<section id="H4393CD936EAD4DD8B446AC61C66BB7E2" section-type="section-one"><enum>1.</enum><header>Short title</header>
 <text display-inline="no-display-inline"><quote><short-title>This Act may be cited as the Reinstating Employee Salaries To Original Rates and Entitlements Act</short-title></quote> or the <quote><short-title>RESTORE Act</short-title></quote>.</text></section> 
<section id="HBA64B63CF02D4FFC96C3AFAABED1669A"><enum>2.</enum><header>Back pay for reinstated employees of the Department of Veterans Affairs</header> 
<subsection id="H741858C10DA648718CDA65BD5594A7EC"><enum>(a)</enum><header>Back pay</header><text display-inline="yes-display-inline">Any individual who was an employee of the Department of Veterans Affairs (including employees who were serving under a probationary or trial period due to a promotion) and who was involuntarily removed and subsequently reinstated or appointed to a position at the Department during the period beginning on January 20, 2025, and ending on the date of the enactment of this Act shall be entitled to back pay in accordance with section 5596 of title 5, United States Code.</text> </subsection> <subsection id="H7D61700290274D778B2A7FCF3CFBB68C"><enum>(b)</enum><header>Limitation</header><text>Subsection (a) shall not apply to any individual removed from a political position.</text></subsection> 
<subsection id="H5CF2AA11C58E4EF08A5B4EF369E437C6"><enum>(c)</enum><header>Political position defined</header><text>In this section, the term <quote>political position</quote> means—</text> <paragraph id="HE1299959B39A47DAAAFC906571E7B36B"><enum>(1)</enum><text display-inline="yes-display-inline">a position described under sections 5312 through 5316 of title 5, United States Code (relating to the Executive Schedule);</text></paragraph> 
<paragraph id="HDACE278ECB7847DD8125DFE713ADED11"><enum>(2)</enum><text display-inline="yes-display-inline">a noncareer appointee (as that term is defined in section 3132(a) of such title); or</text></paragraph> <paragraph id="HC7F1D10EE9704110A5D92FC88E554B5C"><enum>(3)</enum><text display-inline="yes-display-inline">a position in the executive branch of the Government of a confidential or policy-determining character under schedule C of subpart C of part 213 of title 5, Code of Federal Regulations.</text></paragraph></subsection></section>
