          Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to require a notation in the personnel record file of certain employees of the Department of Veterans Affairs who resign from Government employment under certain conditions, and for other purposes.</official-title></form><legis-body id="H7AE7645E0BA74901AEC888AC20EA12DC" style="OLC"> 
<section id="HE85E66C0AB794672AFEC57785D0BA010" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Personnel Integrity in Veterans Affairs Act of 2025</short-title></quote>.</text></section> <section id="HE74E016BB9A948009C2F9150BDEB1ECE"><enum>2.</enum><header>Submission to Congress of annual performance plans for Department of Veterans Affairs political appointees</header><text display-inline="no-display-inline">Section 725 of title 38, United States Code, is amended—</text> 
<paragraph id="HAEE4139AC26B4B9A84694AC115C324AE"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph> <paragraph id="H464BAC4344AC427F926AEA8BDA6752DD"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection (c):</text>

<subsection id="H3FAFF9E5648E41C88A0004919B21C364"><enum>(c)</enum><header>Submission to Congress</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the completion of an annual performance under subsection (a), the Secretary shall submit the plan to the Committees on Veterans’ Affairs of the Senate and House of Representatives.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H8ED1E27A40BB4A08A65F202893F8AC11" section-type="subsequent-section"><enum>3.</enum><header>Notation in Department of Veterans Affairs employee personnel record file of personnel investigation required</header> <subsection id="H6D5DD23A19964E2D9B65843B3C070570"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/7">chapter 7</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text>

<section id="H4ED0A32DDE174D43A292CD65588FB37F"><enum>729.</enum><header>Notation in Department of Veterans Affairs employee personnel record file of eligible personnel investigation</header> 
<subsection id="H8E355AE3BEA747D3AC5AFEDAC37469F3" commented="no"><enum>(a)</enum><header>Notation required</header><text display-inline="yes-display-inline">Notwithstanding section 3322 of title 5 or chapter 74 of this title, with respect to a covered employee who is the subject of an eligible personnel investigation and who resigns, retires, transfers, or otherwise separates from employment with the Department prior to the resolution of such eligible personnel investigation, the Secretary shall—</text> <paragraph id="HC6422CEA27F2491690C14672BF41E28D" commented="no"><enum>(1)</enum><text>continue such eligible personnel investigation until it is completed; and</text></paragraph> 
<paragraph id="H72D49C1377DE4589859CC3B139871C0D" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 40 days after the date such eligible personnel investigation is completed, make a permanent notation of such eligible personnel investigation in the official personnel record file of such covered employee.</text></paragraph></subsection> <subsection id="H818244FEA71B4DEAB9636EBBF3A76DCE"><enum>(b)</enum><header>Certain consideration prohibited</header><text display-inline="yes-display-inline">In carrying out an eligible personnel investigation, the Secretary may not consider the resignation, retirement, transfer, or any other separation from employment with the Department of the covered employee subject to such eligible personnel investigation.</text></subsection> 
<subsection id="HEB76BCD1F71B477DB9D7FD21CF92FB11"><enum>(c)</enum><header>Notification required</header><text>Prior to making a permanent notation in the official personnel record of a covered employee under subsection (a), the Secretary shall—</text> <paragraph id="H365F23DFE875476EA4FD610F9B7761A9"><enum>(1)</enum><text display-inline="yes-display-inline">notify the employee in writing within 5 days of the resolution of the eligible personnel investigation and provide such covered employee a copy of the adverse finding and any supporting documentation;</text></paragraph> 
<paragraph id="HC27BF45FD5B049EE95E915976FE2B439"><enum>(2)</enum><text>provide the covered employee with a reasonable time, but not less than 30 days, to respond in writing and to furnish affidavits and other documentary evidence to show why the adverse finding was unfounded (a summary of which shall be included in any notation made to the personnel file of such employee under subsection (e)); and</text></paragraph> <paragraph id="HBE7A49C0630A4626A5DF8531A8DBCAD6"><enum>(3)</enum><text>provide a written decision and the specific reasons therefore to the employee at the earliest practicable date.</text></paragraph></subsection> 
<subsection id="H344F634E0DEC44D4BF71C54378B08467" commented="no">
              <enum>(d)</enum>
              <header>Right To appeal</header>
 <text>A covered employee is entitled to appeal the decision of the Secretary to make a permanent notation under subsection (a) to—</text>
              <paragraph id="H38AD8CBA51D64A3CBAA8E14A210C7098">
                <enum>(1)</enum>
 <text>the Merit Systems Protection Board under section 7701 of title 5; and</text> </paragraph> <paragraph id="HA49D9D1B08FB4E1488033CAC4766C767"> <enum>(2)</enum> <text>a Disciplinary Appeals Board under section 7464 of this title.</text>
