<official-title display="yes">To amend titles XVIII and XIX of the Social Security Act to provide for coverage of certain services furnished by freestanding emergency centers.</official-title>

<section id="HCF0A71D35F294EF9B6B6CE2037B8BAF8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Care Improvement Act</short-title></quote>.</text></section> <section id="H3767EE1038A5468CA9F800BE458758F9"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H1499A7467F694EA8A2C592F5B5AAAE7C"><enum>(1)</enum><text display-inline="yes-display-inline">To expand provider capacity to respond to the COVID–19 pandemic, in April of 2020 the Centers for Medicare &amp; Medicaid Services issued a waiver allowing freestanding emergency centers (FECs) to enroll as Medicare-certified hospitals and receive Medicare reimbursement for the duration of the COVID–19 public health emergency.</text></paragraph> <paragraph id="HFB517A57A5754623B47CF2BE35041BF1"><enum>(2)</enum><text display-inline="yes-display-inline">FECs are fully licensed emergency departments that are staffed by both Emergency Medicine trained physicians and registered nurses who are on-site 24 hours a day, seven days a week, and possess licensed pharmacies, clinical laboratories, and advanced imaging services. FECs are State-licensed, and adhere to the same standards and provide the same level of care as Hospital Based Emergency Rooms, including State EMTALA regulations on treating all patients.</text></paragraph> 
<paragraph id="HD4CD3B2C4B4A487E8992479E87F93A1C"><enum>(3)</enum><text display-inline="yes-display-inline">Over 118 FECs, mostly located in Texas, have enrolled and provided high-quality emergency services for all kinds of emergency conditions at significant savings to the Medicare program and to thousands of Medicare beneficiaries.</text></paragraph> <paragraph id="H29C71D41155F4AD78B88484043E69B8E"><enum>(4)</enum><text display-inline="yes-display-inline">An actuarial study of Medicare claims data found that FECs did not increase overall utilization of emergency care services and saved the Medicare program 21.8 percent in lower emergency care payments for patients of similar acuity.</text></paragraph></section> 
<section id="HD336D94CD68047088F28D0D4E4697A14" commented="no"><enum>3.</enum><header>Coverage of freestanding emergency centers under Medicare and Medicaid</header> 
<subsection id="H8A1A367FFE724080A650855C167BFC55" commented="no"><enum>(a)</enum><header>Coverage under Medicare part B</header><text display-inline="yes-display-inline">Section 1832(a)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395k">42 U.S.C. 1395k(a)</external-xref>) is amended—</text> <paragraph id="H673D1A184B834B10A43CB03EC6C5D113" commented="no"><enum>(1)</enum><text>in subparagraph (I), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HDCB6EBFEF1A2469DB27EEEB3D8425CFF" commented="no"><enum>(2)</enum><text>in subparagraph (J), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> <paragraph id="H2EBA2DE789EE461EBD5D2302E4A21797" commented="no"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="HC5A002DD3B4147BF80106A6B3A1F72A1" commented="no"><enum>(K)</enum><text display-inline="yes-display-inline">specified emergency services furnished by a freestanding emergency center (as such terms are defined in section 1861(nnn)).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HDE6B080FC5084080BBA941CD2172EC28" commented="no"><enum>(b)</enum><header>Definitions</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H81A7C9F72C9645D49E0AF4A98F694E2B" commented="no"><enum>(nnn)</enum><header>Freestanding emergency center; specified emergency services</header> 
<paragraph id="H0B9E505323B84712A34559BC587927E2"><enum>(1)</enum><header>Freestanding emergency center</header><text display-inline="yes-display-inline">The term <term>freestanding emergency center</term> means a health care facility that—</text> <subparagraph id="H9EFE372B98F149638F5A9BE38684EF1A" commented="no"><enum>(A)</enum><text>is an independent freestanding emergency department (as defined in section 2799A–1(a)(3)(D) of the Public Health Service Act);</text></subparagraph> 
<subparagraph id="H1740CF10798D48B2908D7241193052EB" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">is staffed 24 hours a day, 7 days a week, with a physician (as defined in subsection (r)(1)) available to furnish emergency services (as defined in section 2799A–1(a)(3)(C)(i) of the Public Health Service Act) in such facility 24 hours a day;</text></subparagraph> <subparagraph id="H9C0D71AF2AC048F29B210A38D38D872C" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">has arrangements with one or more hospitals, having agreements in effect under section 1866, for the referral and admission of patients requiring inpatient services or such diagnostic or other specialized services as are not available at such facility;</text></subparagraph> 
<subparagraph id="HD57FBF3B736441548E7544ABCAA61138" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">has established a governing body to determine, implement, and monitor policies governing the total operation of the facility;</text></subparagraph> <subparagraph id="HDC6FF9D868D34365A119D6261FAE71C0" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">develops, implements, and maintains an ongoing, data-driven quality assessment and performance improvement program, and has oversight and accountability for such program, ensuring that facility policies and such program are administered so as to provide quality health care in a safe environment;</text></subparagraph> 
<subparagraph id="H74AF500478CA41068CA2056D7D35EE22" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">is located—</text> <clause id="HAF709183A3C047B298ED98B20087F2B0" commented="no"><enum>(i)</enum><text>in a metropolitan statistical area; or</text></clause> 
<clause id="H5495195A36F7495D93DE8AEC2840D8DB" commented="no"><enum>(ii)</enum> 
