<section id="H672619EE2DCB44EBB0781C09ACA8EFF9" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Critical Minerals and Manufacturing Support Act</short-title></quote>.</text></section> 
<section id="H99BE6D9A20484DFC846E4A77323CC931"><enum>2.</enum><header>Modification of advanced manufacturing production credit relating to battery production</header> 
<subsection id="H706F6A4D60504CBE9B38AE789563AE25"><enum>(a)</enum><header>Increase in credit amount for electrode active materials</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/45X">Section 45X(b)(1)(J)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>10 percent</quote> and inserting <quote>25 percent</quote>.</text></subsection> <subsection id="HBA87719E273144159A04E273E15B6D0B"><enum>(b)</enum><header>Special rules relating to production of electrode active materials</header><text>Section 45X(b) of such Code is amended by adding at the end the following new paragraph:</text>

<paragraph id="H0FD9E09416664C8DA1E0B3D3FB49EAD8"><enum>(5)</enum><header>Special rules relating to electrode active materials</header> 
<subparagraph id="HB3263FF5DA4A47AFB74E5E3303E90D8D"><enum>(A)</enum><header>Production costs</header><text>The production of electrode active materials shall include the cost of raw materials, including material extraction from geological sources or waste products.</text></subparagraph> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H23FC88A918DC4A6CA5CC173874AB7CF3"><enum>(c)</enum><header>Sourcing requirements with respect to qualifying battery components and applicable critical minerals</header><text>Section 45X of such Code is amended by adding at the end the following new subsection:</text>

