reauthorization Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/480">Public Law 109–480</external-xref>).</text></paragraph><paragraph id="H34A151E2B37E425A8C628B4A2BF90939"><enum>(4)</enum><text>In 2006, President George W. Bush issued Executive Order 13405, titled <quote>Blocking Property of Certain Persons Undermining Democratic Processes or Institutions in Belarus</quote>, which authorized the imposition of sanctions against persons responsible for—</text><subparagraph id="H6A8196AA98314CF5A89AD0362D84A712"><enum>(A)</enum><text>undermining democratic processes in Belarus; or</text></subparagraph><subparagraph id="H85046FBA97674D7A92FDB56EDAA33CB2"><enum>(B)</enum><text>participating in human rights abuses related to political repression in Belarus.</text></subparagraph></paragraph><paragraph id="H485FED3905BD473DA4EEF69A4BE6CE4D"><enum>(5)</enum><text>In March 2011, the Senate unanimously passed Senate Resolution 105, which—</text><subparagraph id="H6287D0D052434B06AFC86ADC030F90DC"><enum>(A)</enum><text>condemned the December 2010 election in Belarus as <quote>illegitimate, fraudulent, and not representative of the will or the aspirations of the voters in Belarus</quote>; and</text></subparagraph><subparagraph id="HCBD85A2D256E4C61BA164C885A9B4F6A"><enum>(B)</enum><text>called on the Lukashenka regime <quote>to immediately and unconditionally release all political prisoners in Belarus who were arrested in association with the December 19, 2010, election</quote>.</text></subparagraph></paragraph><paragraph id="H672BCC9A02E346F2B3967D8642065120"><enum>(6)</enum><text>The Government of Belarus continues to engage in a pattern of clear and persistent gross violations of internationally recognized human rights, and basic principles of democratic governance.</text></paragraph><paragraph id="HF8CCEE29C1C145A6A981805B72F07C0D"><enum>(7)</enum><text>The Government of Belarus continues to subject thousands of pro-democracy political activists and peaceful protesters to harassment, beatings, and imprisonment, particularly as a result of their attempts to peacefully exercise their right to freedom of assembly and association.</text></paragraph><paragraph id="H276AD8227AE0461386A1B22C1277944D"><enum>(8)</enum><text>The Government of Belarus continues to suppress independent media and journalists and to restrict access to the internet, including social media and other digital communication platforms, in violation of the right to freedom of speech and expression of those dissenting from the dictatorship of Alyaksandr Lukashenka.</text></paragraph><paragraph id="H124B6A6EE1B1435385C9BD6985BE34C4"><enum>(9)</enum><text>The Government of Belarus continues a systematic campaign of harassment, repression, and closure of nongovernmental organizations, including independent trade unions and entrepreneurs, creating a climate of fear that inhibits the development of civil society and social solidarity.</text></paragraph><paragraph id="H7899EE5D377C4714B4BD24F6F479E9A3"><enum>(10)</enum><text>The Government of Belarus has pursued a policy undermining the country’s sovereignty and independence by making Belarus’ political, economic, cultural, and societal interests subservient to those of Russia.</text></paragraph><paragraph id="HF60E813E8F09417A9DE1B08DFC67F69F"><enum>(11)</enum><text>The Government of Belarus continues to reduce the independence of Belarus through integration into a so-called <quote>Union State</quote> that is under the control of Russia.</text></paragraph><paragraph id="HE229B88FF9CD44A3851CC7BB603379E0"><enum>(12)</enum><text>In advance of the August 2020 presidential elections in Belarus, authorities acting on behalf of President Lukashenka arrested journalists, bloggers, political activists, and the leading political opposition candidates, leading to demonstrations in support of democracy.</text></paragraph><paragraph id="H4FE0465B38FF43638482AFC4A0F586CC"><enum>(13)</enum><text>On August 9, 2020, the Government of Belarus conducted a presidential election that was held under undemocratic conditions, did not meet international standards, involved government malfeasance and serious irregularities with ballot counting and the reporting of election results, and included restrictive measures that impeded the work of local independent observers and did not provide sufficient notice to the Organization for Security and Cooperation in Europe (OSCE) to allow for the OSCE to monitor the elections, as is customary.</text></paragraph><paragraph id="H12E12C3B81B94363B3B97B377E830D3C"><enum>(14)</enum><text>Illegitimate president Alyaksandr Lukashenka declared a landslide victory in the election and claimed to have received more than 80 percent of the votes cast in the election.</text></paragraph><paragraph id="H49B855704A5B4EB8882EE99B8405DA2E"><enum>(15)</enum><text>The leading opposition candidate, Sviatlana Tsikhanouskaya, formally disputed the reported results and was detained by government authorities before being forced into exile in Lithuania.</text></paragraph><paragraph id="H5FF12A7B8BA444D087D74FBC52A27522"><enum>(16)</enum><text>Later in August, 2020, the United States Deputy Secretary of State, Stephen Biegun, and European Union High Representative for Foreign and Security Policy, Josep Borrell, issued statements declaring the Belarus elections to be fraudulent and neither free nor fair.