<subclause id="H26907CD80C3247DDA1F0307D7F622248" commented="no" display-inline="yes-display-inline"><enum>(I)</enum><text>in the case of a facility established prior to 2022, in a rural county; or</text></subclause> <subclause id="H33E1DBB62DF94819884BEA86472B81C2" indent="up1"><enum>(II)</enum><text>in the case of a facility established on or after January 1, 2022, in a rural county that does not have a Medicare-certified hospital or a rural emergency hospital (as defined in subsection (kkk)(2)); and</text></subclause></clause></subparagraph> 
<subparagraph id="HFFDDED1ADDA14593B2867CD43D39F259" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">meets all State requirements applicable to facilities that furnish emergency medical services to individuals but do not typically provide for stays in excess of 24 hours, and meets such other requirements as the Secretary may prescribe not in excess of the conditions of participation under this title that are applicable to off campus dedicated emergency departments of hospitals (as described in section 482.55 of title 42, Code of Federal Regulations (or any successor regulation)).</text></subparagraph></paragraph> <paragraph id="HFCDD3515536D497DB3270C2D4F3CE5A0"><enum>(2)</enum><header>Specified emergency services</header><text>The term <term>specified emergency services</term> means emergency services (as defined in section 2799A–1(a)(3)(C)(i) of the Public Health Service Act) other than a service identified, as of the date of the enactment of the <short-title>Emergency Care Improvement Act</short-title>, by any of HCPCS evaluation and service management service codes 99281 through 99282.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H39CBB38C6FCE4BF1AB1E715A837C862B" commented="no"><enum>(c)</enum><header>Application of EMTALA</header><text>Section 1867(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395dd">42 U.S.C. 1395dd(e)</external-xref>) is amended—</text> <paragraph id="HEF97B4D50E7244FB85AA40EEBE986576" commented="no"><enum>(1)</enum><text>in paragraph (2), by—</text> 
<subparagraph id="H4911DD91EA664959A37E787247F5827A" commented="no"><enum>(A)</enum><text>inserting <quote>other than a freestanding emergency center (as defined in section 1861(nnn))</quote> after <quote>a hospital</quote>; and</text></subparagraph> <subparagraph id="HA1ED220F26EB4541B8292368505BCBF6" commented="no"><enum>(B)</enum><text>inserting <quote>or a freestanding emergency center (as so defined) participating under this title</quote> before the period at the end; and</text></subparagraph></paragraph> 
<paragraph id="H28EB827097F54328A8DEB8EB1187F65F" commented="no"><enum>(2)</enum><text>in paragraph (5), by inserting at the end the following new sentence: <quote>Beginning on the date of the enactment of the <short-title>Emergency Care Improvement Act</short-title>, such term also includes a freestanding emergency center (as defined in section 1861(nnn)), and any reference to a hospital that has a hospital emergency department includes such a freestanding emergency center.</quote>.</text> </paragraph></subsection> <subsection id="HA6AF065BFC744927B5417E7676ADB0F0" commented="no"><enum>(d)</enum><header>Payment under Medicare</header><text>Section 1833(a)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(2)</external-xref>) is amended—</text> 
<paragraph id="H5105ED50D5EA44E19C672F0E7CC9666F" commented="no"><enum>(1)</enum><text>in subparagraph (G)(ii), by striking <quote>and</quote> at the end;</text></paragraph> <paragraph id="H3500D525D178489882BB16DB760CA3F4" commented="no"><enum>(2)</enum><text>in subparagraph (H), by striking the comma at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HA935E005242249F69746E08A69C244A7" commented="no"><enum>(3)</enum><text>by inserting after subparagraph (H) the following new subparagraph:</text> <quoted-block style="OLC" id="H5222903B202442C998E6F715356633B2" display-inline="no-display-inline"> <subparagraph id="H1D9B6BBF5B26448E8BDC4F0960E67E06" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">with respect to specified emergency services furnished by a freestanding emergency center (as such terms are defined in section 1861(nnn)), the amount that would have been determined under subsection (t) if such services had been covered OPD services,</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H1ECE57ED608E452DA4AE08EE34548467" commented="no"><enum>(e)</enum><header>Coverage under Medicaid</header><text display-inline="yes-display-inline">Section 1905(a)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)(2)</external-xref>) is amended—</text> <paragraph id="HF86E00A8C04042CCABBF3FAAD008E7F4" commented="no"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end; and</text></paragraph> 
<paragraph id="HEB5CCBEE925F4DAAB9DE6F025EE26189" commented="no"><enum>(2)</enum><text>by inserting before the semicolon at the end the following: <quote>, and (D) specified emergency services furnished by freestanding emergency centers (as such terms are defined in section 1861(nnn))</quote>.</text> </paragraph></subsection> <subsection id="HFD9B9152179B4341BFDD989F5ADD9FDE" commented="no"><enum>(f)</enum><header>Exclusion from prohibition on physician self-Referral</header><text>Section 1877(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn">42 U.S.C. 1395nn(b)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H503D3F06730F47C7BAD8A5E4436272E9" commented="no"><enum>(6)</enum><header>Freestanding emergency centers</header><text display-inline="yes-display-inline">In the case of laboratory services and imaging services furnished by a freestanding emergency center in connection with specified emergency services (as such terms are defined in section 1861(nnn)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H682F6F471A314D799413A188A212C293" commented="no"><enum>(g)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this Act shall apply with respect to items and services furnished on or after the date of the enactment of this Act.</text></subsection></section>