              </paragraph>
            </subsection> 
<subsection id="HF9B4D0ACBB9B43D2A5EDA6A13448BBBB"><enum>(e)</enum><header>Notation of appeal</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="H38EF15DC456141A8ABAB08539C321949"><enum>(1)</enum><text display-inline="yes-display-inline">If a covered employee files an appeal with the Merit Systems Protection Board pursuant to subsection (c), the Secretary shall make a notation in the official personnel record file of the covered employee indicating that an appeal disputing the notation is pending not later than 2 weeks after the date on which such appeal was filed.</text></paragraph> <paragraph id="H6DF9FDBBC5C648C49F91998AB4281E0B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the Secretary is the prevailing party on appeal, not later than 2 weeks after the date that the Board issues the appeal decision, the Secretary shall remove the notation made under paragraph (1) from the official personnel record file of the covered employee.</text></paragraph> 
<paragraph id="HC4A03B1D0C884C4391BD48B3E1D3EA5C" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">If the covered employee is the prevailing party on appeal, not later than 2 weeks after the date that the Board issues the appeal decision, the Secretary shall remove the notation made under paragraph (1) and the notation of an adverse finding made under subsection (a) from the official personnel record file of the covered employee.</text></paragraph></subsection> <subsection id="H58F3A5EA574943B9AFC100C61D69FFC6"><enum>(f)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HDE6EBAE6AFD142AE91FC16EEA248284B"><enum>(1)</enum><text>The term <term>covered employee</term> means an employee in the competitive service, the excepted service, or the Senior Executive Service within the Department.</text></paragraph> <paragraph id="HF5F6F44EB9624E6189DCDECE7E73C027"><enum>(2)</enum><text>The term <term>eligible personnel investigation</term>—</text> 
<subparagraph id="H9D96DED48EA24859850030877E34465F" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">means a personnel investigation that commences not later than 60 days after the date on which the covered employee subject to such personnel investigation resigns, retires, transfers, or otherwise separates from employment with the Department; and</text></subparagraph> <subparagraph id="H91E7562E3D5E4DD8B209323841F08863"><enum>(B)</enum><text>includes—</text> 
<clause id="HDC5446929BCF4C7FA31BD44D8D3D199E"><enum>(i)</enum><text>an investigation by an Inspector General; and</text></clause> <clause id="HAD2CDDA4545C46D385AA716B02F239A7"><enum>(ii)</enum><text>a prospective investigation that may recommend an adverse personnel action as a result of alleged performance, misconduct, or for such cause as will promote the efficiency of the service under—</text> 
<subclause id="HF59AFE2721204326A1EAB1E4B70BF542" display-inline="no-display-inline"><enum>(I)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/43">chapter 43</external-xref> of title 5;</text></subclause> <subclause id="H09373E17029D4280A84B88552780C081"><enum>(II)</enum><text>chapter 75 of such title;</text></subclause> 
<subclause id="HAC316D734EDE4D588A02BF3057064B82" commented="no"><enum>(III)</enum><text display-inline="yes-display-inline">chapter 74 of this title; or</text></subclause> <subclause id="HD21976015554409E9ECCD2AF5BE4A57C" commented="no"><enum>(IV)</enum><text>section 501 of this title;</text></subclause></clause> 
<clause id="HD066005B306242FAA7BA6C2D581CE87A"><enum>(iii)</enum><text>an adverse personnel action as a result of performance, misconduct, or for such cause as will promote the efficiency of the service under the provisions specified in subclauses (I) through (IV) of clause (ii);</text></clause> <clause id="H88128EA51E394933B681ABE0AE95222A"><enum>(iv)</enum><text>an internal investigation carried out by the Secretary, including through—</text> 
<subclause id="HCE97F85E403346398D7FB3853D11FF26"><enum>(I)</enum><text>the Office of Accountability and Whistleblower Protection of the Department;</text></subclause> <subclause id="H6CED47056989453C9852FF5E47C1FA69"><enum>(II)</enum><text>the Office of the Medical Inspector of the Veterans Health Administration; and</text></subclause> 
<subclause id="HD2897353105D4885B59BF7E026564ECF"><enum>(III)</enum><text>the General Counsel of the Department; and</text></subclause></clause> <clause id="H8F6F7A0DC2CA4E68A06ED790116266F0"><enum>(v)</enum><text>an investigation carried out by the head of any other Federal agency responsible for investigation allegations of employee misconduct, including the head of—</text> 
<subclause id="H2369C6D08F5142E1A151E3EB20D6E5D1" commented="no"><enum>(I)</enum><text>the Office of the Special Counsel; and</text></subclause> <subclause id="HC0EB431CD24048F1952B2E21AA987003"><enum>(II)</enum><text>the Equal Employment Opportunity Commission.</text></subclause></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8B03572BE5D847BA87A3D41D2C3A0E5D"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 728 the following new item:</text> <quoted-block style="USC" id="HCB2CC824245949E7B308427090417FD0" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="item">729.