</text></paragraph><paragraph id="H8543BDCEDC774871BF73E8659FFF21A6"><enum>(17)</enum><text>Following the illegitimate election results, tens of thousands of Belarusian protestors took to the streets, led predominately by women, resulting in the largest protest rallies in Belarus’ modern history, with over 1,400 reported as injured by Belarusian police in August and September 2020, over 37,000 detained by May 2021, and several killed for protesting the fraudulent election.</text></paragraph><paragraph id="H1E5ECC3596004618AD3BA07BCB62D8B1"><enum>(18)</enum><text>The Government of Belarus has consistently restricted the free flow of information to silence the opposition and to conceal the regime’s violent crackdown on peaceful protestors, including through the suppression of independent media and journalists, and disruption of free internet access.</text></paragraph><paragraph id="H836E7660936C4975BB16CC0E3F90A96E"><enum>(19)</enum><text>After the employees of state media outlets walked off the job in protest rather than help report misleading government propaganda, Lukashenka confirmed that he <quote>asked the Russians</quote> to send teams of Russian journalists to replace local employees.</text></paragraph><paragraph id="H459B3296918544D5B649FD152876B503"><enum>(20)</enum><text>Following Alyaksandr Lukashenka’s September 23, 2020, inauguration, the United States, the European Union, numerous European states, the United Kingdom, and Canada announced that they cannot consider Mr. Lukashenka as the legitimately elected leader of Belarus.</text></paragraph><paragraph id="HA94BDF58C09944338CC02F074D7CE5C9"><enum>(21)</enum><text>As a result of the Lukashenka regime’s violence against the Belarusian people and deprivation of their fundamental rights, the United States Congress passed and the President signed into law the Belarus Democracy, Human Rights, and Sovereignty Act of 2020 to demand the rights of the Belarusian people be respected and to hold accountable those who undermine them.</text></paragraph><paragraph id="H1CC47D80707746E1AEEE199641BA893A"><enum>(22)</enum><text>As a result of the Lukashenka regime’s violence against its own people, in December 2020, Members of Congress and transatlantic parliamentarians wrote a letter to the International Ice Hockey Federation President demanding the championship be relocated from Belarus.</text></paragraph><paragraph id="H5D893F51A63E4A45BE854CDF84986F78"><enum>(23)</enum><text>In response to the Government of Belarus’ repressive actions following the 2020 election, the United States, along with the European Union, imposed various sanctions packages on individuals and entities involved with the suppression of democracy in Belarus, including—</text><subparagraph id="H17FCE7119A4943CF887BA58EAB66B191"><enum>(A)</enum><text>the Central Election Commission of the Republic of Belarus and officials determined to be responsible for undermining democracy in Belarus;</text></subparagraph><subparagraph id="H613EC1185DF64E7D805D1B7DDCCDDDB9"><enum>(B)</enum><text>entities and persons determined to be involved in the violent suppression of protestors, such as the Minsk Special Purpose Police Unit, the Main Internal Affairs Directorate of the Minsk City Executive Committee, and KGB Alpha; and</text></subparagraph><subparagraph id="HCBF146D846C746E49E5F7F7F2389B0D7"><enum>(C)</enum><text>state-owned enterprises that provide revenue to support Lukashenka’s authoritarian regime.</text></subparagraph></paragraph><paragraph id="H31AD11B024124882B3D3A595FF30D8DA"><enum>(24)</enum><text>In April 2021, the House of Representatives passed House Resolution 124 reaffirming that the August 2020 elections were neither free nor fair and that the House of Representatives does not recognize Alyaksandr Lukashenka as Belarus’ legitimate president.</text></paragraph><paragraph id="HC718D5A7FB0844A79AFE397FC0064137"><enum>(25)</enum><text>On May 23, 2021, the Government of Belarus forced Ryanair Flight 4978 to land in Belarus as it neared the border of Lithuania after calling in a false bomb report and subsequently arrested independent Belarusian opposition blogger and political activist Raman Pratasevich and his girlfriend, threatening the safety of every passenger aboard the civilian flight, and ultimately detaining Pratasevich as a political prisoner.</text></paragraph><paragraph id="H3CE96EDC39C74356B79A6AC16BBDC208"><enum>(26)</enum><text>In May 2021, the European Union pledged a comprehensive plan of economic support worth up to 3 billion euros to assist in the development of a future, democratic Belarus following a democratic transition.</text></paragraph><paragraph id="id432D31989B5B4077876971FD795569B6"><enum>(27)</enum><text>As of May 2025, the Government of Belarus, led illegally by Alyaksandr Lukashenka, unlawfully holds nearly 1,300 people as political prisoners, including dozens of journalists, peaceful protestors, business leaders, and democracy activists, including Siarhei Tsikhanouski, a former opposition leader who is held incommunicado, Ilhar Losik and Ihar Karney, journalists with Radio Free Europe/ Radio Liberty, Andrzej Poczubut, a Polish-Belarusian journalist, and Artsiom Liabedzka, the son of exiled former opposition leader Anatol Liabedzka.</text></paragraph><paragraph id="HFD9023EA8CC540EB9BA32C31F644D726"><enum>(28)</enum><text>Since August 2020, the the Government of Belarus, led illegally by Alyaksandr Lukashenka, has targeted religious communities who raised their voices against the undemocratic rule and violent repression committed by the authorities, and has unlawfully detained nearly 90 members of the clergy, including 39 Catholic priests and religious, 30 Protestant ministers, and 20 Orthodox priests and religious, including 5 priests who are currently remain behind bars and are recognized as political prisoners.