which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To modify the dollar amount thresholds relating to transfers of defense articles and defense services under the Arms Export Control Act, and for other purposes.</official-title></form><legis-body id="HBBD175CD7DE04C73B5C806795B7CAECD" style="OLC"><section id="H9C5FF3A5B1134384B4C4DE7DEA88AC76" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Foreign Military Sales Reform Act of 2025</short-title></quote>.</text></section><section id="H917C6F80AFCF4B97A941EBA96D195A7B" section-type="subsequent-section"><enum>2.</enum><header>Modification of dollar amount thresholds relating to transfers of defense articles and defense services under the Arms Export Control Act</header><text display-inline="no-display-inline">The Arms Export Control Act is amended as follows:</text><paragraph id="HACCD59B7164A43C28E41128BCF06104D"><enum>(1)</enum><text>In section 3(d) (<external-xref legal-doc="usc" parsable-cite="usc/22/2753">22 U.S.C. 2753(d)</external-xref>)—</text><subparagraph id="H41736BFB50CE48058C2993145256D669"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HFF9FE01F73AE465AA0F5545DD9DBE3B0"><enum>(i)</enum><text>by striking <quote>$14,000,000</quote> and inserting <quote>$23,000,000</quote>; and</text></clause><clause id="HF0201DCD90104624865C0625AA789EC7"><enum>(ii)</enum><text>by striking <quote>$50,000,0000</quote> and inserting <quote>$83,000,000</quote>; and</text></clause></subparagraph><subparagraph id="HF2B26817C47C4734B02989126489C83C"><enum>(B)</enum><text>in paragraph (3)(A)—</text><clause id="H919B25F6528A4C56B69D6D36C7D4CF65"><enum>(i)</enum><text>by striking <quote>$14,000,000</quote> and inserting <quote>$23,000,000</quote>; and</text></clause><clause id="H66945C0FAC0B4311A3BDB52EAA776282"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>$100,000,0000</quote> and inserting <quote>$166,000,000</quote>.</text></clause></subparagraph></paragraph></section><section id="H8865163C5DBA400D8FBBC908A9EE4CEC" commented="no"><enum>3.</enum><header>Report</header><text display-inline="no-display-inline">The Office of the Inspector General of the Department of State shall submit to Congress a report on any activity of structuring payments to circumvent the dollar amount thresholds of congressional notification and review with respect to transfers of defense articles and defense services under the Arms Export Control Act.</text></section><section id="H332B8C83242447B890057D63934CA544" commented="no"><enum>4.</enum><header>Prohibition on certain activities of Federal employees</header><text display-inline="no-display-inline">No Federal employee may intentionally or knowingly structure, assist in structuring, or attempt to structure or assist in structuring any transfer of defense articles and defense services under the Arms Export Control Act to circumvent congressional reporting thresholds under that Act.</text></section><section id="HE41B15510B2F4988B8D6CE6F78AECFC6" commented="no"><enum>5.</enum><header>Imposition of penalties on Department of State employees</header><text display-inline="no-display-inline">Any employee of the Department of State who is found to have knowingly structured payments relating to transfers of defense articles or defense services to circumvent requirements relating to congressional notification and review of such transfers under the Arms Export Control Act—</text><paragraph id="H020C6126284A42EC941148D8AEBA8622" commented="no"><enum>(1)</enum><text>shall be barred from employment in Federal service; and</text></paragraph><paragraph id="H1BCF2617A6724D60A735E71D58B7E27B" commented="no"><enum>(2)</enum><text>shall be subject to civil penalties in the amount of $100,000.</text></paragraph></section></legis-body></bill>
