which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Financial Stability Act of 2010 to establish an Advisory Committee on Economic Fallout From Chinese Military Aggression Towards Taiwan, and for other purposes.</official-title></form><legis-body id="H51A567E8051E4303AAD4BA5693189265" style="OLC"><section id="HE7A8F012012E4F82839B9357244CFDA2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fortifying U.S. Markets From Chinese Military Aggression Act</short-title></quote>.</text></section><section id="HD643AC4C15524B0F8C298B305942A869"><enum>2.</enum><header>Advisory Committee on Economic Fallout From Chinese Military Aggression Towards Taiwan</header><text display-inline="no-display-inline">Section 111 of the Financial Stability Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5321">12 U.S.C. 5321</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HFA4C9A7B78DA4848BF296240F581F7C2" display-inline="no-display-inline"><subsection id="H33F70CBFD4584A8EA8E64DE3D2FECD2B"><enum>(k)</enum><header>Advisory Committee</header><paragraph id="H1500159CE37043148D6021FDD41E8253"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established the Financial Stability Oversight Council Advisory Committee on Economic Fallout From Chinese Military Aggression Towards Taiwan (the <quote>Advisory Committee</quote>) to—</text><subparagraph id="HBE4DF986C19441698EFF16225251C7D5"><enum>(A)</enum><text display-inline="yes-display-inline">study and report on the market implications and vulnerabilities related to Chinese military aggression towards Taiwan; and</text></subparagraph><subparagraph id="H604553EC7E2244C08E2D73271A18FB16"><enum>(B)</enum><text display-inline="yes-display-inline">open lines of communication between policy makers, government agencies, and capital market constituents to prepare for a potential response to, and to mitigate economic strain and market volatility related to, Chinese aggression in Taiwan.</text></subparagraph></paragraph><paragraph id="H4C7170420ABD4D129C8933899D6850A1"><enum>(2)</enum><header>Members</header><subparagraph id="HA294CA7D31B24A99A9AA30C444CEDB72"><enum>(A)</enum><header>In general</header><text>The Advisory Committee shall consist of—</text><clause id="HDDFDE9139476459DBC9C0145ED96728F"><enum>(i)</enum><text>a designee of the Commission;</text></clause><clause id="H1403D486FD1B46BA882B45C166CB2462"><enum>(ii)</enum><text>a designee of the Commodity Futures Trading Commission; and</text></clause><clause id="HB7AF9480F9854BE2AAB8F3C88EAEDB86"><enum>(iii)</enum><text>10 members to be appointed by the Council from among persons who are—</text><subclause id="HF588D983125F474DBDCA9647E1D5AF29"><enum>(I)</enum><text>capital markets participants, including market makers, asset managers, exchanges, and institutional investors; or</text></subclause><subclause id="H1C512B923800400AB14F18746E038282"><enum>(II)</enum><text display-inline="yes-display-inline">experts on geopolitical risk related to China.</text></subclause></clause></subparagraph><subparagraph id="H975B9A2112F64AF5A20CBF4FBE483206"><enum>(B)</enum><header>Chair</header><text>The Chair of the Advisory Committee shall be a market maker appointed under subparagraph (A)(iii).</text></subparagraph></paragraph><paragraph id="H647A4A365B454F71BD24C1690C94E699"><enum>(3)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Advisory Committee shall meet in person at least 2 times per year, with additional meetings at the call of the Chair.</text></paragraph><paragraph id="HEDE5FF854F8340AC856D9AEA29D562AF"><enum>(4)</enum><header>Annual study and report on the recommendations of the Advisory Committee</header><text display-inline="yes-display-inline">The Advisory Committee shall, annually—</text><subparagraph id="HBDAE0E761E844172875E82042A3905D0"><enum>(A)</enum><text display-inline="yes-display-inline">carry out a study on the market implications and vulnerabilities related to Chinese military aggression towards Taiwan;</text></subparagraph><subparagraph id="H3D5A883B49434CEA84318176E1EC92FF"><enum>(B)</enum><text display-inline="yes-display-inline">develop recommendations and supporting analysis based on the results of the study; and</text></subparagraph><subparagraph id="H8CEBABADB2B64040B79647BA346497A8"><enum>(C)</enum><text display-inline="yes-display-inline">hold a public meeting to present the recommendations and analysis to the Council, but with any portions of such recommendations and analysis that implicate national security concerns presented in a closed session.</text></subparagraph></paragraph><paragraph id="HC9D67CFA5B914641ABB323100586A2A5"><enum>(5)</enum><header>Permanent status</header><text display-inline="yes-display-inline">The termination provision under section 1013 of title 5, United States Code, shall not apply to the Advisory Committee.</text></paragraph></subsection><subsection id="H9A5DF2C1803147A88F6CFA339DC8F66D"><enum>(l)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Council shall issue an annual public report, after analyzing the recommendations and analysis of the Advisory Committee provided under subsection (k)(4), detailing the following:</text><paragraph id="HC80FA652DE024AC7B1D5011753F92D52"><enum>(1)</enum><text>Market vulnerabilities related to Chinese aggression in Taiwan, including—</text><subparagraph id="H57E246F0C51444728B75C42EF91B27A3"><enum>(A)</enum><text>the safety and soundness of the United States banking and financial systems;</text></subparagraph><subparagraph id="H5A4645ABDA0A4F76857382E722828A62"><enum>(B)</enum><text>market impact and potential losses faced by United States and global markets;</text></subparagraph><subparagraph id="HE392CD860DE7434BB3534807697FE3AD"><enum>(C)</enum><text>the capacity of United States markets to deal with extreme volatility that could result from aggression, i.e. trading halts, circuit breakers, and other tools for managing liquidity;</text></subparagraph><subparagraph id="H213ED781B1B74B2E9027B4625708F4F3"><enum>(D)</enum><text>the impact on Chinese and Taiwanese listings in the United States;</text></subparagraph><subparagraph id="H770554C789264C5BBD77943D44ABFA77"><enum>(E)</enum><text>the likelihood, and potential impact of, China reducing, or eliminating, its holding in United States Treasuries; and</text></subparagraph><subparagraph id="H83FDB38473274E299B1486B0DB2E2AE0"><enum>(F)</enum><text>the estimated total costs to the United States economy from Chinese military aggression towards Taiwan.</text></subparagraph></paragraph><paragraph id="HF9D4928A333343518E81B8DDDABDD9B6"><enum>(2)</enum><text>Recommendations and action items for regulators to make United States capital markets more resilient against market shocks, volatility, and dislocation described under paragraph (1), including with respect to—</text><subparagraph id="H792D223F4678482EA0E42786EF99F819"><enum>(A)</enum><text>the United States Government’s coordination and response;</text></subparagraph><subparagraph id="H988F691B892744F88C292061E4E70ECC"><enum>(B)</enum><text>ideas for government action to limit the market impacts of a blockade or invasion of Taiwan;</text></subparagraph><subparagraph id="HE55B92530F61423C916CCBE77BFF8273"><enum>(C)</enum><text>potential retaliatory actions by China and the potential response of the United States;</text></subparagraph><subparagraph id="H15A8C3837BF14D09B90AC3AC6455AD3F"><enum>(D)</enum><text>collaboration and testing of trade halt rules and circuit breakers across markets; and</text></subparagraph><subparagraph id="H47C58B5FA6F84F6DAE70A2DFC1A01138"><enum>(E)</enum><text>avenues for further regulator engagement with capital markets participants on the topic.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