</text></paragraph><paragraph id="HB1105B37E6124C0B949B33F20CFD4D5A"><enum>(29)</enum><text>The now-suspended Belarusian branch of the Red Cross has publicly confirmed its involvement in transferring children from Ukraine to the territory of Belarus, and the illegitimate leader of the Government of Belarus, Alyaksandr Lukashenka, has publicly confirmed that he permitted these transfers.</text></paragraph><paragraph id="H467D86F5E7494BD0B5371B3178FC4FE0"><enum>(30)</enum><text>In Spring 2023, the Government of Belarus announced plans for the deployment of nuclear weapons from the Russian Federation to the territory of Belarus, which reportedly began in the summer of this same year.</text></paragraph><paragraph id="H8F5FFD85892C4224A50AFF7E3D67A063"><enum>(31)</enum><text>The Government of Belarus has harbored the Wagner Group, a private military company the United States has designated as a Transnational Criminal Organization, and provided facilities, resources, and a staging ground for the group’s criminal operations.</text></paragraph><paragraph id="HA05624828B0C471C8260262A4736092B"><enum>(32)</enum><text>The Government of Belarus has reportedly provided the Government of the Russian Federation with tens of thousands of tons of ammunition throughout Russia’s unprovoked war of aggression in Ukraine.</text></paragraph><paragraph id="H6DD827F16F35475FAC4D5BF731871631"><enum>(33)</enum><text>As a result of the Government of Belarus’ support to the Russian Federation during its unprovoked war of aggression against Ukraine, the United States, the European Union, and the United Kingdom have repeatedly issued further sanctions packages against the Lukashenka regime to target Belarusian military officers as well as individuals in the military sector, restrictions on entities in Belarus’ defense and industrial sectors, and entities that provide support to Belarus’ military and industrial sectors.</text></paragraph><paragraph id="H865517DEE7E2479B969E711D944C890A"><enum>(34)</enum><text>The Government of Belarus is reportedly engaging in the purchase of significant amounts of military equipment from the sanctioned Islamic Republic of Iran.</text></paragraph><paragraph id="H3FA765722D27439697A9F24B5AED2168"><enum>(35)</enum><text>On August 6, 2023, the Belarusian democratic opposition issued a declaration expressing their objective of developing democracy in Belarus and pursuing membership in the European Union and, by extension, joining the Trans-Atlantic community.</text></paragraph><paragraph id="H70176D5EA6EA41CB84F6A020B4CCC6C0"><enum>(36)</enum><text>The democratic opposition of Belarus have called on the Government of Belarus, led illegally by Alyaksandr Lukashenka, to end its complicity and involvement in the war in Ukraine, and urged against the conscription of men into the Belarusian military.</text></paragraph><paragraph id="H743AFA8D1928446598B1A02F37B1967D"><enum>(37)</enum><text>On February 28, 2022, the Department of State ordered the departure of United States Government employees and the suspension of operations of the United States Embassy in Minsk.</text></paragraph><paragraph id="HD4EBDA8253C348BA9147C069E032AC2B"><enum>(38)</enum><text>On August 21, 2023, the United States Government directed all United States citizens to leave Belarus immediately due to the illegitimate Belarusian authorities’ continued cooperation with the Russian military and facilitation of Russia’s unprovoked war of aggression against Ukraine, and the risk of detention and arbitrary enforcement of local laws against United States citizens.</text></paragraph><paragraph id="H4318AAF2E2254E50A8D573000CF63504"><enum>(39)</enum><text>In September 2023, the Government of Belarus deprived Belarusians living abroad of their ability to renew their passports through Belarusian embassies in an attempt to make life difficult for and to force exiles, critics, and expats to return to Belarus for document renewal and possibly face persecution.</text></paragraph><paragraph id="HB8238E131CFC4ECAA864ACAE9577A381"><enum>(40)</enum><text>In December 2023, the United States Government held a Strategic Dialogue with the Belarusian democratic opposition and civil society and subsequently announced a continuation of efforts to hold Alyaksandr Lukashenka and his regime accountable for their crimes, a commitment to supporting Belarusian culture, sovereignty, and national identity, as well as the need for future working groups with the democratic opposition.</text></paragraph><paragraph id="H26197F5512C5493E991EEE6ED8E42ADC"><enum>(41)</enum><text>On February 25, 2024, the Government of Belarus administered fraudulent parliamentary elections in an environment marked by censorship, persecution of political opposition, illegal manipulation of the vote, and the lack of any international observers from credible organizations.</text></paragraph><paragraph id="H7FB7C1BAAD38488B96E0B3A0601854BF"><enum>(42)</enum><text>In December 2024 Lukashenka announced that Belarus is hosting dozens of Russian nuclear weapons and will prepare facilities for hosting Russian hypersonic missiles.