<subsection id="HDAC45C3BBA6C4C10B4384F6FF426EDE1"><enum>(e)</enum><header>Critical mineral and battery component sourcing requirements</header> 
<paragraph id="H4582298E290B449FB739002715C694A5"><enum>(1)</enum><header>Applicable critical minerals</header> 
<subparagraph id="H62D3A4E47096404384EFA02388A1EBF3"><enum>(A)</enum><header>In general</header><text>No credit shall be allowed under this section with respect to a qualifying battery component unless the percentage of the value of the applicable critical minerals contained therein that were—</text> <clause id="H9F3EEC6B2D824D429AC61ADFD19319CE"><enum>(i)</enum><text>extracted or processed—</text> 
<subclause id="H3F9AFC46632F41728DE8241BD8FCC19B"><enum>(I)</enum><text>in the United States, or</text></subclause> <subclause id="H9D3B9A0C3FA9438F93EFD1F7303F77D6"><enum>(II)</enum><text>in any country with which the United States has a free trade agreement in effect, or</text></subclause></clause> 
<clause id="H2326FACC62BA42C2ADB8AD7317FA35CB"><enum>(ii)</enum><text>recycled, and reintegrated into the supply chain, in North America,</text></clause><continuation-text continuation-text-level="subparagraph">is at least equal to the applicable percentage (as certified by the taxpayer in such form or manner as prescribed by the Secretary).</continuation-text></subparagraph> <subparagraph id="HB72D2C00A1CB458FB37586901C22DF4F"><enum>(B)</enum><header>Applicable percentage</header><text>For purposes of subparagraph (A), the applicable percentage shall be—</text> 
<clause id="HE491CA621F574BC09D9BC5C81F6814E7"><enum>(i)</enum><text>in the case of any qualifying battery component sold to an unrelated person during calendar year 2026, 70 percent, and</text></clause> <clause id="H93FC3A79009A47FAAA2258EA8F91AA9E"><enum>(ii)</enum><text>in the case of any qualifying battery component sold to an unrelated person after December 31, 2026, 80 percent.</text></clause></subparagraph></paragraph> 
<paragraph id="H74DC01B0A7DD4CD9B9D28124D3182CFB"><enum>(2)</enum><header>Qualifying battery components</header> 
<subparagraph id="H0F7E376B5C6B464CB7E0A92ED335FCB4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">No credit shall be allowed under this section with respect to a qualifying battery component unless the percentage of the value of the constituent elements, materials, and subcomponents contained therein that were produced, manufactured, or assembled in North America is at least equal to the applicable percentage (as certified by the taxpayer, in such form or manner as prescribed by the Secretary).</text></subparagraph> <subparagraph id="HAC48B546868449B2BB5EACB78E9F1790"><enum>(B)</enum><header>Applicable percentage</header><text>For purposes of subparagraph (A), the applicable percentage shall be—</text> 
<clause id="H531F33CFE6E0436781CB9561CE84E8FE"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of qualifying battery components sold to an unrelated person during calendar year 2026, 70 percent,</text></clause> <clause id="HFF59D7ADBBA747DAB21F77B7A7EE364B"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of qualifying battery components sold to an unrelated person during calendar year 2027, 80 percent,</text></clause> 
<clause id="H896E099CC8D84A9BB2CDBB4D200A9CED"><enum>(iii)</enum><text display-inline="yes-display-inline">in the case of qualifying battery components sold to an unrelated person during calendar year 2028, 90 percent, and</text></clause> <clause id="H40267F46EC1749CF8E943742A5EC89BB"><enum>(iv)</enum><text display-inline="yes-display-inline">in the case of qualifying battery components sold to an unrelated person after December 31, 2028, 100 percent.</text></clause></subparagraph></paragraph> 
<paragraph id="HABA50E327E0347918D2C50958480E6AD"><enum>(3)</enum><header>Regulations</header><text>The Secretary shall, to the extent practicable, prescribe regulations similar to regulations prescribed under section 30D(e) to carry out the purposes of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HD43719D6F50A4311B7FF135ED391FFB3"><enum>(d)</enum><header>Excluded entities</header><text>Section 45X(c)(1) of such Code is amended by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="HFC1418192D6A4953ACCB05760D133039" display-inline="no-display-inline"> 
<subparagraph id="H43681F67DC9D4DEE9E0373AAD6D7CB23"><enum>(C)</enum><header>Excluded entities</header><text display-inline="yes-display-inline">The term <term>eligible component</term> shall not include any qualifying battery component with respect to which—</text> <clause id="H752D98A940764871AA5DF73CA0C0C28A"> <enum>(i)</enum> <text display-inline="yes-display-inline">any of the applicable critical minerals contained therein were extracted, processed, or recycled by a foreign entity of concern (as defined in section 40207(a)(5) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18741">42 U.S.C. 18741(a)(5)</external-xref>)), and</text>
            </clause> 
<clause id="H659E43BE5C13442EA25F4EBAB172E357"><enum>(ii)</enum><text display-inline="yes-display-inline">any of the constituent elements, materials, or subcomponents contained therein were produced, manufactured, or assembled by a foreign entity of concern (as so defined).</text></clause><continuation-text continuation-text-level="subparagraph">The term <term>foreign entity of concern</term> shall include any entity that is directly or indirectly owned by a foreign entity of concern described in subparagraph (C) of section 40207(a)(5) of such Act.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HA28D2AC17983461697D3740F228A72FB"><enum>(e)</enum><header>Modification of electrode active material definition</header> <paragraph id="H671ED2B061234DB492152844ED1F9CB4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 45X(c)(5)(B)(i) of such Code is amended—</text> 
<subparagraph id="H33A4693FDF464C6B954E2E424146394F"><enum>(A)</enum><text>by inserting <quote>electrode active precursor materials used in the production of cathode and anode materials,</quote> after <quote>anode materials,</quote>,</text></subparagraph> <subparagraph id="HB8A8EB8FDD034959976577D7CAEFDB34"><enum>(B)</enum><text>by inserting <quote>binders,</quote> after <quote>anode foils,</quote>, and</text></subparagraph> 
<subparagraph id="HB1DAD9CD5C7E4FA5869CD52E6813D671"><enum>(C)</enum><text>by inserting <quote>solid state electrolytes,</quote> after <quote>including</quote>.</text></subparagraph></paragraph> <paragraph id="H3799538135D54DF9847E4903EB3480A8"><enum>(2)</enum><header>Electrode active precursor materials</header><text display-inline="yes-display-inline">Section 45X(c)(5)(B)(i) of such Code is amended—</text> 
<subparagraph id="H733D5F16307D43A6BA22CFC761E4750F"><enum>(A)</enum><text>by striking <quote><header-in-text level="subparagraph" style="OLC">material</header-in-text>.—The term</quote> and inserting the following: </text> <quoted-block style="OLC" id="H9CFB8603C1EA4764B63A0E3BE08CDB28" display-inline="yes-display-inline"><text display-inline="yes-display-inline"><header-in-text level="clause" style="OLC">material.—</header-in-text></text> 
<subclause id="H85731483FE9845218C0401D089C64B44"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The term</text></subclause><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HC07C9FDC2172467F842A828776F2E479"><enum>(B)</enum><text>by adding at the end the following new subclause:</text> 
<quoted-block style="OLC" id="H64C2F87EB8A448E69464C89D22908C6C" display-inline="no-display-inline"> 
<subclause id="HB0337E0F663E4507AB56A29BB9DC679F"><enum>(II)</enum><header>Electrode active precursor material</header><text display-inline="yes-display-inline">The term <term>electrode active precursor material</term> means any of the following materials which are of a sufficient grade to meet the purity specifications to supply the electrode active materials market: Cobalt sulfate, manganese sulfate, iron sulfate, lithium hydroxide, metallurgical silicon, phosphoric acid, iron phosphate, nickel manganese cobalt oxide, graphene, sulfur, synthetic or natural graphite pitch, or lithium carbonate.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> <subsection id="HD5ABDF0F5EE84078BF934398E4507FBF" commented="no"><enum>(f)</enum><header>Certain silicon treated as applicable critical material</header><text display-inline="yes-display-inline">Section 45X(c)(6) of such Code is amended by redesignating subparagraphs (T) through (Z) as subparagraphs (U) through (AA), respectively, and by inserting after subparagraph (S) the following new subparagraph:</text>

<subparagraph id="HF5DF5CD1A8274BED8B8D17D15B74C460" commented="no"><enum>(T)</enum><header>Silicon</header><text display-inline="yes-display-inline">Silicon which is silicon or silicon composite used as an electrode active material in battery anodes.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H3199FFA594AF49969A4DBD0D203B3EFA"><enum>(g)</enum><header>Effective date</header><text>The amendments made by this section shall apply to components produced and sold after December 31, 2025.</text> </subsection></section>
