<section id="HDEA5BC5A0F144F16A117FC2CDDD77957" section-type="section-one"><enum>1.</enum><header>Inclusion of surviving children in small business concern owned and controlled by service-disabled veterans definition</header><text display-inline="no-display-inline">Section 3(q) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(q)</external-xref>) is amended—</text> <paragraph id="H68A745E34D2B443BABA1AE53C35C702B"><enum>(1)</enum><text>in paragraph (2), by adding at the end the following new subparagraph:</text>

<subparagraph id="H32449CA86E5C427CA9772DAA9A3F9081"><enum>(D)</enum>
<clause commented="no" display-inline="yes-display-inline" id="H65E83C47D3AA479B912F2A1EE8785838"><enum>(i)</enum><text display-inline="yes-display-inline">During the time period described in clause (ii), a small business concern that was a small business concern described in subparagraph (A) or (B) immediately prior to the death of a service-disabled veteran who was the owner of the concern, the death of whom causes the concern to be less than 51 percent owned by one or more service-disabled veterans, if—</text> <subclause id="H432F386713894CFC9BC3E3547027879F" indent="up1"><enum>(I)</enum><text>a surviving child of the deceased veteran acquires such veteran’s ownership interest in such concern; and</text></subclause>
<subclause id="H0BCC28199D8E49BDA336404DBDCB2464" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">immediately prior to the death of such veteran and during the period described in clause (ii), the small business concern is included in the database described in section 36.</text></subclause></clause> <clause id="HB71B5A685F6449719CABF344941A8805" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The time period described in this clause is the time period beginning on the date of the veteran’s death and ending on the earlier of—</text>
<subclause id="H6AB7C52D36D74D78BDA3855F9FB37545"><enum>(I)</enum><text display-inline="yes-display-inline">the date on which the surviving child relinquishes an ownership interest in the small business concern; or</text></subclause> <subclause id="HB797F4D6B7FE483BA3A13BCDE0EDBA6A"><enum>(II)</enum><text>the date that is 3 years after the date of the veteran’s death.</text></subclause></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="H0FCD39D43136451C857186558D673A0E"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="H05729D622061438CB2D70A34B6A2D415" display-inline="no-display-inline"> <paragraph id="H9FA053EE3B0E447582B418375C1B10C3" commented="no"><enum>(8)</enum><header>Surviving child</header><text display-inline="yes-display-inline">The term <quote>surviving child</quote> means a biological or legally adopted child of a service-disabled veteran.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