</text></paragraph><paragraph id="H60765A07CA2E4513AD06756A4C817BDD"><enum>(43)</enum><text>On January 26, 2025, the Government of Belarus administered fraudulent presidential elections in an environment marked by censorship, persecution of political opposition, illegal manipulation of the vote, the lack of any international observers from credible organizations, and declared victory for Lukashenka.</text></paragraph><paragraph id="HFDA9B55265034CD1827CBF3CB73009D6"><enum>(44)</enum><text>The Russian Federation has facilitated and the Belarusian government is complicit in the illegal abduction and transfer of more than 2,400 Ukrainian children from Russian-occupied regions of Ukraine to facilities in Belarus where they undergo political and cultural reeducation and military training.</text></paragraph><paragraph id="H26C6EE5142FF48DCA690BECFAB80B518"><enum>(45)</enum><text>The United States has imposed sanctions on hundreds of Belarusian individuals and entities, including visa restrictions against Belarusan government officials for undermining democracy in Belarus and supporting Russia’s illegal war of aggression in Ukraine, and their complicity in the abduction of Ukrainian children from Russian-occupied territories of Ukraine.”</text></paragraph></section><after-quoted-block/></quoted-block></section><section id="H48F7DD977D824F84AAC661EB4FE54FBE"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">Section 3 of the Belarus Democracy Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/347">Public Law 108–347</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/5811">22 U.S.C. 5811</external-xref> note) is amended to read as follows:</text><quoted-block id="HD33FAAC6D1624CCFA0ABD90A64EE0254" style="OLC"><section id="HB8781FE9765644C8B626DCB956973D2D"><enum>3.</enum><header>Statement of policy</header><text display-inline="no-display-inline">It is the policy of the United States—</text><paragraph id="H9EE5CE664B504C5BB99E6FA39C1B9CC1"><enum>(1)</enum><text>to condemn—</text><subparagraph id="H63897D3067C04CBC949D51D6E431E589"><enum>(A)</enum><text>the conduct of the August 9, 2020, presidential election in Belarus, which was neither free nor fair;</text></subparagraph><subparagraph id="HB6DF9B88EFCD47C989A531B0C304CF33"><enum>(B)</enum><text>the Belarusian authorities’ unrelenting crackdown on, arbitrary arrests of, and violence against opposition candidates, democratic opposition, peaceful protestors, human rights activists, employees from state-owned enterprises participating in strikes, independent election observers, and independent journalists and bloggers; and</text></subparagraph><subparagraph id="HDB0A7C6DDEB14CBA8EFC5740911BB023"><enum>(C)</enum><text>the unjustified detention and forced or attempted deportation of members of the Coordination Council and United Transitional Cabinet in Belarus;</text></subparagraph></paragraph><paragraph id="H4E2A148893514D278C944F51271E39A7"><enum>(2)</enum><text>to condemn the illegitimate Belarusian authorities’ allowance of Russian nuclear weapons to be deployed to Belarusian territory, their continued political and material support for Russia’s unprovoked war of aggression in Ukraine, and their continued participation in abducting and deporting Ukrainian children from territory occupied by the Russian Federation to the territory of Belarus;</text></paragraph><paragraph id="H3E9D70484BCB4681B588BEBBFB225131"><enum>(3)</enum><text>to condemn the presence of Russian forces in Belarusian territory and demand the cessation of the use of Belarusian territory by Russian forces as a staging ground for Russia’s illegal, full-scale war of aggression against Ukraine or for the prevention of a peaceful democratic transition in Belarus;</text></paragraph><paragraph id="HD66644B2DFCB4F9CB10D13CE6AB82E15"><enum>(4)</enum><text>to demand accountability for the illegal Lukashenka regime’s complicity in the crime of aggression against Ukraine through international justice mechanisms;</text></paragraph><paragraph id="H812FEDC7331640CCB702AB8410D3C48C"><enum>(5)</enum><text>to condemn the weaponization of migrants wherein the Government of Belarus, led illegally by Alyaksandr Lukashenka, has sent thousands of migrants to the borders of Poland and Lithuania in an attempt to destabilize the border region;</text></paragraph><paragraph id="H66F32B8905D047E5BE7FF046F8973B7B"><enum>(6)</enum><text>to continue demanding the immediate release without preconditions of all political prisoners in Belarus and those arrested for peacefully protesting, including all those individuals detained in connection with the August 9, 2020, fraudulent presidential election;</text></paragraph><paragraph id="HB4EFC5D308AB48F3BB3EBFA1CED6F6B6"><enum>(7)</enum><text>to stand in solidarity with the people of Belarus, including human rights defenders, bloggers, and journalists, who are exercising their right to freedom of assembly, freedom of expression, and rule of law and to continue supporting the aspirations of the people of Belarus for democracy, human rights, and the rule of law;</text></paragraph><paragraph id="H35066C5A9E894792BDBF61270EC4D71C"><enum>(8)</enum><text>to continue actively supporting the aspirations of the people of the Republic of Belarus to preserve the independence and sovereignty of their country;</text></paragraph><paragraph id="H0E6B8AD37A3141309669905E4F0A9BC3"><enum>(9)</enum><text>to continue refusing to recognize Alyaksandr Lukashenka’s illegitimate regime and to continue supporting calls for Belarusian presidential and parliamentary elections to be conducted in a manner that is free and