      of energy products on vessels between points in the United States to which the coastwise laws
      apply if at least one such point is in Alaska, Hawaii, Guam, or the Commonwealth of Puerto
      Rico, and for other purposes.</official-title></form><legis-body id="H6A1387B197194F849E6BC5E702694DF6" style="OLC"> 
<section id="H445AF363DFBB4121B1A7AC48C6551757" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Noncontiguous Energy Relief and Access Act of 2025</short-title></quote>.</text></section> <section id="HD791ED478B2B4961AF38159AD6B0E588"><enum>2.</enum><header>Energy products exemption</header> <text display-inline="no-display-inline">Section 55102 of title 46, United States Code, is amended—</text> 
<paragraph id="HDB6CBD9E6D324BC0A7FF8A7763A9895A"><enum>(1)</enum><text>in subsection (a) to read as follows:</text> <quoted-block style="USC" id="HB704A4A4AF8442A89CF4BB4AF7694896" display-inline="no-display-inline"> <subsection id="HA06ABB76AA7E41A08A5FE82EE1822128"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> 
<paragraph id="H527BD8D386BD47879E5B535BE8CD2A23"><enum>(1)</enum><header>Covered noncontiguous trade</header><text display-inline="yes-display-inline">The term <term>covered noncontiguous trade</term> means—</text> <subparagraph id="HEBCE0DF9E06C4E5295C14AE5B6C4CE8D"><enum>(A)</enum><text>trade between—</text> 
<clause id="HC53949A1B9FD4F5984F36A4A4B3D67F5"><enum>(i)</enum><text>one of the contiguous 48 States; and</text></clause> <clause id="H6FED797CFE9B4A4896FA147D05C611ED"><enum>(ii)</enum><text>Alaska, Hawaii, Guam, or the Commonwealth of Puerto Rico; and</text></clause></subparagraph> 
<subparagraph id="H13199EF5943B471688F6DD8B6C151B68"><enum>(B)</enum><text>trade between—</text> <clause id="H6707658A40AC4A42881D94492D26238E"><enum>(i)</enum><text display-inline="yes-display-inline">a place in Alaska, Hawaii, Guam, or the Commonwealth of Puerto Rico; and</text></clause> 
<clause id="HDBCAA1A29A4F44EFBEBF40CF80F716B3"><enum>(ii)</enum><text display-inline="yes-display-inline">another place in Alaska, Hawaii, Guam, or the Commonwealth of Puerto Rico.</text> </clause></subparagraph></paragraph> <paragraph id="H0F8EAA0F5EC4429C85C1E44189C0B50B"><enum>(2)</enum><header>Energy products</header><text>The term <term>energy products</term> means any equipment, component of equipment, or energy source for the generation, storage, transmission, and distribution of electricity.</text></paragraph> 
<paragraph id="H7A8230257456494EA4096EDF968415E2"><enum>(3)</enum><header>Energy source</header><text>The term <term>energy source</term> means—</text> <subparagraph id="HA62B71B748EA4A3786ADBAB7FE8CEBC8"><enum>(A)</enum><text>liquefied natural gas or any other energy source needed for the generation of electricity; and</text></subparagraph> 
<subparagraph id="HA1E254E612404A219C87508DFEFE5B2D"><enum>(B)</enum><text>a petroleum product.</text></subparagraph></paragraph> <paragraph id="H16E7E48537924DEA9B1A3C053941E095"><enum>(4)</enum><header>Equipment</header><text>The term <term>equipment</term> means power generators, storage units, wind turbines, solar panels, hydroelectric plants, and any other components needed for the generation, transmission, or distribution of electricity. </text></paragraph> 
<paragraph id="H6A1BEC1308C74F5F80BD0A1AF63022F0"><enum>(5)</enum><header>Merchandise</header><text>The term <term>merchandise</term> includes—</text> <subparagraph id="H446205C6B6D249B4AB30DF9DE894EE6A"><enum>(A)</enum><text>merchandise owned by the United States Government, a State, or a subdivision of a State; and</text></subparagraph> 
<subparagraph id="HDD2D1E8393FE408E80D6BAC6874F22C3"><enum>(B)</enum><text>valueless material.</text></subparagraph></paragraph> <paragraph id="H51C0DF768C744788A85E76D894FD0608"><enum>(6)</enum><header>Petroleum product</header><text>The term <term>petroleum product</term> has the meaning given such term in section 3 of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6202">42 U.S.C. 6202</external-xref>).</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H1A648F4AC9C8406EB60F6FA0DB5E5556"><enum>(2)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph> <paragraph id="H36D596386F9E4F839D59F74E868B6A32"><enum>(3)</enum><text>by inserting after subsection (b) the following:</text>

<subsection id="H8875F6B651AC48C1812E2D01E43E916A"><enum>(c)</enum><header>Energy products exemption</header><text display-inline="yes-display-inline">Subsection (b) shall not apply with respect to transportation of energy products in covered noncontiguous trade on a vessel. </text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </legis-body></bill>
