<section id="HB69FE5870EC14C1A8D1B11710DBDA439" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Community Access to Pharmacist Services Act</short-title></quote>.</text></section> <section id="H466D119EEFC64FBBA9448201062B35E8"><enum>2.</enum><header>Coverage of pharmacist services under medicare part B</header> <subsection id="H203A2F3E6D1743EFB6943A39855BE8A1"><enum>(a)</enum><header>Coverage</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text> 
<paragraph id="H3EEB49FA447042D8B6FAAC41A362CE98"><enum>(1)</enum><text>in subsection (s)(2)—</text> <subparagraph id="H29BC772F70A241B094F7E7C101C7505E"><enum>(A)</enum><text>in subparagraph (JJ), by adding <quote>and</quote> at the end; and</text></subparagraph> 
<subparagraph id="HD1FB1693C69C4319B7F0495EA98927F2"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="H7F3B33ABB53F486D9A17DAC22106D43F"> <subparagraph id="H1401A806CB6844AD9AC55C0924E51809" indent="up1"><enum>(KK)</enum><text>pharmacist services (as defined in subsection (nnn));</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H644C109989A44C7ABB2AAF4E70BAD6FA"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block style="OLC" id="HDBC8E1410C43467F9421FA01F103DA6B" display-inline="no-display-inline"> <subsection id="H2A42A684481947359F99B205ED0DF861"><enum>(nnn)</enum><header>Pharmacist services</header> <paragraph id="H0FF2E886F8A141EB93DD4C8754F3484C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>pharmacist services</quote> means such services furnished by a pharmacist, and such services and supplies furnished as an incident to the pharmacist’s service, which the pharmacist is legally authorized to perform under State law as would otherwise be covered if furnished by a physician or as an incident to a physicians’ service which—</text> 
<subparagraph id="HA40D8D7ACD01403ABB2816A4878A35F8"><enum>(A)</enum><text>in the case such State law requires such services to be furnished under the supervision of, or working in collaboration with, a physician or practitioner (as defined in section 1842(b)(18)(C)(i)), are so furnished under the supervision of, or working in collaboration with, such physician or practitioner in the manner and to the extent as so required by such State law; and</text></subparagraph> <subparagraph id="HBD15790022824BD1846F56044AEEFD92"><enum>(B)</enum><text>are—</text> 
<clause id="HCC826F24FD18485DA5F2E6EB65717B92"><enum>(i)</enum><text>for visits for the evaluation and management of individuals for testing or treatment for COVID–19, influenza, respiratory syncytial virus, or streptococcal pharyngitis; or</text></clause> <clause id="HA6A7D70B353B4FD79788D2F5409F80DE"><enum>(ii)</enum><text>testing or treatment services that address a public health need related to a public health emergency declared under section 319 of the Public Health Service Act (as determined by the Secretary).</text></clause></subparagraph></paragraph> 
<paragraph id="HD7BA4F20ACD2457DAE50F8AEA5CDF749"><enum>(2)</enum><header>Collaboration</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <quote>collaboration</quote> means a process in which a pharmacist works with a physician or practitioner (as defined in section 1842(b)(18)(C)(i)), as applicable, to deliver health care services within the scope of the pharmacist’s professional expertise, with medical direction and appropriate supervision as provided for in jointly developed guidelines or other mechanisms as defined by the law of the State in which the services are performed.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H87CC78478F0844DCABE67C6769E8B3F5"><enum>(b)</enum><header>Payment</header><text>Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text> 
<paragraph id="H1840813BBA554C3EBEF88B20F86E2CB2"><enum>(1)</enum><text>by striking <quote>and (HH)</quote> and inserting <quote>(HH)</quote>; and</text></paragraph> <paragraph id="H248CB843E4134432A5709B98DC24FFD3"><enum>(2)</enum><text>by inserting before the semicolon at the end the following: <quote>and (II) with respect to pharmacist services (as defined in section 1861(nnn)), the amounts paid shall be equal to 80 percent of the lesser of (i) the actual charge for the services or (ii) 85 percent (or 100 percent, in the case of such services that address a public health need described in paragraph (2)(B) of such section) of the amount determined under the payment basis under section 1848 for such services.</quote>.</text></paragraph></subsection> 
<subsection id="H7A444FC897174C76962FFA24A6CA702B"><enum>(c)</enum><header>Prohibition on balance billing for pharmacist services</header><text>Section 1842(b)(18) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(b)(18)</external-xref>) is amended—</text> <paragraph id="H1EB9F3BEE3F74A0A9FE27528DF1748A4"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>or a pharmacist</quote> after <quote>a practitioner described in subparagraph (C)</quote>; and</text></paragraph> 
<paragraph id="H3D595997265949179AB6835D80BFD603"><enum>(2)</enum><text>in subparagraph (B)—</text> <subparagraph id="H4B9276662BFF4F0495FC780E94A96135"><enum>(A)</enum><text>in the first sentence, by inserting <quote>, a pharmacist,</quote> after <quote>a practitioner described in subparagraph (C)</quote>; and</text></subparagraph> 
<subparagraph id="HD1CC9FE34ACC4060ABE8292F83A1E1A4"><enum>(B)</enum><text>in the third sentence—</text> <clause id="HDFEACA9E131E43A5B911D65B8B0F9FC7"><enum>(i)</enum><text>by inserting <quote>, a pharmacist,</quote> after <quote>a practitioner</quote>; and</text></clause> 
<clause id="H73F1BCFE08EF420EB4AE59F26D6A7F3E"><enum>(ii)</enum><text>by inserting <quote>, the pharmacist,</quote> after <quote>the practitioner</quote>.</text></clause></subparagraph></paragraph></subsection> <subsection id="HE76016B5A89A4AB295DEE18035FB6759"><enum>(d)</enum><header>Application</header><text>The amendments made by this section shall apply to items and services furnished on or after January 1, 2026.</text></subsection></section>