fair according to Organization for Security and Cooperation in Europe (OSCE) standards and under the supervision of OSCE observers and independent domestic observers, including in the 2025 presidential elections;</text></paragraph><paragraph id="HCD24BBB3C84D45DDBFF7E699ED9F9F18"><enum>(10)</enum><text>to continue calling for the Government of Belarus to fulfill its freely undertaken obligations as an OSCE participating state and as a signatory of the Charter of the United Nations;</text></paragraph><paragraph id="HF500668D7FC44B3782B4806769ECCFE9"><enum>(11)</enum><text>to recognize the Coordination Council and the United Transitional Cabinet as legitimate institutions to participate in a dialogue on a peaceful transition of power, and to support these institutions prior to and during such a transition should it take place;</text></paragraph><paragraph id="H185A8D160C8B4975B47BAFB2B5A43917"><enum>(12)</enum><text>to condemn the deprivation of consular services to Belarusian citizens living abroad, including representatives of the Belarusian democratic opposition, and urge the United States to raise this to the United Nations High Commissioner for Refugees, the International Organization for Migration, the Council of Europe, and the Organization for Security and Cooperation in Europe;</text></paragraph><paragraph id="HCCD89594204A4D5288FB6874B95EC68F"><enum>(13)</enum><text>to encourage the United States Government to continue working closely with the European Union, the United Kingdom, Canada, and other countries and international organizations to continue to impose targeted sanctions against officials in Belarus who are responsible for—</text><subparagraph id="H3FFD5BBD63AB4BF9992235249E730DBA"><enum>(A)</enum><text>undermining democratic processes in Belarus;</text></subparagraph><subparagraph id="HFE75139E46C94AA3ACFA3771ADAEA5C3"><enum>(B)</enum><text>participating in gross violations of internationally recognized human rights related to political repression in Belarus and undermining rule of law for the people of Belarus; or</text></subparagraph><subparagraph id="HE4024EADBC904440B2CAC567594F7D89"><enum>(C)</enum><text>enabling or facilitating Russia’s war in Ukraine;</text></subparagraph></paragraph><paragraph id="H4E3534A8C2234FE9AE2D1E7FDEBA0567"><enum>(14)</enum><text>to call on the Government of Belarus to uphold its human rights obligations, including those rights enumerated in the International Covenant on Civil and Political Rights;</text></paragraph><paragraph id="H322DE92D2ACB4151A59F223B897ED8E3"><enum>(15)</enum><text>to encourage the United States to expeditiously appoint a U.S. Special Envoy for Belarus to fill the role vacated in June 2022; and</text></paragraph><paragraph id="H7891B292767C4ED5853850F7D32834F0"><enum>(16)</enum><text>to support the use of the Strategic Dialogue between the United States Government as a means of furthering ties between the United States Government and the representatives of the democratic opposition of Belarus in pursuit of objectives, including—</text><subparagraph id="HF18408B3541246159A2FEE419225832A"><enum>(A)</enum><text>accountability for the Lukashenka regime’s gross violations of internationally recognized human rights and domestic repressions; and</text></subparagraph><subparagraph id="H6242393001FB48E48E961AE8EDC71D76"><enum>(B)</enum><text>increasing partnerships with the Belarusian people by supporting investments; and</text></subparagraph><continuation-text continuation-text-level="paragraph">support for the protection of Belarusian language, culture, and national identity.</continuation-text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H0C143617882C41EEA71DDF376AA08E33"><enum>4.</enum><header>Assistance to promote democracy, civil society, and sovereignty in belarus</header><text display-inline="no-display-inline">Section 4 of the Belarus Democracy Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/347">Public Law 108–347</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/5811">22 U.S.C. 5811</external-xref> note) is amended—</text><paragraph id="H0BE49E19D79D4869B5E6F3A90F16CB87"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HB9FD25FDA00F4BE7A3D2F4E170AB1EB9"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>, the United Transitional Cabinet, and the Coordination Council</quote> after <quote>the Republic of Belarus</quote>; and</text></subparagraph><subparagraph (b), by adding at the end before the period the following <quote>, including political party strengthening</quote>;</text></paragraph><paragraph id="H7B63A004F77A42EEBEFFB50A4CEC3E41"><enum>(2)</enum><text>facilitating the development of independent broadcast, print, and internet media working within Belarus and from locations outside the country and supported by nonstate-controlled printing facilities;</text></paragraph><paragraph id="HF7DC6EB1D89F4591824C8767E7D5694F"><enum>(3)</enum><text>countering internet censorship and repressive surveillance technology that seek to limit free association, control access to information, and prevent citizens from exercising their rights to free speech;</text></paragraph><paragraph id="HC5C9E0FDE5DF4EBE8FDD4975F6FDEE6A"><enum>(4)</enum><text>raising awareness both within Belarus and globally about Lukashenka’s complicity in Russia’s unprovoked war of aggression in Ukraine, including how the Lukashenka regime is providing support to the Russian military and committing crimes against Ukrainian children;</text></paragraph><paragraph id="HCBE6C17C8E53422C9F5FFC9210281A2E"><enum>(5)</enum><text>aiding the development of civil society through assistance to nongovernmental organizations promoting democracy and supporting human rights, including youth groups, entrepreneurs, and independent trade unions;</text></paragraph><paragraph id="H7513690998CE47A8B82A8636C35A0586"><enum>(6)</enum><text>supporting programming that contributes to the defense of Belarusian sovereignty and independence from encroachment by the Russian Federation;</text></paragraph><paragraph id="HAF7CB5198C49447998E0A9CDCD024791"><enum>(7)</enum><text>supporting the work of human rights defenders;</text></paragraph><paragraph id="H1003DD263003454BAEFE4CFB08B30017"><enum>(8)</enum><text>enhancing the development of democratic political parties;</text></paragraph><paragraph id="H49D6B0B9E4F04A0594563D8CF603030E"><enum>(9)</enum><text>assisting the promotion of free, fair, and transparent electoral processes;</text></paragraph><paragraph id="H90A14B8A284045EF8B5CCC1E2281C104"><enum>(10)</enum><text>enhancing international exchanges and advanced professional training programs for leaders and members of the democratic opposition in skill areas central to the development of civil society;</text></paragraph><paragraph id="HACA17222790A4E7CBF48DB2CB3096F7F"><enum>(11)</enum><text>supporting the work of women advocating for freedom, human rights, and human progress in Belarus given the significant and vital role women have played in the Belarus democracy movement;</text></paragraph><paragraph id="H1D6BA77D5583431CB90467081B4DFD7E"><enum>(12)</enum><text>supporting the development of Belarusian language and cultural education and exchanges to preserve and protect Belarusian national identity;</text></paragraph><paragraph id="HFE327369303E40228AA69E36F0268D0C"><enum>(13)</enum><text>supporting further iterations of the Strategic Dialogue between the United States and the Belarusian democratic opposition and civil society as a platform to work on issues of mutual concern;</text></paragraph><paragraph id="HA052E9A87EB74AD48B8A9247194FB399"><enum>(14)</enum><text>enhancing the development of the private sector, particularly the information technology sector, and its role in the economy of Belarus, including by increasing the capacity of private sector actors, developing business support organizations, offering entrepreneurship training, and expanding access to finance for small and medium enterprises;</text></paragraph><paragraph id="HAF287B311AD84D1DB194125506462643"><enum>(15)</enum><text>supporting political refugees in neighboring European countries fleeing the crackdown in Belarus;</text></paragraph><paragraph id="H18B248597F3B4BAD8DEBCEFF96C2FDF6"><enum>(16)</enum><text>supporting the education of Belarusians in exile;</text></paragraph><paragraph id="H8971868F097C4762B36B1B8CF10A75D8"><enum>(17)</enum><text>supporting the gathering of evidence on and investigating of gross violations of internationally recognized human rights in Belarus; and</text></paragraph><paragraph id="H205D88206EEB4A1997B273DE32CF2376"><enum>(18)</enum><text>other activities consistent with the purposes of this Act.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H3EC9923D2B6743189D1E55AB6180352A"><enum>(4)</enum><text>in subsection (f)—</text><subparagraph id="H2CF0217FC99749C089404B1F339FF210"><enum>(A)</enum><text>by striking <quote>the Belarus Democracy, Human Rights, and Sovereignty Act of 2020</quote> and inserting legal-doc="usc" parsable-cite="usc/22/5811">22 U.S.C. 5811</external-xref> note) is amended—</text><paragraph id="H192B6E764D6443DFA1CDE1132C93B030"><enum>(1)</enum><text>in subsection or</text></paragraph><paragraph id="H256E3CF079624F9B9F97A6E746A7E2EA"><enum>(11)</enum><text>is a Russian individual that has significantly participated in the crackdown on independent press or human rights abuses related to political repression in Belarus, including the Russian propagandists sent to replace local employees at Belarusian state media outlets.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7E03546012D04885A3F928C5BFAFD0CA"><enum>(4)</enum><text>by amending subsection (f) to read as follows:</text><quoted-block id="HA355E4F56F6C49B0B2E6E684491C6D85" style="OLC"><subsection id="HA85F6B2D12E741C1B1156DE9645BDCDE"><enum>(f)</enum><header>Blocking of assets and other prohibited activities</header><paragraph id="H28ADBE0DC1A54EF1A1AA81417004840D"><enum>(1)</enum><header>Mandatory sanction</header><text>The President shall impose the sanction described in paragraph (3) with respect to each foreign person that the President determines—</text><subparagraph id="HBF74642CBB3041D78CDECE0DC4E5B8AF"><enum>(A)</enum><text>is a member of the Central Election Commission of Belarus or assisted the Commission in manipulating elections in Belarus including the presidential election of August 9, 2020;</text></subparagraph><subparagraph id="H854C1F933B3140C5B49120F0A714094E"><enum>(B)</enum><text>is a government official or member of the security or law enforcement services of Belarus and has participated in the persecution or harassment of religious groups, human rights defenders, democratic opposition groups, or independent media or journalists;</text></subparagraph><subparagraph id="H7FDFB228C0154C729617B90D4F90C8F5"><enum>(C)</enum><text>is an individual determined by the President to be knowingly interfering in the internal affairs of the Republic of Belarus on behalf of or at the direction of the Government of the Russian Federation;</text></subparagraph><subparagraph id="H33114666773F47318E6DC62E1E49BA83"><enum>(D)</enum><text>is an official who knowingly engages in the abduction and deportation of Ukrainian children from territories illegally occupied by the Russian Federation to the territory of Belarus;</text></subparagraph><subparagraph id="H1577DE3B06944209BC89B9072F4C2AF7"><enum>(E)</enum><text>is an official who knowingly supports and provides for, the Russian Federation’s use of the territory or Belarus to further its unprovoked invasion of Ukraine; or</text></subparagraph><subparagraph id="H34C5DF2D5CB44F348380405D5942C3D6"><enum>(F)</enum><text>is an official in the so-called <quote>Union State</quote> between Russia and Belarus (regardless of nationality of the individual) or works toward the furtherance of such <quote>Union State</quote>.</text></subparagraph></paragraph><paragraph id="H818C962A932B46F6BDC9306A4B430A8B"><enum>(2)</enum><header>Discretionary sanction</header><text>The President may impose the sanction described in paragraph (3) with respect to each foreign person that the President determines—</text><subparagraph id="H294925B84D9D477A9B02C9B565B85E37"><enum>(A)</enum><text>holds a position in the senior leadership of the Government of Belarus;</text></subparagraph><subparagraph id="H2FC5ACF92D0A422D91AF1938E6186E41"><enum>(B)</enum><text>is an immediate family member of a person described in subparagraph (A); or</text></subparagraph><subparagraph id="HB416B765D32A41E99BF311097AD0D7C0"><enum>(C)</enum><text>through his or her business dealings with a person described in subparagraph (A) derives significant financial benefit from policies or actions, including electoral fraud, gross violations of internationally recognized human rights, or corruption, that undermine or injure democratic institutions or impede the transition to democracy in Belarus.</text></subparagraph></paragraph><paragraph id="H08BE12CDD5F749CC868D64AAEC8F2992"><enum>(3)</enum><header>Sanction described</header><text>The President shall exercise all of the powers granted to the President under the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in property and interests in property of the foreign person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph><paragraph id="HF2DC39C968A84AF0914CF6DDA9A01E76"><enum>(4)</enum><header>Exceptions</header><subparagraph id="H13042D51D74F433283C5E805027CF848"><enum>(A)</enum><header>Exception relating to the provision of humanitarian assistance</header><text>The sanction described in paragraph (3) may not be imposed with respect to transactions or the facilitation of transactions for—</text><clause id="H529C20EB3B7E4BAB977AC7443D321177"><enum>(i)</enum><text>the sale of agricultural commodities, food, medicine, or medical devices;</text></clause><clause id="H3187ACF0CB2A48F9A6E856869FF0C194"><enum>(ii)</enum><text>the provision of humanitarian assistance;</text></clause><clause id="HD02273E9D8BB4077A3B51B7F279B5E74"><enum>(iii)</enum><text>financial transactions relating to humanitarian assistance; or</text></clause><clause id="HBF1B1FB767014449AF4E9EF4537F5D80"><enum>(iv)</enum><text>transporting goods or services that are necessary to carry out operations relating to humanitarian assistance.</text></clause></subparagraph><subparagraph id="H3F2331DC8E9E4A57B8976CD07382872D"><enum>(B)</enum><header>Exception for intelligence, law enforcement, and national security activities</header><text>The sanction described in paragraph (3) shall not apply to any authorized intelligence, law enforcement, or national security activities of the United States.</text></subparagraph></paragraph><paragraph id="HC5D81E553AA045DFA9ADD1769977E026"><enum>(5)</enum><header>Waiver</header><text>The President may, on a case-by-case basis and for periods not to exceed 180 days each, waive the application of the sanction described in paragraph (3) imposed with respect to a foreign person under this subsection if the President certifies to the appropriate congressional committees not later than 15 days before such waiver is to take effect that the waiver is important to the national security interests of the United States.</text></paragraph><paragraph id="HB1E5EA347F1046AAA7A84FA83127E78A"><enum>(6)</enum><header>Penalties</header><text>Any person who violates, attempts to violate, or causes a violation of this subsection or any regulation, license, or order issued to carry out this subsection shall be subject to the penalties under section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act under that Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>).</text></paragraph><paragraph id="H366D6B286A874D82AF47015FA0CC7AD4"><enum>(7)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="H370870070A274566831C3AA7FA755E0B"><enum>(A)</enum><text>the term <quote>air carrier</quote> has the meaning given that term in section 40102 of title 49, United States Code;</text></subparagraph><subparagraph id="HF4E009F3964F49509127B85A0B225E9B"><enum>(B)</enum><text>the term <quote>foreign person</quote> means a person that is not a United States person; and</text></subparagraph><subparagraph id="HB33DEC0CC22E4E7DA5BA81D6E53BC0EB"><enum>(C)</enum><text>the term <quote>United States person</quote> means—</text><clause id="HBB77C41A050546E39A819ED674121AEC"><enum>(i)</enum><text>any United States citizen or alien admitted for permanent residence to the United States;</text></clause><clause id="H718166E50CFF466686685CFD1CE7950F"><enum>(ii)</enum><text>any entity organized under the laws of the United States; and</text></clause><clause id="HC43D331EE7484B7F838C72E8A44F8A81"><enum>(iii)</enum><text>any person in the United States.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H351D287223DD4AA5AE5F85F664B0FCA0"><enum>7.</enum><header>Multilateral cooperation</header><text display-inline="no-display-inline">Section 7 of the Belarus Democracy Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/109/480">Public Law 109–480</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/5811">22 U.S.C. 5811</external-xref> note) is amended—</text><paragraph id="H127E1923C9214D52B4F72256BBD8C1E6"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H61CE890A0EBB46E1A1E16DEE636A8CB3"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H51568689757140439F47548029AC51C0"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="HBDF8E2E4CD5A445188E374FEA6860D7C" style="OLC"><paragraph id="H11B802D97EB74E96A76451D9AE938AD0"><enum>(3)</enum><text>to halt the Government of Belarus, led illegally by Alyaksandr Lukashenka, from supporting and assisting the Russian Federation’s unprovoked war of aggression against Ukraine including the abduction and deportation of Ukrainian children.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H3FF3E6070F414D729CEC8314ED3B8BC1"><enum>8.</enum><header>Reports</header><text display-inline="no-display-inline">Section 8 of the Belarus Democracy Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/109/480">Public Law 109–480</external-xref>; and</text></subparagraph><subparagraph id="HAAC37EDAD31742809228C7D79FFEED8F"><enum>(C)</enum><text>by redesignating paragraph (3) as paragraph (2); and</text></subparagraph></paragraph><paragraph id="HFF20605DD28B46F2B708B900F23B313D"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block id="H81963A4C080643AC9D68C73E0325156A" style="OLC"><subsection id="H5CA536FDE63E404683BD5A878356E5DC"><enum>(b)</enum><header>Report on crimes and other actions committed by belarus in support of russia’s unprovoked war of aggression in ukraine</header><paragraph id="H3E4435BE09F84F4C9F012CA010FBDFA8"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of the Belarus Democracy, Human Rights, and Sovereignty Act of 2025, the Director of National Intelligence, in consultation with the Secretary of the Treasury and the Secretary of State, shall submit to the appropriate congressional committees a report on the following:</text><subparagraph id="H940B50D60BFD4F38B42651EC75805EC3"><enum>(A)</enum><text>An assessment of the Russian military presence in Belarus, including the presence of Russian nuclear forces, and the impact this presence has on North Atlantic Treaty Organization (NATO) security.</text></subparagraph><subparagraph id="H26B7ACE6DD064C0F95114506BAFAB6F7"><enum>(B)</enum><text>The degree to which the Government of Belarus, led illegally by Alyaksandr Lukashenka, continues to provide support to and harbor the forces of the Wagner Group or other Russian paramilitary groups and enables their destabilizing actions on the borders of NATO allies, such as Latvia, Lithuania, and Poland.</text></subparagraph><subparagraph id="HDEADC1D2817E42599FDC5DD850ADCED4"><enum>(C)</enum><text>Which actors in the Government of Belarus, led illegally by Alyaksandr Lukashenka, are most responsible for the illegal abduction and deportation of Ukrainian children from Ukrainian territory occupied by the Russian Federation to the territory of Belarus, as well as to what extent organizations such as the now-suspended Belarus branch of the Red Cross are involved in these transfers, and provide a strategy for holding those involved in these crimes accountable including through the use of sanctions.</text></subparagraph><subparagraph id="HCE7927A5EFF1458985EA253D36647A1F"><enum>(D)</enum><text>The degree to which the Government of Belarus, led illegally by Alyaksandr Lukashenka, has purchased weapons from the governments of the Russian Federation and the Islamic Republic of Iran, and whether any purchases of such weapons violate the provisions of section 107 or 231 of the Countering America’s Adversaries Through Sanctions Act (22 U.S.C. 9406 or 9525).</text></subparagraph><subparagraph id="HBD2476CECF124942A00B1E4B2E05778E"><enum>(E)</enum><text>The extent to which the Government of Belarus, led illegally by Alyaksandr Lukashenka, is aiding the Russian Federation in circumventing export controls and evading sanctions, including with an accounting and estimated value of dual-use goods and an identification of the officials or other persons involved in facilitating this sanctions evasion.</text></subparagraph><subparagraph id="H2730EEC1A9B148709A1633F1B84BC7E8"><enum>(F)</enum><text>The impact of the Government of Belarus’ use of illegal migrants to destabilize the borders of NATO countries, such as Latvia, Lithuania, and Poland, on NATO security.</text></subparagraph></paragraph><paragraph id="H24227FB4FEE84E47B20570A2ADE61BCB"><enum>(2)</enum><header>Form</header><text>The report required under this subsection shall be transmitted in unclassified form, but may contain a classified annex.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HC9AD21F8A62D400581C4AEF5DBE04B3E"><enum>9.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 9 of the Belarus Democracy Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/109/480">Public Law 109–480</external-xref>;
